the nation's capitol on high alert as tens of thousands rally against anti-semitism in washington, d.c. is and as attacks on jews and tensions over the israel-hamas war soar. plus desperation in gaza as hospitals go without life-saving supplies. doctors frantically move ing newborn babies out of the nicu in gaza's largest hospital as oxygen runs out. what israel says it has offered to help. and a clean shot to the kidneys, republican congressman tim burchett accusing recently deposed kevin mccarthy of elbowing him in the back. kevin mccarthy denying it. what is undenial, we're three days away from a potential government shutdown. we're following these major developing stories and many more, all coming in right here to "cnn news central." the push to free hostages held by hamas is picking up today. just a short time ago, president biden said he believes a deal would free hostages in gaza is going to happen. a senior u.s. official tells cnn that israel and hamas are inching closer to a deal, and israel's prime minister just indicated that he thinks the ground offensive inside gaza is increasing pressure on hamas to negotiate. also today, demonstrators have taken to the streets demanding the hostages be released. tens of thousands of people are in washington at the march for israel. the rally follows a troubling increase in anti-semitic incidents in the u.s., and this is why law enforcement is on high alert today. and israel, a similar demonstration is underway. family members of hostages began a day's-long march from tel aviv to jerusalem. let's start with gabe cohen on the national mall. what are you seeing at this huge rally today? >> reporter: behind me you'll see a small section of this massive crowd here on the national mall. we just heard from israel's president, who thanked president biden and the u.s. congress for their support during this c conflict in recent weeks. with also just a little while ago witnessed a really interesting moment when our own cnn political analyst van jones was speaking on that stage. he talked about hoping that both sides, there could be an aend to the attacks on both sides of both israel and gaza. and the crowd really went quiet in that moment. very quick ly, we heard very lod chants start up of no cease-fire, no cease-fire. and it speaks to how polarized this issue still is today. this rally happening ten days after a massive rally just about a mile down the road here in washington that was proe palestinian calling for a serious fire. very critical of president biden. and as all of this is unfolding, there's a lot of issue concern about security on the national mall today. we know law enforcement, federal law enforcement are work ing together. the national guard has been called in. and i spoke with some folks in the crowd attending this event about how safe they feel today take a listen. >> you're always safety about security. >> there's a lot of security here. >> reporter: we're still expecting to hear from congressional leaders on both sides of the aisle. the new speaker of the house, mike johnson, and the democratic leader hakeem jeffries and others. we're expecting to also hear from family members of hostages still being held in gaza. so a lot of speeches. we'll be monitoring it throughout the afternoon. ed lavandera is in tel aviv. the focus is on the hospitals and the hostages in gaza. gaza's health care system is on the brink of collapse. what more can you tell us a about that? >> reporter: the catastrophic situation continues tonight here in the middle east. the latest news we have is the hospital that's now the last operating hospital inside of gaza city, and medical officials there describe the situation as dire. minimal staff caring for 500 patients, many of those in critical condition. only two operating rooms and three surgeons left inside that hospital. and another hospital that's been the focus of so much sbensz fighting, that's a hospital that's collapsed. there were babies that were taken to operating rooms, where there were still minimum oxygen splice. defense forces have been offering to take incubators and other oxygen supplies to be able to care for those premature babies, but really all of this just speaks to the catastrophic conditions that are unfoed ing folding. these are areas where many civilians have been seeking refuge from the ongoing fighting there in the streets of gaza. >> we're also hearing optimism from the white house on the efforts to free hostages. where do things stand with that? >> reporter: this comes a day that you saw the families of hostages beginning a day's long march from tel aviv to jerusalem hoping to bring nmore attention and efforts to get the hostages released. but we a heard from president biden just a short while ago, expressing optimism that a deal could be reached soon. one israeli official tells cnn that negotiations are ongoing and the broad parameters of what is being discussed right now, all of this is still delicate, still not close to being nailed down, understand, but it would involve an exchange of what would have to be a large number of hostages in exchange for palestinian prisoners, as well as a day's long cease-fire. so the details of all this is n clear. these are dell indicate negotiations that are taking place, being handled by government officials if qatar and the cia and the israeli intelligence agency, so all of that work kind of continues. and hundreds of families desperate for any kind of movement. good news in this area, which we have seen so very little of in more than a month now. >> that's very true. ed lavandera, thank you so much. today on capitol hill on the house side, drama. what else? an actual fight elbowing and shoving. that is what republican congressman tim burchett is accusing former house speaker kevin mccarthy of. kevin mccarthy is denying the incident. i want to go ahead and bring in our chief congressional correspondent manu raju who is covering all this. what's going on? there's some sort of ethics complaint being filed. >> reporter: that's from matt gaetz. gaetz led the charge to oust kevin mccarthy as speaker. tim burchett, who alleges that kevin mccarthy hit him in the kidneys, elbowed him in the back said it was one of the eight who voted to oust kevin mccarthy. all this tension has just been lingering. for now more than a month in the aftermath of the historic and unprecedented ouster of former speak er. mccarthy told me a few days ago that he believes matt gaetz went after him in order to squash the ethics investigation that he's facing. he criticized burchett as being only interested in press, which is why he sought to push out mckcarthy from the speakership. now what happened earlier today was that there was meeting behind closed doors. they were discussing their plans for the day ahead. in the hallway of the capitol, mccarthy allegedly elbowed him in the back. at that point, burchett ran down the hallway and they got into a heated confrontation. that's how burchett describes it, even as kevin mccarthy is denying it. >> got elbow ed in the back. it kind of got me off guard because it was a clean shot to the cud knees. i turned back and there was kevin. and for a minute, i was like what happened. i chased after him. he's the type of guy when you're a kid would throw a rock over the fence and run home and behind hide behind his mama's skirt. it still hurts because it was a shot to the kidneys. it still hurts. >> reporter: burchett would not go as far as accusing him of assault. he said he would not file an ethics complaint, but that's what matt gaetz is planning to do at this moment. now mccarthy did deny it. heldny zanona caught up with him and said this was a narrow hallway. he didn't do it intentionally. that's what mccarthy told burchett as they got into a back and forth confrontation. a reporter said that burchett said mccarthy didn't have any guts and asked a question what he was doing. burchett confirmed that he said that. so as you can see, so much tension still exists in the aftermath of mccarthy's ouster. this has been in session for ten straight weeks. typically there are recesses between, but they have scrapped those because of all the infighting. perhaps they need a break as they head home at the end of this week. >> exactly the drama, i'm thinking as i see this tour group behind you. i know one of the things they talk about is way back when when lawmakers on one occasion one caned the other and caused a lot of damage. do they realize how rib rhode island tick louse they look that they are coming to a physical all altercation here? >> reporter: the question is whether or not mccarthy recognized that anybody witnessed this. he says he denies it was intentional. reporters who were there saud it appeared to be intentional. so it goes to show where kevin mccarthy is at this moment. he's not in a particularly good place. he's been very critical of those eight who came after him, essentially believes he was pushed out unfairly. but he's saying he did not do this intentionally. we'll see what he says. >> there's a reporter who witnessed this. that's important to note. thank you for the latest as this drama balloons there on the house side. when we come back, the special counsel's office wanting a judge to keep former president trump's gag order in place. we're going to talk about their reasons ahead. later how fellow senators are hoping to breakthrough republican senator tuberville's blockade on military promoexexs. you're watatching "cnnnn news cecentral." we'll be r right back.k. president biden unveiling an alarming new report today from more than a dozen federal agencies showing every corner of the u.s. is feeling the impact of climate change and the things will get worse in the next decade. >> it shows that communities across america are taking more action than ever to reduce climate risks. it warns that more action is still badly needed. we can't be complacent. we have to keep going. above all, it shows us that climate action offers an opportunity for the nation to come together and do some really big things. >> cnn chief climate correspondent bill weir is in new york. he filed this report. >> reporter: there's on old joke that says there are only two seasons in buffalo. winter and the fourth of july. but in the age of global warming, the city wants you to know now their weather has gone from punch line to lifeline. thanks to its goldilocks location amid the great lakes, buffalo has never reached 100 degrees. >> you get on average about three days in the summer get to be 90 degrees or higher. if you're in phoenix, you're looking at that and saying what are you calling that a heat wave. >> reporter: when the professor did a deep dive of the records, the buffalo state climatologist was shocked to find no increase in droughts or flood. >> there was this epic snowstorm last winter, really deadly and destructive. but nost that the an indication? >> no, because we had the blizzard of '85. blizzard of $35. i'm not saying it's going to disappear. it's still there. snow amounts have remained steady in all of this. it doesn't seem to be getting worse. that's the key here. we're still going to have severe weather like the wind, but it's not going to get worse. >> i have to say it's prth ironic about the world we now live in. a place sort of associated with cold jokes and super bowl losses could be a huge winner, relative on a hotter planet. >> that's the way we look at it as well. there was a professor from harvard that was talking about the effects of climate change and listed some cities that would be considered climate refuges in the future. and buffalo was one of the cities on the list, and so we just leaned into it. we are going to not only call ourselves a climate refuge city, but do the kinds of things that are required to be welcome ing with migration, with new americans coming here, with seeing the first population growth in the city since the 1950 census. >> reporter: after hurricane maria, 3 puerto ricans became permanent buffaloens. >> it was hard. when hurricanes start, we move from the second floor to the first floor. >> reporter: including anthony, who is is now a teacher's assistant. >> i remember when i move here. people told me you know where you're going? because in puerto rico it's always warm. it's hot. i said, no, i move here in winter. but like it. it's good. >> did you consider other spots? what was it about this place that appealed to you most? >> the great lakes, the fresh water, the projections of climate change look like buffalo might have a climate more like new york, philadelphia towards the end of the century. >> wildfire smoke helped drive holly and her family out of southern california. as a climate scientist, she said she was welcomed with open arms and the employment. >> people were really forward thinking in western new york and new york state about what opportunities there might be in clean energy and clean tech and how to build those solutions in ways that are good for communities. >> it's not just the latitude, it's theed a attitude. and the welcoming spirit of a place. >> the city of good neighbor, they call it. >> nice. you found that to be the case? >> i have totally. >> very interesting report. thank you to bill for that. this just into cnn. justice department is urging a washington, d.c. appeals court to uphold the gag order against donald trump and his federal election case. chief legal affairs correspondent paula reid joins us now. what is the the government argue ing? >> this brief comes ahead of an oral argument on monday. on monday the government and trump lawyers are going to go before a three-judge panel. to argue about whether trump should be bound by this limited gag order that was put in place by the judge overseeing the january 6th trial. now in this brief, they are summarizing their arguments for why they believe this gag order is necessary, and they say that there's never been a defendant who has been allowed to malign a prosecutor, his family, going on to threaten witnesses. and they say the problems began at the begin ning of the case. they say shortly after they filed their indictment against trump, he threatened to, quote, if you go after me, i'm coming after you. then used inflammatory language to target the district court, the is special counsel and trial witnesses, who he knew were going to provide damaging evidence. and they also point out this extends to as recently as this week. on saturday the former president a at a campaign event launched several attacks against smith and his family. so the prosecutors are arguing that, look, these kinds of attacks and the threats and harassment that come to those who are targeted, this is part of a year's long pattern. they believe this gag order is narrowly tailored to protect his rights and also protect the judicial process and people who are just trying to do their jobs, show up to testimony or show up to work. >> they argue this infringes on his first amendment right. they want the court of appeals to overturn it and have is him not be subject to these restrictions. now he tried this at the lower court level with a judge who imposed it. that didn't work out. he has a chance at the court of appeals as well. >> so what happens next? and what make this is also so interesting is he is the leading republican presidential candidate. >> absolutely. we are legal nerds. this is a big question. because he is running for office. we have never been here before. the extent to which you can limit the speech of a defendant, that's something that has certainly been visited by the courts. when that defendant is also the leading candidate for the republican nomination for the presidency, you get into the realm of political speech. his lurs are really leaning into that arguing that because anything he says is political speech that is entitled to a heightened level of protection. this is a fascinating issue, as they try to balance his rights to free speech, but trying to protect people from threats and harassment. something folks could try to take to the supreme court. >> it really is fascinating. thank you so much. . fellow legal nerd here. stay with "cnn news central." we're going to be right back. the power goes out and we still have wifi to do our homework. and that's a good thing? what are you asking of the israeli government? >> the israeli government, there's a huge disbelief between the city and the government. the main effort from the government through the army is to bring back the hostages. i have a broken family. my sister's family is broke. they need to bring them back. now there's all kinds of talking about deals, but you have to remember we are dealing here not with a state, we are dealing with a difficult organization. everything will be done with my family and all the hostages will be in israel. in light of what happened, this difficult negotiation, what concessions might israel are accept ing to you to secure the release of your family? >> everything. everything we can offer is fine with me. there are many people working on it. i just finished a meeting with people from the government. there's not much they can say, but they promise this is the main thing. it's going to take time. we're waiting already for days. but it needs to ham. there's no other way to keep going through the day, through this war without bringing back the hostages. >> you say everything. obviously, hamas wants a cease-fire. they want as many days as they can get to give up as few hostages as they can release. they want palestinians, who in israeli custody, include ing ma convicted for murder to be released. when you look at those demands specifically, what should israel be prepared to meet. there's no price for a family and kids. there's kids with pajamas. since then, we don't know where are they. so there is a price for it. there is equal to anything. but they don't think like us. they don't behave like us. this organization we will finish it. but first to bring the hostages, everything pal sestinians and murder and jewish people before, okay. we're going to find them later and we kill them. what is the issue. it's to bring everybody back. all the talking around can be anything. israel know what to offer. they know what they can do. we do it. this is the main issue, the main goal. >> what do you want your sister and your niece and your nephews to know? what is your message to them? >> i'm doing everything i can. i put all my efforts into bringing them back. i put it on the table everywhere i can. all day, all time. there's two family here's. they are waiting for their grand kids to come back. this beautiful family. and this is what we do. this is what we live for in this moment. it will. . >> thank you so much for taking time with us today. we are thinking and praying for your family. thank you so much. >> reporter:thank you for havin. >> we'll be right back. sglr a critical meeting on capitol hill. senators hoping to breakthrough senator tuberville's blockade on all senior military nominations. the defense department says it's now prevented the promotions of 452 general and flag officers, many of them in key positions, as the war threatens to become a wider war and we have seen 50 attacks on u.s. personnel in the nation. so is the role of defense to israel. here in the next hour, senators hope to push through a rules change that would allow them to bipass tubervill, who says he's been blocking nominations to protest the abortion travel policy. they are hoping to get support from senate republicans who are came out last week in opposition to tuberville. >> this is doing great damage to our military. i don't say that lightly. >> we are going to look back at this episode and just be stunned at what a national security suicide mission this became. >> we're going to see repurr cushions from this for probably the next decade to come. >> you want to do this, go after the people making the policy, not the people who have nothing to do with it and are simply there trying to do their jobs and keep our country safe. >> joining me now is democratic senator amy klobuchar of minnesota who are is the chair of the rules committee. thank you for being with us. you need nine republican senators to make this change. do you have those votes? >> first of all, they are not on the rules committee, those nine. and the people you have seen just spoke up, they just happen to be not on the rules committee, with us we have both senator mcconnell and senator schumer on this committee. it's the only one they serve on, so what could go wrong. but a lot of things can go right. and that is that we will finally advance this proposal to simply take the 350 people he has already held up and say, we're going to vote on them together with just a few exceptions. we're going to vote on all of them at once. many of their families are going to be there with us in the hearing room. we know that this is, as you pointed out, holding up national security. the head of cyber com, the head of the air command in the pacific, you have viewpoint of the fleet in the middle east, the commander there held up. this is absolutely ridiculous and enough is enough. we're going to say to tuberville today, with or without republican votes on the committee, that we are taking up this rules change. we're going to bring it to the floor. >> normally, the way this goes is it's pretty profunk toir. there's these batches of flag officers and then unanimously senators just approve them. by withholding his support, senator tuberville has done this blockade, and he said, okay, just do them one by one, which you can't do that with senate time constraints. what would the threshold be on the senate floor for a vote under this rule? >> so this is a very temporary focus rule. i would change our rules to be getting on with the business of the country. however, for this purpose because we want to bring in republicans on the floor, and you just heard some of them speak out on your show, this will just be about the 350 and then in the future, other military appointments just for this congress, so we can bulk them together. and this is a unique. there have been all kinds of exceptions, temporary and long-term, to these rules. including exceptions to allow people to be confirmed in groups. that's what this is about. and we have literally bulked together votes before. and voted yes or no. no one is forcing tommy tuberville to vote yes on these valiant military appointments. i don't know why he would vote no. he is playing politics with them. no one is forcing him to vote yes. we just want to vote. we know and we have a vote on all these together, we're going to be able to get them through. >> there are 27 republican senators who just acceptability this letter to defense secretary lloyd austin, urging them to rescind the abortion travel policy, which is the heart of tub erville's projection. this is a more normal way. what thune was getting at. instead of holding these officers up, who don't make policy, are those votes that you cannot rely on, or do you think folks on that letter might support your effort? >> i i don't think we should assume anything. first of all, we know there are some republican senators like susan collins, who are with us on reproductive freedom. that aside, the point is this is not even about paying for abortions. this is actually just military policy. if you're in a state that you can't get a certain medical procedure, it allows these women service members to go to a state that does allow for it and pay for their transit. that's what they do for any other medical procedure. they are not going to exempt this one per defense department policy, as general austin has stated. that's all this is about. so tuberville is way, way out there. had when you think about how people have been voting in s states like kentucky for governor beshear or the vote we just saw in ohio, a straight up vote in a red state when it came to abortion, we know he's off on that. but this is actually so about our military. it is about our chain of command and him holding them hostage for his own political believes. and i believe republicans, who may not be with the public on this issue, still believe in our chain of command and eventually will release the military p promotions and these fine military service members that are just literally in limbo. they have their families waiting to move. they have spouses who have left their jobs waiting it that are promotion because no one has had the gal to do something like this and hold up 350 military members. if we voted on each one individually, it would be 115 business days. we would have a government shutdown. we wouldn't be able to do all the work. so with all the drama you're covering and rightfully so over in the house today, the senate has an act together on passing our appropriations bills, you are going to, and i appreciate you spending time on this. this is its own set of drama and involves one guy. what we are saying today, at least the democrats on the committee, enough is enough. we're headed to the floor. >> his opposition to this policy, though, he's not alone in that. there's a lot of republicans who are against it. sort of surprised. i have spoken with some veterans and those in the military community, i'm talking about moderates, not conservatives, people who are in favor of abortion rights, women included, who say why not just change this policy? there are not that many people using it. it's creating a huge divide. what do you say to that? >> i just completely disagree with treating our women service members like this and not giving them the same kind of benefits that male service members have. so i'll start with that but the second thing is that no one has ever done this before. so if we set this precedent, anyone could holds up hundreds of military promotions over something that they don't like. if you don't like a service war policy, you're going to hold them all up. and we have learned, especially from things like vietnam, you can have disagreements about war, but you don't take it out on the warriors on the front line. which is what tuberville is doing with his disagreements. our position today goes beyond even the issue of reproductive freedom. way beyond. this is about our very military chain of command and the ability of the senate to allow our military to do its job when you have china saber rattling, when you have what's going on in the middle east, when you have russia in ab an all of out invasion and our duty to stand with our nato allies. that's what's at stake here. the security and credibility of the united states of america on the world stage. >> look, there's bipartisan agreement on that centerly coming from congress right now. even as this issue of this abortion travel policy is cating divisions in the military, in the civilian world and there up on capitol hill. senator klobuchar, thank you for being with us. >> thank you very much. when we come back, a new report showing the survival rate for lung cancer patients is rising in the u.s. but it's still the leading cause of cancer deaths. we'll have more, ahead. moments ago, former speaker of the house kevin mccarthy spoke and addressed the accusations from a congressman that he elbowed him in the back. let's listen. >> i would not hit him in the kidney. it's not a very big hallway. so i'm walking out, i called him after you guys talked to him and said did i hit somebody? bruce and i were walking out. i guess an interview was interviewing him and our shoulders hit. i didn't know what he was talking about. i did not run and hit the guy, i did not kidney punch him. >> you didn't shove him? >> no! you guys line up along the way there, it was us walking out, and i didn't know it was him. and i guess our elbows hit as i walked by. i guess it happened, because when i was walking back further, someone was talking to me and he comes running up like, why did you hit me or something like that? i said i don't know what you're talking about. >> but reporters and witnesses said it looked like there was plenty of room for you to walk. >> show me a reporter that saw that. ask bruce westerly. if i would hit somebody, they would know i hit them. >> he said he was in pain that you hit him so hard. >> come on now! >> that's what he said. >> he said you pushed him twice while he was in chamber. >> when? >> he said he was on the back railing once -- >> kensinger. >> i don't know about kensinger. >> congressman gaetz is filing a complaint over this. do you have any response? >> i think ethics is a good place for gaetz to be. >> he said you're the kind of guy, his words, as a kid would throw a rock and go hide under his mom's skirt. that's his exact words. what is your response?
