With 72 saying their governor is doing an excellent or good job. 26 saying the governor is doing a not so good or poor job. Compare that to the federal government, 49 say is doing excellent or good, while 51 give the federal government low marks. President trump gets 44 of excellent and good marks. 54 say the president is not doing a good job in responding. How do you rate your governor . Lets begin with alabama ivey. We cant fully reopen the economy but we are working together and sharing ideas. Some states are opening sooner than others but every governor is responsible for reading the numbers and doing what they think is best for their state. Reporter [indiscernible] i beg your pardon. We want to feel comfortable we can test people when they need to be tested. Right now in some parts of the state that means we take a consultation from a doctor one at a time and wait for the individual patient to get tested. No state has really solved this problem, but we want this testing to be available like any other testing is available. If you need to get a glucose test, you can go to any clinic or urgent care or Doctors Office and have that done. No one is near that yet and we certainly dont have to wait to reach a position like that. What we do need to be able to do is respond when we see outbreaks occurring. We need to be able to get to an area where we have multiple cases reported and get those people tested as quickly as possible and do Contact Tracing as quickly as possible. We have improved our testing tremendously. Again, the ultimate goal is not going to be realistic for any state to see anytime soon. We are increasing our capacity. The guidance we have received repeatedly from hhs is they say we understand Public Health labs are not doing most testing in any state. Continue to work with academic, medical, and providers for capacity. Most tests are being done by those other entities. We continue to try to get them to amplify their capacity as much as possible. Base my opinions on fact, but the truth of the matter is the president does not understand the difference between Testing Capacity and getting testing results. Testing capacity that he is referring to, you have got enough machines in each of your states to run tests that will give you hundreds of thousands of results. He may be right, and he is right in illinois, but what he is not right about his we dont have the supplies to run those tests, so you have the capacity because you have got the machines, but you need everything from swabs tovtm, viral transport adm, medium, to reagent, and if you dont have all of those and there is a worldwide shortage of all of those things and you cannot run a test. To do what he is suggesting, you would have to run those machines 24 hours a day, seven days a week. Many are in private Doctors Offices and hospitals and for us to run any test you have to have an agreement with those doctors and hospitals, but then you need Lab Technicians that can run those tests for you. In order to run machines 24 7, you need three shifts of Lab Technicians on these machines, so the idea that we could do that without the supplies, without enough Lab Technicians is kind of crazy. We needed for the federal government to enact the defense production act to make it easier for us to obtain the swabs and vtm and reagent that we need. None of that has been done at the government level and that is the mistake that happened. Everyone including libertarians would tell you the purpose of the federal government at a minimum is to manage a National Emergency. When people test positive, Public Health officials will try to identify who is in the household and workplace and identify those people that someone tested positive and they should take appropriate steps to prevent the spread of the illness. In hong kong, if you are an , they use iteler for quarantine enforcement. You get a gps wristband and need to stay at home for a period of time. In poland and taiwan, they are using gps. There is an app to download and if you test positive, you record that in the Public Health officials will see with gps and in the app you downloaded, who you are in contact with. The other is bluetooth and bluetooth operates differently. It doesnt give precise locations, however it is a lowpower Wireless Technology that transmits within a few , yous and with these apps see researchers and nations working on them, lets say i the plumbing in my apartment breaks down or has a problem, and i have a plumber come in. If he has the app and i have the app, it will log that we were together in close proximity and if he starts feeling ill, he would log that in the app and i would be notified. Apple and google have very Extensive Networks and pr network, and they want this to be voluntary. The issue is that many Public Health officials, many governments want to know more than just someone tested positive. They want to know who that person was in contact with and they want these apps to help them with that. This week it was reported by bloomberg that french and eu officials want to invert an apple to tell them not only who tested positive google and apple to tell them not only who tested positive but who they were in contact with. We will see whether they do that. They want this to be entirely voluntary and bottomup, but in the next few weeks when this app is released, we will see if states want to mandate this or make it voluntary. The right of the people to be secure in their persons, houses, ands papers, unreasonable searches and seizures but upon probable cause by oath and affirmation and describing the place to be searched and the persons or things to be seized. Guest in the past few years there has been a small revolution in Fourth Amendment cases. In 2012 you have these new technologies like gps and cell phones that obviously were not around 200 years ago. The Supreme Court has read into the constitution that there are these terms of effects that are protected. The Supreme Court has held that when police or Public Officials an edata, that is in ffect and a search when they use that data. In 2012 in the jones case they held unanimously that public data is protected by the Fourth Amendment. Generally, they need a warrant to get the information. Constitutional, we are protected from unreasonable searches and seizures, so if Public Health officials want geolocation data or health information, do they need a warrant or is it reasonable to get it without a warrant given the situation . The Supreme Court held that using months of cell phone information of geolocation is a search, and they interpreted the constitution to protect geolocation cell phone information and changed their prior precedent. The court has shown an ability to update for modern realities and we will see them do that. It is relevant for this discussion we are having about how and when government can use geolocation information in a time of crisis. What is it that they are considering with proxy voting . How would that work . Guest i dont know the answer to that, because everyone is using loose terms and one thing i learned in law school is to find the problem. I dont know whether they are talking about proxy voting or remote voting, and they are two different things. Proxy voting and we used to have this when i worked on the hill one member would authorize another member to vote for him or her during their absence. If they have proxy voting, it is possible according to some of the discussion, that you could have one member be authorized by 3, 4, 5, 7 members to vote in their stead. You could have one third of the body or one quarter of the body or however members however many members are there, and you would count each member and how many people they are voting for. Remote voting would allow members anywhere in the world or maybe anywhere in washington, d. C. , or their state offices to vote electronically. It is not quite clear. Aeny hoyer has come out with proposal to allow for remote voting, but nobody knows, nobody has a document i can look at that will tell me exactly what it is meant to do. The first question for anybody considering this is, what kind of process are we talking about . Are we talking about proxies or remote voting . If we do emergency measure to handle this situation, what would you consider a triggering mechanism . Is it a pandemic . Is it a 9 11 . Is it the super bowl and members do not want to come in town because the super bowl is being played . If you do invoke a remote voting type of situation, how long does it last . Would you do it only for votes on bills suspending the rules, which is the house process it uses for noncontroversial matters . Under normal process, suspension of the rules, there is 40 minutes of debate and no amendments but you need a two thirds vote. Would you allow this kind of remote voting for suspension bills, or would you allow this kind of remote voting for regular pieces of legislation, including rules from the rules committee . Would you allow it for procedural votes, which happen all the time . And no those decisions proposal that i am aware of as of 8 30 this morning, have dealt with these specific issues. They always say the devil is in the details. The senate does not work like the house does, but they have got some noncontroversial items including possibly some executive calendar things meaning confirmations. How would you limit in the senate . In the subset of all of these things is, shouldnt its up shouldnt it applied to committees, the work of committees . Woodrow wilson said the work of the committee is the work of congress. Do you allow proxy voting when you are marking up a bill in committee . Remotely, how are members going to keep up with that . We have a low rate of infection and we are among the top states in terms of testing. We have never taken out more than 1 of our available hospital capacity. So we are in great shape relative to the virus. The real impact has been on the economy. And not because we closed it down. We kept all of energy, all of agriculture, all of health care, and all of education we move to distance work learning. The majority of the economy has been open, but the drop in demand over both oil prices and what we are seeing with the prices asis agate g prices is economically tough.
