Problem with multiemployer pensions, which needs to be addressed. However, this bill, i believe, will actually set us back. It does nothing to address the underlying structural issues of these plans. It actually does nothing to protect younger workers who will be asked to keep paying into a system which remains troubled. And it saddles taxpayers with liabilities which are unlikely to be paid back at a massive cost to taxpayers. Let me provide just one alarming example of how flawed this proposal is, which i also highlighted in our committee markup. Under this legislation, if a pension plan applies for a loan and the newly administration cannot make a determination on that plans ability to repay in order to approve or deny the loan within 90 days, the loan would be automatically deemed approved. Taxpayers deserve timely responses from treasury, but no Reputable Institution would rubber stamp loans like this. Pensioners and taxpayers both deserve better. I even heard one speaker reference public Pension Plans, what has this got to do with this . The subject in front of us is the multiemployer pension plan system that is in no fault for the individuals that were supposed to receive the benefit based upon the contribution they made. Instead we find ourselves in a position where the argument has become that somehow this is a bail quout of special interests. This is a backstop of hardworking men and women who have set aside prescribed number of dollars for the purpose of enjoying a period of time in their lives that they have carefully planned for. Let me draw attention to the following. For two years we have worked on this legislation and i know there are men and women on both sides who would like to find a solution, but the truth is, this is the only plan in town. This is the only plan that has been submitted formally or informally after two years of planning and work and exhaustive one year of a special commission solution to with no the problem. So instead, we constructed through a careful process where everybody on the ways and Means Committee has been heard. I have been around to have a respect for the minority and they get to offer amendments. They offered those amendments. I was prepared to accept a couple of those amendments that i thought were actually pretty good. The provision being that i attached it to accept the amendment, they would have to vote for the legislation. And despite what we are hearing this doesnt have a chance in the senate, i disagree with that. I disagree with that pro foundly. There is an opportunity once this moves to the senate to at least have something to negotiate with, the Butch Lewis Act. And i think there are men and women again in the senate who are prepared to act on this problem largely because the plan will make its way and leach into pbgc. While not endorsing this plan, he said to me, mr. Chairman, im glad what you are doing because you are going to invite further opportunities to address this problem short of in the end having to bail out the pbgc, which will happen if we dont address the measure in front of us today. Families of these Union Workers are counting on these plans and workers, they put their trust in their trustees and too many failed. And too many are still failing. Truth is we are in this crisis, not all managers failed, but many overpromised and underdelivered. You cant rely on the same people to do the same thing and let the workers let down. I have been on the factory floors with these men and women. They are good people. They care about providing for themselves and their families. They just want their promises kept. What our Union Workers need is to come up with a longterm bipartisan solution now and we need to start over to develop serious bipartisan reforms. And again, i pledge to our chairman that republicans are ready to engage if asked to find this solution for the first time, if we are asked, to find a solution. While i dont agree with that sentiment, if thats the argument, then we should trees these bailouts the same these treat these bailouts the same. Doing that, we should do the same rates given to banks under the troubled asset relief program. While i wasnt in congress at the time tarp was passed, the situation were in today, considering a Union Pension bailout, is the best evidence of why we shouldnt have interfered with the bailout of a private financial institution. Nevertheless, that decision was made and now one bailouts being used to justify another. If we believe congress shb in the business of bail should be in the business of bailing out arrangements of private employers, we should do so using the same terms as tarp. The key feature of tarp was a capital purchase repurchase program which provided capital to finance institutions by purchasing senior preferred shares. My amendment would set the Interest Rate of loans authorized under this bill to the same rate that those paid under tarps capital purchasing program. If these terms were good enough for the tarp bailout, they should be good enough for the bailout offered by this bill. The majority refuses to accept the outrageous risk associated with making loans in these plans. Instead, this bill offers low lowinterest loans to macively underfunded, failing Pension Plans and allows loan forgiveness if the plans cant be repaid. This is unbelievable. This proves the majority has no belief that the loans will ever be repaid and simply looking to gift hundreds of billions of dollars of taxpayer funds to these failing Pension Plans. What about the retirement plans affected during the same time . What are we going to bail out next . What are we going to continue to have the federal government come along and throw money at badly managed investments . If we do make these loans, the government shouldnt just throw the money away shouldnt throw the money at a problem without some guard rails. With tarp, banks were given not given low interest loans over 30 years and told it really doesnt matter if you repay these or not, well for give them anyway. In fact, those loans were repaid and the government made money doing that. Now, mr. Speaker, having said that, i served as chairman of the health and employment, labor and pension subcommittee for six years. I worked on the bill with chairman cline and Ranking Member miller to help solve this problem. It is a huge problem. My father was a union member who lost his job 30 years after world war ii. So ive been down that road with my own family. Im willing to work across the aisle. I was on, as mr. Neal stated i on that committee that didnt do anything stated, i was on that committee that didnt do anything. Im willing to work on this. This bill, i disagree with him, is not going anywhere. The pbgc chairman today said we should work in a bipartisan way and im sitting here today telling you that i am willing to do that. I have been willing so for the past six years. And we did pass that bill back about four years ago, which will help with the plans. So im willing to do that. This plan is not it. Who so heroically fought until his death to protect pensions, including ritas survival benefits. As rita testified before congress, and i quote, this pension wasnt a gift. He worked hard for every penny of that pension. He gave up wages and vacation pay and other benefits so i would be taken care of if something happened to him. But now that pension risks being slashed to the core. Workers, retirees, survivors like sam, kenneth and rita, are foregoing much needed medicines or working into their 80s for more income and are being robbed of their benefits they need to help out their families. Not rita, shes not working into her 80s. We must act now. We will swiftly pass this bill to honor workers dignity, support their families, and protect their futures. We must always remember that the middle class is the backbone of our democracy and our workers are the strength of that middle class. If in fact, i do believe that the middle class in fact, do i believe that the middle class has a union label on it. Get financially distressed plans back on their feet, and maximize the chance for full repayment of the loan. C. B. O. Estimates that under the provisions of the bill, the cost of the loans after some defaults will cost less than 60 billion over 30 years. Much less than the hundreds of billions of dollars if we do nothing. This bill specifies an Interest Rate to be around the 30year u. S. Treasury securities rates with a 20 basis point increase to cover cost of administration. Those plans that elect to repay the loan principle on an accelerated schedule, there is an incentive of 50 basis points reduction in the Interest Rate. The bottom line here is that the this is not a program from which the federal government intends to make a profit. The u. S. Chamber of commerce and business round table and many Employer Organizations have not endorsed the bill. However, they did send a letter last year that said, and i quote, financial and demographic circumstances of certain plans will not allow them to survive without responsible financial assistance. Queptly, we recommend longterm consequently, we recommend longterm, lowinterest loans that will protect taxpayers from financial liability. These business groups recognize that doing nothing is more expensive to the taxpayer than the provisions of this bill and a lowinterest loan. The amendment before us man dates the Interest Rate to be 5 for the first five years and 9 thereafter. This is not a lowinterest loan in todays environment where a 30year Treasury Security rate is 2. 6 . Raising trt rates to the level raising the Interest Rates to the level prescribed would subvert the loan program. Nobody would apply and those that did apply would have to represent an earnings rate that would not be realistic. This amendment would increase loan defaults and its effect, whether intended or not, would oom the loan program before therefore, mr. Speaker, i would recommend that we rejegget the loan. B. P. Custody. Many of us have traveled to our southern border over the past couple of months and seen the effects. No one who has made that journey has not been deeply moved by the seefer overcrowding and inhumane conditions. If you have not observed these conditions in person, you have undoubtedly seen pictures by the inspector germ report to know how serious it is. They are housed outside in severely overcrowded cells, lack of access to showers and lack of toilets, flu outbreaks and other conditions that threaten the health and safety of everyone who is exposed to them. Mr. Chairman, i would ask unanimous consent to put into the record a copy of the report submitted by the inspector germ of the department of Homeland Security on the situation on at the border. R. 3239 would pront overcrowding and they would have access to showers and clean clothing so they are not forced weeks at a for time. They would access to water and standardaged to diet. My colleagues across the aisle have claimed that h. R. 3239 is unworkable because c. B. P. Lacks the funding. A few weeks ago, Congress Passed a 4. 6 billion spending measure to send emergency funding to the border. The Trump Administration has yet to prove that it can put this money to good use. H. R. 3239 would do just that. I would like to commend our colleague, representative and doctor, representative rue ease for moving this bill forward and ensuring the dignity and safety for those seeking protection in our country. Mr. Steube the migrant flow was overwhelming the governments ability and they were not designed as longterm holding facility. The democrat majority brought no legislation to fix the problems but it passed the dream act which will incentivize. Hat is the majoritys next idea . H. R. 323. A bill that will not solve the border crisis and will make the crisis worse. H. R. 3239 doesnt address the root cueses or the push and pull factors that drive illegal immigration. It does nothing to fix the agreements of catch and release and does nothing to fix the provision in the reauthorization act that and does not demruse reasonable reforms. It imposes burdensome requirements on c. B. P. Facilities. C. B. P. Should comply and i know the men and women are treating migrants with respect. But it does not address the root causes. Ayes and and the bill does not increase funding for i. C. E. Detention beds. And it does not Fund Additional permanent h. H. S. Capacity. Instead, in the midst of the situation, it imposes extensive medical screening and medical care on to c. B. P. That are unworkable. This bills requirements impacts c. B. P. s mission and influx of migrants that has weamed overwhelmed the system. R. 3239 requires a medical screening of each and every person to include a full physical exam, risk assessment, medical intake questionnaire. He bill he requires to provide additional medical care including Mental Health care and requires that c. B. P. Should have onsite. And quote, licensed Emergency Care physicians, including physicians in the pediatrics, obstetrics and gee at trick medicine and infectious disease, licensed social workers, Public Health professionals, interpreters and chap reasons. C. B. P. Must have them on call. Our own veterans do not have access to the same specialists. I offer an amendment that was not made in order that this bill would not go into effect and for detainees is available for every veteran. C. B. P. Should be facilitating lawful trade and travel. Yet h. R. 3239 would have them setting up full Service Hospitals at hundreds of facilities. The requirements apply not only to Border Patrol stations, but also to ports of entry, including land, sea and airports of entry, checkpoints, Forward Operating bases and secondary inspection areas. As if the Current Crisis werent enough of a challenge, the bill requires updates to hundreds of c. B. P. Facilities, reck whichsition of personnel and equipment, and training for all c. B. P. Personnel coverage facilities, all at immense cost. May i mention again, i offered an amendment that would require the d. H. S. Secretary to also report on the cost of implementation of this legislation. My amendment would have also delayed the sixmonth implementation requirement if congress does not appropriate sufficient funds to carry out the requirement of this bill. Cannot simply process those individuals out to i. C. E. Custody, because h. R. 3239 does not fund any additional i. C. E. Detention beds. The practical effects are simply more catch and release. The majority has made no secret that c. B. P. Will be forced to release even more people into the United States. This is not a design flaw, its a feature of the bill. H. R. 3239 also increases the incentive to exploit children to gain entry into the United States. Smugglers know migrants will be released into the u. S. Interior request they if they bring a child because of a loophole, preventing family units from being detained for a sufficient amount of time to complete their immigrant court proceedings. D. H. S. But before i explain my bills american valuesbased humanitarian Public Health approach, i want to refute a few myths. First, the myth that this bill costs too much. My bill will not raise the deficit one penny and does not require any increase in mandstory spending. Instead, it provides a blueprint for how c. B. P. Should use its current budget and the 4. 6 billion in emergency funding we recently passed to address the humanitarian crisis. Second, the myth that my bill will make it more difficult for c. B. P. To prevent human trafficking. My bill specifically allows for c. B. P. To separate a child from an adult if, quote, such an arrangement poses a safety or security concern, unquote. Such as an in instances of suspected human trafficking. Furthermore, my bill requires c. B. P. Personnel to receive training on indicators of Child Sexual Exploitation and abuse. Third, the myth that my bill requires medical specialists onsite at all times. Thats simply not true. It is simply false. My bill only requires a licensed health provider, like a nurse, a physicians assistant, an e. M. T. Or paramedic, to conduct Health Screenings. And it empowers c. B. P. To call in an Emergency Care provider to help with emergency triage decisions. Thats it. And the Emergency Care providers can include those specialists. But it doesnt require them, all of them, to be oncall at all times or to be onsite. Finally, the myth that my bill is too cumbersome for c. B. P. And will distract agents from safety and security concerns. C. B. P. Agents want the assistance in my bill, because t provides them with humanitarian and Health Assistance to free up their time to focus on safety and security issues. Therefore, my bill will make our country safer. And look, look, i was an early responder after the Haiti Earthquake and medical director for the largest internally displaced camp in haiti. If nonprofits can meet the humanitarian standards in this bill, in the worst circumstances, in the poorest country in the western hemisphere, then we can meet them in the greatest country known to man. So heres what my bill actually does. It creates a Simple Health triage system and basic humanitarian Public Health standards. It ensures that every individual in c. B. P. Custody receives a Health Screening to triage for acute conditions, and highrisk vulnerability. Something thats easy to do. You dont need a full physical exam. Youre just triaging. You need a vital signs and a cursory physical exam. In fact, most people it would take less than five minutes to perform. It ensures that every individual in c. B. P. Custody receives a Health Screening to triage for acute conditions and highrisk vulnerabilities to speech dont die under the responsibility so people dont die under the responsibility of c. B. P. It ensures an Emergency Care provider is oncall to pick up the phone and help make triage decisions for lifethreatening medical emergencies. Thats it. Thats all were asking for. My bill also prioritizes highrisk populations. You know, the most vulnerable to severe illnesses and dying. To receive a Health Screening within six hours, including children, pregnant women, and the elderly. My bill requires very basic and necessary things like tooth brushes and diapers. It includes nutrition standards to make sure that infants have formula and babies have baby food. How hard is that . In terms of shelter, my bill will ensure that people are no longer packed and piled on top of each other, that the temperature is not too cold, weakening a childs immune system, and that toddlers dont have to sleep on a cold, concrete floor. Cold concrete floor. Finally, my bill addresses the challenges of surge capacity, adds training and requires reporting. The straightforward reforms in my bill are essential to protecting the health and safety of agents and the children and families in their custody. Let me repeat myself. Let me reiterate. In the medical field, oncall means 30 minutes or closer. So this bill absolutely requires that all of these specialty physicians are available either onsite or within 30 minutes or closer to being able to be at the location. Any of these c. B. P. Locations. And they have to be provided this health care within 12 hours of manifesting themselves at these facilities. Right now our veterans dont have the access to this health care that is ensured in this bill for Illegal Immigrants coming into our country. If you go to a clinic at a v. A. Facility, they dont have specialty physicians. You have to wait 30 to 60, maybe 90 days to get an appointment with a specialty physician in order to get the care that that veteran wants or needs. Not 12 hours. So we are providing through this bill Better Health care opportunities for Illegal Immigrants showing up at the border than we are for our veterans who have served our country, who have raised their right hand to swear an together to our constitution, who have an oath to our constitution, who have serviceconnected disabilities and have the ability to use veteran sfailts. Only have 30 to 60 days to get those medical needs taken care of. Illegal immigrants get it taken care inform 12 hours according to this bill. I reserve. We are going to put this Unfunded Mandate when they are taxed and tolled with the crisis we have on the border to implement all of these medical requirements. With that, i close. If you have a medical emergency, you should call for an ambulance or having an heart attack, you should go to the hospital and be treated. If you have a medical emergency, you have to be dealt with under this section on page 4. If there is an indication of a problem, you have to have the ability to reach to an expert by phone, if necessary, or to get some guidance on what to do. This is just common sense and we have relead on dr. Rue ease who saw this system work in one of the poorest nations, haiti, after an earthquake and had no infrastructure and the nonprofits could do this. I have no doubt that the richest nation on earth and the department of Homeland Security could do as well as nonprofits in haiti after the earthquake. And to suggest they couldnt i think is really a problem. I would like to note that if we said that veterans are going to get the care outlined in this bill, it would be a dramatic reduction in the care provided to veterans, because this is a minimal standard. One year after c. B p. Was to complete these audits, they have not finished the job. If they are not taking this basic step, we cannot be sure they have implemented crucial policies. Despite these heartbreaking story, theres a stunning lack of transparency about sexual abuse at customs and Border Patrol facilities. According to the agencys most recent report on assessing sexual abuse at Holding Facilities, in f. Y. 2017, c. B. P. Processed more than 534,000 individuals in its Holding Facilities and yet the agency itself only received seven claims of sexual abuse. 10 months after f. Y. 2018, c. B. P. Has wret to release its report on abuse last year. From my own experience, working on Sexual Violence prevention on College Campuses and in the military, i have learned that the absence of formal complaints of sexual abuse does not reflect the absence of Sexual Violence. But rather signals a culture that prevents people from reporting violence. According to a freedom of information act request, between january of 2010 and july of 2016, the department of Homeland Security office of inspector complaints about sexual abuse at customs and Border Patrol facilities. Considering this information, c. B. P. s failure to promptly publish its own sexual abuse data and the stories of survivors who have come forward there is a clear need to improve transparency about sexual abuse at c. B. P. My amendment, which i was proud to introduce with representatives moore and cisneros, directs the secretary of Homeland Security working with the d. H. S. Office that typically received complaints of sexual abuse, release all complaints of sexual abuse at c. B. P. Once per quarter, removing any information that would compromise the anonymity of survivors. This is an amendment that all members should be able to support. Releasing more data in a timely manner will help lawmakers grasp the scope of this problem. Knowing that they are not alone may also encourage other survivors to step forward. Employee, contractor or detain yes. Well never know if the complaints were substantiated or unsubstan shated. We wont know if the complaints were against c. B. P. Personnel, staff, or other aliens in the facility. Im also concerned that the amendment requires c. B. P. To exclude personally identifiable information of the individual with reported the abuse but is silence as the personally identifiable information of the accused. It would be inappropriate to publish a complaint against an individual without context especially if it is determined the complaint is unsubstan shated. E judiciary went through a similar thing with health and Human Services when one member said hundreds of complaints were made when in fact many were against contractors and other u. A. C. s. This would give the appearance regardless of the facts or ultimate outcome that c. B. P. Facilities are rife with sexual abuse and the further implication is that c. B. P. Personnel condone Sexual Violence. Such a characterization is insummitting to the men and women of c. B. P. Who follow policies to prevent sexual abuse in their facilities. In fact theyre bound by published regulation that the agency mandate, quote, zero tolerance toward all forms of sexual abuse and quote, zero tolerance isnt a mere buzzword. The regulation continues extensive and detailed requirements to prevent Sexual Assault. They detail the steps c. B. P. Must take in response, train, education, risk assessments, reporting mechanism the official response following a detain yes report, disciplinary actions for staff, contractors and volunteer, medical care, and compliance. The managers amendment to the bill makes clear the bill doesnt abrogate existing policies. In fact, it acknowledges that c. B. P. Has a zero tolerance policy for sexual abuse. Furthermore, d. H. S. O. I. G. Is directed to conduct unannounced inspections of facilities and the their own regulations require periodic audits. C. B. P. Is already confronting a crisis. To fix the loopholes in our law that fuel illegal imfwreags. The men and women who protect our borders have been given an enormous task, fuel by offensive rhetoric. We shouldnt make their job harder by publishing complaints without context which will have hard ll of painting these working officers as criminals. Frankly, one instance of Sexual Assault is far too much. This data will provide more transparency for congress and for survivors and frankly more transparency for those members of the Border Patrol that are doing their job with respect to migrants.
