[inaudible conversation] >> they are basically saying that the candidates are overturning the results of the last election. thus an exceptional argument. we'll see if that will gain traction. it really shows the rush of fixation. how many times did he mention russia and vladimir putin. this is becoming apparent that this is really all one thing. they continue to buy into the russia conspiracy theory. and they rigged our last election somehow. that is illegitimate. in the present trump is somehow fixing her to steal the next election. that is a crazy conspiracy theory. but their whole case is built on that. they king back to it over and over and over. that's when i anticipate that we will hear from the next three days. my view is the consequences of the republic are overturning the democratic relet election because he don't like the results, because you believe that that election was somehow corrupted. when in fact, the evidence shows that it was not. the stuff forget that the independent counsel included the review. they found that there was no collusion or conspiracy. that is really central to the case. and again, i think they have not given up on that very in their basic argument is that you can not trust elections. you can not trust the democratic process and we need to overturn the last one. i was surprised by that. i did not anticipate that. i think it's extraordinary. [inaudible conversation] i think that was white. i noticed a shift in tone, mr. shift, he attempted in the beginning he thanked the senate but i think that was an attempt to shift the tone. i think a lot more offended. it was treachery, there is about against the united states, the chief justice admonished them. when talking about the elections and how they can't be trusted. that is an interesting approach. i think it is crazy frankly. it will be interesting to see how they unspool that. [inaudible conversation] i have not seen his comments. thank you guys. >> that was josh holly, from missouri, also former attorney general. just outside of the senate. they are expected to gamble back in just before 4:00 p.m. eastern. we will take your calls and comments. let's go to ricky first in indiana. >> bangmac sorry, we will take you to the president's attorney. how do you respond this can't be fair trial. >> we go with the 11 hours of playing a piece last night. unless he is making it up, it seems like he's got a lot of information. so proceed with your case. the more they do this, two and a half hour events at a time, it undercuts their entire argument. you know what, ultimately that's up to the united states senate to decide. they said basically, we have all of the materials printed this is a challenging case for the dimmer numbers. and vet say that he is boasting that he is successfully obstructed congress. how do you respond to that allegation. >> executive privilege and under nonsense. these are privileges recognized by the supreme court of the united states to, the united states constitution. this is not nonsense. it's really what the constitution is about. what they are putting on the case, the good news is we only have 22 hours more to go. and then we will go. let them put their case on. and then we will continue. [inaudible conversation] >> there is a lot of things i would like to reply. and we will reply. you noticed that adam schiff today, talking about quid pro quo printed notice what is not in the articles of impeachment. allegations or accusations of quid pro quo. that does not exist. there's a lot of things the way will rebut and we will do it in it more systematic fashion. and if of gotta do it. [inaudible conversation] >> i can't make any determinations on how long are proceedings will go because we have to mason on what they will do. [inaudible conversation] >> i don't do that. [inaudible conversation] >> last question. >> how much of your presentation will be on rebutting what you here today. >> a combination of both. we will challenge aggressively the case that they are putting forward based on what we are hearing. and also we have an affirmative case that we will make as well. we will devote. thank you very much. >> the legal team talking about the president returning from davos, the world economic forum and he was asked about how the president there may to the reporters as he made to the reporters. in a tweet, president trump we have all of the material, they don't have material. here's what he was talking about printed. >> i got to watch glimpses, wasting time in washington. they didn't talk about my conversation and transcripts. this, went shift made up the phone a story and he repeated it to congress in the world, it was a totally funny story. then i released the transcript. there is supposed to be a second was a laura to him. it was supposed to be an informant. what happened to the informer. all of these people disappeared. when they saw this transcript, they said we have problems. but they went ahead because they were already there because they had a funny, concocted story made up. so here is the story. i did nothing wrong. it was a perfect conversation. it was totally appropriate. the best lawyers in the world have looked at it. the department of justice has looked at it and given it a signoff. there was nothing wrong. they never thought i was going to release the conversation. they probably didn't think we had is fibers. we did have it transcribed. but they never thought we would release it. when we released that conversation, all hell broke out. with the democrats because they said, wait a minute this is much different than 50 shift, told us. so we are doing very well and i got to watch enough, i thought our team did a very good job. but honestly, we have all of the material. they don't have the material. >> i want to make a few brief remarks and answer a few bushes before we begin our presentation today. yesterday we feel we laid out a very powerful case for why this should be no different than any other trial in america. it should involve the calling of witnesses, it should involve the production of documents. thousand have the opportunity to prove his case. and if we prove our case, the senate should connect and remove the president from office. but the senate should allow us a fair trial. fair to the american people, one that allows the house to call witnesses. one thing that was clearly established yesterday as the senate is not a court of appeals. in the wee hours of the morning, by the president's own team, the senate is not a court of appeals that must deal with a dry record from the court below. there is no court below. the house charged the president the senate tries the case, a trial involves witnesses. if it is fair and we laid out exactly why these witnesses are important. what we expect they would have to say, we laid out all of the documents that the administration is withholding and how the senators if they are doing impartial justice, would want to see those documents. the president last night or early this morning depending on where you are in the world, right that he thought things were going well because they had all of the materials. while indeed they do have the material. they have a hidden. from the american people. that is nothing to brag about. and if the senators are serious about wanting to learn all of the facts, if the president's team wants to contest any of the facts, these documents and witnesses will need to be produced pretty that the american people here what john bolton has to say. but then hear what mick maloney has to say or secretary pompeo or any of these other witnesses with the relevant information. they want to know. the american people overwhelmingly want to hear from these witnesses and for a very good reason because they can shed light on the presence misconduct. so yesterday we made the case for the witnesses and the documents, today we will begin our trial with the factual chronology and we will go into detail about what happened and when and how we know that it happened. we do not assume that everyone in the senate was able to watch all of the house testimonies. some of you in the press, were able to do that and we can not assume that the editors were able to do that. let alone the american people were able to do so. so we will layout all of the facts in front chronology and all of the facts come to light. we believe we will make an overwhelming case for the president's conviction on both article one and article two. >> that is out of shift on this morning. we will whether or not they can support the case. but i will tell you what, every time they say that this indisputable, their story unfortunately that is just not reality in the american public is a lot [inaudible conversation] >> we look forward to hearing from the whistleblower. and then just as today, the story where he described to all of you, to chairman nadler, and most important thing to the white house counsel, that mr. zielinski, but today were supposed to believe him. and in spite of the history, where seven important things that he had exactly wrong. so when he talks about presumption, and when congressman turner under oath at the hearing, if that is the kind of game that they are playing here and again i think the american people see through it all. >> was the wrong to no republicans in the deposition. almost every saying interview. >> they subpoenaed every saying witness. they kicked out all of kinds of numbers. then they say that chairman nadler says last night, he used the term cover up. [inaudible conversation] >> the cover-up, are you kidding me. you all covered it. the distinction is the president's counsel wasn't present. so look at what happened in the nixon inpatient. this 1608 days from the time the inquiry started in the resolution starting the impeachment inquiry until the articles of impeachment were marked up in the judiciary committee. president nixon's counsel was allowed to participate all 11608 days. the same thing from clinton and 792 days from the start until it went to the articles of impeachment they were marked of the duchenne judiciary committee and compare that. we will take you downstairs in the basement. [inaudible conversation] >> right after on july 24th, the very next day, he is feeling exonerated. he's doing really fantastic. he called to chat with the ukrainian president. do me a favor. so this is what he does. so imagine what happens if he is not convicted of what he did. imagine what he will do. who will he shake down next. one money is he going to withhold next. what will he try to extract, some other person or country. and wanted their country will interfere with our elections. this will be a president totally unprecedented. [inaudible conversation] >> considering that the president's team in my view, for their portion, and you this is sort sort of done deal for the president. and for them to attack the house or is really beyond the payoff. why don't you guys just get on with what you need to do and provide us with exonerating evidence if there is any. i have seen (i know for a fact that they weren't doing this they would criticize something else. mrs. what they do. what are they focus on what the president did. they have a trial without witnesses and evidence. i just overheard my colleagues say something like are you waiting for something new. many hours yesterday trying to spring forward. and we were all shut down. [inaudible conversation] >> let me say a few things first. please don't put these in front of me. adam schiff news speech was one of the most compelling i've heard. i think that a good number of my republican colleagues for the first time, or the entire argument, powerfully distinctly and completely. i am hopeful that can begin to change minds. in addition, the american people heard many of the american people have heard the arguments powerfully, completely and distinctly philippe, i don't see how any senator, democrat or republican, goods in the floor in here adam schiff and not demand witnesses and documents. there were so many powerful part to the speech that demanded witnesses and documents. so many things. when did mullaney say before and after his speech. what made him reject it. the documents, right before the days of the 24th and 25th and 26, which we have requested of july. very important. so i thought it was an amazing two and half hours. i am hopeful. we have seen that the public pressure for a fair trial is having some effect. yesterday a good number of republicans went to lena mcconnell, and said we need to improve the resolution. they didn't improve it on the main area. but they did approve it in a few other places. i am hopeful through speeches like schiff and the attention of the nation, more focus on the schiff's issue now that endeavor has been. that there will be continued pressure many republican members to ask for witnesses and documents. they did last night. there was sort of a little amendment. they were saying all along, done for bilbo for them now. we will have a chance later. don't vote for them now. if there's not a sure chance later, we introduced amendment that there would be. they rejected it. but if anything that may put pressure on the people by the end of the week to vote for witnesses and documents. i will take a few questions. [inaudible conversation] >> the chief justice, those guys without naming anybody, he thought should be toned down. i was so impressed with the house manager news case, it was on facts, and answered the questions and talked about why we had witnesses and documents. the president's lawyers never answer the question of witnesses and documents. they talked about a lot of other things. they did some finger-pointing. but they never answered the question. i think if you are a juror listening to both sides, you would have cited with the president, the house managers because the president's council didn't directly answer the question why we shouldn't have witnesses and documents. [inaudible conversation] are you pretty nervous. >> i said what i am going to send that issue. >> would you be open to a witness - >> no. the republicans have the right to bring in any witnesses they want. that trade is not on the table. >> what more do house managers have the same printed. >> the house managers continue to do what they have done over the last two hours. i think that it will continue to make a powerful case. the first witnesses and documents and second step, we can rear real fair trial. and who knows what will happen once or is a real fair trial. if there's not a fair trial, if they shut it down, any acquittal, president trump will have little value. [inaudible conversation] i don't think that's entirely accurate. they change their minds on a couple of things. mcconnell put in the resolution and i think that because the public wants a fair trial, it may happen on witnesses and documents as we move through the week. that is what i hope. that is why i pray for the sake of the republic. i certainly think it is not out of the question.
