Good morning. Welcome to the National Press club and welcome to everybody is watching online on our website and on cspan. My name is chris, underreported of the los angeles times, and im a new member of press club. Im happy to be here hosting todays headlines newsmaker with California Attorney general xavier becerra. Many washington are familiar with them. He served 12 terms as a congressman from los angeles begins a member of the ways and Means Committee and the highestranking latino in congress. Up until a few weeks ago i was based on a Sacramento Bureau sought more familiar with his recent work in california. Governor jerry brown appointed him as attorney general last year after his predecessor was elected to use senate. His political future is a constant source of conversation in california. Next use his run for first full term as attorney general, a position that is been a stepping stone to lead our office. Hes navigating so the most important issues in the state and the country. One out of every eight americans lives in california. The states democratic leadership is dedicated to opposing president trump. Hard as they goes by without news of another legal action from his office. On the environment he is against everything from Energy Regulations for ceiling fans to form a president obamas clean power plan. On immigration he sued over the construction of transportable and to protect dreamless and possible deportation. Today he will touch on some of these topics First Experience in both california and washington and get how is using his current position to talk the talk administration. A few housekeeping things. So without further ado, California Attorney general. Thanks for being here. Chris, thanks very much. James, thank you, with all the folks at the National Press club. Appreciate my having a chance to be with you today. I recognize a number of bases, former staffers and former colleagues in crime on the present side who i had a chance work with why this was this iss you are. I know ive will say its nice to be back but you get accustomed to california weather and california politics, and the site to be the common california fulltime. I do enjoy visiting washington, d. C. The company could keep my remarks vertebrate because i believe you will probably have some good questions for me and id like to entertain as many as i can. It is nice to be had to get to talk to you about federal issues even though i am a state attorney general because so much of the work that im doing these days in california pertains to the work thats going on now in washington, d. C. At the federal level. I think its important because not everyone here used to work for me or is a former press person who i used to speak to. To give you a bit of background on who i am, as chris mentioned, Governor Brown, jerry brown, a little bit more than a year ago nominated me to fill the vacancy created by Kamala Harris assenting to be used senator from california joining diane feinstein. Ive been in office for about ten months now, and its been, ive been a pretty much every fed a chance to visit and this is been extraordinary right and i will hopefully get into some of that. But what is important about my experience as a new ag is that what im finding is that my 24 years in congress has informed immensely the work im doing as the state attorney general for the largest and most potent state in the nation. And its important to understand what goes on in washington, d. C. , and sometimes we can make sense of whats going on in washington, d. C. , because it not only forms what we do in our state of threat the of the state of the nation, but it will have an impact on a daytoday basis the people who live in california and throughout. It is great to have 24 years of experience running through my veins as i try to make crucial decisions for the people of the state of california. Its also important perhaps to mention that my route to become the attorney general was not the most conventional. I believe because of my 24 years in congress, two years before that in the state legislature and previous to that for your serving in the very office i now run as a Deputy Attorney general, all of those things combined really gave Governor Brown a sense that perhaps this is the right time and the right place to have someone who brought together a number of very interesting qualities to the position. But i hope Governor Brown also took into account that on the first in my family to actual and the chance go to college. I understand the importance of defending student who tried to go to college and then get stuck with Student Loans that they cant repay because the forprofit university attended goes under or never provided them with a diploma with the paper it was written on. Perhaps governor looked at the fact that im the son of immigrants, and recognize that so much of what impacts the state of california is the work done by families who came to this country and to their state of california very recently. And perhaps because im the son of immigrants who have been intuitively the congress often issues of immigration as a person who convened principally responsible for convening the Bipartisan Working Group on immigration in the house of representatives as early as 2008 and working through 2013, had a lot of experience dealing with a lot of policy on immigration, but also personally lived his life as the son of immigrants. Or perhaps its because Governor Brown knew that i probably would not have a mother today with not for the fact my parents have Health Insurance because my father was a labor. He only got got to the sixdayt he was a union worker, and because of his work in the late wishing he is able to have Health Insurance coverage and as result of that when my mother was hemorrhaging at a loss of the pregnancy, we were able to have her go to a doctor. I didnt understand in those days. I was about four or five years old, but i do know that today my mom is still alive and perhaps he understood that when everything comes i was one of the people who worked hardest on the Affordable Care act as a member democratic leadership i served for about ten years in democratic leadership and as result of that perhaps he thought there was someone who would stand and fight those efforts that might occur to try to steal from people the Health Insurance that they didnt under the Affordable Care act and mras that explain why were so ready to not only defend the Affordable Care act in court by filing a case to intervene in the existing what was then house versus propublica came house versus price, now its change can come right . But its still a case that is for the course. Also were within hours of the Top Administration submitting their executive order that we deny women under the Affordable Care act access to Birth Control coverage. Ready within hours to file a case against the trump administrations actions claiming that it violated the law. And so i hope that the governor in california phillies that he made the right decision in moving toward someone who had the experience not just because the twin for use in congress but because he grew up as the son of immigrants versus them to go to college, who understood coming from a Labor Household how important was to have benefits like Health Insurance, that there were things we could do working together as a state. California is as forward leaning as you get. We are blue because we understand what it means to be green. We are progressive because we believe moving forward, not going backwards. We intend to protect the 40 Million People in our great state. What i find intriguing is that my job as attorney general and the chief Law Enforcement officer for our great state has always required me to be ready to uphold the rule of law, to make sure that the 40 Million People in our state believe that not only they must follow the law but everyone up and down the state regardless of their status and rank must follow the law. Its difficult to explain sometimes the 40 Million People that sometimes the most forceful actions i must take to defend the rule of law against very occupant in the white house is supposed to be helping us enforce the rule of law and whats perhaps most disturbing in trying to enforce the rule of law is to find how unwilling the adversarial party is willing to give us the information about why they taken the actions that undermine whether its the healthcare, the immigrant rights or the Movement Towards criminal Justice Reform that we try to implement for 49 people in california. What is this administration trying to hide when it does what revealed to us the basis for its decision to try to deny 200,000 Daca Dreamers in california the chance to me or the 8000 dreamers of the country the chance to remain. With not been able to get them to provide us with the documents that prove the basis for the actions to repeal the daca program. What is it in this administration that forces the administrator for the epa to fail to reply to a simple freedom of information request, freedom of information act request, by the California Department of justice . Thats been requesting one in the same could file today. Yet we now go to court to force administrator pruitt to simply provide us information that we are entitled to by law not just because i am the attorney general, because of the Member States of america and im a citizen, and entitled to this information. So i will tell you that roller coaster right has been an interesting one and were going to continue to fight. And whether this new Administration Washington d. C. Wants to enforce the law will protect the rights of the people of this great country, at least in california were going to pick up their fumbles and were going to run with it. We dont care if someone wants to abandon the Playing Field right when people are counting most on our leader to stand up for them. We will be there, and ive said this to the people of the state of california, if you play by the rules, you should be able to expect fair play in return. Thats the way i saw going up as my father with a sixth grade education was able to see his kids go on to college when he himself couldnt walk through the doors of the university. Let alone the doors of a restaurant because of the signs that were outside those establishments in the states that said no dogs or mexicans love. So here we are today, ten months into this term. I feel pretty good that i got on the right roller coaster and im going to write this baby as hard as i can. Because there are so many people on that roller coaster with me who have to survive. And if we do this the right way, not only will america thrive but the economic engine for our country, which is the state of california the sixth largest economy in the world, will continue to thrive as well. And he doing deserves the chance to say that if they were card, whether youre a construction worker like my dad a generation ago, or the clinical worker like my mother a generation ago, that if you work hard, you, too, will have a chance to own a home, send your kids to college and retired indignity. That is the American Dream you give them that and they will do the rest. Thats what my folks did and at a construction worker, in america should know that if that still the way we play the game in america, then glass is halffull. We should be optimistic. In california where optimistic on a son of immigrants of optimistic because its in my dna. We are going to move forward and i think the governor of state of california jerry brown for giving me this chance at least for these last ten months to be our chief Law Enforcement officer for the state of california. With that i will take any questions that you might have. Before we get started, i will call them people from the audience to ask questions. So the question relates to the issues of immigration and how we move forward, given a number of circumstances that have occurred. I will simply say this. California didnt become the sixth largest economy in the world because it just sat around and waited. Californias of the largest number of immigrant families in the country. Each and every one of those families has contributed to making california the hypo economy that drives the American Economy. Without those immigrant families, we wouldnt be number one in manufacturing. We wouldnt be number one when it comes to the tech industry. We wouldnt be number one when it comes to everything we do in the entertainment industry. We wouldnt be number one when it comes to hospitality. We probably wouldnt be number one in the number of graduates coming out of our universities. We wouldnt be number one of beautiful people, and we probably wouldnt be number one in the ability to say that there is a future in the great state of california. So immigrants have proven a lifeblood to the American Economy and the california economy. Immigrants have proven that they revitalize communities and immigrants is also proven that they commit fewer crimes, use the Healthcare System less than americans born in this country. And so when people try to point the finger and direct all the ills that we see in front of us and give, a point responsibility immigrant families, i say not just as the attorney general, not just as a 24 your former member of congress, but as i see as the sun immigrants you better read of your facts. Because the revitalization and the constant rejuvenation of the American Dream comes because their people everyday for using their hands and the brains who are of immigrant stock who are replenishing our stock of goodwill and good future. And so i think its clear that will continue to see that happen, at least in california. And if were successful we will continue to see the threat the country as well. It was issued shortly before he Left Congress at the end of last year where your server was the site of the bunch of cybersecurity incidents basically. House supports the people made unauthorized access to server 6000 times logging over 70 different accounts. Individual long time i. T. Guy was moving other date onto your server. The reports i should learned in 2016, you want to replace him with his wife and cataloging anyway. Such a block investigators from looking at the file siding speech and debate clause. It says your physical server itself which is evidenced later disappeared. This kind of thing doesnt happen everyday encompass. You didnt mention this to the 17 members whose bid may been affected. Before he was on the physical server did disappear. What happened to the server and especially given your love for the background are you seeking to present charges against these i. T. Guys given at a minimum certainly the rules concerning cyprus could on the house were violated in some pretty strange ways. Luke, you should go back and you should research your fax. Youve got them wrong. I i understand this matter is still under investigation, and we have cooperated with the authorities both in congress and within the federal government on this one. You should check your facts because he stayed a a number tk that were incorrect. [inaudible] i would just urge you to to the folks who are doing the investigation of that. But check your facts because he cited a number thinks that are incorrectly stated. Id like you to comment on the tax reform. Increased tax for california and new york and if theres anything youre thinking about doing. And also today the house is voting the project, the reciprocity carry permit, that it would allow people to use that carry permits for guns anywhere in the u. S. If this is approved to intend to challenge this law . So having served on the taxwriting committee in the house for 20 years, im familiar with most of the different provisions that were in this bill except for those of course that no one had a chance to read because there added at the very last moment and written on the sides of the actual legislative bill. But what i will tell you is this. Everyone is always told in america that when come with going to tackle our tax code so we can make it simple, fair and competitive. I find it hard to believe that the product that is now surfaced out of the house or the senate is either simple, fair or competitive and certainly if youre in the middle class in america, you would be very hard pressed to believe that increasing your taxes while decreasing the taxes for the highest and wealthiest americans and for the largest corporations is what most people would define as making things fair. It certainly doesnt make it simpler in the sense that while you may see a number of documents reduced, the chances are that there for you to be ao come out paying no more taxes than you pay today, you probably will find it will not be a simple course that you take, try to navigate figure out how you would pay less in taxes than say the wealthy folks are getting the result of this bill. I will tell you this. Competitive, most companies in america are small businesses. They are not megacorporations. Most americans work for small businesses, not megacorporations. Yet the lions share of benefits in these tax bills go to megacorporations, and those who are wealthy enough to own a lot of stock in those corporations. How competitive it that makes us as yet to be determined here i will tell you this, that if you are lowering the statutory Corporate Income tax from the mid\30{l1}s{l0}\30{l1}s{l0} down to the low 20s, that may sound good but for Many Companies in america they are paying below the mid20s in Corporate Income taxes. Its a really interesting dynamic in play. I think one fact is indisputable. At the end of the day, these different versions of, these taxcut bills are going to increase the size of the deficit which will put more pressure on budgets as well see over the next two or three weeks the same movie is going to play out again where we are going to go to the breakout shutting the government down, tried to come up with a budget to keep the operations of the federal government going. As a result will be that few people would get the resources they need to read the Research Done on cancer the National Institute of health, fewer people have the support they need to send their kids to college other choice because hell grants and Student Loans will be harder to get with federal health. And what we will find is we will have many more difficult to sustain the life saving programs of Social Security and medicare and medicaid because they will be those who claim that the budget deficits are putting pressure, squeezing those very important programs, and will have to make cuts to them all because deficits have been increased to provide tax cuts to very wealthy and very large corporations. Garrett epps, the atlantic. You were the respondent at the National Institute of families case in front of the supreme court. Wonder if you could briefly talk about what evidentiary basis the state felt it had to require, this is a case that requires certain disclosures and signage by socalled Pregnancy Crisis Centers and is been challenged as a First Amendment matter. Could you talk about the evidence the state was relying on before it impose this requirement . Sure, good question. When your pregnancy crisis center, what comes up in your mind . While you and i cant do this because we can imagine what a woman must go through because she is speaking out guidance, counseling, what goes through your mind when your Pregnancy Counseling Center . You would hope that place, that center would provide you with all the information you would need to be able to make the best decision you can about your course of conduct because it affect you as an individual. It could affect your health and it will affect your future. We dont believe that anyone should be out there marketing their Services Without fully disclosing what they do or on top of that, what a woman you seeking that counseling and debt service can receive or is entitled to receive. And so california has a long that requires the centers, many of which are not licensed to provide Health Care Services require the services of a licensed professional. We simply require them to provide full disclosure whether they are licensed or the types of services that a woman would be eligible for within the state of california because those are her rights under state and federal law. So were defending the law now because we believe every woman in america and certainly every woman in california under the legislation this been challenged deserves to all the information to make our decisions. I just have one quick question and ill send it back to the audience. Under president obama, texas was a state those always suing the federal government. And that democrats have kind of come back around. How you compare what you were doing in california to it texas did under president obama, why should states have this autonomy that the Obama Administration did not wanting to have when he was in charge . Chris, i would distinguish what california is doing from what previous states have done, whether its texas or the Southern States back in the 1960s using states rights within the constitution. When we go out and assert a a right as a state under the constitution and the tenth amendment to proceed in the forward leaning manner is because we tend to be inclusive in the way we conduct our affairs. When i try to separate families so because they are of immigrant stock. When not trying to deny students a chance to reclaim the monies they pay for a student loan from a forprofit university that went under or never provided a a real education for which i to be inclusive of the people of the state of california. It could take a look at some the actions of some of the states previously that you mentioned, those actions and asserting a states rights was for the purpose of excluding and, of course, in the 60s it was very clear. Federal government, stay out of our affairs. We will decide who can attend what skull of what university aced on color of skin. Eric the state out of her hair. We will let the people of our states know who can sit at a counter and have breakfast or lunch at that public counter and federal government, stay out of our hair when we decide what seat in unless the person interested can take. Recently texas was very aggressive in say federal government, state out of her hair. We will decide how we treat the people with a different background in texas. The approach is very different. We are simply saying we should not allow the federal government to exclude people simply because it doesnt fit the political leanings of those in government. We believe the constitution is there to protect everyone equally and we would use our right as a state to make sure that where we had the power, we enforce that part of the constitution. In the back. You mentioned filing a lawyer for conflict of interest, and also recently, sued over the destinations in new york and massachusetts. I was wondering kind of, and given the emphasis on federalism on the current epa, what is your take on this . What you see are the biggest in our mental issues that states including california face . And how are you building allies with other states . So we have been working with other states on the very moment i took office. In fact, before then i was already in communication with a lot of other state ags talking about what we would do together it once i got sworn and i have the actual official. Thats been one of the really redeeming features of this job that ive assumed is to be able to work in concert with so many other talented leaders in the country who are attorneys general. Let me separate the question, because the issue of the administrator of the epa refusing to provide documents under the freedom of information act as required by law is, i believe, an absolute abuse of power and discretion. He guessed im not requesting that as some powerful elected official in the biggest state in the union. Im doing it because every one of us in the training of america has a right to request that our government be open and transparent. And the fact that i have disabled the attorney general of the state of california has to sue the environmental protective Protection Agency and its administrator mr. Pruitt simply to get access to documents which are Public Record is an outrage here its unconscionable. Its almost as if they believe they are above the law. On the issue of how we handle these various cases which, by the way, we have not lost the case yet against the federal government on these in my mental matters, what were simply doing is defending the rights of our state to move forward under the law and with the support and Previous Partnership of the federal government to take actions which not only benefit the state and environment of california, but also benefit the entire nation. And we will defend them vigorously, those actions that weve taken, because we did them not just under the law but with the blessing of the federal government. If the federal government wishes to change course, there are ways to do that. But once again, the federal government is not above the law and it has to go through a process if it wants to make legitimate changes to legitimate policies that are in place that states like california have relied upon to make major decisions, consequential Financial Decisions in how we will move forward to it i dont care if youre talking about Energy Efficient light bulbs, Energy Efficient ceiling fans, release of methane gas and what we do to the ozone for whatever side of the spectrum you are on, its all important and i can show you the investments in the billions of dollars that california businesses and consumers have made to make california a cleaner state and a clean Energy Producing and using state. And when not about to let someone because they think they have by fiat the right to change things all of a sudden in fact, our consumers and most importantly our businesses and put them at a disadvantage with some of who doesnt want to be as clean and has claimed that rely on polluting energies to move forward. We cover higher education, and i want to ask you, really ask for an honest answer about what speech as opposed to the others you mean . Substantive, lets say that. About what d. C. Is the leverage that Daca Recipients have two, number one, closed and the government, or number two, to even be fully legalize . Majewski to background. I am seeing diminishing of latino voice in congress. You are gone. Gutierrez is now a lame duck as is Raul Labrador and ileana ross lightman. Immigration is more and more cnet as the National Security issue, and base more, more on immigrants from muslim countries. And even the daca kids have gotten so aggressive, they shouted down pelosi. Its not a good image. So what do you see as the leverage to get them legalize completely . And to even shut down the government. I dont see it. Good thing im an optimist. I would say this. [inaudible] yeah. I firmly believe, and ive said this for many years as a member of congress and out as an attorney general, that i believe the daca agreements are here to stay piccadilly they will be some of our greatest leaders in the future. Because they have been tested. For them to get out, and another saying, undocumented and unafraid. Thats powerful. Because they put everything on the line. By the way they used to shout at me, too. [inaudible] but you know what . Thats the american way. Thats what i love about them so much is that theyre willing to get out and say im going to fight for this thing, even though at any moment that might be subject to apprehension, detention and deportation. Thats what you want. I suspect that during the revolutionary days the founders were looking for folks just like him to say we want you in our fight. I make it deleted on this, but they are not ass i think a lot of people would say. They really are. Bad ass. They are tough. Theres some politicians who need a little bit of spine like they have. So what i i would tell you is this. I dont think the role and influence of latinos in this country is diminishing. I believe it is increasing. And i believe that there are meaning new leaders emerging throughout the country, not jt in the latino community, but throughout this country who understand what it means to come as my parents had to do, by for everything they could, who even to this country wouldnt let my dad walk into a restaurant because of the color of his skin, he never once complained because he knew it would be a future if you work really hard for his kids, and by god, when you come to my office and assure that photo of the president of the United States standing in between my parents, you understand how they were rewarded for their dogged fight, just as of late the dreams will be rewarded for their dogged fighter thats what this country is about at the end end of the. So i feel very optimistic, not just in terms of the dreamers, not just in terms of latino leadership moving forward by the way, california believe on every symbol, in every single race in our statewide election coming up next year there will be a latino on the ballot. And theres change amidst, and i believe you will find that that diversity is going to make us a Richer Country and a richer politically prepared country as well. But get ready because those dreamers are coming. So we are getting towards the end of the program so we had time for a couple more questions but i just wanted to mention a few things that come up at the press club. There is an active case with Consumer FinancialProtection Bureau control and several conservative states have weighed in on behalf of the administration. He is california or do you know of any of the states that will weigh in on behalf of the other acting director . I know a number of us have worked very closely with the bureau, and mr. Cordray when he was there as the director. I will do everything in california to make sure that the Consumer FinancialProtection Bureau continues forward in a robust fashion protecting the rights of consumers, and what it means defending the provisions in the statute that we prescribe who would take over with mr. Cordray is absence, whether it means making sure that is not an agency that leaves the Playing Field when people are right now in need of people who know how to quarterback on selected issues. We are going to be there. They are just too important of an agency. We work worked handinhand wim on so many cases, and weve had success working with them on any number of matters in court and outside of course. So we will continue whatever form that takes. [inaudible] are you going to file a stay tuned. I wanted to piggyback on the question, like what leverage do you think the dreamers have to shut down the government . Like what you think they can actually do . So the leverage is with the dreamers. The only folks that can shut down government are those who have the votes to keep the government from securing the monies it needs in its budget. The only folks who could do that are in congress. And quite honestly because we have a party system, the only people who can shut down the government are the folks who are part of the party in power. When you have the majority of the votes, you determine what fails and what passes. The Minority Party can never kill a bill because the Minority Party doesnt have enough votes to kill a bill. You always required a membership in the majority to participate in defeating legislation. Thats my definition democracy, right . Majority. If youre in the minority you dont have the majority. Remove the fog is very simple. In congress will have a budget and our Government Services, whether its for Social Security, national defense, Homeland Security will not shut down if a majority of members in the house and the senate vote to pass a funding bill in the budget. If they cant get a majority of the votes, then the government shuts down. The Majority Party is going to run its bill. Nancy Pelosi Chuck Schumer are not being given the chance to write the bill to keep the government open. They are in the Minority Party. Its the Majority Party that will draft the bill on whether or not they are up or down votes enough to keep the government running. And so if the chest down it will be because of democrats, nancy pelosi and chuck schumer, and it certainly will not be because of folks who dont have the vote in congress and dont have a vote in america, the dreamers pick it will be because a majority did not put together a bill that could secure the votes necessary. And so i government shutdown, thats in the hands of the republican majority in the congress, house and senate. Let no one else take response just as you are a parent, your kids dont make decisions over the household goes, a ghost is going to come who goes to work another. Its the parents. Dont shift the responsibility where it doesnt lie. You get elected to do your job, and would you get a majority in your party to govern, my god, you should govern. And if you cant, dont put the finger at someone else, especially someone who doesnt even have the ability to vote. Dreamers are powerful. I wish they were as powerful as some people seem to indicate dreamers are just fighting for what they can. Dont expect them to stop, but dont blame them when the Majority Party in congress cant come up with the votes for its own bill to keep our Government Services moving forward. So this one other quick one want to ask as well having worked in d. C. Now working in california. California is often viewed as an outlier, you know, you some youn california doesnt always make it over the rockies and you gone from a place where democrats have almost no power to place were democrats control everything. What lessons do you think are not reaching these political lessons that might be worthwhile to consider . They will reach the rest of the country. What happens in california altima happens in the rest of the nation. As goes california, so goes the nation. Just sometimes it takes a little while. We were in the throes of this immigration debate a couple of decades ago, proposition 187 in 1994 s at that integrate a measure as you will find. It passed by 60 in california. It propelled republican governor pete wilson to reelection at a time when he was losing in the polls. And so we were there, been there done that. Thats a great thing, its past tense. I think the rest of the nation will get there as well. Once they do they will find that its better to have clean energy jobs. In california we have ten times more energy jobs than are the entire number of jobs in the coal mining industry. Why would we want to go back to the old days . What we want to do is explain to the other states, if they lose a coal mining job they have lost the job altogether, that no, there will be replacing because everyone has to work. My father, he would assert you i need to work, ive got to do something. Ive got to build something in order for me to take care of my family. And so i think what you find is that california may look like an outlier but we are one of every eight as you mentioned, we are one of it in the country. Its hard to be an outlier when youre so big. Without the economic engine of california, every other 49 states and all the digital gone at all the territories would suffer as well. As much as california needs to be part of the u. S. , the u. S. Needs california to be part of america. We will be in good shape. Watch what we do because you will be doing it soon, too.
