Ongoing challenges at the u. S. Southern border, with a former integration and Customs Enforcement official, a former judge, and the parent of a man who was killed by an undocumented immigrant. They talk about border detention policies, a National SecurityNational Security concerns and an event hosted by the heritage foundation. This is about hour. Welcome to heritage and this event which i called catch, release and then what because i want to try to find out what would happen to millions let into the United States on President Bidens watch. I did it twice in the year i have been here which is two times as many as President Biden has as an elected official. I saw hundreds at onetime in one place entering the country without any visa or apparent process that i could see and i through started thinking, will happen to them. If you will imagine that in 2024 we elect a president of either party who believes in enforcing Immigration Law and maybe appoints officials at Homeland Security who believe in doing their jobs and i believe the rank and file and Border Patrol and customs and ice want to do what they are paid to do what would it look like. How would an enforcement minded separation make it better than it is now. I put together three experts with more experience than i have and complementary experience and i look forward to talking to them about their views. Before we do, that i hope you will bear with me five minutes to watch a short video put together mostly with footage i took with my camera so it is low quality but the people here made it look nicer to give you an idea what i saw in case you dont follow this closely what is happening down there. The u. S. Mexico border is sparsely populated with desert, mountain, farmland for as long as as United States of america and mexico have been in existence it is a vitalle conduit for trade. The border has always been vulnerable to smugglers but in the last two years we have seen historically unprecedented illegal crossings mostly from people far farther than mexico like peru, indiana, poland and cuba. It is a result of the policy of the Biden Administration to enevery program by previous administrations that kept the border under control. He stopped border wall construction his first day leafing gaps and piles of unused materials and kept them outside of the United States. His d. H. S. Began releasing them in mass numbers. The word spread at the speed of social media that the u. S. Border was open. This decision to allow them into the country despite knowing they will not qualify for asylum has effected not just border communities but the whole community. Nearly 2,000 died trying to cross in the last two years. Agents and border and state military risk their lives and more rail on the Border Patrol is low and hiring is hard. Around die every year from opioid overdoughs mostly by fentanyl which comes through mexico. It is a big story. The border is 2,000 miles but lets zoom in one spot, yuma, arizona. They grow 90 of the lettuce. Beyond there is the Colorado River and wall. There is a gain where a gate was never finished. It is the preferred spot for aliens to cross. To make it easier d. H. S. Under the Biden Administration did not use some of the lights and monitors in place. The gap is next to an indian reservation with only small barriers to stop vehicles. In the day you often wont see people so you can find traces they came through leaving trash, coins and documents showing they come from all over the world. Even though they want to surrender to Border Agents they dont want to use documents because they have been granted alum before coming to the United States like this venezuelan who had status in peru. The real activity starts when day turns to night. Now they walk around the wall and give up to the Border Patrol and wait. The Border Patrol gives them a luggage tag to claim the bags. One typical night we met people from 16 Different Countries none with a visa. Mostly looking for work. Opportunity. Nonetheless the Biden Administration wants to let them in so they assume they will all ask for asylum. Only about 15 are approved most of those released wont qualify. They never qualified for visas in india. Flying to mexico and crossing illegally is safer. They get on buses. They get sent to processing camps run by d. H. S. And they get a notice to appear in court to begin the process that would remove them. Sometimes they just get a letter telling them to investigative the most convenient ice office then they are sent to processing officers who are paid by federal grants and left to fend for themselves. Sometimes they get clothes and shoes. The n. G. O. s give them a plane or bus ticket and they have no money to go anywhere they want. Americans need to fly using a real i. D. That asks you to prove who you are. Illegal aliens can just travel with the document from the d. H. S. At the same time many have entered without being arrested. Some brought across the desert and hide. Then they are driven north. This travel makes it coyotes very rich. U. S. Agents have signs that over 1. 5 of these have entered but we have no idea who they are. They are increasing the number allowed to apply for parole using the phone application and inventing new programs in violation of the law and congressional intent. Never before in 4eu69 have so many in addition missable aliens been allowed. The cost for them are over 150 billion but there are plenty other costs that cant be counted in money. What happens now . To help me answer that question i would like to welcome our panel. First we have andrew author a resident fellow at the center for Immigration Studies and former immigration judge. Next to him tom homan visiting fellow at heritage and a long career in Law Enforcement. Next to him Don Rosenberg the president for advocates for victims of illegal crime. Tom, i would like to start with you. What we see every day if we watch the right tv channels is this normal . Can you put it in Historical Context . No, it is not normal. Under the last administration of President Trump, regardless of what your opinion is of President Trump you cannot argue the success of his administration on Border Security. Illegal immigration was down 83 , 4year law. Unprecedented by any president. I worked for six president s from ronald reagan. Every president took Border Security seriously because you cant have National Security without Border Security. No one did more than President Trump. This is based on raw data. Great success the joe biden is the first president in history who came and unsecured a border. He abolished pretty much everything we did. We went to the most secure border to historic illegal immigration win months. Within months. Not by mismanagement. By design. What we see today is incredible. It is a lawless border and now that the d. H. S. Claims they have had success they move them through the port of entry. When they were losing, if the judge based it on the parole statute im not a lawyer but i can read. They can proehl a half Million People we know of. When i was ice director a year and a half i think i did three paroles. They did over a half million. They are becausing the parole statute to move people through the port of entries. That way they can claim illegal encounters are down and claim victory. Border patrol i think they had over 5,000. You add that to the thousands coming through port of entry, the numbers are historic. It is a shell game. As long as they continue to do this with no deterrence to enter illegally they will keep coming. That brings me to the next question which is about the heal aspect. Can you help us understand what is actually happening to the people we saw lining up . I was under the impression that if you arrived you were supposed to be detained. That is what the immigration nationality act says. In part it has says since 1903 with respect it the rest of them since 1996 they are supposed to be detained from the moment they are an pretended to granted asylum. You mentioned i was an immigration judge. I was an many segregation judge in york, pennsylvania. They would put them in the york county jail. That was under obama. This isnt a republican or democratic thing this. Is joe biden against everybody else. When they release them it is under protocol which is supposed to only be used in the case of somebody who needs emergency medical treatment or is a material witness in a criminal case. The Biden Administration has paroled 1. 4 Million People on a casebycase basis outside of those parameters. Im not making up the parameters. The former i. N. S. In 1982 said that is what was intended. 890,000 of those people came in through the ports or were apprehended. The other way they are releasing them is under 236a which is the general arrest and release authority in federal law with respect to immigration. That only applies in the case of somebody who is arrested on a warrant. It wont surprise you the Border Patrol agents are not there with warrants asking simon i have your arrest warrant. They are abusing that their own recognizance any sapbs. The recognizance any sapbs. The only time you do that is if they are not a danger it the United States or a flight risk. With respect to whether they pose a danger it the United States, Border Patrol doesnt know. They only have access to u. S. Information data bases, class n. C. I. Things like that. They might have some fortune information. I refer you to the case of a brazilian who was arrested in somerset, massachusetts. He was appear apprehended in arizona. He was convicted of murder in brazil. He had been arrested in connection with the assault on a Brazilian Police officer and he was a member of brazils largest cartel. They released him in the United States because they didnt know anything about him. But a judge in a decision that he issued in florida versus the United States on march 8 said they dont know anything about the people who come into this country. That seems a good segue to ask don, if we take a given pop lease of people say 10,000 released every population has a percentage of people with criminal records. What is the impact on American Communities from releases thousands of people some of home are recidivist criminals . My impact of where im coming from, from advocates, my son was killed 13 years ago by an illegal alien. Thats what got me involved and looking at the statistics. Where tom certainly tries to keep them out and art is involved in trying to do that, i get it at the back end. We get it we the crime has occurred and we have a victim that we are trying to help the family because their child, spouse, grandparent has been typically killed. Trying to find numbers on how many people is almost impossible because a lot of the crimes never even try to determine if the person is illegal. For example, i live right outside the city of los angeles. In 1979, the city of los angeles create wad they call special order 40. Special order 40 basically forbids the police or Law Enforcement from determining whether the person who has committed a crime is here illegally. Now, they have certain openings but how many have committed crimes just in los angeles in the last 44 years . If you look at numbers, a good place it look is g. A. O. Issues a report i guess three in the last 18 years where they talk about criminal alien crimeed a they are looking at it from the back end. These are people in jail, have been identified as being here illegally and committed crimes. Just to give you one number, this is the 2016 report which covered maybe four or five years, the people in jail here illegally were responsible for over 33,thou3,000 homicides, manslaughter convictions. That is one little time. And that number constantly in the report they are reminding everybody that that is a minimum number. Because a lot of people are not caught. They leave the country, dont spend the time in jail you need to to qualify. So the numbers are outrageous. You are talking about crimes in that period in the millions. You bring in 2. 5 Million People we know of and another million and a half or closer to two million, even if it is a small percentage it is a lot of crime. I was devastated to read that story. And, as you say a crime happens to an individual. Tom, we hear secretary majorca say like the border is secure. He says aliens refused asylum will be swiftly put in remove proceedings and if they dont get asylum deported. Ferrell if his lips are moving he is lying. He lies and he is being impeached. The republicans need to get it done. I watched a hearing and he wouldnt answer the question about how many illegal aliens had been removed. That is close to zero because i talked to leadership and here is what is happening that people dont understand. Why are they being released. Why are they not descend when they should be. If we look at the data the last 10 years in the many segregation court you said 85 failed it is 87 so nine of 10 never get relief because they dont qualify or dont show up. So, why are they detained . Go to the report the seconds report if you are in ice you are removed 99 of the time but if you are not, you leave 6 of the time. So they know what they are doing. They know this administration has the same data points nine of 10 will fail but if they are not in detention they what leave and what is said on recordment being in the country illegally is not enough so it is set up that they cant be removed. Our next administration there are millions of people unlawfully released in nine of 10 cases dont get comfortable. We will come look for you because if you dont have execute the judges order, the due process means nothing. The left cant keep saying they have a right to due process. Ok. But we that due process ends in a judges order in has to be executed or it is battalion up. Shut down the immigration court. If the order doesnt mean anything shut them down. But let me add one thing about when you get an order removed and it is not executed what happens . I used to take phone calls from republicans why did you remove that . He didnt have two kids when he entered the country and ordered to move. Now that he went he is immune and the order means nothing. That is why if you wonder detention and less than 40 days. See a judge before 40 days. When you are released you look at five to seven years, maybe a decade in new york city and they will get equities, buy a home and it is more difficult to remove them yankees why they are to the detained. I think it is always important to distress this is not an immigration good or immigration bad conversation. Im an imgrant and i know this country was built by immigrants. It is a rule of law that are enforced. One step further. Im not antiimmigrant. Im antiimmigration because of what happened. People say the biden is more humane. When you make a promise to the most Vulnerable People you enter illegally you will be released we will transport you you will we will transport you to any city, you get a work visa and even if you get remanufactured no one is looking for you the most Vulnerable People will take you up on that and put you in hands of cartels. We had over 1700 migrants died from overdoses. Women and children section traffic hick record. Cartels making more than they have ever made. Dont tell me the policies are humane. They are killing aliens and americans in record numbers. I want to get in the details because we understand the system is not working. How is the asylum process work . And in theory how should someone be removed if they have had due process and 87 dont get it. The larger question is talk about the back logs. Right now there are 792,000 affirmative asylum cases people not in proceedings but applying for asum and an asylum officer decides whether there should be granted. 792,000. That is more people than you have living in San Francisco and seattle. On top of, that there are 799,000 i believe is the number asylum came of claims in the courts. Even that number is a canard. One thing the Biden Administration has gotten in with the due process is to dump cases that are perfectly legitimate. Almost 92,000 kisses before the immigration courts last year should have gone forward, should have reached a resolution. The Biden Administration simply terminated them and sent them to uscif which is already overwhelmed to have the claims there. Joe biden a of talked a lot and you will hear people the Trump Administration dismantled the immigration system. This is crushing the immigration system. The immigration system works perfectly well. You go to court, put on the evidence the government attorney offers evidence, cross examination. Judge makes a decision. In detention 40 days is the average. When they are not in custody the average time from application to a hearing is four years plus. About four years and 27 days right now. That is on average. Some of the cases take 10 or 12 years. More than one judge will handle them. Trial attorneys will retire. But it gets worse. The Biden Administration in certain cases is no longer sending a government attorney to court to argue the cases. Anybody who has ever been to a court of law in a criminal case the prosecutors are like never mind we wont show up. That puts the judge in a position of being judge and prosecutor. That is unenable and un untenable and unfair. They have turned the situation into theater t. Is a show, shadow play. And they are crushing this system. They are crushing the agents, they are crushing the ice attorneys in the country. They are crushing the ice officers. It will be very difficult for any future administration to undo this. Not impossible. I want to go back to one thing don said about it local order in los angeles. We hear about sanctuary cities and cities that that say we are not going to help. What is the Practical Impact of a city saying we are not going to let cities they are not going to let the people do their job. The people they let out do more crimes. There was an article in the l. A. Teams a week ago and the city council was boasting there were 782 what do you call it im losing my train of thought. Detainer, yes. There were 782 detainers filed in l. A. In 2022. That is a low number because the Biden Administration is not filing detainers. So these people are bad criminals and they are boasting that not one of them was adhered to. So they let 782 people go just in one year that are hardened criminals, served time most of them in jail. The recidivist rates are up in the 60 to 70 so they will commit more crimes and this is all over the country but it is particularly bad in california the people dont know there are people in their cities committing crimes that are there illegally because they dont talk about tplt they were talking about bussing people. The city went crazy when they bussed 42 people. They never mentioned only 42, probably not many criminals, theres got to be 200,000 people that have gotten to los angeles, maybe in some other areas of california, sense Biden Took Office of people they released. So with 200,000 if only 1 commit a crime that is 20,000. If i could, this is important. The emergency that sanctuary cities make it possible for Law Enforcement to work with the immigrant community because victims and witnesses of a crime wont come forward if they think they are working with ice. What sanctuary city means the ice is locked out of they wont let us in the jail. They want access to the jail where the bad guy has been locked up. Apparently hes probably at risk of escaping and he is locked up. They made a decision to put him in a educational cell. That is the person ice wants to talk to. We want to talk to the bad guy. To say that witness would be afraid to come most immigrant kphaopbts are law abiding trying to support their families. They dont want criminals in their neighborhoods either so if the person is released he will offend. You take a victim and witness that wants to buy back their witness system they dont. If they cant arrest the bad guy they wont go to the neighborhood and find them. Sanctuary cities put them at greater risk of crime and ice probably will not find others. Any person who says sanctuary cities are a good thing go to a Community Meeting and ask a simple question would you rather have ice in the jail or your neighborhood. Theres argument that they protect them is crap. They are sanctuaries for criminals. Bottom line. Never have tom on a panel if you want to keep a sense of order. We have done studies where we have shown the assertion that noncooperation with ice makes people more likely go to the authorities is not true. It is not based on anything. Tom alluded to guidelines that secretary may orca put out that directed the 6,000 ice officers in the United States how they are allowed to question, not arrest, whether they can question somebody. They have to consider mitigating and aggravating factors and among the aggravating factors is how bad is the crime. Mitigating is Community Involvement and whether it will effect a member of community and whether anybody in the persons family has ever worked for the federal government. Respectfully and i have nothing against the postal service, they bring me my stuff, if you are a 65yearolds child sex offend early who volunteers at a preschool and Coaches Little League and your kid works for the Social Security office, why arent those positive factors. But i will cut it short because i know we are short on time. Secretary mayor cant directed ice not to go after people that engage in Domestic Violence. That is a crime that cuts across race, religion, socioeconomic groups. It is a problem. I was a judge, tom was an agent. We will tell you how prevalent and awful Domestic Violence is. Theres a provision in the u. N. A. Says to rightfully go after domestic abusers but the secretary said hands off because that makes it less likely that the victim goes to the police. That is the works thing. In california they have had the sanctuary law quite a years and as crazy as we are in california, theres some exceptions that you can still cooperate with ice in california law. The county of san mateo, in may just passed an ordinance that you cannot cooperate, no one in san mateo can cooperate with ice even in the cases of child molestation, rape and murder. And it passed 41. Child molestation recidivism rate is as close to 100 as you can get. I would be more surprised if we hadnt seen rogue prosecutors in big cities with the same philosophy but if you go out and murder something i dont think they will say you have an uncle in the post office. It doesnt seem to be a thing that applies across the board. It is real. Im always surprised doing what i do. I think the budget for ice for the next year set the target at 30,000 criminal aliens. Does that mean they are not going to make an effort with anyone who has a final order of removal and i believe there are 1. 2 million of those . Unless you are aggravated of a felony being in the country is not illegal. You have to wait until they commit a felony which is too late. Theres nothing in the i. N. A. That sails you have to commit another crime, a serious crime, to be here unlawfully. If they are here illegally ice should be able to arrest them before they commit a crime. If they are not detained in an ice bed they can go to alternative city detention. In my day that was first opportunity you you see a judge within 40 years and depend on the decision of the court. But we dantoni detain them so we had the ankle bracelet and some sort of g. P. S. Tracking system but this administration destroyed this. It has been taken out. They are awarding it to n. G. O. Groups and i was told by a good source i have a neighbor at ice who has taken control of most much the operations was talking about keep the promise at the made through the base. So, it wont be effective like the ice program with g. P. S. They had Great Success like 90 hoe up in court. When you show up in court and get a removal that removes the appeal later because i cant tell you we i never got reordered. But if they show up they get the order. A. T. D. Is a great complement to detention. We it is only if run by a Law Enforcement agency. They are take apart that capability. Why would they take g. P. S. Capability away . Pause they dont want to find them. This administration has just went nuts. As far as detention in two years of hick immigration, ice has the most numbers removal. It should be the opposite. By design. Ice officers, the latest budget they are not funding more officers. Shame on them. It is a pretty good bill. But millions are being released and you dont give ice the capability it arrest them . If they are not having consequence they will keep coming and hide out and wait for them to go away and wait for the next docket. Todays family groups are tomorrows daca unless Congress Takes it seriously. Entering the country illegally is a crime and when a federal judge orders you removed they need to lead. We spend billions on Border Security and detention and immigration courts. If we dont execute the final decision of an immigration judge then the system is never going to work, it will never be fixed. I think we cant lose track of that. It is by design. It is not just that it is broken theres a deliberate policy. I met with people on the hill. They need oversight hearings of what is going on in detention and a. D. T. And sole source contracts of n. G. O. s. Theres sole source contracts that have to be justified. Theres been billions of dollars awarded without competition so the Companies Want to compete against government for the best plod product. If they have the dollars congress and homeland oversight needs hearings. How are these billions of dollars going to n. G. O. s that transport illegal aliens to the United States . You can put an alien person in a empty aoeulgs bed and about 112 and we have medical and dental 247 and you will put them in a motel at three times the cost. There needs to be oversight hearings. I think 8 million a day in new york city alone. Just to go back to my imaginary scenario of a president who appoints officials that want to enforce the law has there been any precedent where we could get through the cases and due process without depriving anyone of their rights. I alluded before that about 890,000 people who were apprehended pe southern border have been released. Under the statute the secretary of Homeland Security can terminate that. Under the parole statute those people all have to return to custody and return to the status they had. They can be moved out because they are in the ice of the law Still Standing at the border of the United States. With respect to ramping up the number offism tpwraeugs judges of Immigration Judges we only have about 600 Immigration Judges in the United States handling a docket of two million. Being figure that out. It is a great job. I sure do still enjoy the pension i get from it. And but i mean when doug correctly said it is a very good job. With respect to detention, tom alluded to it. There are county jails and state facilities that sit empty. Those places are willing to take 140 a night to detain people that. Is what york county, pennsylvania did. That is why those people were in my court. I would walk through the halls and i would work out in the gym at the prison. I had great interaction with most of the people retained there and all of the guards. There were no abuses like you hear it is the most horrible thing. It wasnt. It seems harsh but thats what the law says. If congress thinks the law is harsh change the law but good luck enforcing it. It can be done but absolute Silver Bullet that would nip this is everify. That is mandatory, Electronic System that will in real time verify the employment authorization of anybody coming to work. Since 1986 you have to move that you are authorized to work in the United States within three days of starting work. We know this. Should bring in the Social Security card and drivers license. That was never put on the Electronic System because we didnt have one in 1986. In the 1990s they didnt want to fire people that processed i. N. S. Paper work. The Bush Administration and even the Obama Administration improved that everify system and it can be done quickly. If you cant work you are not going to stay. That is the way that it is. Mandatory verify, we saw Governor Desantis has moved to that in florida. That is the way you address it huge population. I am going to side step to go back to the enforcement memo we talked about that majorca signed. Continuing there are five Million People in the process and 1. 2 million have final orders of removal and if a judge gives an order and you dont carry it out we have to follow through. If you work out that there are about 400,000 or 10 are criminals so they would be you would think a priority about 10 . This is not a technical question but, don, do you think the secretary who is in a community understand the risk he is asking his fellow americans to run by leafing these 400,000 people here . Yes, absolutely. We always looked at cases like my case and thousands of them that we were Collateral Damage to a system that wanted to bring in people illegally. Now you see you have the 400,000. What do you think they will do . The proof of that is now that even the people coming here illegally are considered Collateral Damage because of those diagram on the way dying and he doesnt care. It is a game of numbers. The support people we can let in we are willing to sacrifice other people. He has first of all, if he doesnt foe that he should never have been in the office. I have met him. He is a sick person but he is not a stupid person. He is an evil person and has a mentality that it is good for the country, maybe it is good for him and maybe for the politicians on the left side to allow any number of illegal aliens into country and if you are a criminal from anywhere this is the best time to come to the United States. So they are coming because it is easy to get in. It has never been easier. I think we have some time left. I wanted some questions from the audience and at the end give you a minute to wrap up. Sir. Specifically mr. Arthur, you were talking about verify. Everify something we have come across a lot of parolees in the lawful program but released from the border, most of them with a parole term of one year or more can get Work Authorizations so you have millions let in illegal ail yeps with the illegal right to work and they have employment authorization documents. How do you address that . That is a key problem. It is important to understand why we have Immigration Laws to begin with. If you go to the statute in the first round of 212a1 that is medical like the Immigration Law. If you have tuberculosis you cant to the United States since the 1880s but you get to 212a5, which is the provision that says nobody can come to the United States to work unless the secretary of labor has verified they wont adversely affect americans. The Biden Administration couldnt care less about the wages and working conditions of americans. Tell say we need labor. The Labor Participation in the United States cant in 2008 it has never come back. Part of the reason so many are dying of fentanyl and why there are Domestic Violence cases and so many d. U. I. s and our things you have a population of working age particularly men but women, too, who are not working. They will fill their time with things that are not good for our society. Respectfully and im not telling anyone how to live their lives but a steady job and monogamous relationship are the two greatest civilizing factors in the life of a man and im just talking about males. If he has to get up and go to work and take care of your family you are not going to be out doing drugs all night. You are driving American Workers by that i mean not just citizens but lawful immigrants out of the workforce. They will engage in things that erode our society. Completely heedless of how the world works but what the law says. I think blue and then the gentleman in front. I have noticed on among law students that they do not believe there are major factors this tracking crime. There are studies [inaudible] this rate per 100,000 Illegal Immigrants and lowest is alien per 100,000. Illegal immigrants with probably shy away from Law Enforcement and not have their crimes errored or at least convictions recorded. Some of you may want to jump on this. I cant tell you how many times i have heard that illegal aliens commit less crime than the native born. I know within crime at the committed. They killed my sonment i dont give a damn if they commit more or less crimes. You are right there are studies done that i know cato is thing about one they commit less crimes and with you they debunked that but it is totally irrelevant. The number of criticisms illegal came yens should commit is zero. That is the important number. Should i feel better when somebody says im not accusing you of saying that but i have had that said so sorry. I just testified two weeks ago at a House Judiciary Committee hearing and every democratic although they wouldnt ask me questions they start out we are so sorry for your loss. What i should have said is no, you are not because if you were you wouldnt continue doing with your doing. I ran into Elizabeth Warren in 2017 in the hallways in congress and i had a big picture of my son we were visiting various congressmen to talk to them and we kind of walked by each other and she had no idea who i am and i said senator warren and we stopped and i showed the picture of my son and he looked somewhat like me and when i said to her my son was a dreamer and she took a little like ok but he was killed by an illegal alien. She said im so sorry for your also. I said no you are not and she went ballistics and started screaming at me you dont know what is in my heart. I dont care what is in your heart i care about your action. The people say that and dont mean it one bit. That is their excuse for we are sorry your son is dead but no, there is no but. To your pint, we dont really know how many crimes or what the criminality rate for illegal aliens, people here unlawfully is, we dont. As tom and don both alluded to a lot of jurisdictions dont ask the question so they get lumped in with the native born crime rate. But to dons point the one thing away do know is alien criminals commit crime. That is a trite phrase but a study was done about nine years ago that talked about the rate of recidivism for alien criminals. The rate for alien criminals each was arrested about seven times. In fact i think it was eight. I didnt want to say eight but i think it is eight in addition to the one for which they were arrested. So, you talk about the most serious crimes. Domestic violence, child molestation and d. U. I. Are all crimes that are subject to resid villanova. You can ask any professional they will tell you the average person tries drugs 90 times before they are arrested for driving drunk. For what it is worth, i will when your mind. Drunk driving is not a ground of remove ability. You have a green card you can have 40d. U. I. s. Now theres a provision that allows a habitual drunkard to not receive certain benefits. But again, with respect to any of these studies the answer is always the one that don gave. If you are a criminal you should not be here. We have plenty of home grown criminals in the United States. If i go to your house and say this is a inaudible you will throw me out. If i go to france and violate their law im expecting they will throw me out and that is the same role we should follow. I wont get into the weeds on the study that is flawed but theres been great reporting on that to show how flawed it is. A deep dive was done to show it was deeply flawed and for numerous reasons we cant count on that study. I agree with don, every crime committed is a reason to not be here. I think we have time for the gentlemans question. Im an Intelligence Analyst and former diplomat. It seems pretty easy to imagine al qaeda or ice sills or the Iranian Intelligence service viewing this loophole as a once in a lifetime opportunity to move a sleeper cell into the United States. If in fact there feels another terrorism spectacular, is that enough to finally shut it down . Let me address that. I have been all over this the past year and my good friend mark morgan. We have been pushing this for over a year and a half. What is hang on the border is not immigration, it is Border Security. This could overwhelm the Border Patrol and bad people get in. Because criminal cartels will push family groups knowing the agents will seize that humanitarian issue and thats when they move the fentanyl across and t terrorists. The strongest nation on the earth doesnt have control of their southern border. Criminal cartels do and biden gave it them. Here is what you need to understand. There are only 1. 7 known got aways. Border patrols arrested people from 170 Different Countries many sponsors of terror. They arrested over 200 people on the f. B. I. People on the data base. I think it is 147. Thats what they arrested. If you dont think a single one of that 1. 7 million didnt come here to do us harm you are an idiot. That scares the hell out of me. This is the biggest National Security this country has ever seen. Me and mark morgan had a conversation will it take another terror act . This is a National Start failure. I cant tell you how many terror uses have crossed and this is preventible. To your point i have been doing this for 32 years. I have been doing this so long that i was a National Security advisor with respect to immigration to janet reno. I was the staff director for the subcommittee and chief terrorist prosecutor for the i. N. S. If you go back to september 11 in the 9 11 report the commission wrote before september 11 it was not a component of National Security. You read that 388 to 389 read that and consider the implications with respect to toms point all the people that i dealt with say it is not a question of whether but we at this point. We have had 18 years in we have not gotten real i. D. A new license and as you mentioned it showed in the opening presentation i need a license or passport to get on a plan but these people dont. It would be a miracle if theres not remember the last hearing the secretary was telling people almost on terrorist watches have been arrested. The last data i saw well over 10,000 peoples republican of khaoeupbl nationals had come in and last year like a 1,000 so that is a large increase. If i was trying to a fairly large increase. If i was going to try to infiltrate. After 9 11, we created all these databases. Even dod databases. And it worked. The Visa Security Program prevented thousands of people with derogatory information from getting a visa. But why would any terrorist put himself in a position to get a plane ticket or a visa when you could simply go to mexico and cross the border and get away like 1. 7 million others did . Big National Security failure that we will pay the price for someday. I hate to leave it on that note, but i think the optimism is often the future. If we ever do get an enforcement administration, i think you gentlemen could contribute a lot to the effort. We will. [applause] thank you.
