The bottom lane is its bad. Ill speak with one of those rebels. Perhaps the most surprising of all of them in a moment. But first, listen to two republicans who describe how tense it is inside their party on capitol hill right now. Ill be really candid. I think if we had stayed together in the meeting last night, i think you would have seen fists thrown. Im not being dramatic when i say that. Theres a lot of raw emotions right now. Yesterday was different. There was anger, frustration. Frankly, there was desperation going on. So far two candidates have officially thrown their hats into the ring for the open speakers job. Steve scalise is the second ranking republican in the house. And jim jordan, the chairman of the House Judiciary Committee and a former Freedom Caucus leader. Other names are floating around. The key Question Tonight is who can get enough votes to get that job . One person that we should note that it wont be, despite some Wishful Thinking by some of his allies, is donald trump. Yes. It is true. The speaker of the house does not need to be a member of congress. Perhaps most obvious, the reason thats spelled out in the House Republican rules. It says any member indicted on felony charges that carry a a prison sentence of two or more years is required to step down from leadership. Obviously, that would apply to trump but it did not stop him from posting a picture on social media wielding the speakers gavel. Lets get straight to the source with one of those republicans who voted to remove Kevin Mccarthy from the speakership role. Congresswoman, i want to give you the opportunity to respond directly to mccarthys criticism of you during this exhaustive Press Conference that he had last night after you voted to oust him. Nancy mace is a whole other story, okay . Lets just be honest. I called her Chief Of Staff yesterday. I called the Chief Of Staff . Well, she was on the view saying i didnt keep my word. I called her Chief Of Staff. Maybe i dont connect her with something else. I said to him, can you please tell me. I dont understand where have i not kept may word . Do you know what the Chief Of Staff said . You have kept your word 100 . But if you have a problem with the bill, i will help you. But i cant work it all way through committee. He is suggesting that you were lying when you said he did not keep his word. Whats your response . Well, number one, i would like to know why he called may staff rather than talk to me directly. And im very familiar with how to write a bill. Women in congress can draft, write, file and pass legislation. So the facts are our side. I was very public about what kind of deals and negotiations and legislation that he would back and support me on throughout the entirety of this year. Thats all a matter of public record, including the timing of those pieces of legislation. To date, none of those things came extra. So may focus today is to focus on the focus, to focus on the opportunity hear that we have as a party, as a country to come together and find a speaker who will tell the truthful find a speaker who will be honest and keep their word. You cant tell conservatives one thing, tell moderates another, tell democrats something else. Thats not leadership. Thats not building consensus if you tell everybody different things. So we have a lot of work to do. We have to roll up our leaves and im very much looking forward to the speakers race next week. Ill met with every candidate that throws their hat in the ring. We promise to be responsible with Taxpayer Dollars and this is our opportunity to show that kind of leadership next week. I want to look forward. I want to bring the Party Together and find a leader that we can all get behind. Do what we told the American People to keep a speaker that will keep their word. Do you think whoever is the next speaker will be more moderate than mccarthy . I think the most important thing is that we get someone who will be honest. Who will keep their word. If we say were going to follow the law, there is a law from 1974, the Budget Impact and control act that says were supposed to have a budget. Were supposed to have 12 separate up or down spending bills. Thats good for the country. It is also good for both sides of the aisle. Because leadership will often, as you know, they skirt the law. They dont want to give the power back to the people. A select few, the most powerful, have all the say. They take that power away from the people and they avoid the law. When they avoid the spending bills. When we do the bills, theyre vetted through committee. You have time to read them and it is a full house process. Thats how the Constitution Works and it is good for everybody. Thats not an unreasonable ask. Im asking about womens issues, oversight, things that make sense to everybody on both sides of the aisle. Are you concerned that youll be expelled from the republican conference or kicked off your committees . Well, certainly, the eight of us that voted this way, if you want to have the gavel, if you want to move forward united, youre going to need our votes. I think if we look backward and punish people based on their principles, thats only going to further divide our conference. We have a lot of work to do. We promised the American People we would deliver results and we need to do that. I dont judge my colleagues for their votes or what their values are, or their principles are. Ive said it on your show. I am willing to work with anyone who is willing to work with me. So youre not worried about it. That means moving the ball forward. I am not today. I made my decision to fundraise over the last 24 hours because of the threats that i have received over fundraising and money drying up, which is why i need help. The people, the establishment is coming of a me. Ive gotten a lot of threats from different members that they will withhold fundraising no matter what and i do need help from the people. When it comes to who is going to be the next speaker, one thing that weve heard from some members, republicans, is that they want to reform the whole motion to vacate. It can be one vote to move to out of the speaker. Do you think that should stay as a house rule . It should stay as a house rule. This has been precedent for over 100 years until nancy pelosi changed the house rules when she was in charge. By and large, this has been around for over 100 years. Rarely used. And there is precedent in the house for having it as a rule. And again, this was a commitment that was made earlier this year. For my perspective, i care that womens issues, i care about balancing the budget, and i care about following the law. And following our rules. When you look at what happened in washington last night, where this is going, how does the paralysis in the house affect your ability to function in the senate . Well, weve seen it already. Weve seen deals get done when it comes to mccarthy and schumer and Mitch Mcconnell and the president all agree on a big spending deal. Because of the, sort of intrans intelligence of a very narrow extreme minority, part of the republican caucus, the right wing, then mccarthy betrays the deal and walks away. It brings a lot of frustration when we are passing appropriation bills, getting things done in the senate in a bipartisan way, to have to come over hear. Even though theres a bipartisan majority for a lot of the common sense things americans need. To fulfill the full faith and credit of the united states. Mccarthy is unable to get it done because hes catering, or at least unable to get it done because hes catering to the small extreme minority. If hes unable to get it done, are you worried about what the person does who will take his place . Yeah. Im very worried. When you see a party who says, lets find it in the middle. Lets do the urgent things we have to do right now. Supporting ukraine and defending itself by this outrageous authoritarian invasion. Funding our government so that we can invest in the things from science and research, all the way to infrastructure and health care that we need to invest in. And doing the kinds of things we should be stepping up and doing together in this country, which frankly, 70 of americans agree on. So have this government be run by its extreme, a tail wagging the dog, is absurd to me and not just me but republicans in the house as well as the American People. And at least one of those is against supporting ukraine. Do you believe the aid to ukraine is in doubt . It is unclear, the democrats and republicans in the house, the Majority Stand against authoritarianism and for freedom. I know in the senate, the majority of us, republicans and democrats believe in standing with ukraine. Standing against putins unjust war and understanding that we dont stand here, the cost will be extraordinarily more expensive in the long run. We agree in the majority here. If the whole government will turn on a handful of people whose allegiance is not to america, not to freedom, not to democracy but to donald trump, theyre going to find ways to tear the house down if they dont get their way. Yeah, then we have a problem. It is existentially important that we stand with ukraine right now, we stand with democracy, we stand with freedom. If it was good enough for republicans when Ronald Reagan stood up against the then soviet empire, and said we are going to stand strong as a nation against this kind of authoritarian rule, it should be okay for todays republican party. Are you willing to hold up any bill that comes to the Senate Without that funding for ukraine in it . I have never seen the kind of resolve in my caucus, and i wish there were Public Meetings to see the passionate speeches given across the spectrum of may caucus in the senate about how the urgency we all see, people have quoted history, people stood up who had relatives who survived the holocaust. The speeches ive heard and the private meetings in the senate are so strong and in support of ukraine. And i know from talking to my republican colleagues that theres a strong support there as well. So i have every confidence that we will do whatever we have to do to fight to make sure ukraine funding happens. It happens in a way that gives them the unbroken resources they need continue to repel this russian invasion. Yeah, Senator Mcconnell has made that clear. Hes a republican. On a subject deeply personal to you, you have called on your fellow new jersey senator bob menendez who is facing Bribery Charges to resign from his position because of those charges. Today we have learned his wife, before she was his wife, was driving a car in 2018 in your home state of new jersey when she struck and killed a pedestrian. Police questioned her. They concluded she was not at crash for the crash. The New York Times said she was never tested for drugs or alcohol and that crash is now at the inception, allegedly according to the indictment, of a bribe the couple has been charged with. Are you disturbed by this new information . What do you make of it . I want to start where you started. Ive served ten years in the senate this month. And ive served alongside bob menendez and found him for ten years to be an extraordinary senator. And this indictment, when you read it, this sort of shocking things that are in that. They do not comport or cant be reconciled with the person that i know. I felt like i made the right decision in affirming his innocence until proven guilty, but believing he should step down. So now theres an Ongoing Investigation. There will be a lot of things that theyll be looking under and looking into. The situation youre talking about, a human being died. When i read the article, it is a tragic incident. At the time, again, there were authorities on the screen that made determinations that i know will be further examined under the light of this indictment. So im focused right now as not just being one of new jerseys senators, but bob menendez said he is not stepping down. So finding a way to make sure that my state continues to get the benefit of the work that we do here amidst this Ongoing Investigation that im seeing with this, there might be more revelations. Do you have any concerns of whether or not he was involved in this 2018 incident . Again, i know what ive read and i know there will be investigations. And again, im a Firm Believer, as much as ive called on him to step down. I am also a Firm Believer that people are innocent until proven guilty. The authorities will investigate this and im sure a lot more. And he has pleaded not guilty. His pledge to make his case in court. What he was indicted on were Corruption Charges over accusations that he second bribes to help egypt obtain military aid. You were on the Senate Foreign relations committee. Do you agree with senator cardins decision to block more aid for egypt at this time . Absolutely. Im one of those folks who believe that Human Rights Concerns involving the Civil Society in egypt is a critical issue that we should be doing more to pressure a resolution to. This was nothingng more than a political stunt. A fundraising stop. Speaking of fundraising, Trumps Campaign says it raised more than 45 million in the last quarter. Obviously, a massive number there. Im joined by cnn legal analysts. Ely, lets start with what happened in the courtroom. The reporters there said the judge was getting quite frustrated at times with trumps attorneys and their line of questioning for a long time accountant. The justice at one point pounding his fists saying this is ridiculous. Do you think they have this this line of questioning as a delay tactic . I think this is the difference between having a judge trial, as we have here, and a jury trial. I think they were trying to make a point to undercut this accountant who was the Attorney Generals first witness. In front of a jury, you want to drive a point home so you may want to ask the same question over and over and over. What the judge is saying, there is no jury here. You dont need the dramatics. I got it. I get the point. And thats what caused donald trump to throw up his hands in frustration. The judge is trying to find the sweet spot between allowing trump to defend himself but not allowing this to drag on forever. And there is no jury in that room. Trump has been complaining about that every time. His attorneys say that wasnt an option here. I think the judge caused some confusion when he said neither side asked for a jury. Can you remain us why there is no jury . The ag filed their form saying they were not asking for a jury trial. If they did, then trump could have filed a form saying we want one. When youre asking for equitable relief, which is mostly what the Attorney General is asking for, then youre not entitled to have a jury. There is an outside shot they would have gotten it but most believe they wouldnt have been entitled to a jury. It was a mistake that really cost them and trump has been there three days in a row. We dont expect him to go back maybe another time in the trial but not tomorrow since hes back in florida. He doesnt actually have to be there. His presence is not required. Hes complaining that it is keeping him off the Campaign Trail in South Carolina or new hampshire. Why do you think he is there . A great question. It could be political theater. Ordinarily, you would want your client to be there in the courtroom. A, so they can help you with your case. So you can lean over to your client and say, is that true or not . Also, normally want to show with a judge or a jury, theyre not ghosting you. Ill tell you when he will be back. When he testifies, if he testifies. He said he wants to. He can actually be forced on to the stand because this is a civil case. And we can see him back. Next time we see him back he may be in the witness stand. Which would be really remarkable. Its not like were not hearing from him because hes basically been speaking nonstop. The judge took the step of issuing a limited gag order saying dont even mention my staff but certainly dont attack them after he was making some pretty gross conflicts about the clerk. The judge said he would give sanctions if trump breaks that. He will issue fines. Its theirettally possible down the road, if you do it again, ill hold you in contempt. I if he does it again, he will fine him. If he does it again, hell fine him more. Eventually hell either stop or have to take the next step. If hes not attacking, he didnt go after any clerks today but hes still attacking the judge. The rules that the judge has set is you cant go after may staff. And i think thats the right move by the judge. These gag orders arent meant to enforce manners. You dont have to be nice. Tell judge is right to say, you can criticize me. You can criticize the ag. You sign up for that when youre a judge or a prosecutor. But dont go after may staff. And i think that was an appropriately narrow gag order. If trump does verify that, i think the judge will come down on him with a severe financial penalty. Thank you. Stick around. This comes at a time, not really the best for giuliani as he is facing criminal charges and owes millions of dollars in legal fees to other lawyers who have previously represented him. What has been his focus today . Not any of that. Instead, he is pushing back on a report in the New York Times that details giulianis alleged Alcohol Issues and why jack smith is now said to be asking questions about it. I have an alcohol problem, i should be in the guinness book of world records. It is a typical New York Times malicious lie. I do not have an alcohol problem. I have never had an alcohol problem. When the hell was i drinking . I was working 24 hours a day. It is a big damn lie. Giuliani also went after President Biden today, alleging in a new lawsuit that President Biden defamed him by calling him a quote, russian pawn as he did in the president ial debate. He said, your buddy, Rudy Giuliani, he, then he said something we cant understand, bla bla, like he does sometimes, is being used as a russian pawn. He is being fed information that is russian thats not true. Im trying to give you the flavor of it. You can go listen to it yourself. Yeah. I can tell you in the time that i worked for him in the early 90s, i never saw him drink. I only saw him drink diet coke. Thats my frame of reference in terms of his alcohol consumption. Ive seen him at the cigar bar on occasion that closed in 2020. I saw him have a drink. A casual drink with other people. So i wasnt in the room when he allegedly told trump, just say you won, you know, drunkenly. So it was very good reporting, i must say. A lot of sources, most of them anonymous. It was well researched and reported. They kind of look into this window. They note that. And they look into the window where it was amplified. Some of them are not anonymous that are not on the record, talking about this. They do believe it is part of what were seeing today. The grand scheming. Can you imagine trump saying that under the advice of drunken counsel, i won the election . That sounds like what the defense will be. Thats why it is legally relevant. I was listening to the advice of my lawyers and it was reasonable. Wasnt outrageous and i had a decent basis to rely. On if hes visibly or detectably drunk in a way that jack smith can prove it, really undermines that. To remind everyone, given the news cycle we live in and how this happens, this has been confirmed that he was drinking on Election Night at the white house. This is jason miller. He was asked about this in his testimony. This is what he said. The mayor was definitely intoxicated but i do not know of his intoxication when he spoke with the president. Who will sign on with a guy who doesnt pay. When you look at this Defamation Suit that he has filed against President Biden, what do you make of it .
