Im told by multiple israeli officials that an invasion, that a Military Offensive into rafah is not imminent. And there are two key reasons for that. The first of which is the fact that the forces in gaza as i have not yet been built up to the point that they would be ready to go into rafah for an allout offensive. And secondly, the plans for evacuating the civilian population from rafah. They have yet to be finalized or approved by israels war cabinet. And im told that an evacuation of rafah is expected to take at least two weeks now, this doesnt mean that israeli officials have ruled out going into rafah during the month of ramadan, but it certainly doesnt appear like an invasion of that scale is imminent at this point. But certainly israeli officials, very mindful of the fact that this month of Ramadan Hamas is leader yahya sinwar is looking to use this month as an opportunity to launch a second wave of attacks in israel to see if he can revive what he launched on october 7 and israeli officials very much taking that into account as they plan their Military Operations going forward, brianna all right. So israeli officials, as we just heard, jeremy said they havent built up their required forces for an offensive into rafah yet they say it could be done in short order. Im wondering what you think still needs to take place. How many troops advanced like that would require and how soon this could happen. Well, boris, i think what we what were witnessing is the israelis are being a little more cautious at least their narrative is a little more conservative. If youll allow me that in terms of their approach towards rafah the, rest of the world has been focusing in on it as have the israelis. But i would suggest the israelis have sufficient Manpower Troops on the ground and capabilities in terms of intelligence collection, Logistic Support to their Forward Deployed forces and as well as airpower. So i dont think that there is a real requirement for the buildup of Additional Forces irrespective of whats being said. I think theres certainly is a little bit of a pause until they figure out how they are going to work this out in terms of their approach. I would also suggest that what the israelis, but the idf has learned over the course of the last several months of combat in gaza is theyve experienced a procedures in terms of this type of tactical fight. And i dont expect it to look any different going into rafah in terms of working out their approach, israel as assured the us that a civilian evacuation would happen first, us officials though have expressed skepticism that guaranteeing civilian safety is even possible. Theres more than 1 million people. And what has largely become a tent city. Whats your assessment i mean of that could israel actually carry out an efficient evacuation yeah. Well thats the conundrum. Efficient evacuation. I think an oxymoron look, its not going to be an aseptic and its not going to be 100 clean. There will be continual casualties. And i think thats the nature of your very, very first discussion point, which is the israelis have indicated they want to try to facilitate an evacuation, whatever that looks like in advance of conducting their operations so i think thats where where we are right now. Were at that juncture i want to ask you about some recent Satellite Images that show israel built a road all the way to the mediterranean sea, splitting the gaza strip effectively in to the idf is claiming that this will give them an operational foothold what does that signal to you . What does that effectively mean well, what that describes is clearly what the israelis are looking at is in the near term, the near horizon. They are not anticipating departing from gaza until the mission is complete. Look, they dont want to be there forever. They dont want to provide governance. But while they have soldiers on the ground, they have a footprint on the ground. This is essential for their command and support type of operations but also going forward, this road could provide that type of support over the shore type of logistics that would be coming ashore that can further be distributed into the country. So it has a potential down the road commercial application as well. Lets take you now, live outside the courthouse with cnns Jason Carroll jason walk us through these new charges and what we saw play out in Court Well First and foremost, boris, as you know, this senator and his wife have remained defiant throughout this denying all charges neither of them said anything as they entered the court or as they left the court while inside when the judge asked Senator Menendez how he was going to plead he said, once again, not guilty, your honor. Both of the senator and his wife now facing 18 counts, including conspiracy, acting as a foreign agent, bribery, extortion, and wire fraud. They were already facing Bribery Charges. But in the Superseding Indictment, prosecutors are alleging that both the senator and his wife knew they were under investigation knew they were facing Bribery Charges and tried to make it out that instead of what instead of bribes, what they were receiving were loans. So in other words, it was alone for the money they received to pay off their mortgage. It was alone for that money that they receive to buy that brand new mercedes prosecutors saying that was simply not true also alleging in the Superseding Indictment that they lied basically to their former attorneys and that those attorneys then in turn, in meetings with us attorneys, made misleading statements. Now, again, the senator and his wife and addition, the two other defendants have denied all of the allegations, the senator saying this is just the government trying to go after him saying in a statement, it says that the prosecutors are afraid of the facts, scared to subject their charges to the fairminded scrutiny of a jury. It says once and for all that they will stop at nothing in their zeal to get at me. Now, this trial had been scared scheduled for may 6, and there was some question with a Superseding Indictment, if that would somehow be delayed, but the trial is still set for may 6, floors Jason Carroll live outside the courthouse in new york for us. Thanks so much, jason, brianna. Lets talk more now about this expanding case against the senator. We have cnn legal analyst and former federal prosecutor, Jennifer Rodgers with us. Thank you for going through this with us. Codefendant, jose uribe flipped just before this Superseding Indictment came down in a court according to the new york times, jennifer ehrbased says, he agreed to lie to investigators into his own lawyer after he spoke to Nadine Menendez to say that the mercedes payments that were made for her, were actually alone rather than a gift which could obviously be seen as a bribe. And menendez and his wife, according to prosecutors, then lied to their own attorneys and in turn, the court, as you saw there, how problematic is this for the senator and Nadine Menendez yeah. This is a game changer. Briana, now they have a cooperating witness who was part of the scheme itself. So he will have given them a lot of information about how the scheme work. Thats why we so additional substantive charges coming into the new indictment, but he also gives them something else, the Obstruction Of Justice part the part where after they all realized they were under investigation, they tried to cover it up. By pretending that bribes were actually loans. And thats so critical when you go to trial because jurors understand inherently the cover up they understand getting caught with something trying to make it seem like you didnt do what you did. And so thats a really, really powerful tool that prosecutors use, both in a separate charge, like they have here and Obstruction Of Justice charge. But it also goes to consciousness of guilt for the underlying offenses as well. So jose uribe flipping and now testifying at trial as he will for the government is a huge, huge benefit for government here. What are you having to cover up . Have you didnt do something wrong, right. And thats certainly something they understand. Nadine menendez, it was it was sheehy who met with a rabiya initially to talk about how he was going to characterize this car payment. Does that insulate the senator at all if the senator also had his lawyer lie as prosecutors are alleging not much not much, they really piece this together well, in the indictment, the prosecutors do they show all of these communications, many of which were with the senators wife, Nadine Menendez, and then they have calls to and from Nadine Menendez and her husband. But you also have to expect that some of their communications were not over the phone, right . They would have been in person. So what you see is you see these communications among the other coconspirators and then you can assume communication from Nadine Menendez to her husband because you then see Senator Menendez doing basically what Nato Menendez and the others were talking about. So its not as directly implicating him in some of these instances, but theres plenty of ways with circumstantial evidence that you can piece it together. And frankly, plenty of evidence of Senator Menendez himself being in these meetings and having communications with the other coconspirators. So the proof is very, very strong here and a certain point, could you see nadine and bob menendez flipping on each other or are they just very much tied together at this point thats a really interesting question. Im wondering if there will be a move to sever their trials because the problem is, if they want to flip on each other, theres a marital privilege here. Marital communications are protected and so its not clear that one of them could testify about certain things, including communications that happened between the two of them while they were actually married, not all of these facts occurred while they were married. Some i think were before that, but there theres a big marital privilege issue here that complicates a little bit the notion of whether they can be tried together and what they might do. But so far they seem to be hand in glove here. They dont seem to be turning on each other. They instead will focus on some legal arguments, trying to claim that theres no official act here or what he did was just part of his job, so they dont seem to be attacking it that way. But boy, there could be some interesting legal questions that come up if, if that does happen, even if it doesnt, they may move for separate trials. As i said, how concerned are you about the fact that the senator is still has access to classified information despite what hes alleged to have done yeah. I mean, listen, its never a good thing when a public official with that kind of public trust and access to information is accused of Something Like this and is still in place he has been taken his Leadership Position has been removed from him or he resigned from it. So thats good. I think there are enough eyes on him at this point that its not a Huge National security risk, but i do think that one of the things prosecutors do when they faced this kind of case is tried to perhaps craft a resolution, a Plea Agreement that includes a resignation and thats for that reason, we dont what people in these positions of public trust who have violated that trust in the way that menendez is accused of doing. So, well see if hes amenable to any Plea Discussions at all that involve resignation so far hes been very defiant and says that hes going to see it through to trial. So well see about that.
