That trump is expected to surrender on thursday or friday. He and 18 codefendants are charged with plotting to subvert the 2020 Election Results in georgia. Local officials have said they will treat the former president like any other defendant. Sources tell cnn that trumps team has been in contact with the District Attorneys Office about the conditions and logistics for his surrender. Cnns ryan young has our report. Reporter we continue to try and get a sense of whats next as we continue to watch developments. Thats after trump and 18 others were indicted on monday. From a security standpoint, we know theres been heightened watch and security outside the courthouse and the jail. In fact, you can no longer just drive up to the jail where the former president is expected to turn himself in. Two deputies sit at the end of the driveway, limiting access. Weve also learned the Secret Service has visited the Fulton County jail to work with Sheriffs Department officials to get an valuation of the current Security Situation and determine what needs to be done to protect the former president. Jail insiders believe the process for donald trump will clearly be shorter than what a normal person would go through in the process. As of right now, checking the jail website, none of the names of the people indicted have been included. Obviously next week will be very busy. Theres a belief from some Law Enforcement officials that the end of the week is when we could see former President Trump show up at the jail to be booked in. Ryan young, thank you so much. Joining me to talk more about trumps surrender and indictment is brian kelley, a former federal prosecutor who tried james whitey bulger. Lets talk first about this news that trump is expected to surrender thursday or friday in Fulton County. The sheriff says he will be treated like any other defendant. Hes the foreman pmer president to Secret Service detail. How do you think his booking will set a tone for the trial . Well, thanks for having me. I dont think his booking will have any affect on the trial. The jury who decides this is not going to be shown or exposed to anything from the booking process. If we can reflect on what youve been accustomed to while prosecuting the case against mo mobster whitey bulger, you said he was trying to manipulate the system so he was never brought to trial for his role in the 19 murders and he was trying to slow down the trial. Do you see there might be any similarities in this trump case or the approach his attorneys might have while facing these charges . I think in every case its to the defendants advantage to slow things down, because typically the evidence does not get better for the prosecution as time goes by. Sometimes witnesses memories lapse or sometimes witnesses are no longer interested in participating and have to be forced to participate. The more time the defense has, the more time they can find the weaknesses in the state or federal governments case. I think in any criminal case, the defense is probably going to be playing for a little bit more time than the government wants. At the time, bulgers attorney said the volume of evidence from prosecutors was so enormous and they needed more time to go through it. Well, that sounds very familiar. Is theis a common defense that gets any serious consideration from the judge . I think most fairminded judges will listen to that, especially here. Unlike the bulger trial, which was just one defendant, theres now 19 defendants in this case, which is frankly an extraordinary number. I dont see how the d. A. Is going to get all 19 in the courtroom. It seems physically impossible. Theyll have to split the case up. Theyll have to what they call sever different groups into different trials. Just logistically 19 people in one courtroom with one juror with all these different Defense Lawyers is impossible. So the state is going to have to at some point soon figure out how they want to proceed, who goes first and im sure everyone is going to be fighting to go last. If you dont go first, you can see the states case, you can see how the witnesses perform, you can get to know the weaknesses of the other side. Given that it would be a challenge to have all of the defendants in the courtroom at once, is it your feeling that the d. A. s office is hoping some of those codefendants are going to want to plead so there would never be a case for all of them . Yes, i think thats always the prosecutors hope that the case gets simplified when numerous defendants plead guilty or reach a Plea Agreement with the state or federal government. That simplifies it. Youll notice that in the federal charges out of d. C. , theres only four charges. Here theres multiple charges, including a massive Rico Conspiracy charge, which is pretty complicated. I dont think they want 19 people. Theyll probably all have at least two lawyers. They dont need all these lawyers throwing rocks at their case. Its a major headache. Lets talk about whats at the core of this case, of the indictment. Trump is facing 13 charges on this georgia indictment. Perhaps the biggest threat he faces is the racketeering or rico charges. This was a law originally intended to fight Organized Crime and mobsters. You prosecute d several rico cases. Tell us why it is being used in this case and why Donald Trumps legal team should be concerned. The federal rico statute was passed in 1970. About 30 states across the country have their own state rico charges. In georgia, the rico statute is a little bit broader. It permits more crimes to be considered as part of the racketeering activity. So its concerning for any defendant, because it permits the state or the prosecution to introduce a lot of evidence that otherwise they would not be able to present, because the rico statute is so broad. It requires the state to prove there was a Racketeering Enterprise and all these people were trying to overturn the state election. Theyre going to have to prove theres a pattern of racketeering. It cant be unrelated crimes. It cant be a tax evasion and like the goal has to be the same. And smuggling or something. It has to be a pattern thats for a common goal. Since theyve charged a conspiracy, it makes it easier for the state to prove it, because all you have to show is that these people were agreed to this crime and they knew that somebody would commit two or more. They themselves do not have to commit two predicate crimes, but somebody in the conspiracy did. They have to knowingly agree this was the purpose. So the Conspiracy Charge is very broad. Frankly, its a little complicated the way theyve drafted it. Theyve included whats called overt acts in addition to Racketeering Acts. The Racketeering Acts are of the alleged crimes. Overt acts can be anything. They went and gave a speed, they went and had a meeting. So it has the risk of backfiring against the state, because if they made it so complicated and so many different overt acts, i think 160 have been thrown into the indictment, which to me seems unnecessary. They should have simplified it if they didnt want to risk the 12 jurors listening to all this evidence trying to decide who knew what when, who agreed to what, what does this overt act mean, is it racketeering, is it not. It can get very confusing. Do you see this case staying in georgia or going the way of federal court, which is what mark meadows and his attorneys want . Honestly, i havent studied that issue very much. I think theyre going to be hard pressed to get it out of the state court system. Im not sure what would give them the right to transfer it to federal court. These are state crimes charged by a State Grand Jury by a State Prosecutor regarding the state federal election. Thats probably the hook theyll try to say. But well have to see what the courts say to that. Brian kelley thank you so much. Nice to see you as well. Now to an urgent storm warning. More of this is going to fill in as we go through the afternoon and the evening and overnight hours tonight, because that storm is going to continue to push north into colder water. The bulk of the heavy rain really sets in overnight tonight, continues all the way into the day sunday. Most of it finally wraps up by the latter half of the day monday. Youre talking a full 48hour time period where we are looking at moderate to heavy rainfall. That includes death valley, palm desert, las vegas, los angeles and san diego, all part of that moderate risk. Again, youre talking a years worth of rain in less than a day for some of these areas, widespread totals of 24 inches. Its more than they get in an entire year, in some cases multiple years worth of rain in a 24hour time period. There will be some spots that could pick up 6, 8, even 10 inches of rain in just a 48hour time period with the bulk of that falling tonight going into the day on monday. New york City Officials who are desperate to find more room to house asylum seeks now want access to the shuttered metropolitan correctional facility, a Prison Notorious for squalid conditions and highprofile inmates. Its the same place Jeffrey Epstein hanged himself in 2019. This comes as the city continues to scramble for resources after receiving more than 100,000 migrants since last year. Cnns Polo Sandoval is with us now. This is an extreme measure to house these asylum seekers. Reporter that facility commonly known as the mcc is a potential site because we are still very far from a point where the city may potentially use that space. First, this wouldnt be the First Time Since the city has been using another facility that had been previously used to house inmates, now being used to house migrants. In terms of the mcc, we are still very far from potential use. For starters, the federal government has to authorize the use. A spokesperson for the bureau of prisons wouldnt go into detail in terms of whether or not those conversations are happening with the city, but did tell me they have not finalized any longterm plan. I asked a City Official whether or not thats even a possibility. That official tells me at this point it is not. But it is in the realm of 3,000 other locations theyve looked at to try to house asylum seekers. The city is calling on the white house to help expedite Work Authorizations for the over 100,000 who arrived here in new york since last spring. We know Chris Christie has done his own thing. Have the audience been receptive to candidates focusing on things other than donald trump . Yeah, they have been. Hes got about 1500 people there. This is a very popular event. One thing that was interesting is ron desantis appeared yesterday. Desantis has really been falling in the polls. Suddenly there are a lot of people who wonder if he has the makings of a real strong president ial candidate. Yesterday people saw a side of him that they werent used to, a more casual, relaxed desantis that he hopes will be the beginning of his efforts to get out there and be more people friendly as he campaigns in iowa and New Hampshire. Desantis had a one on one meeting, a discussion with georgia governor kemp. Kemp has not endorsed anyone yet. Is this an indicator in any way of his leanings . No, i dont think so. Kemp and desantis have a lot in common in terms of the policies they have supported in florida and georgia. I think brian kemp is in a position right now where he is so popular in the national party, hes become a Strong National republican figure. Theres no advantage to him jumping in and endorsing anyone at this stage in the race. This now ahead of donald trump being arraigned. Sources tell cnn he is going to show up at the Fulton County jail thursday or friday. Weve heard from legal analysts and even the sheriff who say he should be treated just like any other defendant. Donald trump has been able to say, yeah, one more arraignment, this is only going to help with donations, with support. Is there still that feeling . I think the sheriff has made it clear that he wanted to have trump fingerprinted and that a mugshot will be taken. Of course, all of that will take place in private. Its not as if were going to have cameras in there while hes being booked. It will be interesting. Somebody with an iphone who works inside might want to do that. But this will all take place in private, so were not likely to see that process play out for donald trump. If it does happen, youve got to imagine as boastful as trump can be and as sure of himself as he can be, its a very humbling process to go through. Humiliating would be the word. She doesnt have to climb over stuff as much over here. All these dogs over here are unk uncomfortable with this environment, because they all practice on collapsed d buildi. Theres no way to train on Something Like this until a devastating event like this occurred. All the dogs are getting comfortable as the days go by. How does harper tell you when she comes across remains . She actually has an active alert, which means that once she senses remains, shell start barking. She wont leave that area until i reward her. Its like a hide and seek game for these dogs. Its a game for her. All she wants to do is play with that ball that i have for her. She knows she wont get it until she finds what shes looking for, in this case human remains. Talk to me about the fatigue. I understand for some dogs, they can only do this 15 minutes at a time because it is very fatiguing. This is such a colossal massive space of destruction. What measures do you take so that harper does not get fatigued . Or what are the signs that she is fatigued . Well, as the days have been going by, weve been here about five days already. I could tell that shes slowly getting fatigued. The first day she was out there running around, searching as quick as she could. But this heat and humidity, we dont get this in southern california, so we cant train in that environment and get her accustomed to it. It has taken a toll on her. I try to now keep her searching for anywhere between 10 to 15 minutes. Then ill put her back in the car with the ac, give her cold water and just let her rest for another 30 minutes. Its a large area to search here, and the team im assigned to right now, they all know how these dogs work, so they do care about these dogs. They know we cant push them too much and theyre good about giving us breaks. In your view, what are some of the challenges of Seating A Jury in such a highly publicized case . Theres three main problems that i see. One is that obviously theres the politics involved. You cannot divorce a case like this from the politics, because the rico action being filed against him has to do with him actually trying to overturn georgias election. So obviously the political aspirations or the political affiliations of jurors are going to be closely scrutinized. Thats one issue that can be incredibly polarizing as weve seen across the country. Second issue has to do with the pretrial publicity. Theres been so much publicity about President Trump that peoples exposure to that pretrial publicity and his other cases also will be coming into focus. Last is what i would call system credibility. Theres been a lot of discussion lately, kind of a significant downturn in the publics confidence in institutions in general, but also in the justice system. So the court is even going to have to discuss with jurors their ability to be fair and impartial and follow the law and the evidence in the case. So these are three main challenges that i see. Given those main challenges you see, do you still believe a fair jury can be seated . I do. I do think that. Its interesting, theres something quite extraordinary that happens when a group of diverse citizens comes together and are charged with a significant role of deciding the fate of an individual defendant or series of defendants. Sometimes the politics and all noise kind of floats aside. That being said, its going to take a lot of time. There could be thousands of jurors who could be questioned to even see if they could put aside feels they have. I think it can be done. Jurors can do it. They can be fair and impartial. Theres something about the Group Dynamic that happens when jurors are put together and are charged with an important job. Highprofile cases youve been involved in from o. J. Simpson to even casey anthony. So what questions could Perspective Jurors expect to be asked in this kind of case . Jury selection really is jury deselection. Each side is trying to identify jurors who are significantly predisposed against them. Theyre trying to find out. So the questions youre going to be asked are obviously what are your opinions of President Trump, what are your opinions of the election in general. Theres snignificant polling tht suggests about 70 of republicans feel that the election was fraudulent and that joe biden is an illegitimate president. Prosecutors are going to be looking for those types of jurors. The defense is going to be looking for people who think they have a terrible opinion of President Trump either from just his four years in the white house or from a lot of other publicity theyve heard about him. So if fu those are going to be the significant questions. What have you heard, what are your opinions . Then do you think security a going to be an issue, meaning, those jurors are going to be worried about their own personal security given what has happened to grand jurors and their names and addresses and harassment theyve been experiencing since helping to render this indictment. I think security is going to be an issue. Just the amount of people who can sit for the length of time this trial is going to take is going to be an issue. Also people are going to have to think about how their verdict will impact their friends, family and the community.
