legal matters and trump's life, but also the future of immunity for all president's, cnn's joan biskupic has more on today's ruling you are watching for this to come down. now, are we certain that this is going to come down today? we have been waiting for this throughout the course of this supreme court session it will share and i'm about to leave my little posterior and our dc bureau and run over there because at 10:00 sharp, this is a very punctual supreme court 10:00 sharp eastern time. >> the justices will take the bench. they will read excerpts of the final opinions of this term with the last been i'm sure this immunity decision. we don't know yet who will who has written it. there's a strong chance that's the chief justice of the united states, john roberts, who would have kept this very important case for himself. and just to remind everyone what's at stake here, the question is going to be at bottom will former president in donald trump be subjected to any kind of criminal prosecution for election subversion for what he did back in 2020 after joe biden validly won the white house will be subjected to any kind of trial before the 2024 election comes. this fall lower courts had rejected donald trump's claim that he should be absolutely immune from any kind of prosecution because of the power of the presidency. they had rejected it with a lower appellate courts saying for the purpose of this criminal case, former president trump has become citizen trump with all the defenses of any other criminal defendant, but any executive immunity that may have may have protected him while he served as president? no longer protects him against prosecution now, sarah, i should say that as much as lower court judges completely shut the door on donald trump the u.s. supreme court, as it heard oral arguments back in april suggested that they were gonna go deeper and look at the specific activities at issue here that are part of the four charges brought by special counsel, jack smith on behalf of the justice department and the united. all of the united states people here against the former president. and that will mean that when they rule, they could offer a new set of standards for the lower court. judges to go deeper into the kind of activities there that are alleged here are the activities that could be deemed a part of donald trump's official conduct and therefore shielded from any kind of pressing prosecution or were they have been private acts that he took his candidate trump, that would definitely not enjoy immunity. so there'll be a lot to look at and hopefully we will be able to tell how realistic it is that donald trump would be subjected to trial. but also sarah, just stepping back a little bit further and thinking about the separation of powers, whatever the justices do today, will apply to all president's down the road and i have to say this is the first time since i'd say the 2000 case of bush vigour, that these justices are the position to really determine what could happen in a presidential election. a lot at stake, sarah do you have any sense of how they're going to rule? we have heard, of course, the arguments we have heard some of the questions that some of the judges had been asking back in april. do you have a sense of where they're going? >> okay. i presume that chief justice john roberts is going to try to get as unanimous decision as possible. and this is a very splintered courts. so he had a very tall order before him, but i think that he's going to try to do something that is not that maybe offer some broad strokes on some of the issues i just mentioned and doesn't go into areas that could automatically cause some splintering among justices who are on the margins. i pass cases. sarah of challenges to the offices of the presidency back in the nixon years back with bill clinton. those supreme court's were able to come together unanimous to sort of bridge their own ideological and political divide. and if john roberts can pull it off here, what we're going to be getting is a ruling that offers new standards, but then leaves it to the trial judge in this case to actually determine some of the key questions, resolve those questions as donald trump could possibly be put to trial yeah whatever happens, this could be one of the most consequential decisions is that this court has made since overturning roe versus wade. thank you so much. joan biskupic. i know you're gonna be running down to court now. john. >> all right. with us now, cnn legal analyst steve vladeck. and for nita tolson, dean and chair of the usc school of law, steve, first two you general consensus that the court will likely rule there is some concept of presidential immunity. the real question then is how they will describe when there is immunity. what are you looking for here yeah. >> i'm in jonathon. that's right. and it's not just a question of whether we get a specific test in whatever the supreme court hands down today at the oral argument in april, justice neil gorsuch talked about the importance of right i didn't rule for the ages. jonathan, there's also the question of whether the justices then at least tried to apply that test to the four charges against former president trump, or whether they leave that for the lower courts for judge chutkan in the first instance, john, that's going to have a lot to say about how quickly things move after today's ruling, are we going to get guidance from the supreme court about the specific application of whatever it says to the case of former president trump. or they're just going to say, here's the test. you lower courts, you go deal with it, which of course is going to take even more time de tolson to that point how directly involved you expect this court really wants to get i think it's hard to tell i do think chief justice is looking at the overall landscape in some ways because just last week, the court found in favor of a january 6 defendant. a few months ago, the court found that the state of colorado couldn't keep former president trump off the ballot in enforcement section three of the 14th amendment. so it is entirely possible that the chief justice or whoever's assign the opinion wants to write an opinion where the court is not as hands-on as one might think. and of course, to steve's point, this goes to how they apply whatever standard they come up with today and how that affects how things move in a lower courts. >> steve, it's july 1st. i did look to make sure i'm right about this. it's july 1. in the special counsel asked the supreme court to first get involved with this and way in back in january. and if in the end with the court's going to do is kick it back to lower courts here. do they really need to weigh seven once they do that? >> yeah. john, it's a fair question. i mean, i think there's no doubt that the supreme court could have moved faster in this case. i mean, for you to mention the colorado ballot qualification case, the court moved a lot faster to resolve that dispute. i think the key point though, is the court is still moving relatively quickly. i mean, the court moved much faster, for example, then president trump had asked the court to move when they agreed to take this case, trump hadn't even formally appealed yet, so i think there's going to be a lot of dissatisfaction no matter what the supreme court says today. hey with how slow the court moved, with what the court says, with how much it leaves for the lower court. i think that's understandable. part of the problem is that i think to jones point from before, it really doesn't seem like the court is of one mind given how the oral arguments went in april in contrast to clinton versus jones, in contrast to the watergate tapes case, where what made the court's decision so resound him and so impactful was that justices from across the ideological spectrum justices appointed by presence of both parties, joined in one opinion no matter what happens at 10:00 this morning, i don't think we're getting that it didn't tell us one of the things i will be looking for here is how much of a definition the supreme court chooses to get into over what is an official act because that is something that has been litigated at every level of some of these january 6 cases and continues to be an issue, frankly, it a lot of aspects of governance versus politics issues and to be clear, even if the court finds that the president is immune for official acts, immune from criminal liability that doesn't mean that kennedy trump wins, right? >> because at the end of the day is hard to see the a post 2020 november 2020 acts as being official x, right? so spreading false claims of election fraud persuaded state officials to change your slate of electors based on his false claims. the infamous call to the secretary state of georgia to find 11,780 volts, which is at issue in the georgia election interference case is really hard to think of. about these as official x although president, former president trump is claiming that those fall under the category of official acts, while the definition might be somewhat gray following this supreme court decision, i do think that is a tough sale to look at this as acts of a president as opposed to accept the candidate i guess what i'm asking de is is will the supreme court leave it gray? isn't this a good opportunity to make it a little more black and white? what actions a president or a chief of staff, or someone who works at the white house, what actions they can take that are governmental or presidential and what actions they take a purely political or as a candidate? >> it's hard to come up with a rule that's absolutely black and white, especially if the court articulates a standard and kicks it back down to the lower courts. just by definition, the lower courts will have some influence over how that definition develops, right? so i don't think will. and this is true of most supreme court rules. i doubt that will have a rule let clarifies things to the point where the president is absolutely certain that they're free of criminal liability. now let's be clear. the president is already laboring in a system where impeachment hangs over the president's head right? >> while there is still an attempt here to try to calm nerves especially amid anxiety and concerns within all corners of the democratic party still days after thursday night's debate. >> now, we know that the president huddled with his family over the weekend at camp david, where his family continued to encourage him to stay in the race grace and showed their support. advisers also telling cnn of the conversations are really focused on how the family can continue to help him in the race, not whether he should reconsider his candidacy of course, his family is crucial. they have been really important in an influential when it comes to the president's decision-making about running for office and reelection. now the president himself has also been collecting data and public polling and anecdotally, again, as they still grapple with that immediate fallout from the debate, there has been anxiety among donors, the president had fun, run razors over the weekend where he tried to quell some concerns again, acknowledging that he had at a bad debate night, but also noting that he would continue to fight hard and the alla, his allies have taken to the airwaves to continue to make this argument and especially keep the focus on the difference between the two records of the candidates. take a listen to what chris coons, a longtime ally of the president, said this morning we need to remind the american people of who joe biden is. a strong and capable president with an incredible record and a good heart who can tell the truth and get the job done in sharp contrast to who donald trump is a man who on that stage just viewed chaos, anger vengeance, and lies. we don't have time for this. this hand-wringing. we have less than five months, 20 election. we have less than two months to the convention doubled down on organization right now, not on worrying about what happened during a 90 minute debate. >> so you can see there how allies are trying to move on from this. interestingly, koons also said that the president should be out there more often and unscripted moments and sort of showing how he can be energized. and in the first post-debate ad that was released this morning that's what the campaign also focused on. the north carolina post-debate rally that the president did where he was more forceful and energized instead of showing any clips of him on the debate stage. so clearly the campaign continues to be under scrutiny. there are still calls that they're making privately and notably, john, there was a fundraising email. were they also put out polling? what other democrats or how other democrats would fare against former president donald trump, making the point that president biden is still best suited to be his contender. yeah, that polling was interesting. the fact that they released that polling, i think is the most interesting thing, as much as what the numbers show, priscilla alvarez. great to see you. thanks so much. sarah. all right. to continue this conversation, cnn political commentator and democratic strategists, maria cardona and former trump 2020 director of strategic communications, mark lotto. thank you both for coming in this morning. we just heard from debbie wasserman schultz. we also heard this weekend from representative jamie raskin, who said there are serious very honest and rigorous conversations taking place at every level in the party concerning joe biden's presidential bid. so maria to you first, is it a bigger political mistake to keep president biden or to try and run some of the names being brought up by democrats. i'll show you the list here so far they're are about ten names that are being bandied about i think that what we need to do is focus on the choice ahead because sarah, the reality is, is that joe biden is our nominee. >> he went through a whole process, a whole primary process, which as you know, is pretty complicated from a rule standpoint, he got all the delegates and what we can't do now is pretend that we can now undergo a whole new process with a whole new crew of people. joe biden is our nominee. he is the one who is best suited and best position right now to beat donald trump. everyone else that you just showed on the screen, they hey, are a great for their states and for the positions that they are in right now. but they are not well-known nationally, sarah, it would be almost impossible to mount a campaign for any one of them between now and november, where they could raise the money, put in the infrastructure. do everything that they would need in order to beat donald trump that's, just a reality. and so that's why you hear debbie wasserman schultz senator coons, and even jamie raskin at this point understands that what we need to do as a party if we want to beat donald trump, is focus on the choice at hand. a good man, a decent man and accomplished president who had a bad night versus a bad man with a putrid character who lied every single time he opened his mouth during that debate, wants to destroy our constitution, get rid of our microsoft, be a dictator on day one is a convicted felon, wants to take away. all rights and freedoms. that is still the contrast and i believe at the end of the day that the american people will focus on. and we'll choose a president that has given them the accomplishments he has for the past 3.5 years and, they're not going to let a 90 minute debate a clips. all of that mark with all of the criticism aimed at biden's performance polling doesn't necessarily show that donald trump got this big boost from voters. how is he going to use this? you think as his campaign goes forward? the issues with the debate and all the clips and so forth well, i think that most people in the polls prior to the debate showed that the majority of american people thought that joe biden wasn't mentally up to the job. so this just reinforced an existing narrative. but the underlying foundation of this campaigns not going to change hey, joe biden got record high inflation, gas prices. we can afford 12 million illegal immigrants into our country. we've got women being raped and murdered by those illegals. all of that happened on joe biden's watch. it's why donald trump is actually performing 11 points better now than he was at this zero point in 2020 and the debates just going to reinforce what people already thought if joe biden's presidency is not good for them maria can candidate when let's put that poll backup, that you just mentioned, bark can a candidate win when 72% of people polled say he does not have the mental and cognitive health to serve as president when you put what the actual choices in front of the american people absolutely. >> because look, we have had pulls from the very beginning of this race where it has shown that the vast majority of the american people don't want either candidate, sarah but guess what? this is the candidates that they have. and so right now, the choice is between joe biden and donald trump. and what i will say to my good colleague here on the other side of the aisle, is that what this debate also highlighted? is how draconian how horrific they will remind people what happened the last four years that donald trump was in office when he ripped babies from the arms of their mothers. and now he wants to make sure that women do not have the right to have bodily autonomy let me and make decisions over their own bodies he wants to pit immigrants against black people. he wants to pull this country apart by the same. and if you look at what the dials showed the night of the debate, sara, i was on cnn espanol doing analysis and on univision and telemundo, this happened as well. the audience heard the debate through translators and every single dial of independence let the independence, they moved toward biden every single one of them because they could not fathom somebody like donald trump having another four years in the oval office who believes that latinos and immigrants poison the blood of the country. they don't want to see their families ripped apart yet again. and i think the black audiences as well when the president talked about black jobs, what, what does that even mean? she's going to undergo a mental health evaluation and then he's in a report is housing unit and this is where he's going to spend four months behind bars. now, he has projected this era of defiance. he acted like he doesn't care at all about the fact that he's facing this prison sentence. when i spoke to him about it, he predicted, i'm going to be more powerful in prison than i am now. he also told me it will have a much bigger impact on the campaign when i'm in prison than i have now at this right? he's likely to get out in october just before election day. i also talked to sources closer to bannon who said you know, behind the scenes, this is someone who was sort of in denial about the fact that he was actually going to have to report to prison. he really thought that he would be spared by the supreme court or one of the lower courts. you know, there's a certain amount of apprehension about going here, about spending this time behind bars for someone like fanning. so i'm sure we'll get a lot more of the defiance, a lot more about president trump's get former president trump's campaign when bannon arrives here in just a couple of hours done. >> all alright. sara maria now happens. >> but i think it has a bigger impact joe biden, minute hazard me. actually all right. >> cnn senior crime and justice for katelyn polantz, is with us now notwithstanding what legal analyst donald trump just said about this, this is a huge ruling, not just for donald trump, but for the presidency for the presidency john, but make no mistake. this is about donald trump. this is about donald trump as a criminal defendant, and it is about the case he faces in federal court in washington, dc, charging him with many alleged crimes related to what he did while he was serving as the president. but as a person wanting to hold onto that office when his supporters overran the capitol and tried to allegedly obstruct congress. so what's happening today at the supreme court is they will issue their final opinions. there's a couple opinions coming out. we very much expect the usv trump to be decided by this supreme court sometime after they take the bench at 10:00 a.m. and whenever they are ruling on this, there's a couple of things to look for here first of all, do they dismiss the case against donald trump entirely and say the presidency has vast protections that would be a very big deal. anything they say is gonna be a big deal with that would be a very big deal, putting it the end immediately to this case, and likely any other cases like that one in georgia against donald trump. we don't necessarily expect that to happen though, based on what the supreme court had asked at oral arguments. so instead, we're looking to see how the supreme court will define or articulate the bubble around the american can presidency. and what happens when someone is serving in that office and takes actions that the justice department believes could be crimes that could be charged before a jury if they say that there are things that are private actions or that are not protected then that is one of those things. john, that means this case could very well gone to trial and then the next question is, when this here potentially yeah, it'll be very important to know whether the court itself rules what actions donald trump took or official or non-official, or whether they asked a lower court to make that determination. that's where the clock gets very interesting. katelyn polantz, great get to see you this morning. thank you very much so as that is going on, obviously, the other major story this morning is what will happen with president biden and his presidential campaign. there are people out there wondering whether he should stay in the race. however, no prominent elected democrats have said that he should drop out just yet and one historian who was predicted nine out of ten presidential elections says, replacing the president could cost democrats in november with us now is allan lichtman, presidential historian in history professor at american university professor when we last heard from you friday night with abby phillip you said no replacing president biden would be a mistake. you've had two more days to think about it. how do you feel this morning even more strongly that it would be a in the state, you know, all of those who are calling for biden's withdrawal they have zero track record in predicting elections and yet they presume to tell us what the democrats need to do to win this election. >> and remember, all the pundits watched hillary clinton when three debates in 2016, they all said trump was finished after access hollywood and they are so often wrong. i have a system as you know, that's been successful. i would say ten of ten, but we can argue about 2000 since 1984. and the way it works, i've 13 keys have six fall against the white house party, their predicted losers biden ticks off the incumbents tk, and he takes off the party contest key. you push him out, you lose the incumbency key, and you lose the contest key. so instead of starting two keys up and having six more keys to fold a predictive democrats defeat, they start to keys down and only for more keys would have to fall. moreover, how often since the turn of the 20th century has the party holding the white house, everyone in an open seat with an uncertain or contested nomination. the answer is never, and that's what all of these critics would be sent heading up if they'd push biden out of this race, they could not be more misguided. and his term in terms of biden's capacities, i'm not a neurologist. they are not neurologist. they have no standing to comment on that. and i would only say far better to judge biden by three and three-quarter years or so of his presidency than 90 minutes. >> allen, but people are talking about this. the voters that people who are going to be making these decisions. and you look at some of the polling and it says 72% of the voters after they watched the debate so they didn't think that he had the mental acuity to be the president do you pay attention to those polls? how much does polling play a role in how you see things? >> polling place far two more, two much of a role in our decision-making paul's are snapshots. they're not predictors, and they change rapidly over time. one can turn to another poll. i think it was the morning consoled paul which showed that after the debate, biden improved by one point, he went from a dead, he two 245 to 44% victory. and, you know, i love you guys in the media, but i have to say you are complicit in donald trump lying and conning his way to the presidency all the attention has been on biden's faltering debate. but donald trump's debate was vastly worse. it was based entirely only's more than 30 significant lies. that's one line for about every one minute and 2030 seconds. he threatened our democracy by saying he wouldn't accept necessarily the results. of a fair election he said he would seek retribution. why wasn't that the headlines? why wasn't that the greatest concern from the debate rather than all the focus on joe biden. there's an old saying. it's not just the evil people who wreak havoc on the world. it's the good people who don't do enough to stop them. and the media right now is complicit in donald trump gaslighting his way to the presidency and threatening our democracy professor, i've been a big fan of your model for decades i think the model is terrific. >> and so not asking any questions about the bottle itself and how president biden fits or doesn't fit into that model. my question to you is when you talk about they, they have been questioning whether president biden should stay in the race. have you talked to devote or since thursday night? at what what's the discussion been around you with people who may not be in politics since the debate thursday night has the discussion among voters and said, i i'm curious to know, have they talked about donald trump and allies he told which we did report on, or have they talked about how president biden looked on that stage thursday night i've gotten a slew of emails ever since my cnn appearances, you say on late night last week, which by the way, has gotten about half a million views already on youtube. >> and some have said you're wrong biden's gotta remove, but the vast majority of community occasions to me have said, thank you. thank you for highlighting the importance of keeping biden in this race and that the real danger is not biden faltering in a debate. but donald trump lying his way into the presidency and threatening our democracy. that's been the great bulk of communications i've gotten totally non-scientific, of course, don't draw any conclusions from that. but the american people who seem to be aware of the very serious stakes that are involved in another term for donald trump i have to ask this question. have you determined who is going to win the 2024 election a great question. >> and the answer is, i haven't made a final prediction. i'll make it after the democratic convention in august, but i have said with biden winning those two keys upfront he's only down two keys, right now for more keys would have to fall to predict his defeat so a lot would have to go wrong. it could. what are the four keys to look at? forget the polls to get the pundits. its governance not campaigning that counts so look at third party, which is a sign of discontent with governing social unrest and other sign. and with two wars raging, look at my keys on foreign policy, failure and success. so my final word is to get the polls ignore the pundits, keep your eye on the big picture as gauged by the keys to the white house. and i wish those who were so quick to dismiss joe biden would pay more attention to the fundamentals of how elections really work. >> i know you pay close attention and we will be talking
