First, quickly, the dysfunction got so bad after the vote, we learned today that republicans cannot even stand to be in the same room together for more than a few minutes. There was a meeting last night as you may, know of republicans, and that room would have devolved into i think physical attacks on one another if people stayed in there for long periods of time. That is a republican congressman resident mitt at left members last night unable to agree on a successor or anything else except putting off a decision until next week. Today other than congressman jim jordan throwing their heads in the ring, and Marjorie Taylor greene saying the former president should get the job, nothing whatsoever happened. Nothing but anger and recur nations against the gop rumbles who voted to ask mccarthy, especially the instigator florida matt gaetz. I think yesterday we saw matt gaetz, one of the greatest acts of heresy ive seen in a while. Matt gaetz undermined the entire conference, he undermined the entire institution. What theyre guys doing is not the best interests of the United States of america. You want to come at me and call me a rhino you can kiss my thump your chest on, twitter yes, come to my office and i really cant believe that people like matt gaetz were so dumb to fall for this. He is certainly going to have to earn some respect within the conference. There needs to be accountability for the eight individuals who selfishly upended our house majority, and put their own interests above the country. Matt gaetz is using the American People as pawns in his narcissistic game of charades, and i think we have had enough. Yes, i guess in a way, they have to give their public view, but i think at their heart they know. This was the most foreseeable thing. It is disingenuous of mccarthy, or lets think about the motion to vacate, lets think about, this do you really think a single republican if the script was flipped would have voted to not vacate nancy pelosi from the speakership . You think Kevin Mccarthy, this was the, point as you mention in the opening, he open an Impeachment Inquiry without he went to maralago and resurrected donald trump. I mean literally, he took the figuratively he took the paddles out of the ambulance, and brought him back to political life. So i think republicans today, republicans in the house are scratching their heads, saying how do we get here, but all they have to do is think back a few months and you can see it. Do you think the next week or whether well have to cut deals with the farright members in the same way . Will they have to agree to the same one person can vacate the chair . I think so. I think the only way that changes is if we go a month without a speaker. We have multiple races, eventually people are desperate to put a speaker in. This is where i think it will get interesting. You have folks that are willing to vacate the chair, you have folks willing to whatever the demand is, and they are all extreme demands. The question is, what does this do to ukraine aid . What i really worry about is those that move to vacate Kevin Mccarthy with have no idea where she came from on this, but they have all been talking about things like regular order. To the viewers, regular order means if you are a member of congress, you should be able to bring up a resolution, or an amendment in that you get voted on the regular way of the order of business. But these are the same people now saying, they do not want to come to the floor and vote on ukraine. That would put overwhelmingly and have to get their message straight. I worry that whoever runs for speakers would have to commit to no ukraine aid and of course, i have to tell, you i think hes going to be in the seat on, this and i can get into, that but i think it is important for five or ten members of the house, near refuse for anybody that wont bring ukraine to the floor for a vote. When they do that, and probably not. Why do you think jim jordan is in the seat. Because it is all about, i think if it was a secret ballot, he went overwhelmingly, for anybody but jim jordan, but what you are going to start seeing is on the emails of the fund raising of other cable news networks, jim is now going to be the new litmus test of are you a true conservative or not . A source close to pelosi says, the move was retaliation for democrats citing against mccarthy inside the speakers vote. Rather than being petty and silly, and throwing nancy pelosi out of her office, how does that contribute to civility appear . A House Of Representatives without a speaker, paralyzed. We cant get anything done, those can be brought with us, what we can to be on the house, what we can pass an eating into law. So when the accusation came, out nobody defended, him and no one and the media would give him the time of day. All of a sudden he found fame because it was the speaker of the house back in november, and he is always stay there. Are you surprised by the personal nature of the attacks between members of the gop conference in the last 24 hours . Im not surprised. Tensions and members have been running pretty high for the last nine months. Anderson, you know, it with a small group of hardliners that are just making it impossible for us to run the house like it needs to be run. I would note just a tiny bit of amusement that one of the allegations that matt gaetz leveled as Speaker Mccarthy was, he had not passed 12 bills on the house floor yet. Part of the reason for that is that ease hardliners have been polling against bring in these Appropriation Bills to the floor. The spy, that kevin kathy managed to get 70 of Discretionary Spending through the house before the deadline, but for matt gaetz, all attention and chaos is what he sees. So some of her gop colleagues most recently who spoke with moneywatch a short time ago talked about expelling matt gaetz from the gop conference. Would you support that move . I am pretty frustrated still. I am angry. I try not to make decisions when im angry. I would counsel all my colleagues to just take a couple of deep breaths for the next couple of days. Before we make any decisions about accountability, before making decisions about who should be speaker of the house, lets make sure we are clear and focused on what can move the house in the right direction. Because anderson, if we do not the foundational problems of the oust republican conference, the new speaker is just going to be in the same old clown car, but a different driver. That will not get it done. So what are the foundational problems you see, obviously many of the things that mccarthy had to agree to in order to get the speaker job as mixed mcconnell pointed out made a job impossible. I thought it was a bit of an unfair allegation at the top of your show, nancy pelosi also had she agreed to a number of world changes. This is what happens. Nancy pelosi and Kevin Mccarthy will cut the deals the need to get to cut to get to 218, in some respects those rules made the husband or an others they made them harder to govern. Regardless of the rules. Would you be comfortable voting for either of the two most prominent candidates . I know you said you wanted to take a breather, what do you make of the names that are out there . I think they are capable individuals, but we need to do a better job of putting them in a position to win, and mccarthy is as emotionally intelligent as anybody i have ever worked with. He listened as much as anybody i have ever served with. He really found and delivered some victories that many in the media and the house did not think he could deliver. The temperature has come way down. The judge even wished one of the government attorneys a happy birthday, and the trumps attorneys even objected less to all of the questioning. So this will continue now as we get into the nittygritty of these financial, statements at the values of these properties. Anderson . All right, thank, you joining us now cnn legal analyst joey jackson and she is a Defense Attorney specialized in White Collar Crime and a columbia university. Obviously, there is the politics of all of this. Did the former president help himself or hurt himself in just legal turns . So legally, anderson, what it is about is what happens in the courtroom. This is a judge trial as we all, know you are not pandering to a jury, playing to a jury. Judges are generally well equipped in assessing what the factual issues, are and assessing what the legal issues are. Remember to put everything in perspective. You are talking about seven different, if it were indictment we would call accounts, but it is a civil case, right. We call them causes of action. The first cause of action relating to, fraud we all know where the judge stood relating to that. He issued what is called a summary judgment. A motion in favor of the Attorney General, indicating that there was persistent fraud here. So what is left to on the other counts relating to what . False Financial Statements, relating to falsifying business records. Exactly right. So i think the judge, he is a little concerned about what trump does outside of court, hence the gag order, my as it relates to the legal and factual, issues no matter what the feuding, as i think he will has his eye on the prize. Caroline, the a multiple times the lack of injury, but there is not usually a jury in this kind of trial. Well it is interesting the legal question, not to be too lawyerly like, but theres a difference between a remedy in law, and a remedy in equity. Because the statute, the cause of action that Laetitia James actually brought this case, under the one that the judge ruled on summary judgment. Because that is a unique statute that really has its real median equity, as a disgorgement, she is looking for being repaid for what the state of new york was defrauded from. Typically, there is some case law on point that would point to the fact that there may not be a jury in that type of case, however, i will, say that any competent lawyer would have had at least check the box as it were, put in that boilerplate language that we requested jury trial, this could have litigated the issue for sure. And im not sure they and the judge said that neither side asked for jury trial. That is significant, to the, point you could at least make the ask without getting into the niceties of equities, and what it is about. Ultimately, what happens in the civil trial, is theres two phases. One is to determine liability, as i noted the judge made that assessment. You have liability as fraud, talking about fantasyland and everything else. The judge will make assessments factually as to the issue of cooking the books as you mention, anderson, that is the Financial Statement fraud. The issues relating to falsifying business records, insurance, frauds but certainly if trump wanted a juror, trial that issue could have been litigated. It was not. As a result of, that you are stuck with this judge who is going to assess the facts, and only the facts. So help them. Caroline, what do you make of the case that prosecutors are presenting . There are shady dealings in new york, really, state and people pump values, and sort of have aspirational values . That certainly is going to be one of the arguments that trumps defense team makes on appeal. I think what is interesting about this case, the summary judgment, really it is half of the hole in this matter. The interesting part is that now, tish james will have to show intent to defraud, show that there is a victim in this case, whereas before on the other issue of pervasive fraud, it is really a strict liability there was this misrepresentation and persuasiveness reconcentration. The hurdle is a bit larger, now and for the state to move forward, and the criminal trial here were getting inside of ahead we saw today, they are really pounding away at the accounting, it was your fault theres a lot of Finger Pointing and terms of what was known pointing and saying it is your fault. So the point where anger was state hands on the, table saying he is not a codefendant, they are basically trying to Pin Everything on him. I think a lot of the ones that we speak to on the front line, anderson, are pretty shocked at some of the things they are hearing out of washington simply because none of them could ever have fathom that the u. S. Would be the country whose support could be uncertain at any point in time. The support has been so strong and so important, also for ukraines war effort. I think one of the things that our viewers would be surprised by if you go around the battlefield here in Eastern Ukraine is how much u. S. Vehicles are on the ground here. U. S. Guns and u. S. Ammo as well. The thing about the mlas, the ukrainians really say that with this counteroffensive they need a lot of it. Certainly, nato countries could replace some of the emails that the u. S. Has been giving, but there is also certain kinds of ammo that only american can give, like, for example himars, guided missiles are very important. Also, some of those missile systems, that stuff is only punishable by the u. S. If u. S. Support went away, it would be catastrophic for them on the battlefield. More than 27 years after rapper Tupac Shakurs murder, a suspect arrested for gunning him down appeared in a Las Vegas Court for the first time. Duane keith davis is his name, accused of orchestrating the shooting and will be arraigned later this month. There are a lot of questions about the investigation, about what actually happened and why it took so long for the man to be arrested. He had not only said he was at the scene of the crime, but in the court with the shots that killed tupac shakur were fired. I am joined now by the clark County District attorney, whose office is Prosecuting Davis for his first interview since that arrest. Steve wolfson, appreciate you being with us. The arraignment was delayed today because the suspect had no Las Vegasbased attorney. How strong is the case, do you think . Well, thanks, anderson for having me on your show. I want to start off by saying that mr. Davis enjoys a presumption of innocence like any other person charged in this country with a crime. The arraignment was delayed because mr. Davis said he had retained a lawyer out of california and we cannot arraigned a person until they have a lawyer. In terms of the case itself, is there much you can share about why you believe tupac shakur was gunned down . Well, there has been a lot of talk in the media for the last number of years, and of course recently in the last few weeks. It started with a number of admissions that mr. Davis has made over the last few years. He participated in the documentary, he coauthored a book, he gave a number of youtube interviews. So, his admissions really peaked the investigation to look more closely into what was going on. It was brought to my attention. We then executed a Search Warrant at mr. Daviss home where we seized certain items of physical evidence. After all of those considerations, we wanted to make sure we got it right, anderson. This is an important case that is getting a lot of attention, so after we reviewed all of the evidence, we felt comfortable that we should bring this case to a grand jury, which obviously agreed when they returned, and indictment. So, even after all this time, 27 years, when you did a Search Warrant on his house, or is saying that there was evidence that you will use at trial, which implicates him . Yes, a number of physical items of evidence were seized at his house that will be used. We wanted to gather as much supporting evidence as we could. We didnt want to proceed just with his admissions. Certain witnesses came forward in the last couple of years, so we felt at this point when we put it all together, that we had a Strong Enough case to charge mr. Davis with murder with use of a Deadly Weapon with a gang announcement. Police have given some details. There was this beating that occurred, a fight that occurred, in a casino where tupac shakur were there to see eight mike tyson fight. We are showing the Surveillance Video of the beating that tupac shakur and sugar knight allegedly took part and. The person who was being kicked there on the floor, that is the nephew of the suspect you now have that a grand jury has and stated. I want to play with his nephew said in 1996 and an interview, the man who was beaten, there. Were you involved in any way in the death of tupac shakur . No, i was not involved. I am like a victim. I feel sorry for him. So, i believe he is no longer alive and mr. Davis is the only suspect or the only person who may have been involved who is still alive. But he was in the car with his uncle. His uncle was in the front seat when the shots were fired, correct . That is what the evidence shows . That is true. I dont remember exactly who was sitting where, but mr. Davis was in the car, as well as mr. Anderson. Just because one of the accomplices, 25 plus years ago, says he was not involved doesnt mean we stop investigating the case.
