jury doesn't have enough knowledge to make that determination by the point you just made. and also in the united states supreme court case on point. what i do think in terms of the process, i think a new jury that will be determining the penalty faces should have the opportunity to go backwards and let them be the ones to determine, and even though it may just be a rubber stamp, it was an aggravated homicide and therefore eligible for the death penalty, if you're going to do a new jury with a new penalty phase, which i have never heard of, but god bless arizona -- then let the new jury decide. >> at it $1.7 million. that's how much it costs the state to prosecutor this women with the unbelievable amount of evidence against her. we're going to spend another few hundred thousand dollars to get a new jury? when the new jury is empanelled they have to hear testimony and see evidence. there's still weeks if not months of evidence.
