Before i begin i would to take a moment to recognize and thank the dedicate a Law Enforcement professionals that are here on the stage with it. I have shared jim skinner from Collin County texas. Share wayne i80 from Brevard County florida. Sheriff harold everson, evensen, Rockwall County texas. Sheriff matt saxton from Calhoun County michigan. Sheriff senator warner from north dakota. Sheriff Jesse Sandoval county, new mexico. Sheriff sam page, rocking him county, North Carolina. Sheriff dale schmidt, dodge county wisconsin and mike davis was the Deputy PrincipalLegal Advisor for i. C. E. He is the highest ranking career official with the i. C. E. , also Legal Advisor, which is one of the most critical enforcement arms with an i. C. E. And with his clone whos the for enforcement with enforcement and removal operations. We are here today to help the public understand the human cost of sanctuary laws and policies which band and prevent local Law Enforcement agencies from working with i. C. E. , to include even the simple sharing of information about criminals already in their custody. Laws and policies like these make us all less safe. Its plain and simple. This isnt a lyrical matter. Its a Public Safety matter. And its past time to put aside all the critical rhetoric and listen to the facts. And the fact is people are being hurt and victimized every day because of jurisdictions that refuse to cooperate with i. C. E. As Law Enforcement professionals it is frustrating to see senseless acts of violence and other criminal activity happen in our communities, knowing full well that i. C. E. Could have prevented them with just a little cooperation. The type of cooperation we seek is simple. I. C. E. Utilizes a decades old process in which we all issued an official immigration form known as the detainer to advise our Law Enforcement partners that weve established probable cause to believe that an individual who again has only been arrested for an unrelated criminal violation and place in that agencies custody is an alien whose removal from the United States under this nations immigration laws. The detainer asks our Law Enforcement partners for two simple things. Advance notice of the aliens released from custody, and a brief continued detention of the alien in the partners custody into i. C. E. Can be present to take this individual into federal immigration custody in a safe and secure environment. The fact is that 70 of the arrests i. C. E. Makes are at local jails and state prisons across the country. But we used to make more, and we used to get more criminals off the street before sanctuary laws and policies prevented us from doing so. Leaving us with no choice but to expand significant Additional Resources to look at arrest criminal aliens and other immigration violators out in the community, including at their homes and places of employment. A a more dangerous undertaking r our officers and a more disruptive action within our community is. Simply put, a less effective method. There will be criminals we dont find, and sometimes when we do find them, its only after they have been arrested for another subsequent criminal violation. Our at large criminal alien and fugitive operation teams are working in your community everyday. We would much rather take custody of criminal aliens in the safety of the jail and fireman instead its in our officers out to perform the dangerous and difficult task of finding them all over again because a local Law Enforcement agency has refused to allow us to exercise our lawful federal authority to make an immigration arrest. Theres a lot of misinformation out there with regard to how we do our operations and what is required some going to give you information and context to distill some of the misinformation that is out there. One that is that sanctuary jurisdictions, along with many politicians and members of the media continually perpetuate, is that i. C. E. Doesnt prioritize its limited enforcement resources. Nothing could be further from the truth. 90 of the people that we arrest in the interior of the United States are convicted criminals, individuals who have been charged with a criminal violation, our immigration fugitives or are illegal entrants, meaning they have been through the Immigration Court process previously, been deported and reentry illegally, which is a federal felony and one of which we receive 7000 convictions for last year. And immigration fugitives, to be clear as well, are those individuals who have had their day in court, have exhausted all forms of due process, have in order to be removed by an immigration judge and have failed to comply with that removal order. Last year we made more than 105,000 criminal arrests and removed more than 145,000 criminal aliens to include the arrest thousand criminal aliens to include the arrest of nearly 10,000 gang members and removal of another 6000. Many sanctuary jurisdictions will also incorrectly assert that they cannot hand over custody of criminal aliens in their jails and less i. C. E. Provides an arrest warrant signed by a federal judge. Those that say that are either willfully ignorant or patently disingenuous. The truth is that federal law does not provide any mechanism for judicial warrants warrant e issued for civil immigration violations. There is not a single judge, magistrate anywhere in this country that has the Lawful Authority to issue a warrant for civil immigration violation. By statute, congress has given this authority solely to supervisory immigration officers. This is one of the ways in which our system, the Immigration Enforcement system, differs from the criminal Justice System. And its perfectly lawful. If Law Enforcement entities that have criminal aliens in custody want to release their and is back to the street as opposed to a cooperative with i. C. E. , they should not justify their actions through a misstatement of federal law. The truth is that every committee is safer when Law Enforcement works together. Some of the sheriffs standing beside me worked with i. C. E. For the 287 g~ program, the authority for which again comes direct from congress. This program is proven to be an entirely successful mechanism for state and local Law Enforcement agencies to work with i. C. E. As response for removal of hundreds of thousands of criminal aliens and Public Safety threats from our communities. However, there are numerous other ways lawenforcement agencies can work with i. C. E. The bottom line is where you to collaborate with other Law Enforcement agency we can end it is a Public Safety and national security. To further illustrate, just this week to dedicate women and men of i. C. E. Conducted a targeted intelligence based at large criminal alien operation. Many of the subjects we were pursuing had been released for uncooperative sanctuary jurisdictions. Of the nearly 1300 arrests made this week, our office arrested nearly 200 who couldve been arrested and jailed at the detainer had been honored. Of the criminal aliens we took into custody this week, three had convictions for manslaughter or murder. 100 had convictions for Sexual Assault or crimes but the victims of half of them being children. 78 convictions were Crimes Involving drugs and more than 320 had convictions for driving under the influence of drugs or alcohol. For example, in Boulder County colorado our officers found and arrested 56 youll illegal alien with prepas been released in the local jail after his arrest for felony Sexual Assault on a child. We launched a detainer but it was ignored and use again out on the streets, until yesterday. Regrettably, despite our best efforts we were not always so fortunate. Like in Mecklenburg CountyNorth Carolina earlier this year and illegal and was arrested for a dui. I. C. E. Watch the detainer but it was ignored. Then in june that seen it was arrested again but this time it was for two counts of assault on a female, assault my stimulation, assault with a deadly weapon, and another dui. We launched a detainer again but it went unanswered. An Mecklenburg County released him from custody. Hopefully well find them before he hurts or kills another innocent victim. So far in 2019, fy 20 necking, i. C. E. Has lots more than 160,000 detainers nationwide. For those nationwide. For those that are honored we are notified in advance of an aliens release. The system works and were able to place that criminal alien in removal proceedings or execute an existing lawful removal order. On the other hand, if a jurisdiction chooses to become a sanctuary for lawlessness or chooses to put politics over Public Safety, we simply will not know that a removal, often dangerous, recidivist criminal alien is no longer in Law Enforcement custody. I can tell you in my almost 25 years of experience, weve seen numerous tragic incidents of aliens being released from custody after having been arrested for state or local offense, the one to commit other often more egregious crimes. For those who support victims rights, and who among us doesnt, how do we tell a greeting victim that the person who hurt you or your loved one that the crime was preventable if local Law Enforcement had merely honored i detainer or even given us a phone call backs who are the sanctuary cities really protecting . The answer, sadly and often tragically, our criminal aliens. Sanctuary jurisdiction proponents have well scripted talking point that they like to recite when confronted with the realworld implications of their illadvised rules and policies. They proclaimed king of the trust and local police will be disrupted or degraded if these local agencies work with i. C. E. Of what these advocates do not it does is that when these release criminal aliens commit further crimes, their first target is often the very immigrant communities that sanctuary advocates claim to be protecting. What does it say to the victims that you report crimes, when the Law Enforcement agencies turn a blind eye to the illegality of the person to just arrested and released into the street, knowing full well that i. C. E. Was willing and able to remove the threat from the community . I actually has a rare ability within the Law Enforcement community to prevent crime i. C. E. We cant arrest remove criminal aliens before they can or anyone else again, immigrant and citizens alike. I want to take the time to think of all enforcement partners to understand that working with i. C. E. Is in an immigration issue. Its a Public Safety issue. Its time to publicly call it those who have put politics over Public Safety, those who make our commute is less sacred who great safe haven in which criminal aliens and gangs are allowed to flourish and can victimize innocent people with impunity. Today, i. C. E. Senior leadership is Holding Press Conferences in st. George jurisdictions throughout the country to highlight the dangerousness of these laws and policies. California with the recidivism rate among some illegal alien cohorts is 46 . King county washington, chicago, new york city, new jersey, Mecklenburg County, North Carolina, denver, colorado. These may be the first with calling out that this will be the last that needs to stop it work with us. Find a way we can prevent murders, pedophiles, rapist, drug dealers and domestic abusers from being released back into our communities. Its plain and simple. To the public who want to live and raise your families in safe neighborhoods, we ask you to hold your lawmakers accountable before you or someone you love is unnecessarily victimized by a criminal that i. C. E. Couldve removed from your community. Ill answer questions in a minute but first id like to get from a couple of our partners. First off is sheriff jim skinner from Collin County texas. Good morning. My name is jim skinner. Im the share of Collin County texas. I am the legislative director for the Chefs Association of texas and also served on the legislative committee for the National Sheriffs association. For his ongoing efforts to remove criminal aliens from the United States. Lastly i want to thank our fellow shrubs from across the United States and other Law Enforcement officials for all that you do to fight crime. And to protect our citizens. Nuclear lives on the line every day and we are grateful for you. All one has to do is to look at the nightmare occurring on southern border, to understand that all americans are safer in federal state and local Law Enforcement officials cooperate with eyes and their efforts to remove criminal aliens from our country. Not all aliens are dreamers. The experience brought them to the United States. As a matter fact, substantial number are criminal aliens. Persons who violated other United States laws. Make no mistake, they are a threat to our Public Safety. Like thousands of other sheriffs in this country, when icheic the files of inmates, on federal immigration detainer request, i find their most often charged with crimes other than being in the United States and in violation of the immigration laws. To be clear, they are in my jail, because my deputies and other local Law Enforcement officials, have probable cause for violations of state and federal law. In these circumstances, to help keep our community safe, it takes Effective Communications in close cooperation with i. C. E. To close the loop. We know that is it too often in the wake of these criminal aliens are left nothing but a trail. Yesterday, i had the opportunity to meet with angel families. Upon the west side of the capital. These are folks that have lost their loved ones at the hands of criminal aliens here in the United States illegally. As i looked into their face i saw the pain and anguish that these people are experiencing because of the death of their loved ones. They have pictures of the daughters and their wives and their husbands and the grandparents. Most important, their children who have perished at the hands of the criminal aliens. I thanks myself when i see this, what is that oath that you took. I am a part of the same blue line so long with every other sheriff and Law Enforcement official in this country. Federal state and local. I raised my right hand and took an oath to preserve and protect and defend the constitution of the United States. In the laws of this country. I expected Law Enforcement officials we all understand that that we all are going to work hard towards that end. So in spite of the fact that a peace officer may work in a jurisdiction where politicians or lawmakers are willingly ignorant or blind to the rule of law, and our godgiven rights in our constitution, we the Law Enforcement officers are the ones who must assure that the rule of law is respected and adhered to. My word to them is pushback and be brave and remember your oath and remember that your first responsibility to the citizens that you serve. In these times is that collaboration between federal late state and Law Enforcement. Protect the citizens we love. There are two ways to cooperate with i. C. E. The main two ways of course our compliance with the federal immigration detainer requests. And that we are speaking about a few minutes ago and of course participation in section d program. Both of these are vital. Both of these are vital for any community that is interested in keeping their citizens safe. To honor our else, we have to be wheeling to work. All levels of Law Enforcement to protect our citizens. We are thankful for i. C. E. We are thankful for the invaluable service. They provide to the citizens across this nation. Like so many other officials across the country, i in texas, i am better prepared. To serve my citizens and my communities because of my relationship with i. C. E. We are grateful. For these men and women of i. C. E. Thank you. Good morning everyone. I dont have a howdy like my partner from texas but good morning. [laughter] michael of the Law Enforcement officer standing here with me today and around the country, we are honored to stand with our director of i. C. E. And a teammates or mice. As we all Work Together to combat the illegal immigration cases that is currently impacting our country. In order for us to properly address and combat destroyed the problem. It is imperative to the local and federal Law Enforcement officers were together. Just as they would at the battle any other crime that was our citizens and our country at risk. Unfortunately though some of our country think that Law Enforcement should not work with i. C. E. On this critical issue. And as such, created the concept of sanctuary cities. To block enforcement efforts. To be clear, the concept of sanctuary cities, is perhaps the most ridiculous and outrageous idea i have ever encountered in my almost 40 years of Law Enforcement. To think that there are those in power who took the same oath of office that we did, told the constitution to who would be wheeling to oppose the rule of law. That is completely insane. And it is unacceptable. Thats why im extremely proud of the state of florida, on the direction of a great governor, we recently banned sanctuary cities creating a partnership environment for local Law Enforcement officers to work handinhand with our partners at i. C. E. And city peak. The law also mandates the resident relief illegal aliens back into our community his. County jails must enter into agreements with i. C. E. To temporally house persons subject entered agreement. The direction Enforcement Program known as a 287g, enables permit Law Enforcement officers to perform immigration Law Enforcement functions. After they have received the appropriate training. In addition, our governor recommended the florida shares a cost or participate in the 28070 program. As well as the Foreign Service officer program both of which are working perfectly and enhance partnerships between local and federal agencies while making a difference in keeping our communities safe. Im proud of the state of florida for taking lead on this. I cant begin to tell you how important it is for local Law Enforcement to be un handcuffed so that weekend work with i. C. E. And tv to enforce law. To combat illegal immigration into protect our citizens. I challenge you to find any other crime where alecto officials would want federal and local authorities to not Work Together. When they do everything in their power to stop them from working together on the homicide. On a mission tile case on drug cases or even Human Trafficking cases. The answer is unequivocally no. They would want them to Work Together and do Everything Possible to solve his cases bring that criminal to justice. Yet by creating a sanctuary where he for illegal aliens to hide, theyre actually protecting criminals who commit narcotic violations and Sexual Assaults and prey upon our citizens. For some elected leaders in our country to ignore the little rule of law and created century there protect those who entered our country illegally, its not only outrageous, but in my opinion is criminal. The immediate violation of the very oath he took to support and defend our constitution. As time to hold those accountable that create sanctuaries for criminals. Its time for congress to stand with our federal Law Enforcement partners instead of standing in the way of justice. And most importantly, in the way of protecting our citizens. In closing i am a very simple message for those who want to create a sanctuary that harbors criminals. Those members of congress who have become obstructionists and the protection of our citizens. You need to stop standing with criminals. You need to start standing with heroic men and women who are putting their lives in the line every day to protect our citizens. It is become a part of the solution or get out of our way. Because i can assure you that nothing is going to stop local Law Enforcement from working with our federal partners and the protection of our great nation. I mean, absolutely nothing. Nothing is going to stop us. Thank you. Thank you. You mentioned your frustration with obstructionists local government and in some cases even statehouses. What is your message to the people who live in those communities. Not government officials and others who have a political agenda that might be of close to i. C. E. In particular. What is your message to the people who live in those places. About why it is important you all do what you do and the help that you need. My message to them would be they should be challenging those lawmakers and policymakers within those communities. As to why they were cooperating with us why are they choosing to put politics about Public Safety. Why do they want these criminals and released back to the street as opposed to reading removed from the country if they ate with they have a removal order. Its kind of incredulous for me to think about these jurisdictions. One of the Law Enforcement agency to expend the resources to arrest these individuals for a criminal violation that theyre sworn to uphold. But yet, it will prevent another Law Enforcement agency from exercising that same responsibility. It doesnt make sense. I cant believe that at this. My 25 year career, that i have to thanks a Law Enforcement agency to help me. When i started in 1994, we had something to do, we had a warrant to search, you had to be away partners with a stick because so many people were wheeling to help right frankly, most will. I couldve had 50 upon the stage if either important. Its really these future is unfortunate they happen to be in areas where there are very large populations of criminal aliens. This might be tell them. What about the president said here with respect to his. I have not discussed this with the president. I was wondering if you could give more detail on the family extensions. In addition to the bills or convert other i. C. E. Facilities and what is the followup to the detention capacity. How can i answer that question. I really trust in the topics. Family detention we can only expand to the loophole that congress appropriates. So we can only expend funds to that. About 3300 family. In the absence of his preparations were not looking to expand. Were looking to utilize those beds. To what extent do you find a resting undocumented immigrants in courthouses who have been some lawsuits that have been publicized recently. Other standards with your agencies as to when to arrest and when not. Is the great question. Thank you. The fact that we have to arrest people in courthouses, is largely necessitated by the fact that Law Enforcement agencies will not be honor our retainers. For five years ago before this whole sanctuary city exponent, we have to go to court rooms because we would be able to get the individuals while they are sitting in the custody of another Law Enforcement agency. According to our policy, we worked very closely with the state association of chief justices in court administrators. When i was the director, we worked handinhand with the leadership of those two agencies to develop a policy. The policy excess today is regard to how we conduct enforcement operations in courthouses, their feedback, their input was integrated into the policy. Is in a disruption to the judicial process. To the american citizens who are being victimized. Even any courthouse, and the slant, and the sharks will tell you that they will have Law Enforcement officers from a very agency nearby arresting somebody in the courtroom every day. Criminals are local, most are recidivist, i guarantee you the Fairfax County today and there will probably be sheriff his from many different counties waiting for somebody. It is a common occurrence in Law Enforcement. The only reason is been controversial because politicians are looking to exploit. Local Law Enforcement will often say that they shouldnt be seen as harmless eyes. They wont get, operation from his communities. [inaudible conversation] i havent seen any statistics that prove that what i can tell you is that the number of immigration alien queries which those are, is when an individual is arrested by a state or local up Law Enforcement and we get the fingerprints through the fbi out of our databases. Those numbers have gone up every year. Which means more and more Crimes Involving aliens are being reported. The numbers dont bear out that argument. I would think that more Chilling Effect as i mentioned, is that those victims that do come forward asking the local police to take these illegal alien out of their house or out of their community, the Police Arrest him and he bogs out goes right back to the same community and victimizes the people in the first place. What is that due to the victims. Theyre not going to be wheeling to report this crime. I would say ive also heard with regards to crimes of violence. In reduction of crimes of violence. The past three years, we have arrested more than hundred and 57000 people that were involved in crimes of violence that included family domestic violence. Is making it harder for asylum. Does your agency want people of illegally and what you are doing about it. [inaudible conversation] i. C. E. Does not deal with direct order of custom and border protection. I would different the question to them. What we have seen though with regard to some of the very important measures that we have put forward, in the administration has put forward in the past couple of months with regard to asylum audit agreements. Federal regulation with regard to face our country with the migrant protection protocols. What we have seen, which is consistent with my experiences we have seen time and time again, that when individuals cannot come to this country illegally and be released from detention, and numbers of those individuals that try to come to this country increase. You mentioned a number of sanctuaries cities by name. You say are not cooperating with Law Enforcement. Your belief those cities the mayors of the cities are not interested in protecting their own citizens. So back on my cast my thoughts on what those might be the thoughts of the mayor. I think hes got uphold the Public Safety. Its hard to imagine that there would be any sort of framework within a jurisdiction that would prevent local Law Enforcement from sharing information. Why would you kick us out of gang databases. He was against us arresting gang members. Why would you shut that source. Again i think is people putting politics. [inaudible conversation] i havent spoken with them. I can tell you and i was up here in dc working in the space, prior administration, secretary johnson, mustve made at least a off a dozen tribes. To chicago to try to convince them to cooperate with us on the priority Enforcement Program. To no avail. You said you arrested 200 people this week how is that different from any other typical week that you do target Enforcement Actions what is this particular continued nationwide to lash out against sanctuary cities. What is the timing of that. Its not in a moment. As one this not getting enough attention. I wish it was in april or problem we would be at the front end of it. Unfortunately it is been mustering domain after year. More of these jurisdictions are choosing not to cooperate with us. There was no particular reason for the timing of this operation. We conduct daily operations everyday throughout the country. This was a concert operation which we had a large number of individuals many of whom came from the sanctuaries date jurisdictions that we went out to try and to arrest. State moguls will do warrant searches as well. When the gross. [inaudible conversation] i am here to talk about the asylum deal was dealt with pain higher in the department. Im not involved with that. [inaudible conversation] on thanks you about timing of this. Their people are going to say this. The timing of this and why it is happening right now. Why not wait until after this. We started planning this several weeks ago. Im going to answer your question. Several weeks ago, we wanted to concur with the end of the operation as you can imagine, and largescale criminal activation. We are arresting thousands. Were not in a position to try to change our operational footprint. We done surveillance and surveillance and we think these targets are located. We need to act upon that. During the press congress with the operation only makes sense. Is it urgent. I think its hard to everything day to get people to continue to be victimized to get them out of the communities. Do you find that having the administration having eliminated deferred action for childhood arrival actually helped i. C. E. In terms of actually making people who are legally working in this country even though they were undocumented, they were actually within the system. Now theyre illegal. Does that help i. C. E. Understand that is generally not involved with that. That individual status still remains. They still have docket. Those individuals that have doc up, then we come in contact with just as most of the individuals that we come in contact with, is the result of their interaction with the criminal Justice System meaning they been arrested for another crime with the Law Enforcement agency. We received information in the biometrics were taken upon that rest. Tax related charges and some of them were released back into the community because of the policies there. Leadership following that case and in a situation like that, what can you do on your end with a local policy change in order to increase cooperation in your agency. We work closely with both Law Enforcement officers as well as elected officials within the cities. We try to find ways to work with them. I can speak specifically of that. Weve had meetings with commissioner of the county, and trying to find ways in which he will cooperate with us so they dont turn these dangerous criminals back on the street. But i dont think anything encapsulates the issue any more so than whats in Montgomery County in last month. If i worked Montgomery County, i would be ashamed of the fact that i was turning criminal aliens back into the streets. Seeing the criminal histories and the victimization of these people are causing. In the counties, claimed that he was cooperating more with i. C. E. Says the National Attention has been brought on this. Have you found that to be the case. Is been really recently since we met with him so i dont have information on that. I wanted to thanks the fact the abolished i. C. E. , i covered one headquarters in dc, and enemies one where i. C. E. Workers were trying to get in the building but were blocked. These happen all over the country. I was wondering if you talk about the effect it has on morale employees and both of it has any effect on how you would enforce. I can be more proud to stand here represent a dedicated professional advice. I have met no match of federal employees and service in my career that are more dedicated and more committed and more professional than the men and women of i. C. E. Despite the challenges that are are in front of us, despite the rhetoric, and the risk in the past several months, we have seen individuals shoot into a one of our buildings we have officers working in the command center dealing with criminally deep aliens. We have seen individuals try to blow up a detention facility. We have been called and told to run concentration camps knowing full well that we dont want concentration camps. Anybody can go to our website or the media for the past several months and look at hard attention facilities. We have opened up a detention his facilities to the media completely. And, one individual try to blow it up. More media has been down to our Family Residential center in philly. Everybody in this room has seen for the past year, year and a off, pictures of the challenges that cdp was facing with the overwhelming numbers of family coming to the border during the height of the surge and early spring. Every media outlet shared those pictures. I have 40 cameras from every media outlet locally and nationally provided they came to her Family Residential center and show them what the real conditions are for individuals that are actually being detained within i. C. E. Not one National Network should one clip of that. Feel free to go to local, affiliates that all of these were in and look at that video. Think back and tell me that we run concentration camps. There was a case where the city was putting people off about i. C. E. Rates. Other certain sanctuary commit ms polities that are particularly dangerous like have you been tracking the attacks on your officers. Is there any way that you can identify. We certainly are following them closely and we have the intelligence that we follow up on. I think what we have seen, is that a lot of these places there are sanctuary cities where the ready. It is spewed continually. Thats where those threats and challenges come across. I dont think the sheriff his jurisdiction is going to have people marching onto his gel. I. C. E. Want to follow up really quickly on family detention things. In order to enforce to encapsulate and enforce the new rules settlement, how can you do that that went out further facilities to existing families. Family detention is just one as we have gone through with publishing the regulation of the Settlement Agreement required by the court in order to and that Settlement Agreement. That is just one. We have migrant protection protocols which are requiring family units to remain in a cell while they wait for hearing. We have regulations which will prevent family units from being able to apply for asylum in this country of the. There are various things, they may not need to use that. At least for those who are initially arrested. We have been using it for is those families that have gone through the Court Process and most of whom do not even show up for the first hearing. They been ordered by an immigration judge, detain and stage and removed from the country. The Obama Administration did differently where is being more successful at Law Enforcement partnership. Lower than they are now. Apples and oranges. The role of numbers that you talking about were hired was the result that the fact that most of the people coming across the border were individuals that were matching nationals they can be returned almost immediately if not shortly thereafter. That was the largest population coming across the border which is why you have those numbers.
