Today storya yesterday about a yougov poll. 7 ,d that nearly half, 40 disagreed with the idea that the election is likely to be fair and honest and significantly more than half, 51 , will not generally agree with on who is a legitimately elected president of the United States. That online poll conducted october 1 through second. It also noted that another found poll of 1500 voters that 56 found they expected the an increased in violence as a result of the election. Those results by yougov published in usa today. A politico, this focusing on pole about 6000 americans that came out in september. That poll noted that in september, 44 of republicans and 41 of democrats said there would be a little justification of violence if the other partys nominee wins the election, both up from a june poll, when 35 of republicans and 37 of democrats expressed that same sentiment. The story goes on to say there is a larger increase in the chair of democrats and republicans who believe there will either be a lot or a great deal of justification for violence if the party were to lose in november. The share of republicans viewing substantial justification for violence at their side loses jumped from 15 in june to 20 in september, while the share of democrats jumped from 16 in june to 19 in september. They went into a white neighborhood, broke windows, and it was on tv. See what she did, she put out a dog whistle for them to start rioting again. That is the way i look at it. Caller well, i do believe that there will be violence, myardless of who wins, but comment that i wanted to express this morning is that my sign was over at my house over the weekend, and we was talking about the people that made less than 400,000 a year would not have a tax increase if mr. Biden won the election. And my sign told me that im retired and he told me, if that my taxesss, for 2021 will go up at least 2000 if he eliminates the trump tax cut. And i did not realize this, because i was under the impression that my taxes was not going up, based on what they had said. And people need to realize out there, everybody, that if you vote for biden, you are going to be paying, in 2021, you are going to be paying out of your pocket over 2000 more than you are going to pay this year. Caller i dont know what to think about it, but i will say this, if it is something that really did happen, the president of the United States of america is the commander in chief, so he therefore kind of runs the fbi a little bit, so if it is true and it didnt happen, it is very sad, he has to authorize the investigation for months to watch over the governor. There is too much division. I have faith in the American People, and i think just because the media shows us pockets of violence, i think, overall, our country is going to stand up and do the right thing. Whole countrythe is engulfed in racism and violence. But the fbi has to approve protecting together and to uncover this. Host candy, President Trump made that point on twitter yesterday, when talking about it, that his Justice Department was leading that investigation, foiled that dangerous plot against the governor. He went on to say, rather than thank me, she called me a white supremacist. But candy, you say you are confident that the country is going to stand up and do the right thing. What gives you confidence right now in that . American, i love my country, and i just believe in the American People, that we are going to do the right thing, that they can see through this, show us the bad se and not the good i just have confidence in the American People. And i am so thankful that whatever was out there, that nobody did get hurt, though. And i do support the police. I think they are awesome. I am thankful i live in a country that we d there is an electoral process, we have laws, and you have to think about all the lawabiding citizens that have suffered because of all the violence and the writing that has happened. Those are not peaceful protests. We have the right to protest peacefully. We dont have the right to destroy other people and other citizens property and businesses and wellbeing. Most of the stories coming out about this plot, to kidnap the governor. Mr. Egan, take us through what we know so far, how far it got before it was foiled. Know isk, well, what we there were a number of conversations that were going on, both in person, and, in some cases, encrypted over private facebook groups, discussing a number of plots, including one to kidnap a governor, possibly from her Summer Vacation home. That is one that seems to advance the furthest to the point where a highvoltage taser was purchased, night goggles. There was supposed to have been a purchase of explosives taking place this week. There was discussion about designating a bridge near her summer cottage to divert police. There was actually evening surveillance that had occurred on two occasions of her summer home. Thats thats about what there was a know, lot of talk, which, you know, sometimes you can ask the question were they just talking . Or was there going to be action . But there were certainly some element of action taking place, including purchases of weapons and surveillance of the governors home. Host and now 20 individuals have been charged in this case. The group, the Militia Group, the name, the wolverine what do we know about that and how widespread the movement is in michigan . Watchmene wolverine was founded by two of the individuals that have been charged in this case. Theres some association with, you know, what has been come to be known as the boogaloo apparently ach is codeword word for a second civil war, you know, there is anarchy with some of these Groups Associated with some of these movements, talk of, you know, sparking some kind of a war that would allow, you know, people that believed only in the bill of rights, then to sort of, you know, create a new society among themselves. You know, a lot of the stuff is pretty far out there, but michigan has long been a hotbed of militia activity. I mean, when you go back, there were ties to the Oklahoma City bombing in michigan. A number of years ago, the feds brought a major indictment against a Militia Group called hutari that were apparently plotting to blow up police funerals. That went south, although people spend a considerable amount of time in custody. Really no convictions resulted in that case. It gets difficult at times to say well, you know, this was just crazy talk, or it was action, and then, you know, it verythe feds in a difficult position, because if they do not act like some of this talk that looks like it is proceeding to action, then, you know, the commentary always leader is going to be, well, there were all these warning signs. Why didnt somebody do something . Host explain the emergency orders that are in place in michigan, how they played into and whole story yesterday, are the emergency orders in michigan significantly different than emergency orders in other states . Guest well, that is an interesting topic, because on friday, the Michigan Supreme Court struck down as unconstitutional the main emergency law that the governor legalen using to as a underpinning for these orders, so a large number of these orders have basically been declared unconstitutional. Now, many of them are backed up by separate orders under another statute, but to get to your original question, yes, there is definitely a link here. The governor, like in many states, i would say michigan was probably more aggressive ban many states in imposing a stayathome order, which was imposed in march, lifted june 1. Many businesses were closed completely. This was certainly a point of contention among the alleged conspirators. There was talk about, you know, Governor Whitmer being a tyrant, that she had taken absolute power. A number of the people, at least two or three of the people that have been charged in this were photographed at the capitol, at demonstrations that were taking place against the stayathome order, or, in one case, a second arose,nt rally that also so there is definitely a link between the emergency orders and this anger that these men were apparently feeling, but, yes, there has been a recent twist on, you know, technically, it could be right now that michigan is the only state in the union that does not have a statewide state of emergency in the moment, in light of this friday Michigan Supreme Court ruling, which is a 43 ruling on a partisan line basis. Host what is next in this case . Are we expecting more charges coming . What do we know about stepped up security around the governor now . Guest um, it sounds like more charges are possible. You know, there were references in some of the affidavits that were filed to other planned kidnappings. You know, the question always is, you know, at what point, again, was this talk proceeding into action . But there are certainly a number of arraignments taking place yesterday. Has been stepped up for the governor in recent weeks. There was a new, high fence erected around her official residence in lansing. Normally, this is something we would have really noticed more. Governor rick snyder, the former republican governor, after the flint water crisis, there were a number of threats made against his life, and we noticed a huge increase in security around him. You know, because of the pandemic, the governor really has not been out and about as much as a governor normally would be, so other than seeing them erect that new fence around the residence, the stepped up security was not as apparent, because of the pandemic. But certainly there have been a number of extra efforts to protect her and her family. She is married with two daughters of her own and two husband, who is her second husband. Host staying on the michigan story for a moment more here, these are the remarks from Governor Gretchen Whitmer yesterday, reacting to the charges that were released by federal authorities. [video clip] Governor Whitmer this should be a moment for national unity, pulled together as americans to meet this challenge head, with the same might and muscle that put a man on the moon. Soon, the humanity in one another, and doing our part to help our country get through this. Instead, our head of state has spent the past seven months denying science, ignoring his own health experts, stoking , andust, fomenting anger giving comfort to those who spread fear and hatred and division. Just last week, the president of the United States stood before the American People and refused to condemn White Supremacists and hate groups like these two michigan Militia Groups. Stand back and standby, he told them. Stand back and stand by. Hate groups heard the president s words not as a rebuke but as a rallying cry, as a call to action. When our leaders speak, their words matter. They carry weight. When our leaders meet with, encourage, or fraternize with domestic terrorists, they legitimize their actions, and they are complicit. Here they are from the president. Governor whitmer of michigan has done a terrible job, the president said. She locks down the entire state except for her husbands voting activities. Federal Justice Department foiled a plot, and rather than say thank you, she called me a white supremacist, anarchists, burn downnd mobs that democratrun cities. What i will always do as your president , governor wimmer, open up your state can open up your schools, open up your churches. That was the president on twitter last night, asking you your first hour of washington journal, how concerned are you about this country spurring violence, and what can you do to turn down the temperature . ,an and winchester pennsylvania, good morning. Glad that the am government is safe, and i am glad that Law Enforcement was able to get in and, you know, get in and get those people under arrest. Even after that happened and President Trump sent out another tweet, it was a very nasty tweet. Says a lot of things, and theres people out there that act on some of the things he says. And as far as the protests, the protests theres peaceful protesters, and sometimes it seems at the end of their protesting, when they leave, these opportunists come in, which burned down things, loot things. They are not part of the protesters. Thats other hangers on people. Do alll come in and these things, and that is why and then fox news shows that part. Peacefulot show the people who protest and chant or maybe sing or something. They dont show them. Violenceys turn to the. And, you know, it is just disgusting. It is horrible. Of course it was horrible, and thank god she was ok. And yes, of course, i was trump aide given a nice, warm, fuzzy answer, like biden did, sounding much more president ial. But i am very concerned that the Political Divisions will stir violence as a result of whatever the election the national election, you know, president ial election brings, from both the farright and the farleft. You were reading an article earlier, though, that was talking about the percentages of people worried about violence, and i think in the that you did not read, it was talking about i think it was twice as many republicans are worried about democratic violence, spurred violence, as democrats versus republicans or whatever. And then come again, this is my republican opinion, and whether or not it is right come about from my viewpoint, it appears theres ahope small percentage of republicans that are extreme right, like the White Supremacists and all that stuff, and in the more extreme left democrats who kinda feel like they have to resort to violence to be heard and to get change. So, again, as a republican, i am more concerned if trump won when, that there would be would win, that there would be more violence from democrats, then if biden wins, which would really bomb out half the country. The numbers from this nations gay poll of 6000 americans that they are talking about, about partisan ideological partisan, the numbers are higher among ideological partisan come among democrats who i did buy is very liberal, 26 said there will be a great justification for violence if the president if their candidate loses the presidency compared to 7 if they had and if i i simply liberal. Of republicans who identify as very conservative, 16 said they believe there would be a great deal of justification for violence if the gop candidate loses compared to 7 of those identifying as simply conservative. This means the ideological extremes of each party are two times to four times more apt to see violence as justified than their partys mainstream members. I would like to complement the fbi and Police Agencies for what they did and how they stepped up, but look, the words of president s matter. We have said this before. They can cause the nation to have a market rise and fall, grow the war, bring peace, but they can also bring oxygen to those filled with hate and danger. The fact that she wakes up every day with such hatred in her heart toward President Trump, and President Trump is the one out there condemning these radical groups, whether they be on the right or they be on the left. We saw it two weeks ago when he was in atlanta, introducing his platinum plan, his contract with black america, where he labeled the kkk and antifa terrorist groups. Both are deeply rooted all the way back to colonial days between rugged individualists and communal collectivist on the other. Theres a duality between the two. It plays out in so many different aspects in our life and politics. Define populism and pitchfork populism. Guest the u. S. Has a long history of populism movements. Back to these goes 1700s, and even the creation from colonies to the country as a form of populism, but this is different. I call it pitchfork population because it evokes the image like the frankenstein movies where the townsfolk are upset with grievance and resentment and they storm the castle with pitchforks and torches. Trying to vent their anger. Populism. Se its not normally populism empowers the people to be able to fulfill their aims and objectives. In this case, donald trump founded a cohort that felt behind after the economic turbulence of 2008 and 2009 and that they were not being served by democrats or republicans. He motivated them to empower him. Isthat case, what hes doing the transactional approach is how he governs according to each situation is different and he acknowledges that. Dealmaker ande a to deal with each situation as its own transaction. Contrary to what populism is. Host this cohort that donald trump found back in 2016, talk about its development and how long it has been feeling left out. Guest its researching. A research resurging. Between thisrence particular cohort, and im not talking about those who are dead set in either direction but especially the people in the middle, theres really nobody in the country who could say that they dont know who donald trump is or what he is about. His base is a subset of that. Within his base, in chapter 10 i document and theres a lot of people who agree that is between 20 and 25 , somewhere in that that segment of Donald Trumps voters are very passionate and will remain very passionate. But theres a lot of people who voted for donald trump for different reasons. Along among a lot of other groups that the other subsets of people who voted for him and still support him, there are a lot of people with misgivings, who are right now contending with this conflict between their principles and values versus they got something that they wanted, maybe they liked deregulation of a particular industry. But on the other hand, donald trump is doing things that are contrary to american democracy you have a lot of friction on that side. But as far as biden support. We saw this the day after inauguration with the womens march. Theres a lot of passion. There are a lot of people who are upset for a lot of reasons when you think of kids in cages and charlottesville. We could spend another hour going to reasons why people are upset with decisions that have been made either from the white house were different areas of the administration. Theres a lot of passion in support of joe biden and Kamala Harris. Host and this story out of michigan, this kidnapping plot against Governor Whitmer. We asked viewers whether they were concerned about Political Divisions, whether it will spur violence. A lot of those colors this brought up their concern that the media is playing a role. Abouthey are concerned violence but that the media is stoking the violence. It was brought up by callers on both sides of the political aisle. Can you talk about the role of andmedia in populism today those concerns that viewers have about it . Guest its between a rock and a hard place. When there is a president of no choice but to cover the president of the United States. When donald trump, at the first debate, refused to disavow white had the statement stand back and stand back and standby to White Supremacists, the media has to cover that. They have to explore what does this mean. That the media is trying to understand it is not that they are stoking. Nobody wants that. Thats contrary to a mac contrary to american democracy which is about voting peacefully in peaceful protest. But when the president puts Something Like that on the table , it cannot be ignored. In chapter five when i talk about the battle between media and the battle for truth and fact, i do have solutions. The book looks forward to the next year. And when it comes to the largescale media and broadcast and cable, there could be solutions. Basically giving viewers warnings. This is one example. Theres a number of solutions on one side and separate solutions for social media. But the media cannot ignore when donald trump says something that is contrary to the fabric of what is america. And you are the founder and director of bipartisan bridge. Guest thank you for mentioning that. I created that in 2006 when george w. Bush was president. I acknowledge, i have worked for democrats in the federal and state level, but the important thing that i have always believed in is a working arm in arm with my republican friends to get things done. When george w. Bush was president , i disagreed about a number of things but i still wanted to be able to work with him. So i created this initiative about how democrats, republicans, and thirdparty affiliates can Work Together and collaborate. Because i believe most issues can be done in a bipartisan way. Maybe its a 9010 or 8020 split but most things can be done in a bipartisan way. But there are some things where theres too much intensity with certain things that we disagree on. , inthis era is different 2006 with president george w. Bush i was doing all i could to be able to bring people together and Work Together. In this case, donald trump does not allow that. Even on the republican side he has put forward legislation and recommendations for legislation and then criticized his own proposals. That is not how bipartisanship much. 2017 it was health care. He said what he wanted. The republicans in control of the house and the senate put into legislation and donald trump called a mean bill. If you doing that even among republicans its hard for democrats and republicans and other people to come together. Host lots of callers calling us to talk to. And its been said that if you can give the white man something to look down on he will give you his money, lbj said that. Thats how southern politicians have been running that ruse for a long time. Ask the Biden Administration tough questions why packing the Supreme Court . They want to answer that. They want to take over. They want to do away with filibustering. And now they have been encouraging certain members of the judiciary to retire early so there would be more vacancies that they could fill. So this situation about packing is not binary. I voted for obama in 2008 and for trump in 2016. I am genuine on that. But i want you to talk about the bitterness in this country. If you look at some of these earlier phone calls like that lady from florida, you couldnt tell her anything. She is totally focused on some grievance that she has. The grievance is largely, this is what i want you to focus on, are largely economic. Since 1975 there has been this tremendous decline in the middle class. Thats all these angry white men that you are seeing. These people did not have the education, did not have the opportunity and now they are upset. And the last thing that they do is go over the guns. I dont think theres any possibility of bridging anything in this country anymore. I want you to focus on the economic aspect. Because i actually suffered during affirmativeaction, opportunities taken away given to less qualified minorities. And i never owned any slaves. Thats the thing that you have to change. As far as the economic aspect, thats part of how donald trump gained crack traction. On the book in the book i named five driving forces that propel Donald Trumps. But they were driven by principles and policies. In the case of donald trump he has driven not so much by personal interest as psychological need. Thats not just a tossed out statement, i document that. When you are talking about economics, how can we help individuals get on their feet . How can we help all americans achieve the American Dream in the way that they so choose. That should be our focus. Its about everybody. Its not about the president. It should be how we lift everyone, from job skills training to diversity and inclusion and opportunity to Access Capital to start a business. And loan guarantees. Theres a long list and different kinds of partnerships, things that we can do for people like the gentleman who called in that we should be focused on, and what we have seen during covid is the incredible dislocations and all the jobs that have been lost, the business is closed. Speaker pelosi developed the most recent bill, three months ago four months ago and Mitch Mcconnell did not want to bring it to the floor. Something might happen over the next few days, we dont know. Elosi teasing that yesterday the Washington Times story noted that the legislation will not go anywhere because it has to pass the senate and be signed by President Trump. And your thoughts that thats a piece of legislation thats out . Guest something i have wrote about in the book, what ive seen more and more since 2020 and am more concerned about is that as donald trump is seeing the evidence of people not appreciating his divisiveness and pursuing his selfinterest, he tries to shake things up more. Where hertain tactics tries to distract people to another issue, and creates another division. The more that he flails, the the fabric of the Democratic Institutions are degenerated. One of the tragic things that we saw, after the tragic killing of george floyd was in lafayette park, in washington, d. C. When donald trump called out the break up a peaceful protest using teargas and pushing people, we saw a lot of the video. And certain military people were with him yesterday when word were with him with were with him the next day at a Church Photo Op and the church repudiated him. There was a Silver Lining to that. It made people realize this could happen. Hes trying to do this. He wants people to come along with him as he destroys american norms. The military heard from retired generals and admirals and a lot of people they respect saying you cannot do this. Fastforward to the bill you brought up today. Of donald trump, after november 3, tries to do certain things invokingoking the insurrection act or other things like that. This bill is sending a message. The reminding the cabinet, Vice President , that if donald trump continues to act erratically and in ways that are contrary to american fundamentals, its up to them to take action. Because of what we saw before, i think a lot of people have realized they had to take the responsibility. If he starts doing things that and this ishe pale, all exacerbated by treatment for covid. And now that he has tested positive and we are trying to find out the details about when that first began. But with the cocktail pharmaceuticals he has been taking, that too plays on your mental state. If you pricked combine his previous orientation with the in gestation of everything is taking now it could create problems. The question is how much of the violence is related to the political environment and whether it will continue after the election. None of us really have an answer to that. But i worry a great deal that if President Trump is elected, those who are opposed to him, which seems to be many of those engaged in violent acts, will continue their violence. Guest it is something that i think back to, when i was in college back in the late 1960s, and we had significant violence across america. We had many bombings, which thankfully we have not seen these days. But the difference is, with the today fromthe today as opposed to the late 1960s, there are Public Officials at the state, local and federal level that seem to to they turn a blind eye violence thats occurring, but explicitly discounted and thereby encourage it. Thats the significant difference from the late 1960s, when you had rampant violence in many cities. And you had consistent and very uniformed pushback by Public Officials against that. The fact that nowadays we have Public Officials who not only will not condemn the violence, but in some instances seem to encourage it. That makes a very dangerous situation. Guest you have the mayor in chicago, her response to the chicago is to condemn President Trump as if he is out there in the streets looting and burning cars and attacking police. At the end of the day in any election, at some level, people and voters are certainly concerned about violence. I think this year is going to play a higher degree of relevance in the campaigning than it normally would. But it is certainly not the only issue. Theissue of the economy, issue of the health of the american public, but law and order is certainly going to play a role in the election, particularly as you have seen in recent months with a surge in street violence. I want to know, is there some situations with the education of the department of police what training do you suggest the police get to make them more sensible to all elements of protecting the citizens . This is an area where both in a lawd my position enforcement Education Foundation and a number of experts, i dont include myself as an expert, but have identified one of the problems in modern Law Enforcement as the lack of good comprehensive training for Law Enforcement officers. Part of the reason we are seeing a decrease in proper training for Law Enforcement officers is a result of budget cuts. A local Police Department faces a budget cut, one of the first, if not the first, place they cut his training. Is that is unfortunate. Not only are we getting Police Officers that dont really understand how to use the power they have, such as we saw in minneapolis with george floyd earlier this year, but they arent receiving the type of training necessary to make them forize how important it is them to understand the community in which they are operating. That is very important. It is important for both the public to understand the job and the problems Police Officers are facing, but equally important for the police to understand and be compassionate with the community in which they are serving. Its a very good point, and i would like to see more training and better quality training acrosstheboard for the police in this country. Congressmembers of the and president came to bob barr today and said we want good, comprehensive police training, what would you say it would cost and who would lead that training . Who is guest guest doing it right . There are at the department of justice a number of programs, grants, that go to Police Departments, but they are insufficient. One of the things i would urge would be for congress, the house and senate, to come together and better fund the Current Police Grant Programs through the bureau of justice assistance, for example, but also to increase the scope of that training. Unfortunately, the environment in the congress right now, in the house and senate, is so divisive that even on Something Like increasing police training, both the funding and scope of police training, it doesnt seem they could get together. That would be one area that i think would be very productive. I also think that in the prior administration, the Biden Administration, there was almost an adversarial relationship between the department of justice a local Police Departments that didnt help at all. We need a better working relationship between the federal government and local police that is not antagonistic or adversarial. Windermere, florida, endorses the biden harris take it. Caller i was wondering what you thought about the fbi director being criticized by President Trump right now for not going after antifa, and he said it was not as big a problem as the white Militia Groups. Guest the director of the fbi has a degree of independence that is broader than a lot of officials in the executive ranch. It doesnt completely insulate him, nor should it. The director of the fbi serves at the pleasure of the president , and there should be a good working relationship in terms of the priorities between headead of the guy and of the fbi, the president , and the attorney general. If you dont have that, that could have problems that were to the local level if you dont have a good working relationship between the president , the attorney general, and the director of the fbi. In recent years have been pretty good about not exercising their power to relieve the head of the fbi simply over policy disputes. If the president is going to remove the director of the guy he must have a good the director of the fbi he must have a good reason for it, and that must be explained to congress. In regard to chris wrays comments in regards to dangers posed by different groups, violent white supremacist groups have always demanded, and it should continue to demand, a high priority by the fbi, as should movements like antifa. I dont think the director of the fbi is saying antifa is not a problem, i think what he is saying is its more difficult to the with that because of disorganized structure of antifa. And itainly is a problem, would be concerned if the director of the fbi said it wasnt a problem at all, but i dont think thats what he was saying. At least i hope not. Some of these mayors, in addition to the one i mentioned in chicago, have really not only done nothing to stop the violence, but through their ridiculous policies encouraged it. That is unfortunate. Barr, i had a question for you in the scenario where you and your foundation do think lethal force was not appropriate in a shooting, in a killing. How would you counsel that Police Department in that kind of scenario . Guest training Police Officers , and inse of force particular the use of deadly force, is the most important aspect of police training. It is also the most difficult for outsiders, such as juries coming to deal with. Whether or not a jury believes that if they were in that situation they would react the same as the Police Officer is not really the appropriate respective appropriate perspective. Its difficult, because you have to give the Police Officers sufficient flexibility so if they reasonably believe the circumstances they are facing place them or another person in the immediate vicinity in fear of severe bodily harm or death, that allows them to use deadly force in return. But, of course, there are many situations where this becomes a very complex afterthefact analysis. It is very important and train police and set a proper standard for the police. I know there was a bill earlier this year that was introduced i think by the democrats in the house that purported to banned chokeholds. The language purported to ban chokehold. The language was so broad it would not allow any way for Police Officer to detain a violent suspect. Anything they did might impede the persons breathing, even momentarily. It is very difficult to set very specific standards. What is most important is to make sure that your Police Officers understand the basic role of an officer and that they can use force, particularly truly force, only if they and reasonably believe in the circumstances that they face serious bodily harm or death, and it has to be from their perspective. Not from an outsiders afterthefact perspective. Proposedaking of bills that could alter police actions, qualified immunity and what you think about qualified immunity Reform Efforts . Dinner really speaking, this is something that we inherited centuries ago from british common law. That is there is sovereign immunity, immunity that applies to the sovereign. In the british system it was the crown, and the crown was immune. O actions by the citizenry you could bring suit against the crown. In the United States, we took but not exactly the same, there is, for example, in my state of georgia immunity that state officials have that immunizes them or protects them against being sued unless by statute the state has agreed to be sued. That i think is unqualified immunity that goes too far. With police, its important to police that if you say are going to be reliable for anything and everything they do, youre not going to have police. No one is going to want to serve if they are secondguessed and liable for every mistake they make. On the same token, if police go beyond what they are supposed to use unreasonable force, force that is not called for, particularly deadly force, they should be held to account. They should not have blanket immunity. We saw this in the Breonna Taylor case in tennessee recently sorry, kentucky, louisville in which the police executed a warrant. There is dispute over whether or not they announced themselves or didnt. They say they did. Breonna taylors boyfriend said he didnt hear that. Thats a fact issue, but case raised a specific question over whether or not since the police used deadly violence and Breonna Taylor unfortunately was killed as a result whether they should be liable. The grand jury like that all of the facts and circumstances and said unfortunately there was not liability because the police when they broke into the apartment pursuant to the warrant her boyfriend shot at permitted towere use deadly force in return. These questions revolve around sometimes complex fact issues evidentiary airy as well as the standard for the police. You have to look at the police at the time, not afterthefact from an outside observer. That means that the police know what to do, they just choose to do what they want to do in certain cases. You mentioned about immunity that the decision should be made about what the police determined. Who is going to determine that but the police themselves . Thate police determines one needs a hamburger but to kneel on the other persons neck, how will we ever have justice in this country . Guest im not sure what a hamburger has to do with the george floyd case, but the caller points out appropriately that in the george floyd case two issues have come up. One is the fact that the Police Officer, by every account and looking at the video of that, acted improperly in maintaining the pressure of his knee on George Floyds neck for such a long time. That seems very clear. We dont know everything that happened before that, but from that point on, from the point that the Police Officer put his knee on George Floyds neck and exerted force, that went on for far too long. Secondly, and this is important anyway, that shows lack of proper training on the Police Officer. If the caller is criticizing that, the caller is justified in criticizing the apparent lack of proper training on the police to uses part or failure the training he might have received. Those Police Officers, including the one who exerted the pressure on George Floyds neck and killed him, that Police Officer and the others who were there are being prosecuted. They were indicted, they are being prosecuted, and apparently they should be. The fact that they might have thought one thing doesnt really play a role here. They were indicted and will be held to account. By all accounts our system is working very well in that instance in terms of accountability. Host you think they would have been indicted and held to account if not for the video, the public that went viral and made this such a moment that the whole country focused on . I presume the grand jury was presented the evidence to that case, including at least some of the footage of the video of the officers bodycam and made its decision based on that. That needs to be a part of not only our education system, but the education of police.
