Shutdown is all but certain at this point. Republicans in the house failing to pass a short term measure to fund the government, but the House Speaker says he has other ideas. House republicans are expected to meet here in the next hour after their leader just suffered his latest defeat. The short term Spending Bill voted down. He did not get enough republican support. There is now less than 34 hours for congress to approve new funding and while the senate short term option is a bipartisan deal, it too is not likely to pass before the saturday night deadline. A shutdown would freeze the pay for about 3. 5 million federal workers and it would also impact air travel, impact tax return processing. Food and workplace inspections, some child care and a whole lot more. We have Manu Raju On Capitol Hill for us. You had been sort of bugging the speaker about what his plan was after this 30 day short term funding bill failed. And it sounds like maybe smuf answers now. Whats going on . Reporter well, he has indicated he may give more information to his conference Behind Closed Doors when they are poised to meet at 4 00 p. M. Eastern. Just within an hour or so. The speaker will i asked him are you going to reveal your next steps and he laughingly said no, im going to keep it a secret. So suggesting that perhaps well finally get a sense of what he plans do. There have been a lot of ideas thrown up, but it is clear talking to his closest allies they are in the dark about what the Speaker Plans do next. This is significant because depending on how the speaker decides to go, it could lead to a Government Shutdown, perhaps there could be an 11th hour deal to overt a Government Shutdown or perhaps there could be a challenge to his own speaker ship. Just happening moments after the speaker still pushed ahead to try to get a republican only plan through the house to keep the government open for about a month, but that failed. Opposition from 21 house republicans, mostly on the far right, didnt go far enough in Cutting Spending but democrats voted against it because they believe it went too far in Cutting Spending. And so now that that is put to the side, what happens next is the big question. The senate is moving on its own track though they are still slowly moving through the procedural hurdles to get to a final process, a final deal potentially by monday after the shutdown deadline. The speaker has already said he opposes the senate bill because it doesnt include issues like Border Security and also doesnt cut spending the way he wants and includes aid to ukraine. So those are major issues that they have to reconcile. And if the speaker does move forward on a bipartisan deal, perhaps the only way out of this to get a bill out of the senate through the house and signed into law by the president , if he goes that route, then he could face a challenge from the far right. Members who are threatening to oust him if he were to actually cut a deal with democrats because one member could call for a vote seeking his ouster and this that threat remains over the speaker even as he has brushed that aside. So so much riding on the speakers next move. Well see what he decides to tell his own members when they meet Behind Closed Doors in an hour. All right. Manu raju, thank you for the latest reporting there. Government shutdown would hit military families especially hard. We know this. If it happens, it would mean that more than 2 million active Duty Service Members and reservists would be forced to report for duty and they wouldnt get paid. Im joined now by john kirby, National SecurityCouncil Coordinator for Strategic Communications at the white house. I first want to ask but this, of course you are familiar with what military families go through when it comes to a shutdown. You retired as a rear admiral. Is the white house working with anyone on the hill to make sure that the military will get paid in the event we do have a shutdown . Because it looks like we will. To the degree that we can keep them paid, we need to get the Appropriations Bill. So were urging members of congress and folks in touch with members of congress about what they can do to get the Appropriations Bill to the president s desk so he can sign it so that there is no reason that the troops would have to have a temporary measure that they can continue to serve the country and get paid. Sometimes there is a carve out, so it sounds like no carve out respec out, it is all together. I know of no specific carve out. We want the troops to get paid obviously, but what we really want is a proper Appropriations Bill for the spending of government. So should democrats throw mccarthy a lifeline if he ultimately asks for one . That is for members of congress to decide. That is not something that were going to take a position on here at the white house. What needs to happen, conversations that need to happen, meetings that need to happen, decisions that need to happen, are between Speaker Mccarthy and this very small minority, the extreme republicans in the House Of Representatives in his own ca caucus. That is where the Negotiating Trade Space seems to be and that is where he needs to put his energies. There is Republican Opposition to funding ukraine. You are well aware of this. It is growing in the house. That is by the way also a reflection of American Public opinion. We are seeing that in our polls here at cnn. How long can you realistically keep up this level of funding that has been for the war in ukraine . Well, we have enough appropriated funds that have not been spent on aid to ukraine to get us through coming weeks. I couldnt give you an exact date on the calendar of when it would run out because it would depend on how you parcel it out and what Weapons Systems you are providing to ukraine. So we do have unspent funds that we can continue to work on past this weekend. But we asked for 13 million in the defense related stuff for ukraine just to get us through the First Quarter of the fiscal year in the fall and it is a critical time because this is when they have a few, maybe six, eight weeks left of good weather before the counteroffensive will be harder to fight. So this is a critical time to have that funding. So how long . It will depend on what Speaker Mccarthy is able to do here. But any additional funding for ukraine is going to be welcome, it will be used and well appropriately apply it to getting them the capabilities that they need. But if we dont get it, one thing is sure, that they wont be able to get the kind of capabilities they need to fight the counteroffensive and it comes at a critical time and it could result this leaving Ukraine Forces high and dry as they try to reclaim territory all throughout the east and south. So do they have a plan for when this may run out, this funding . I think that i dont know if you heard, but the comptroller at the pentagon talked about this a day or so ago. Again, weve got enough for coming weeks no, no, i mean do you ukraine, and this what im really speaking to is that ultimately it seems that there may not be an appetite long term for this funding. Do you feel confident that ukraine has a plan for if they run out of this funding that they have been counting on . Ukraine is very dependent on the support from International Donors all around the world. The United States is the leading donor, leading contributor to ukraines selfdefense needs. So they very much need american support. And people look to us for an example too. There is more than 50 nations doing this. If the United States just pulls the plug on them, it could affect the will power of other nations to continue to provide support for ukraine. So ukraine is very much dependent on all this international support. And again, it comes at a very critical time. She broke through so many glass ceilings. What are you going to remember her most for . Certainly for being the first. The first woman elected mayor in san francisco, the first u. S. Senator from california, the first Intelligence Committee chair, the first Ranking Member on the judiciary but what i remember about her most is her grit and gumption. She never shrunk from a fight. She was just a baby senator when she took on the nra and got an Assault Weapon Ban passed for the United States for a period of ten years. So just a remarkable life. She was a personal friend and a mentor. We shared, you know, many experiences together both in tragedy and in happiness. And she is just a great loss for all of us. There are some interesting parallels in both your lives, facing violence specifically gun violence, and you mentioned her work on that 1994 Assault Weapons ban. She tried to get it passed again after the Sandy Hook Massacre in 2012. It didnt really go anywhere. There wasnt an appetite for that kind of legislation. Im wondering from your perspective which issue will she be remembered for championing most, is it Gun Control Legislation . I think that it is a number of issues. I think that the Assault Weapon Ban, i think the torture report really laid bare egregious activities of the cia and military with p. O. W. S, and i think her work on conservation, her work with lake tahoe, her work creating the Largest National monument of desert lands, some 7 million acres. But there is a list that goes on and on. And something that stood out to me about the reaction that weve seen on capitol hill is the bipartisan nature of the praise for senator feinstein, especially maybe im cynical, but especially stunning given the acrimonious nature of the debate right now, backdrop being a potential Government Shutdown. What does it tell you that so many people from both sides of the aisle spoke so highly of her . Well, because she really was someone who was not afraid to cross the aisle to get legislation passed. She was not afraid to negotiate and was not a purist. She would work with the other side to get measures passed. So you know, in some respects it appears almost like a bygone era that we cant afford to make it a bygone era. So hopefully part of her legacy will be a return to bipart bipartisanship. Congresswoman, she also leaves behind a very big vacancy and Governor Newsom is now tasked with filling that vacancy. There has been some debate about who it should be. What qualifications do you think are most important to now fill her enormous shoes . There is an active Campaign Going on to replace her in california. He has already mentioned that he would like to have a caretaker in that post. He has also mentioned that he would like it to be an africanamerican woman. It has to be someone who can hit the ground running, who knows the system, to be able to provide the leadership we need for the next 14 months. Second Republican Debate where donald trump was not. Could this be a potential s selffulfilling prophecy for some of these candidates if they decide not to invest in california . It is further down in the list of states that are doing primary voting. Yeah, if you are a candidate not named donald trump, you arent probably very focused on california just yet because the path to actually take on donald trump is going to come first in iowa and nevada, south carolina, new hampshire. But trump and his team have done something savvy here in the sense that they have showing us i think, you can tell me if you disagree, but they are a bit more of an organized operation than they were back in 2015 and 2016. And so they are playing a bit of the inside game as well. And one of the things that they have done in california is to try tole after the way delegates get allocated there so that if somebody gets more than 50 of the vote, they win all the delegates. That is a savvy move. It has caused desantis operation to pump the brakes. But they are all in on iowa and new hampshire. That is where they see their best chance at stopping trump from steal rollim rolling to th nomination. And there is a new report about the conservative antitrump group. They spent 6 million in iowa and south carolina. They tested all these different ads, attacking trump on a variety of issues, and none of it seemed to work. In fact some of these ads actually boosted trump. Yeah, so it really goes to show you why this race has been so difficult for his opponents because they cannot figure out how to attack donald trump and neither could this group. This pac was started by david mcintosh, a fiscal group of conservatives who used to side with donald trump and now they are mortal enemies. But what you are saying is correct. Almost nothing they tried was actually affect deffective. They hit him head on, they say nice things and then time to move on, but nothing seems to be working. And his polls go up. So i want to show you one example of the ad in iowa that they ran, and ill tell you what happened with it. I would have to say that donald trump did a great job. I always supported him. I supported him in 16 and in 20, but i didnt like his response to covid. I thought probably got led a little bit by the bureau krat. Okay. I want to read to you what they said about this ad. This ad was our best creative on the pandemic and vaccines that we tested in focus Group Settings but it still produced a backlash in our online Ran DemocratizedControl Experiment improving President Trumps Ballot Support by four points and Net Favorability by 11 points. That was an attack ad. And then they did a focus group and it improved his likability or Net Favorability by 11 points. Now, they to say that there are some things that these candidates can do to try and get through the centrally support for donald trump and this is one of those things they say. They say essentially to disarm the viewer, you have to have this opening of the Ad Establishing that the person did support trump, they do think that he did a good job when he was in office but time to move on. But even in that ad, he says it at the top that he likes donald trump yet still it had the complete opposite effect. Again, it goes to show you how hard this is, an Uphill Battle for some of these candidates. And we should note the timing of these ads. When you talk to strategists about trumps dominant stature in the race, he has dominated the information. There is Little Information about the other candidates that break through because of the indictments. Not only is he dominating the headline, but hes been indicted and so his supporters are rallying around him. One thing that the other campaigns are watching, now as all the sort of trials are getting set and he is not under indictment on a monthly basis now as a new thing, if he starts receding a bit in terms of the constant Information Domination and there isnt that Rallying Effect anymore and does that provide an opening as we head into the voting season for some of the others to gain traction, we dont know the answer to that. That is one other part that is so confusing. Even though he is taking over some of the Media Attention sucking the octxygen out of the race, but they say talk about trump fatigue. But yet again that is also helping people get attention and having supporters rally around him with all the coverage. So it is very unclear how exactly this ends up working. And what works. Quickly, david, have you ever seen an Attack Ad Benefit a politician . Sometimes an Attack Ad Benefits like a third politician, right . Like attack ads work. But usually there is some backlash on the Person Lauchblinglaucnching the attack, but sometimes somebody on the Sideline Benefits from it. Were expecting a Press Conference at any moment from officials. Josh campbell is joining us live, he has breaking details on what happened. So josh, take us through it, what led to this arrest . Reporter yeah, boris, so for nearly three decades there has been this looming question who murdered tupac shakur. The answer has been the subject of endless speculation. Even conspiracy theories. But were learning that suspect associated with that case was taken into custody today by police in never he never. He is dwayne keffe davis. He is a self described witness to the murder. Going back to july, police in nevada searched the residence associated with davis and carted out computers and iphones, hard drives, also a memoir that he wrote about life in a street gang and describing the Murder Of Tupac Shakur. So all of that evidence could possibly have come into play here and actually leading to his arrest. Josh, well go straight to that Press Conference in las vegas. Lets listen in. 27 years. For 27 years the family of tupac shakur had been waiting for justice. We are here today to announce the arrest of 60yearold duane davis, aka keffe d, for the Murder Of Tupac Shakur. He was arrested this morning by My Criminal Apprehension team. And thiS Investigation started on the night of september 7, 1996. It is far from over. It has taken countless hours, really decades, of work by the men and women of our Homicide Section to get to where we are today. Several of those detectives standing here with us include Detective Cliff Mogg, the lead detective. He is now retired. While i know there has been many people who did not believe that the Murder Of Tupac Shakur was important to this police department, im here to tell you that was simply not the case. It was not the case back then, and it is not the case today. Our goal has always been to hold those accountable and responsible for tupacs violent murder accountable. Just like we do for every homicide victim, every single victim, every life that is lost is important and remain as priority to this police department. As we methodically built this case to move forward with an arrest, it was also important that at the same time were building towards a successful prosecution. We worked closely with our he is team the District Attorney and his office to ensure that it is going to happen. Mr. Davis own words reinvigorated our case in 2018. Ill give you some of those details and introduce to you our homicide lieutenant Jason Joe Hanson and he will provide you many of the details on how we got here today. Thank you, sheriff. Thank you for being here today. My name is Jason Johansson and im the homicide lieutenant with the Las Vegas Metropolitan Police department. My goal is to walk you through our investigation and what led us to the indictment of duane davis also known as keffe d for the Murder Of Tupac Shakur. This case has been reviewed by our Homicide Team and Homicide Detectives for over 2 1 2 decades. Ultimately our persistence in thiS Investigation has paid off. Let me walk you through a time line of events that as we know them right now. Prior to september 7 of 1996, as we all know, tupac shakur was an artist who had signed with Death Row Records. And Death Row Records and its ceo shug knight and he had an ongoing feud. Duane davis was the leader and shot caller of the south side Compton Crips. Both of these gangs operated out of the Southern California area of compton. On the night of september 7, 1996, tupac shakur along with suge knight and members of their entourage came to vegas to attend the mike tyson fight at the mgm. Members of the south side Compton Crips which included duane davis, along with his nephew Orlando Anderson, were also in attendance at the same event. As both were leaving the fight, members of Death Row Records spotted Orlando Anderson near an Elevator Bank inside the mgm and at that time they began to kick and punch him near that Elevator Bank. I will now show you Hotel Security footage as many of you have already seen related to this incident. On this incident, you will Seetoo Pac Oig who is wearing a shiny sat continue shirt along with suge knight who is a large man punching and killing Orlando Anderson. Following this incident, you will see Hotel Security intervene. And then they will leave the area of the fight. Little did anyone know that it is this incident right here that would ultimately lead to the retaliatory shooting and death of tupac shakur. Following this incident, tupac and suge knight both left the mgm to make their way to a postfight party which was to occur at a local night club. At the same time word had spread amongst members of the south side Compton Crips of what had occurred inside the mgm and that is when duane davis began to devise a plan to obtain a firearm and retaliate against suge knight and tupac shakur for what occurred against mr. Anderson. After davis obtained a gun, he entered into a White Cadillac along with terrence brown, deandre smith, and Orlando Anderson. Based on our investigation, this is where we know that they they were seated. At some point in time, as they were in the White Cadillac, mr. Davis took the gun he had obtained and provided it to the passengers in the rear seat of the vehicle. As they were both as they were driving west on flamingo road, they located the black bmw driven by suge knight and in the Passenger Seat was tupac. And they pulled up near the passengers side of that vehicle and immediately began shooting at mr. Knight and tupac shakur. Following that shooting the White Cadillac fled the area southbound and officers arrived on scene and tupac later trance ported to the University Medical center where he was treated medically and died approximately six days later on september 13th. My momHomicide Section handled S Investigation and we knew that we were working a Gang Investigation where our victims, our witnesses, and our suspects were all from Southern California and not local to las vegas. Within the first few months of the investigation, our detectives knew most of the information i just briefed you on. However, we never had the necessary evidence to bring this case forward and present it for criminal charges. As time went on, this case had been reviewed multiple times by different investigators assigned to my section, but it wasnt until 2018 that this case was reinvigorated as Additional Information came to light related to this homicide. Specifically duane davis own admissions to his involvement in this Homicide Investigation that he provided to numerous different media outlets. In our section, we knew at this time that this was likely our last time to take a run at this case to successfully solve this case and bring forth a criminal charge. It was at that time that this case was assigned to cliff mogg, detective within my mom side section, and other the last five years, my section worked closely handinhandside section, and other the last five years, my section worked closely handinhand with the District Attorneys office and followed an investigative plan over the last five years. Weve conducted countless interviews and corroborated numerous facts that were not only consistent with the crime scene on the night of the incident, but also Krob Rated A Rob Brated and consistent with the see questions of events that night. We secured a certainly warrant for mr. Residence. Following that Search Warrant, this case was presented to the grand jury which ultimately led to davis being indicted on charges of murder. Before i hand it off to the District Attorneys office, i would be remiss if i didnt thank Detective Mogg and all the other detectives that were not only assigned this case and reviewed this case but all the other detectives from other agencies that assisted us in thiS Investigation. They know who they are. And thank you very much for all the assistance you provided. It does not go unnoticed. And lastly, one of the most important things in my opinion is we need to make this and be a reminder and then the charge of murder does not have a statute of limitations. This agency has been and is invested in solving our cold case homicides so that we can bring closure to those families and justice for those victims of homicide. It is a quote we hear often and for many, many years when talking about our legal system. But not in this case. Today justice will be served in the Murder Of Tupac Shakur. Id like to acknowledge the relentless work of the many Las Vegas Metropolitan PoliceDepartment Homicide detectives. Weve mentioned Detective Cliff Mogg many times and we cant mention his name enough. He is the detective along with hisle colleagues that brought this case here today to you. A clark county grand jury has indicted duane davis with one count of deadly murder with use of a weapon. Davis will appear in court in the next few days or so for a hearing to determine his Custody Status and to set a jury trial date. This grand jury has been receiving evidence for months and has determined there is sufficient evidence to justify the filing of this criminal indictment. Ive signed two of my top prosecutors to prosecute this case. I know a lot of people have been watching and waiting for this day. Tupac shakur is a music legend and for a long time this community and worldwide have been wanting justice for tupac. Today we are taking that first step. Tupac was actually quoted as saying death is not the greatest loss in life, the greatest loss is what dies inside while still alive, never surrender. We didnt surrender thanks to the great work of the Las Vegas Metropolitan Police department under the leadership of sheriff kevin mcmayhill, lieutenant johansson, retired Detective Cliff Mogg, im proud to announce the return of this document, this is the indictment weve been waiting almost three decades for. It spells out the facts and circumstances and what justifies a clark county grand jury in returning an indictment. Justice will be served. Thank you. Thank you, steve. We wont talk about any particular statements, but maybe he can address what ill say, there is a lot that will come out when it comes time for trial. But he provides his own series of statements that are very consistent with the evidence that we have on the scene that weve obtained through our investigation. Ill leave it at that. Can you identify anything that came from the raid sorry, the service of the warrant in july that you didnt know before . That is a good question. What ill say about the Search Warrant that we did in july, that we obtained information or evidence during that execution of that Search Warrant that corroborated information obtained from our investigation and ill leave it at that until we go to trial. And i know that this is obviously a big move. Is there anyone else being looked at at this point . I know a lot of people have passed away since the incident, but is anyone else being looked at as part of the investigation . As i stated earlier, in this case the only living suspect related to thiS Investigation is duane davis. All other three suspects are deceased. Vanessa murphy, channel 8. You can talk about the Murder Charge if he is not the one believed to have pulled the trigger . Yes, well, under nevada law, and this is the law in most states in this country, you can be charged with a crime whether you are directly involved or whether you are an aid or abetter. We have an aid and abetting statute. So if you helped somebody commit a crime, you can be equally as guilty. Best example is two guys that agree to commit a bank robbery and one goes into the bank with a gun and actually commits the robbery and the other guy is the getaway driver. Never went in the bank. But he assisted the guy that went in the bank. So he is equally guilty. That is one of the theories in this case as well. Last question. Do investigators believe davis was the only person behind the plan to kill tupac or was he one of multiple people who came up with the plan . I think the best way to characterize that is duane davis was the shot caller for this group of individuals that committed this crime. And he orchestrated the plan that was carried out to commit this crime. Can you say how he obtained the gun . We know he obtained it from a close associate. A moment almost three decades in the making, a moment many fans thought would never come. An arrest, an indictment in the Murder Of Tupac Shakur. Really investigators are going into stunning detail about how his murder was a retaliatory killing, that an investigation in which they knew soon after the murder of tupac around September Of 1996 the details of, but in case that went cold, until 2018, and now one that is headed potentially for a conviction. They showed this Surveillance Video and they said this is a moment, this altercation, that ultimately led to that moment on september 7, 1996 on the Las Vegas Strip where someone pulled up, multiple people, in a White Cadillac they believe and shot into the Passenger Side of to you ptupac shakurs vehicle. Days later he died in the hospital. But fans of his music, people who knew him, his family as well, they have carried this hurt for so long. And now knowing that police have arrested someone also they said there were three other suspects, but all of them are deceased. And the arrest they made, you are looking at the mug shot there on your screen, duane davis, a 60yearold man who they describe as head of a rival gang that had issues with tupac and his cohort. Lets discuss these latest details with Josh Campbell and also with us, joey jackson. Josh first to you. There was a lot of detail in what we just heard from investigators there. Going over all the evidence that they collected. Reporter absolutely. And you know, this is where the time line of this murder comes into play here, so important. We know that after tupac shakur left the boxing match, it was a White Cadillac that pulled up alongside his vehicle, tupac was in the car with suge knight when the Shots Rang Out. And duane davis the suspect now charged here, indicted in nevada, he gave public statements. This is something that the officer alluded to there shortly saying some of his own comments are being used here as evidence particularly if you look back in 1998, davis gave an interview to b. E. T. Saying he was in that other car, he was in the front seat, he claimed the Shots Rang Out from the back seat, he refuse to the publicly name who else was in the car saying that was the code of the street. But there was this question about, okay, so you are there, what other role did you have. Interestingly we also just heard the prosecutor talked about the law here as it applies, he said you dont have to actually be the person who pulled the trigger in order to be charged with this murder. So we start to see the elements start to shape up. If he was in the vehicle as he claimed and that plays into the law that you dont is to pull the trigger to also be charged with murder, Police Believe that he was the shot caller here, the person who devised this plan to retaliate and lead to this murder. And joey, indicted with one count of murder with a Gang Enhancement. Tell us about this. Yeah, so that is a big development. Lets talk about what we learned. Number one, this is an indictment. It means that a grand jurien come screened and held evidence. A grand jury consists of at least 20 people in the state nevada. Of those 20, stwefl have to make t the assessment that there is reason to believe that crime was committed and that this particular defendant committed it. So the grand jury we also learned has been Hearing Evidence for quite some time. With regard to that grand jury and with regard to that charge, we also learned at this presser that there was means, motive and opportunity. What were the means . A gun. Weve heard about the retrieving of the gun from that defendant there mr. Davis. We learned about the motive and that is predicated upon the surveillance that we saw in that hotel with regard to the attack of mr. Anderson apparently mr. Davis nephew and the opportunity based on the motive of okay, they attacked my never new, never few so ill get a gun and kill tupac shakur. Few so ill g kill tupac shakur. They spotted him and shot and fired. And we also learned about the Corroborative Evidence that they have to doing countless interviews to quote them. So they came up with the charge of murder. Obviously the Gang Enhancement related to other people acting in concert and those other people acting in Concert Meaning collectively together at the directive of mr. Davis so the gun is in his hand. We know las vegas, certainly nevada, a Death Penalty jurisdiction. Not suggesting that this is such a case, but i am suggesting that we know that the penalties would be steep in terms of life in prison without the poebts of parole primarily with that gang enan enhancement. And investigators at the Press Briefing specifically pointed out the fact that there is no statute of limitations on murder. One other thing that struck me as we were hearing from the sheriff of las vegas talking about how many people thought that the department sort of set the case aside and didnt pay as much attention to it as they should. He said the goal is always to bring justice for tupacs family. And he said he thought this might be the last run that they would have at this case and obviously this is a moment, they seized it.
