Trump says he will be holding a major News Conference on monday to prove the election was somehow rigged in georgia, even though multiple recounts and court cases have proven over and over and over again joe biden was the winner and trumps lawyers withdrew every one of those cases. Rudy giuliani, one of trumps coconspirators says he will surrender and hes slming the da for using racketeering charges. The same type of charges he used to prosecute mafia leaders in the 80s. Hes a politician and not a lawyer. Not an honest, honorable lawyer. This is a ridiculous application of the racketeering statute. Theres probably no one that knows it better than i do. This is not meant for election disputes. This is ridiculous what shes doing. Also, i dont know if she realizes it because she seems like a pretty incompetent, sloppy prosecutor. Another codefendant, mark meadows, is fighting to move his case from State Court To Federal court to try to get it dismissed. Thats the most fascinating part of it for me. Lets bring in senior legal analyst elie honig. We know these new things out of georgia. What does this tell us . All four indictments are in. Lets take a moment and assess where we are and whats next. Fulton county is the newest one. Whats happening in that case . The judge has given the parties until august 25th to surrender. Thats the easy way. If they do that, they come in themselves and are processed. If anybody does not surrender, then the dad. A. Has the right to send out Law Enforcement officials to make an arrest. The other big issue, and we just said this, removal, get ready for a lot of talk about removal. Mark meadows is trying to do this. Donald trump will try to follow. In a nutshell, this means if a federal official gets charged with a state crime that relates to that federal officials official job duties, you can get the case moved over to Federal Court and then potentially dismissed. So these are really important motions. Mark meadows has already done this. Trump is sure to follow. The other thing that were watching for here is we have 19 defendants in this case. Thats a lot. And a lot of these folks are facing criminal charges for the first time. Are people going to try to save themselves, cooperate and flip. If so, are they going to be able to take prosecutors up this hierarchy chart. Watch and see if anyone pleads guilty or if theres Cooperation Agreements or an information. A lot of whats in the indictment is part of jack smiths most recent indictment talks. Walk us through those three outstanding cases. Now were into the federal cases. This is jack smiths 2020 election interference case. The big issue there is what will the trial date be. Doj put in a brief asking for january 2nd. Pretty aggressive timeframe. Trump is not responding yet. His response is due later this week. Maybe never. Certainly after the election, and the judge is holding a hearing to decide the trial date and other sklking issues on august 28th, a week from monday. The other jack smith federal case, now were talking about the maralago classified documents case, they are going through how are we going to handle classified documents. Doj returned a superseding indictment, a version 2. 0 where they added this other defendant and added three charges against donald trump. The question is that going to come promiez the may 2024 trial date . The dynamic, trump is going to want to push back. Doj is going to want to say lets keep it. The first of the cases, the ma manhattan case, they are going through pretrial motions and they have a date of march 2024. Calendar . Look how wide open it is. We have an election in november of 2024. New york, the hush money case, their trial is scheduled for march. Thats going to go through april. Maralago, the florida case, that is set for trial starting in may. Thats going to go into july. Now where are the other cases going to fit . Lets take jack smiths case. They want to start it in january. They do not have enough time to get that in before the new york case. Then we have fani willis case. Theres no place for that. You cant so close to the election. If they start a trial in august, theres no way. Especially a rico case. I dont see any room for fani willis case before the election. Even jack smiths case, someone has to get rid of this. The d. And we should note to the point that you guys were just making about the various layers of the legal woes here, the aid shows up in another of the indictments that trump is facing, the one related to maralago documents. She was in the room when trump was brandishing what he described as a secret Military Document that he could have declassified a as president. The piece is so interesting. The headline is trump taunts test limits of release. And the lines that the judge sought to lay out about what he can and cannot say. Hes really pushing here in a way that could hurt him in terms of how this trial is conducted, when this trial is conducted. He has been attacking prosecutors and other judges in these various case, but the judge who oversees the January 6th Case against him at the federal level, warned at a hearing on friday there was clearly going to be a limit to trumps free speech. Now his lawyers and his advisers are the front runner for the republican nomination, hes a political candidate, he should have a fair amount of leeway because of that. She was suggesting there are going to be lumts despite that because the laws of the court have to come first. He went within a short time of that hearing and began posting on truth social, his social media website, other peoples posts about the judge, adding some of his own commentary. Generally, it was other peoples. One included a large picture. Hes clearly testing the terms of his release, both in this case and i would say with the attacks on Rt Prosecutors in others. Some lawyers say, and we talk about this in the piece, other defendants if they were doing similar things would be in jail. Its very complicated to think of Something Like that happening to someone who has Secret Service detail, but will the judge or the prosecutors seek some kind of recourse as he continues to talk. She did threaten to move it up the more he talks about not the personal threats, but about discovery. Right. What she suggested is she maybe forced to preserve the sanctity of the jury pool, she maybe forced to move the trial date up sooner if this continues. So well see if the government tries to suggest a that he has reached that. For the last several months, probably longer, theres been a lot of speculation about mark meadows, his role in all of this, regardless of the Special Counsel investigation. He was obviously indicted in the georgia case. He moved alone yesterday to try to chip things from State Court To Federal court i was interested in the fact he did it by himself. He didnt do it with the other 18 codefendants and he moved first. Whats your sense of that dynamic right now . The moving fehr was significant. Youre going to see a pretty aggressive defense in that case. They are trying to lay down a marker this ought to be in Federal Court. Im not surprised it was only him. I dont think in a rico case where defendants are arguing they want to move together. I think that meadows is going to make a specific argument as a former chief of staff. But as you note, med does is the focus of specific attention for a lot of people. For people around trump because people have wondered what he said, for prosecutors because hes one of the people who knew a lot. Now he has clearly was not especially help ful to investigators in georgia. You can just read the indictment and see that. But i think you are going to see him try to argue very ex extensively he should not have to face trial in a state court in georgia. Does it indicate anything to you, though, that he was not indicted in jack smiths probe about january 6th and is indicted here in terms of cooperation . I dont want to speculate about what he may or may not have done in other cases. With january 6th, house select committee, he partially cooperated. He would not give an interview. Here he does not seem to have done a whole lot, although as i understand it, he had been brought in at some point by prosecutors. He is very apparent in the federal indictment, as you say. Hes trying to not do that because it would embarrass him and draw attention to his misfortunes, but we were able to pick through some Court Filings that do outline in lawsuits that hes facing related to his work for donald trump after the 2020 election just how much his bills have piled up right now. So right now, he has 181,000 in current bills. That includes a judgment from a Court Last Week saying he had to pay a phone bill for his company from 2020 that he has to pay legal fees for two Georgia Election workers, who are suing him. Thats what the sanction would be at 89,000 sanction. Thats not even what happens if he were to lose that case. On top of that, he has a lot of bills for just keeping ahold of the records that he had in his various cell phones and other electronic equipment. He has that all in a company. It costs money to do searches for those records every time hes getting sued and it costs money just to hold them with that company. So he has access to his electronic records. Its a lot of legal bills, but on top of that, he has debts. One of the debts that has become public in the Court Proceedings is he had a 320,000 debt to this Company Hosting his electronic records. Donald trumps pac has paid that off. We learned that from the Court Filings. But this is not even captureing the scope of the money Rudy Giuliani is just being bogged down with in order to fend off lawsuits related to the 2020 election and other Court Proceedings. Welcome back. We have new developments this morning in the police raid of a local newspaper in kansas. The Kansas Bureau of investigations is now leading that probe into last fridays raid of the Marion County records. Police searched the home and office of the newspapers owners and seized computers and phones and servers and recorders and editors. Authorities claim it stemmed from an investigation into identity theft. A Coffee Shop Owner accused the newspaper of illegally be tang documents about a dui she received 15 years ago. The paper says they got those from a source. They were trying to verify the information, and only published it after she started accusing them publicly. The Coffee Shop Owner previously barred the paper from covering an event of a republican member of congress. Eric meyer says his 98yearold mother, joanne, who was a coowner of the paper, collapsed and died on saturday, the day after police raided her home. According to the paper, meyer had been, quote, stressed beyond her limits and overwhelmed by hours of shock and grief. Eric joins us now. Good morning, eric. We are all deeply good morning. We reached out to the police about all of this, because they did this and they were handling the investigation prior, and we didnt hear back, but i want to read people a statement from the police chief on sunday. I believe when the rest of the story is available to the public, the judicial system will be vindicated. Have you gotten any more answers from police about why they did this . We finally were able to obtain the probable cause affidavit that was to support the search warrant. It was filed three days after the searches were conducted, which is a little suspicious. But it, interestingly, refutes most of the claims against us. One of the allegations was that we obtained this document and gave it to the vice mayor. In the document itself, the vice mayor says she got it from the same source we got it from. Which supports our contention. One of the things we dont understand is, we actually told them about this. This was our disclosure to them that we thought that there was a document out there that maybe somebody had improperly done. Also an allegation that police were ignoring the fact that the Restaurant Owner had been driving for 14 years without a drivers license. So we alerted the police to it. They never asked us a single question. As i understand it, Search Warrants are supposed to be sort of a last resort. If you cant get the information any other way. They could have asked. We would have given it to him. Here is the document we obtained. It was sitting on my desk next to the computer. They didnt take it. Well, the fact and this is the first time wearing learning that the probable cause affidavit was submitted after this Magistrate Judge granted a search warrant. That raises important questions. You have said that the paper was investigating at one point the police chief getting but never published that investigation, werent able to verify some of the claims. Do you have any reason to believe that investigation factored into this raid . Just speculation. There are oddities about this coming here. Also there are longstanding animosities in this town among various different factions. When i talked to the Restaurant Owner, she said i wasnt out to try to get to you. I was trying to get the vase mayor. The vice mayors house was also raided. This is, obviously, very important to you, your community, your paper. This is very important to america because this is about First Amendment and Freedom Of The Press. Your lawyer, as i understand it from the new york times, wrote a letter to the police chief and said they are treating your paper like a drug cartel or a street gang and you are filing a federal lawsuit, is that right . If so, on what ground . We are planning to. A violation of the first, fourth, and fifth amendments, among other things. But that has not happened yet. We are hopeful that now that the kbi has taken over, that there may be some cooler heads that prevail, shall we say, and they apparently are going to examine not only what the evidence says, but whether it was proper to go after it the way they were going after it.
