Nor do i think it is in the best interest of the kind of culture and economy that we have that believes in Capital Investment in the private sector. We dont need to have the government run everything as the only choice. We need to make sure the networks are safe and secure. There are bad actors out there and its a country tries to infiltrate the network we have a partnership for security in the networks, the government taking over controlling it is probably not the way to go. There are very good resources saying they are not considering recognizing. [inaudible] i think we have to be able to have these discussions. We need to have robust discussions and people need to be able to kick out ideas and i dont think that its elevated itself to what the white house had a position on this and i have every confidence that some of the other important elements would have weighed in on the proper time and manner. I think originally before this new sort of broke with the state of the union coming up, and infrastructure being a hot topic especially for 2018 historically infrastructure initiatives have been very bipartisan when i say that thinking about the spectrum in particular but it could be a number of things involving the internet and broadband in particular. What would you like to see happen this year . I would like to continue to pubuild on the success from the past as you know we were able to be in the process to free up the receipts in terms of the amount. It was 44. 4 million for those of you to keep score they said it had no value and gave a zero score and then the rest of the Television Auction took place. We have to fix this piece to make sure it is properly funded so that is working its way through the process right now. Ive been in regular contact with the device to call him assistant secretary david rebel. For those of you that dont know him, he was the chief counsel on the subcommittee for six years and now i have to properly address him as the honorable, too. [laughter] 38 questions for everything he says. To continue, we did 2012 and we are continuing to scrub the spectrum to find what else is out there that we can bring to market so that is one piece. Second, the fcc who i want to get a great applause to has identified that they should follow the law. This is shocking news in the nations capital. Theres a problem ithere is a pw that precludes him from putting the auction deposit proceeds into the proper place. The last Administration Just went ahead and did it. We have to chang change the lawy you can deposit here, there. That is high on their list so we can proceed in regular order for spectrum auction. Second, we have a hearing tomorrow we have 25 pieces of legislation and ideas for republicans, democrats and republicans on infrastructure and a lot of it has to do with the governance process out of the age into the digital age and by that i mean streamlining how you can move forward and getting the government to move at the pace of innovation in the hightech sector. Im going to refer to my notes. Crown castle was an Infrastructure Company in 2016 looking to expand their tower site which is in a parking lot by a 14 by ten area adjacent to its existing tower. They have to prove ther had to o adverse effect. They had two dozen entities to work through and it took five months to complete and thousands of dollars just at 140 square feet so my friend and colleague introduced a bill to make clear to be required to perform these and existing rights or facilities to be expanded by no more than 13 feet in any direction. Its things like that that stand out and this is important in a district such as mine where 55 of the land in the district i represent which is two thirds of thmississippi within the exceptn that with all of the requirements its not that you want to pla avoid the required methods that need to be up to expedite the process. I had a little town of probably lesthatprobably less than 150 pe spend three years trying to get permission to put the polls on so they can finally get power and sound. These are the things we will look at and then we want to make sure that the mapping is done right. When the Obama Administration did the stimulus they pushed the money out the door before they knew that the areas reserved for underserved. We want to get the mapping right. The resources that us could spend should be spent in areas that its least economically attractive to the sectors. We need to build where there is minimal service. 39 of the areas have 23 Million People that are lacking access and that is where the Public Investment should go so we need to make sure we have a whole series with all of those issues and more. So, you come from a uniquely rural area and very few people are spread over a large area. What do you think are some of the Better Solutions . You talk about removing the regulatory barriers tha but what else can be done . Evil ways need to be able to get the flavor out across these areas and it makes a lot of sense there its possible to streamline wherever you can but also i think with the new Wireless Technology and perhaps the new Satellite Technology and the ability to more data through existing systems makes sense. Lets face it in some of these areas i have some counties there is one person for every 9 miles of power lines thats probably not going to be economically achievable but what you can do now from a wireless standpoint and the throughput that is going to change lives so i think the faster we can get a fight she developed and removing these analog impediments getting the streamline in part with the agents again its not too played any of the environmental walls it is just tof this just to tryp the process. Thats naturally, and i know we are short on time, but how does the recent action in fact the broadband rollout and legislative priority is . It has affected for years. I remember sitting in the Capitol Office was then chairman upton and myself asking him not to proceed to giv because the cs an opportunity to legislate and we thought w we wouldve were mn that path that we ende ended rehearsed and moved ahead with the regulation. We have a difficulty trying to find any bipartisan agreement on anything that came near since then because one site says it is on its neutrality and now we need to modernize the fcc into everything. We ought to be able to come to find Common Ground to prevent the bad behaviors all of us can agree upon. We will have a hearing on the authorization because that gets into how the internet works today. You have a situation where traffic is prioritized today. It should be prioritized over watching some crazy cat video on youtube. There are things that happened today in the management of the internet that makes sense and i dont think that they are fully understood by my colleagues or myself. Thats why we do hearings if we ask for the input. We want to get the policy right. If we just continue on a with litigation versus litigation, america will move further back and i dont want that to happen. I want broadband investment to go up and now you see that with the tax code changes we can drive more investment in the buildout and its done in the private sector. You think about the huge amount of coverage. The private sector every year does 7,577,000,000,000 a year. So, that is where its at and we need to let the partnership move forward and get the conductivity in high speed so i would like to see us move forward on the issues where we can find agreement. I think that they are dead on arrival at 1600 pennsylvania avenue. Trade politics for some, but its not even going to pass the house and senate i cant imagine that they will end up the paperwork. So, why dont we come together today as i tried to do the last five years before they were implemented by the administration and legislate this space. So im asking all parties. Ipad draft proposals on the tables antable since probably 2d 2015. So its not a legislative solution. Its just a bulldozer that takes you back and they cant do anything in this space. Beyond that, you are seeing a growing debate which is a pretty surprising character set and the Internet Service providers that may need to have a discussion about net neutrality. It may be the facebook and amazon and the more you learn about how theyll get caught operate in their algorithms and how many followers do you really have is somebody monetizing all that by the way . You go back and a great newspaper business they have to certify how many readers they have it published that because that is what they are based upon. You think about the synchronization are we getting scammed in this market we know that there are some out there that pretend to be people and there are followers out there that dont exist to do with this is getting monetized, so i think there is a poll from the ftc and congress. This is an area that the committee will be giving an investigation. The state of the markets into the net overall. Youve got to put the consumer first and to keep the consumer first it means you have a market you can trust and that will drive innovation and competition to lower prices and expand choices for consumers and of his bad behavior we will go after that i dont care who it is. The Commerce Committee has a pretty good record on doing that, going back republican and democratic chairs. You mentioned earlier in the wake of the 600 megahertz auction which you and i worked on a little bit. It is a complex endeavor and you mentioned before that there might need to be some more help or thought in this area. The commitment when it was being put together is if you are not a part of the option we will make sure that you are not harmed in terms of the overall viewership or whether you should have to pay a price with a penalty just because you are licensed and getting moved around so efficientl so traditie legislation we have a 3 million once we figured out what it would cost. That got negotiated down to the 1. 75 billion now the number probably is about 3 billion. Now weve allocated all the proceeds and we have to find money to make this up. We need to not only to keep our word but also getting this done, public broadcasters are running this, Public Television stations are running into a problem because its only like 80 of the money at the time so there are questions about what you can commit to and we dont need that so im working hard to figure out the funding stream into thinking the other associated changes because it is a tight timeline here and you have issues with a limited supply of people applying and move and that is an issue he put on the committee. We dont need anything that stands in the way of progress because it is a new network with throughput and coverage areas so we need all of us to stay on track and work. Its what the investors in the spectrum paid for on a timeline they predicated their business and protesters were promised they would incur any losses in the congress now needs to step up and i think we will have an opportunity to do that. Frank pallone, who have developed a good working relationship with on many issues even when we disagree its amicable, i know he has a bill authorizing this. Its easy t to offer despite wee heard appropriate from an authorizing standpoint. But we need to find the money and w the work shoulder to shoulder on that. I know we are starting to run out of time and at the recent false alarm in hawaii dont attend into all of our Emergency Alerts and the conversation regarding 911 and the next generation 911. What would you like to see how happen clacks the committee next week before commissionfebruary, false alarm. A couple of things one you mentioned im an amateur Radio Operator though im not active much. The committee is actually wired an Emergency Alert system or two or three in radio stations because my wife and i own radio stations for four plus 20 years in the pretend to be an engineer at times so i know a little about that and i go back far enough to remember when it was the emergency broadcast system right in the control room next to the operator and i think it was a pink envelope that had authentication codes in case of the National Emergency and those got changed out i would say every month he would get a new envelope from destroyed the old one, never open it its like ripping the thing off your mattress i think. [laughter] but this was very well thought out. I cant imagine a scenario where they say push the wrong button and we have a Nuclear Attack coming. I dont know how that would have happened in so i think this needs evaluation. We discussed the matter of great seriousness and there could have been a loss of life as a result because we had an interesting thing when i was in the radio business. I had a retired guy who would come back and work one saturday morning shift. He was a great guy and they were doing a drill in the oregon and the whole shtick is one of the major across the Columbia River had been breached. If that happens, portland is under the whole bunch o a wholeo they are going through the drills and he gets a call saying now its your turn to activate the Emergency Alert system to notify people of this disaster. He says okay thanks. No, no i dont think im going to push the button and go on the air and say that its been breached. I think that is sort of orson wellewelles stuff that he refuso do it but you cant get to that level and wherever we are you have to be cognizant especially in the stretch of his times and places like hawaii or elsewhere that has better command and control so we look forward to working with our First Responder community and broadcasters in states to see what went wrong and how we make sure that it doesnt happen again how are we on time . When we talk about the Digital Divide in Rural America we often hear a lot about Public Investment and a little about the specific technologies that will deliver broadband to the underserved areas and there are some stakeholders including panicked america now for the use of the technology to play a role in this mission. Do you believe that this should be a part of the solution and if so, what steps should Congress Take to ensure . I want to make sure we dont have interference, that is the first thing wherever you are in the spectrum with all the issues that fall from there you always want to be pushing out and maximizing the use of the spectrum but you dont want to create unintended consequences and in this case it could be interference with existing users so thats something we are continuing to investigate. I am not at all opposed as long as there isnt some sort of interference issue that has to be first and foremost but we are scouring to do the kind of things and as well as look at unlicensed and with the appropriate amount of that is. We are going to try to get the spectrum out there. There was a tie i would say in 2012 and i maybe wrong on this we thought that some of the spectrum we werent really sure what it would be used for if it have to much value and now its like some of the new beachfront if you sit here looking at how we maximize the use of that. Can you say anything about any opportunity to update the 96 Telecommunications Act . I started an effort on that when i chaired the internet subcommittee. We did a very extensive information gathering project comment, updates and added a lot oit had alot of good input on ho that. It was my hope to do kind of a major rewrite as i mentioned earlier its kind of collided with the picnic neutrality in the room and precluded our ability to move forward so that we arwhatwe are doing is lookiny piece. As congress i think we also need to look at the functions and how it works today to modernize it. They are doing that with the department of energy. Then i look at the statutory responsibilities the commission has and i think we are basically carping goes up a piece at a time and a program at a time so we live obviously in a different era than when the act was written. The market has changed dramatically so we need to look at the different programs piece by piece and that is what we are doing. So i wouldnt forget a comprehensive review of the act. I think instead you will see program by Program Evaluations and changes going forward. I should say shes a terrific chair of the subcommittee and has done a great job.
