ENGLEWOOD CLIFFS — In its latest challenge to affordable housing mandates, the borough has filed to invalidate a settlement that was years in the making.
In the paperwork filed in Superior Court in Bergen County on Friday, Borough Attorney Eric Bernstein requests that Judge Christine Farrington declare that former council members Deborah Tsabari and Ed Aversa had conflicts of interest in the litigation.
The filing seeks to void all council votes at the Oct. 4, 2020, and Jan. 10, 2019, meetings and void any settlement agreements with the Fair Share Housing Center and Normandy Real Estate Partners, the developer looking to build on the former Unilever campus at 800 Sylvan Ave.
