i don't know if you've been watching this but there's an increasing drum beat among conservative scholars to get rid of qualified immunity all together because it gives too much of a bye to governmental officials so the qualified immunity case will be controversial then the hobby lobby case is not a stand alone with regard to religious liberties. he dissented from denial of a hearing on bank which is a dissent from a decision not to rehear a case in a little sisters of the poor case which was kind of a crazy case from my perspective so it may be that there's reasonable room to debate this but from my perspective it seems crazy because the obama administration says if you want exemption from the contraception mandate sign this form and the objection from the little sisters of the poor was signing the exemption form itself was a form of complicity so they refused to do it so they were opting out from opting out and he believed they had a case so i do think there's a relious ght to discriminate and different rules apply to believers and nonbelievers or people who belong to minority
