Right now in talking to medical examiner, theres palpable tension, particularly among allies which most of the republican conference, which was aligned with speaker mccarthy, the former speaker mccarthy, criticizing the members who held out, those eight republicans who decided to side with democrats, kick Kevin Mccarthy out of the position here. The question is can they agree on a candidate, a new candidate who will lead them, but in talking to members, theres a lot of bad will within the conference and a long ways to go before they can get behind a consensus candidate. Those eight people are anarchists and kcaucus members, and they get their power with the democrats voting with them all of the time. They have demands that nobody can meet. There are too many people who are willing to lie to our own voters, they refused to deliver, well, explain the mechanism by which that delivery would have occurred, given the political reality we live in. Its very dishonest. We believe is best for the country, and i will say theres been a blow dealt to the status quo. I think this is a step in the right direction. Reporter so there are still some questions about who exactly will run for the next Speaker Of The House. There are several people who have been making phone calls to sound out their colleagues to see whether or not they have the support to replace speaker mccarthy. Among those people in particular, Steve Scalise, the current number two, the House Majority leader. He was once seen as a person who could run here, and the House Judiciary Committee chairman jim jordan who told me yesterday hes open to the possibility of running. He didnt rule it out. Hes signalled to his allies he could be open to the possibility of running and, kevin hern, a member of the republican study committee, the largest conservative group in the house. He has been talking to colleagues as well. Others could emerge, patrick mchenry, the interim speaker, a possible candidate as well. I may have to figure out the other candidates down the line. Something that the current republican whip could potentially go for. The big question is who could get 218 votes in the house. That will all take place next week. First, the House Republican conference will nominate someone to be the next speaker. That requires only half of the House Republican conference, but then someone needs to be elected speaker, and that requires half of the whole house, 218 members, and with republicans that means that their person will face the same issue that Kevin Mccarthy did, can only afford to lose four republican votes on any Party Line Measure which means the new speaker candidate, kw whoever that person may be, will have to assure that the hard liners are appeased and moderate members are appeased, theres an enormous amount of frustration, getting to consensus will be difficult for whoever the new speaker candidate is, guys. Trump pushed mccarthy across the finish line, securing some final votes by calling lawmakers and publicly endorsing mccarthy. But now, ten months later, mccarthy is out, thanks to fellow republicans who are big trump supporters, and congressman matt gaetz is now suggesting that he had the backing of the former president. My conversations with the former president leave me with great confidence that im doing the right thing. Cnns Alayna Treene joins us now. What are you hearing at this point . Will donald trump weigh in to all of this in a bigger way . Reporter well, actually, sara, we just got word that the former president as he was arriving for his Third Straight day for a civil trying in new york city, he did mention briefly what is happening in congress. He said that they have a lot of good people in the Republican Party, and kind of left it at that. A very vague statement x. Thats in keeping with his posture the last few days. Ive spoken to many of Donald Trumps advisers and allies over the past 24 hours, and they told me that he purposely did not want to get involved in the Power Struggle in congress. They noted that, one, donald trump has a lot going on himself right now. He obviously is attending his civil trial but also focused on his 2024 race. Also, the other fact is he had people who endorse him and support him on both sides of the speaker fight. Of course, matt gaetz, the republican who led the effort to oust mccarthy is a donald trump supporter. He endorsed him, and hes a surrogate for his campaign, but you also have a lot of people who backed Kevin Mccarthy and did not want to see him removed from his speakership who also endorsed donald trump. And so really, they told me that they didnt see a lot of political up side to trump getting involved in this. I have one quote from a trump ally that Encaps Latulates how president is thinking about this. He cant be sticking his neck out whenever theres a fight in the house, especially when you have people who endorse him on both sides. Thats where the former president stands on this. As you mentioned, sara. Its a stark contrast from what donald trump did back in january. Of course, mccarthy was going through his 15 rounds of voting in order to secure his speakership and the gavel. Donald trump came in in the 11th hour, and Kevin Mccarthy won. Yelled he did not go into speaker fight with donald trump. And we saw him ultimately get removed from office. Well see what happens next with chaos, chaos, everywhere in congress. So donald trump is not in a great position to weigh in on this fight. And Kevin Mccarthy should not have expected his loyalty to trump to go both ways. Thats never the case. I mean, after he reversed himself on january 6th, quite possibly. If Kwevin Mccarthy is even in te game of politics with any real influence. And patrick mchenry, the pro tem speakers first item of business was to email speaker aemeritus nancy pelosi to vacate her office. All problems have been solved and function has been restored. I had democratic member of Congress Annie Custer on last hour, and she was saying that she hopes what emerges from this is maybe some consensus. Maybe republicans will decide to put a moderate candidate forward who can get the support of the caucus at large. There are certain things that donald trump has been told that he can not say or write about about certain people involved in the court, and we are waiting to see if he abides by these new rules. Reporter yeah, john, as always, the former president before he walked into the courtroom for the start of day three, he did make some comments. As you just noted, he was a little more careful this time, all because of the gag order that was issued by the judge here after that personal attack, the judge called it, from that truth social post that donald trump made yesterday. It was a picture of the judges clerk, identifiable of who it was, in a picture with Senate Majority leader Chuck Schumer saying without any evidence that she is schumers girlfriend. That was really a bridge just too far for this judge. He issued this rebuke against not only the defense but everybody involved in this case to not issue anything publicly about anyone on his staff, whether it be, you know, in comments or on any social media saying personal attacks of any member of my court staff are unacceptable, inappropriate, and i will not tolerate them, and he said there will be strict sanctions if those are broken. Its unclear what he meant by that. He hasnt issued a full order, we do know both parties did go back into the courtroom after everyone was told to leave. So things clearly were discussed. As for now, we have the defenses former accountant, rather on the stand getting cross examined and as we noted, the former president sitting there, and hes engaged. He has been gauged the past three days of testimony watching this unfold as he is really trying to, as he says, protect his brand because a lot is at stake. It is in jeopardy, his brand, at the end of this threemonth trial. Important to note for the first time weve heard from him says he wants to testify. Well have to wait and see when exactly that will happen, whether it be for the states attorneys or his own defense. It is something he has claimed before in many of the various cases against him. And it usually doesnt quite happen the way he pledges it will. We will wait and see. Brynn gingras great to have you there, thank you very much. With me now is cnn legal analyst, and former federal prosecutor, jennifer rogers. Well start with this case, the gag order. The judge talked about sanctioning. What does that mean . What can he do if donald trump does not follow the order to stop attacking his staff . I think the first step will be fines, right, which really will hit trump where it hurts. This judge has not been afraid to do that before. He fined him 110,000 for a discovery violation. In theory, if it goes in, he could find trump in contempt, if there are repeated offenses. In a civil case, though it would be unusual, he could theoretically jail him. The most likely are fines, escalating fines, every time theres a violation until it stops. I want to move to the Election Subversion Case in georgia. Were learning that several defendants in that case have been approached by prosecutors to try and make a plea deal, and thats what sour soces are tell us. This is a normal course of business for prosecutors trying to work out deals. What would this look like . How does this work . Absolutely its normal. They need to get a lot of defendants out of the case if they have any hope of doing just the early trial next month, and then one more trial they need to get down to six to eight left, some with Cooperation Deals if they think their testimony may help, others with a cheap plea to get them out of the case and narrow it town. Theyre going to be focused on the trial happening next month. If they can get the two defendants pled out, all the better, the pressure is off or looking to cooperate people who have the best testimony against s s Sidney Powell and ken chesebro. Donald trump is not one theyre trying to make a plea deal with. Those were potential coffee county, the folks that are not high profile. I want to ask the things they need to be offering. Theres one person who has said yes, im taking the plea deal, and going forward. What needs to be offered . They will offer what they offered the one defendant who pled out, a nonrico plea. They offered scott hall misdemeanors. Thats one way out from the rico. When you talk about the rico, the penalties are high and you look at jail time. To get lower level people out, i would look for more misdemeanor plea offers, something outside the rico to get them out of the way. I want to move on to something that really strikes a chord here because it was something that pomdpped out. The New York Times reporting that prosecution is looking into the Drinking Habits of Rudy Giuliani, and if we have that picture of the times. You know, you look at this, and im questioning why are prosecutors looking into this. Giulianis drinking has trump prosecutors attention. Why. What are they looking for in this particular incident . Well, one issue is the intelligent. Right . Anytime youre prosecuting someone, you have to prove they intended to do what it is you allege they did. You might rooej Rudy Giuliani, i was too incapacitated. I didnt understand what was happening when i interacted with these people. Thats one issue if theres a possibility of that being a defense, prosecutors are going to want to look into it themselves to counter that narrative. Is there also the issue of donald trump, if he knew that he was inebriated he knew one of his members of his counsel was inebriated, that could play a role here. Anytime you have that issue, an issue of whether someones doing something with their full faculties, youll want to explore all of the options, i think the prosecutors position is that he shouldnt have been relied on refugee Rudy GiulianiNo Matter What state he was in. But sure, theyll want to play out everywhere that takes them if they decide that someone actually truly was incapacitated and wasnt able to act. Every possible scenario theyre trying to look at. The next person needs to meet that threshold. But i will say that i think we have to find someone who is capable of bringing us together to focus on governing, to actually deliver for not only the American People but for the people that i represent in upstate new york. What did you think of the advice from your fellow new yorker, from Chuck Schumer saying not coddling the hard right is what is needed in the next speaker. While you agree on very little with Chuck Schumer, would you agree on that . Well, i would id suggest that perhaps that advice could have been given to democrats yesterday when we had the opportunity not to upend the entirety of congress. I mean, truly, democrats could have joined with Reasonable Republicans like myself to not undermine congress and to oust the speaker. Remember, i think the senator referred to republicans kicking out the speaker. Well, no, eight members used a tool that should be used very carefully. They used it, i think, very callously, and instead of being lectured by the senator, it would have been helpful, i think, for democrats to respect the institution and not engage in an effort to undo the republican leadership. Congressman, excuse me, the control room is just telling me in my ear that cnn is learning that jim jordan is speaking out saying that he is going to run for speaker. Would you support jim jordan . There are a good number of members, you know, Steve Scalise is considering this. There likely will be others. I spent the last ten days in the room negotiating with members whom i agree or disagree. We talked about this last week. Ive built some relationships and i intend on behalf of new yorkers and on behalf of Upstate New Yorkers to insist that kw whoever wants my support works to earn it and the people i represent have a seat at the table. I welcome all comers but at the end of the day, whoever wishes to lead this conference needs to be focused on governing, needs to be focused on delivering for the American People and building consensus among a conference that clearly needs structure and needs to be focused on making progress. Does jim jordan have those attributes . Is jim jordan cableable of that . Thats up to him to explain to all of us. Im not going to discourage anybody. We have to have a conversation. What we experienced was eight members who used a tool callously, thats not the way to build consensus. Whether its jim, steve or anyone else there needs to be a commitment to focus on the issues that the people i represent care about and delivering for the American People, not engaging in petty politics. Its what most americans get very frustrated with. Have you i dont know if this is a wild question or not but have you tried to speak with matt gaetz who you put this squarely on . Have you tried to speak with him since this all went down . Ive not had any conversations with him since yesterday, but lets be clear, i mean, im willing to talk to anyone. I had some very heated conversations with some of my democratic colleagues yesterday and even today. The reason i ask is im hearing from some republicans similar to you saying that a reckoning is needed, and that accountability is needed for those like matt gaetz and the others who voted to oust Kevin Mccarthy. Do you think they need to be held accountable . What does that look like to you . Yeah, i think there needs to be accountability, but i think that that is something we need to address within the conference. I believe that we need to confront the rules that make it too easy to use a motion to vacate as some sort of weapon. I do mean this, the people i represent are tired of the pettiness, they dont want this kind of political back and forth, this gamesmanship that doesnt produce anything for them. As a conference there needs to be accountability, and to the American People there needs to be accountability and thats got to be focus of the governing majority and next Speaker Of The House. You acknowledged on twitter that Kevin Mccarthy was a big help in getting you elected, fundraising for you even just recently. You well know that youre a top target of democrats this coming cycle. Heard from steve womack one of your colleagues saying that he is concerned that what has happened amongst republicans just now could threaten that republicans could lose the House Majority because of this, are you concerned about that . Whether im concerned or not, that is a true statement. Yesterday congress was undermined. The House Majority was undermined. And america was undermined. Thats a reality that will play out in districts like mine, and the truth is no one person worked harder to earn my support to be Speaker Of The House than Kevin Mccarthy, and so now moving forward, whoever wishes to earn that support, you know, really has seven days to work at it. I mean that sincerely. This isnt a coronation. This isnt a game. Absolutely not. But when it comes to people the people i represent deserve to have someone whos serious about delivering for them. And you have always made the point to talk about that you very earnestly will work with folks across the aisle and will work with anyone to try to come to con sensus. I think that hes certainly going to have to earn some respect within the conference, and i just wont engage in the kind of, you know, personal back and forth that i know others want to, but, yes, there needs to be accountability. Reporter well, the search for suspects continues this morning. I have been talking to the Baltimore Police department and they have offered really no update on whether they have any suspects, if there may have been multiple shooters in the case or if this was random or perhaps targeted. We just dont have that information yet at this point. I did just get off the phone with the media team for more began morgan state university. They wanted to reassure that it is safe to go about their business. There is no reason to believe that there is any ongoing danger. And then the search for the gunman unfolded. They combed through buildings, students being told to shelter in place. And it is particularly difficult because this is the Third Straight homecoming here at morgan state that has been marred by gun violence. Shootings the past two years that injured one person each. This one even more serious, five people injured, and still at this hour Police Searching for the shooter. It is so disturbing that this is happening on a campus yet again.
