We know theyre still in there. Its after 5 00 right now. Paula, walk us through what happens if the grand jury decides to indict donald trump and or any of his allies. Reporter we expect the indictment also be for over a dozen people. The former president s lawyers say they do expect he will be among those indicted. We would expect the District Attorney would seek an indictment from the grand jury and it would go to the Clerks Office where we will most likely get our copy. Then it will be made public and well be able to read about the charges. One of the things thats unclear, jake, is when the former president would appear for his initial appearance and a potential arraignment. In the federal cases that happened quickly. Down in georgia, sources telling cnn that the former president s team expects it may take a little longer to have his first appearance down in georgia if hes indicted. Paula reid, thanks so much. As those witnesses continue to testify before the grand jury in atlanta, donald trump is expecting he could be indicted at any moment. Cnns Alayna Treene joins us. How is trumps team preparing for this latest indictment . Reporter jake, they have a playbook now. Theyve had to respond to three previous indictments, and theyre planning to use the same playbook with this potential indictment. They are lining up surrogates and allies, having them ready to respond to potential charges if they are filed. Theyve also spoken to conservative media and had them write pre written statements. Theyre preparing a response ahead of time for when or if an indictment in georgia does come. Im also told that Donald Trumps team does expect that a potential arraignment, if he is indicted, would be in person. That he would have to show up in person in georgia and appear before the court. Of course, thats an early guess from his team, from what they tell me. Thats what theyre anticipating at this time, jake. Alayna treene, thanks so much. I want to bring in tom dupree, the former assistant Attorney General under president george w. Bush. We heard trumps team is expecting an indictment imminently. I know this is all speculation, but informed speculation. What kind of charges are you expecting . I think these are going to be broad charges. My strong suspicion is that fani willis will indict many witnesses. The other claim she might bring which im keeping an eye on is a rico charge. Explain what that is. Thats usually for gangsters. Exactly. Rico is a federal and state statute. What it basically does is allows prosecutors applying to a variety of situations. My strong hunch is they are looking seriously as bringing a ricotype complaint against President Trump and his advisers for a conspiracy involving the election. We know donald trump leaned on Secretary Of State Brad Raffensperger to find the correct number of votes, to flip it. We know the prosecutor has evidence tieing the Trump Legal Team to a breach of the Election Machines in a republican county. We know that there was a slate of fake electors that was submitted and not accepted. We know Rudy Giuliani went down there and met with legislators to talk about these wild and outlandish and disapproved claims about the election and telling them they should, therefore, flip the election to donald trump. Is that a conspiracy to commit a crime . It should be. What youve articulated is what lawyers call predicate acts, discream criminal acts that you use to tie together a larger criminal conspiracy. There are items you mentioned, the call to Brad Raffensperger, Voting Machine alleged tampering, the slate of false electors. The other thing is more recent conduct by President Trump or advisers to tamper with witnesses or otherwise obstruct justice. That would be something that was a little different in time, separated in time from the 2020 election. Nonetheless, it could form a part of the charges shes about to bring. You talk about tampering with witnesses. Our cnn colleague and former Lieutenant Governor geoff duncan who is a witness and testifying today, donald trump posted something on the Social Media Site saying he shouldnt testify. Is that Witness Tampering . Well, a prosecutor can make a strong case thats Witness Tampering. If you have someone you know or reasonably expect is testifying either before the grand jury or before trial and you threaten or cajole or attempt to obstruct that testimony, sure, a prosecutor can make out a case for Witness Tampering. That seems to me at least a little too recent in time to form a basis for this indictment that presumably is forthcoming. It wouldnt surprise me if fani willis found other examples where people on the trump team used what she deems to be improper pressure to get witnesses not to testify. Paula, theres a key difference in this case and the fed federal case. In georgia, trump cannot pardon himself even if he is elected president next november. Reporter thats right, jake. This is one of the reasons that the former president s legal team has been most concerned about georgia. Not only the evidence that many of us are familiar with like that call with the Secretary Of State, many other key pieces of evidence that fani willis has gathered. Once this case is brought, if hes indicted, he cant make it go away. If hes reelected to the white house, most legal experts agree he would likely have his handpicked Attorney General fire the special counsel. He also has his pardon power, likely for himself and certainly for others. But the state of georgia, that is beyond the reach of even the president of the United States. Theres no mechanism for him to make this case go away even if he is reelected. So what happens, tom . What happens if donald trump lets presume the verdict doesnt come in until after november 2024, and lets presume for the sake of this exercise that he wins which could happen, both the nomination and the presidency. What happens if a georgia jury says hes guilty of xyz, rico has a fiveyear minimum sentence. The president of the United States goes to prison . I think there are a few hurdles theyd have to get through to make that happen. In that scenario, President Trump would say you need to exercise discretion and not sentence him to jail time. In other words, hes the duly elected new president of the United States, and you should either suspend the sentence, allow him to serve as president. The second argument the trump team would make is it infringes on his constitutional duty to execute the laws of the United States, it would be unconstitutional to force an incumbent president of the United States to serve jail time on a state charge. Were a long way away from that point. Those arguments have never succeeded, have never needed to be presented. Thats the sort of argument you would see if the scenario played out as articulated. We should note if a thing and a verdict happened before the president ial election, he could run for president from prison. Its happened before. Eugene debs in the 20s or something was a president ial candidate who had been put in prison for violating the sedition act of all things. Absolutely right. You have to dig pretty far back in our nations history to find something even remotely analogous. Our founders probably didnt envision the scenario we find ourselves in today. We see trump attacking d. A. Fani willis on his truth social page, even as shes in that building possibly preparing an indictment against him. Reporter thats right. This is nothing new. Hes repeatedly attacked fani willis, calling her a marxist, a racist, today pointing out the crime issues in the city of atlanta, suggesting she should be focusing on that instead of this indictment. Similar to the attacks he launched against the mann District Attorney who also indicted him in a second case. Lawyers who have worked for the former president have made the argument to me that there are legitimate questions about whether elected District Attorneys, in this case, a democratic prosecutor, should be able to file charges against a former president of the United States, or if thats something that should be reserved for the Justice Department and for special counsel. The former president not making that nuanced argument, instead calling people, quote, nasty disa disasters, marxists, leftists, and launching personal attacks. Behind the scenes his lawyers have other questions that i do think are going to become a theme in the court of public opinion, but probably not on truth social. Today new information about how power lines on the island might have played a role. Thats right, jake. The local utility is under increasing scrutiny. Did downed Power Lines Spark the fires . Should they have done more over the years to prepare for Something Like this . And should they have preemptively shut down the grid in such high winds . A Class Action Lawsuit has already been filed against the Power Company and it reads in part, by failing to shut off power during these dangerous fire conditions defendants caused loss of life. Here is the pushback, specific to a formal power program, we like most utilities do not have one t Hawaiian Electric spokesperson told cnn. He said shutoffs would have had to have been coordinated with the First Responders because on m maui, quote, electricity powers the pumps needed for firefighting. Here in california pg e was found guilty of 84 counts of Involuntary Manslaughter for the fire that pretty much destroyed the town of paradise. Now, i must stress there is no official cause yet for the fire that destroyed lahaina. Clearly there were a few factors at play, those storm winds as well as a lot of dry vegetation. While many candidates attended events and met with voters, donald trump seemed focused mainly on up staging ron desantis. It appeared that President Trump was at times trolling desantis. He had a plane flying overhead with a banner saying be more likable. He traveled with an entourage, also, of trump, largely made up of floridians, desantis home state, including members of congress that endorsed him including byron donalds, matt ga gaetz, mike waltz of. Do you think it bothered desantis at all . Probably. Not very many attendees of the Iowa State Fair know any members of the florida congressional delegation. They dont recognize them, they dont care about them. You just mentioned it. Its mentioned in all the media stories about how trump trolls desantis. I think thats what they were going for. Another theme of the weekend, paula, candidates needling trump to try to get him to join the debate stage. Take a listen. People ask me sometimes what i think about debating donald trump. I tell people ive debated donald trump a thousand times, just never with the cameras on. President trump, its his decision whether he wants to get on the debate stage. He has to earn the support of the american public. He ha. You have to show up. You have to debate. Do you have to earn the nomination, do you have to debate . No. Trump would be foolish to do so. He may do it because hes quite a foolish guy. Is his ego bigger than his political sense. He gains nothing. Hes 40 points ahead. By the way, i love the trolling. I do. Im a small, horrible person. Its all aboveboard. For trump, thats he knows desantis who is very high in intellect but not quick witted. What if desantis looked up and said, oh, look, ladies and gentlemen, theres con air. Laura, in order to join the Debate Stage Trump would have to sign the rnc pledge, that you would support the nominee no matter who it is. Trump said he didnt want to sign it, there were three or four people he wouldnt support. At the same time fox is asking to join. I think ultimately, even if the former president signs it to get on the debate stage, it doesnt mean theres enough evidence. Weve seen this play out before. It doesnt mean hes going to actually hold true to it and support the eventual nominee if it isnt him. I think right now, id be surprised if the former president actually joins the debate stage. He has said over and over again to pauls point, that he doesnt think it would help him, hes so far ahead in the polls. Hes threatened to counterprogram. When i talk to republican strategists across swing states they say, look, trump could just drop in somewhere, command a crowd of thousands, and thats all he needs to do. He doesnt have to be there every day the way other candidates do. These candidates are all looking for their breakout moment. Oh, nikki haley. Oh oh, ron desantis. Vivek ramaswamy started rapping at the fair. A tribute to eminem. Take a listen. First of all, hes trying to lean in to young voters, but i will say that the people who like that song are oldies like you and me, gen xers, do you know who yes. Millennialtion like him. He found the one white rapper. Look. I cant get too worked up about it one way or the other. I dont like performative politics necessarily. It was good rapping. I think ramaswamy has been very effective at meeting a big chunk of the republican electorate thats paying attention, thats tuned in to all this stuff, by being a bomb thrower and an entertaining guy. I think hes probably the second choice for a lot of trump pers as opposed to ron desantis. The whole plan was that he was going to be the alternative to donald trump. I think ramaswamy is kind of a lightweight when it comes to the actual substance of things, but so is donald trump, and thats been very successful. Paul, on the democratic side, Robert Kennedy jr. Made an eyecatching remark over the weekend. Well, this is what he told a reporter, i think an nbc reporter about whether or not there should be a Ban On Abortion. I believe that a decision to abort a child should be up to the woman during the first three weeks of life. So you could cap it at 15 weeks . Yes. Or 21 weeks . Yeah, three months. You would sign a federal cap on that . Yes. Hours later his campaign put out a statement that read in part, quote, mr. Kennedys position on abortion is that its always the womans right to choose. He doesnt support legislation banning abortion. The campaign tried to blame this on, there was bad sound or whatever. He said it three or four times in that interview. He kept coming back to it. Its not 15 weeks. Its 12. Do the math, bobby. Its 12. When his uncle teddy was running against romney for the senate. Teddy said in the debate, mit, youre not pro choice, youre multiple choice. Bobby is now multiple choice. Do you think this is going to hurt Robert Kennedy or do you think people, 10 to 19 of the democrats in certain polls say they support him, do you think they dont care, theyre just antibiden . Hes definitely benefiting from the antibiden wing. I dont see how you actually make a viable case in the democratic primary, one where you can potentially win which i dont think he can at all, and thats safe to say, and say that you support a national Ban On Abortion at 12 weeks, at three months. This is such a salient issue for democratic voters, and even independent voters. The voters that republicans or an independent candidate is going to try to have to win over if they want to make a viable case. All the voters that ive checked in with in these swing states that are maybe on the fence, they say that abortion is one of their biggest issues. Especially since roe v. Wade was overturned, which is one of the reasons it was so staggering that he didnt seem to have a position articulated at the time. This is kind of important to democratic voters. I kind of welcomed it. Its been much commented upon on my side of the aisle about how republicans dont have the vocabulary to talk about abortion because they can hide behind roe v. Wade all this time. Its nice to see democrats not have the vocabulary either. Im not sure how many people consider him a democrat at this point. Thanks so much. Six now former Law Enforcement officers pleaded guilty today to State Charges for abusing and torturing two black men. The former officers who once referred to themselves as the goon squad pleaded guilty e same january nth to federal incident. The brutalized victims say the officers handcuffed, kicked, water boarded and attempted to sexually assault them for nearly two hours. Cnns ryan young shows us how this story went from coverup to courtroom. Reporter one by one, sis disgraced former Law Enforcement officers were led into a mississippi courtroom monday to plead guilty to State Charges related to assaulting eddie parker and Michael Jenkins for nearly two hours. The torture included physical, racist and attempted sexual abuse and a coverup. I enjoyed the view seeing the shame, the walk of shame, the head down. I hope this is a lesson to everybody out there, justice will be served. Count one aggravated assault. Guilty or not guilty . Guilty. Reporter the men admitted to calling themselves the goon squad, giving themselves that moniker because of their alleged willingness to use Excessive Force and not report their actions. On january 24th, the six officers entered the victims hope without a warrant, handcuffed, repeatedly tased and attempted to sexually assault the two men after a white neighbor complained about suspicious activity at the home. It ended with jenkins getting shot in the mouth. They left him lying in a pool of blood, gathered on the porch of the house to discuss how to cover it up. Reporter in july i spoke to parker, jenkins and jenkins mother, and cnn toured the home where the crimes occurred. Its hard to stay here knowing what happened here. Reporter jenkins injuries make it difficult for him to speak. It hurt. Embarrassed. Has anyone from the department ever reached out to you and apologized . Have they ever asked for anything at all . No. Reporter Rankin County sheriff, brian bailey, who is also named in a federal lawsuit by the victims but does not face any charges spoke about the incident in late june. I believe in my heart that this Department Remains one of the best. Reporter he later apologized saying he didnt initially fully understand the gravity of the crimes. Today he issued a Statement Saying in part, we hope todays guilty pleas bring some sense of justice to the two victims in this case. Jake, when you think about the pain this family had to go through, mary jenkins said she didnt think her son was going to survive this. Now the big question moving forward, how many other victims have been involved with this goon squad . Its a question well continue to ask as well. I have a 13yearold and 15yearold, and i often think about how are they and that generation, including you, going to judge my generation when it comes to Climate Change, especially the baby boomers who, between you and me, i think are mainly responsible. But todays ruling may set legal precedent for similar cases in other states. It wont, however, stop the mining or the burning of fossil fuels in montana. What is your reaction to the ruling . Well, first of all, im really excited about the ruling. Its been a long time coming. Weve waited three years, being part of this case and weve known about humancaused Climate Change for at least half a century. Getting a ruling that listens to or stories and our voices and the best available science is just really important. Yeah. All we can do is the actions that are in our control moving forward. Whether thats as individuals or states, we can take responsibility, and all generations are involved in that. Ricky, the office of montanas Attorney General said this ruling is absurd but not surprising from a judge who let the plaintiffs attorneys put on a weeklong taxpayer publicity stunt. Montana is expected to appeal the ruling. You just graduated from college. Will you continue this fight if the State Appeals . Yeah. Julia can talk about this more. If it gets appealed, well go to the Montana Supreme Court and it will continue, yeah. Julia, on a practical level, what does this ruling accomplish beyond, obviously, the symbolic victory . This ruling is monumental. Its one of the most important rulings on Climate Change in the history of the world. What happened in montana was experts, climate scientists, medical professionals and the youth like ricky took the stand and they told the truth about whats happening to the planet and to montana and to the health of these young people. And what the ruling will do is it will stop fossil fuel pollution, not overnight in montana but it does really hamper the states ability to continue to improve new fossil fuel projects. The judge says its unconstitutional to continue to do so. And the states going to have to look hard at continuing to allow Fossil Fuel Development and emissions in montana going forward. But if the state does appeal the ruling and it goes to the Montana Supreme Court, is that friendly terrain for your case, do you think, julia . I think the Montana Supreme Court is a very fair and thoughtful court, that it is willing to uphold the Montana Constitution and protect the rights of the people of montana, including its youth. So we think we have a really fair shot. And in the meanwhile, the judges opinion is the Law Of The Land in the state of montana and the states required to comply with it. And do you plan on doing this in other states . We do. We have a Hawaii Trial Set for june 2024. Were going to the utah supreme court, and were also in the Virginia Court of appeals in addition to our big federal case the Julianna Versus United States litigation. He was more than a year out from his stroke. He had already undergone physical therapy, Occupational Therapy and despite the early improvements, it wasnt improving. That why dr. Andre machado offered something to stand that was to stan that was a first in humans, a deep brain stimulateor. You may have heard of this for parkinsons disease but this was specifically to help stan recover from the stroke. Stan had weakness but was able to walk with his left leg.
