Breaking overnight, 96, that is the death count so far from the hawaii wildfires and only 3 of the Disaster Area has been searched. The governor calling it a Fire Hurricane. It spread faster than a mile a minute, and now a new lawsuit against the states main electric provide r. Hours from now the Fulton County District Attorney is expected to present her case to the grand jury in the Georgia Election subversion case. This means a potential fourth indictment looms over former President Trump. Cnn learns exclusively about key evidence obtained by prosecutors. And a home explodes outside of pittsburgh killing five. Gas systems were operating as designed, according to officials, who say it could take months to figure out what happened. A new serious concern over First Amendment rights. Cnn this morning starts right now. Its been just devastating for what is happening in hawaii as the death count goes up and up. The pictures are extraordinary. They are heartbreaking. Its tough to put into context given how devastating its been. Were going to get into all of it. 96 people are confirmed dead in hawaii. Wildfires with only 3 of the Disaster Area searched so far. Just think about that. They have so much more to search. You are looking at video of what is left behind. This morning the governor says fema crews are discovering other tragedies in ongoing fashion. Extra search and rescue crews are on the way along with 20 cadaver dogs. They are asking Family Members to provide dna to identify people who died. There are new questions about how this happened and the response to it. Power company now facing a lawsuit for not cutting electricity when forecasters warned about wind gusts. The New York Times reporting that firefighters had to cope with hydrants running dry and backup generators maintained the supply, but water started spewing out of pipes, leading to low pressure. Heres the governmor. I have authorized a comprehensive review of what happened in the rl hours of the fire and the hours thereafter. We will build back together. We will find out what we could have done to prevent such loss of life, to the best of our ability. As of now, the best information we have is that in those hours when the fire sparked, there were several fires across maui. One fire was deemed to be out. It must not have been completely extinguished, because when the winds rose up as high as 81 Miles Per Hour, fire spread rapidly. We believe between 60 Miles Per Hour and 81 Miles Per Hour across that part of the island. And that meant that fire traveled 1 mill mile every minute resulting in this tragedy. With those kinds of winds and 1,000 degree temperatures, all the pictures you will see will be easy to understand because that level of destruction in a Fire Hurricane is something new to this in this age of Global Warming was the ultimate reason that so many people perished. You heard the governor there of hawaii calling it a Fire Hurricane, something new to them, he said. Pointing really at Climate Change and Global Warming. You also heard him say the flames spread 1 mile per minute. Thats faster than anyone could run. Its as fast as you can drive on the freeway. Heres a sense of what that was like. No, no, no, no. Not like this. No, not like this. Oh, no, we have to get out or something. Theres nowhere to go. The car, the car. They did get out. Those people are safe. They ended uptaking shelter on the rocks. Other survivors now struggling with what to do next as so many line up to try to get back into louiah lahaina. Reporter good morning. And whenever you are standing here talking to people, families, people who have lived here for decades, its an extremely emotional juncture for anybody who crosses through here. A few hours ago, we met a woman named susan who told us just what it is like to experience the dramatic change from this landscape to the moon skap of ash and streets, debris and explain to us in quite moving Terms Everything that she has seen. Listen to what she told us. When i drove through on friday, i had no clue what i was going through. I got everything is gone. I lost friends in there. They have gone back to get animals and she died. Its really sad because people come over here. I heard there was a Snorkeling Boat looking at lahaina town. Give them respect. Its so bad. People died here. Its not just a vacation place. We live here. Reporter to give you an idea of the contrast that were seeing, earlier this weekend on saturday, one of the route into the Disaster Zone opened up, ands it was organized chaos. Mostly chaos. It was about a mile long line to get in. Profound frustration, a lack of communication between law enforcement. People who were just struttggli to see if their homes survivored. Now theres a better system. This is the only way in. A counterclockwise direction on a map that we have made showing you the only way in to the Disaster Zone taking about an hour from this position that were in. A thousand feet above the Pacific Ocean into the area near lahaina. So people, again, trying to see what has survivored, as we start a new week here in the heart of maui. Back to you. Also this morning, were following a fourth possible indictment that is looming over former President Trump as the District Attorney in georgia prepares to present her case to a grand jury as soon as today, fani willis is expected to present evidence in her sprawling investigation in the election scandal. Heres cnns exclusive reporting. The prosecutors have Text Messages and emails that Show Trump Lawyer from behind the breach of a Voting System in georgia over the weekend trump continued to insist he did nothing wrong. Is there any chance you take a plea deal . We did nothing wrong. Thats a wise guy question. We dont take plea deals because i did nothing wrong. Its called election interference. Security precautions already underway at the courthouse in atlanta as Fulton County District Attorney fani willis is expected to begin her case today. We have working for two and a half years. Jeff duncan, the former Lieutenant Governor and cnn contributor, confirming hes been summoned to appear before the grand jury. I did just receive notification to appear on tuesday morning. The breach of Voting Systems is part of the probe. Sources tell cnn investigators have long suspected the breach was a topdown effort by trumps team the rather hasnt an organic effort by trump backers. And sources say they have Text Messages and emails that directly connect members of trumps legal team to that breach. Did you have any sense this was tied to other operatives in the Trump Campaign and beyond lower level people . Not initially, but there were allegations and then, as you dig down deep, more is revealed. Reporter Surveillance Video previously obtained by cnn shows a local election official escorting a team of protrump operatives in to examine the machines on january 7th. The group included scott hall, an atlanta bail bondsman. Im the guy that chartered the jet to go down to have them inspect all of those computers. They scanned all the image, equipment and scanned every single ballot. Reporter according to Text Messages obtained by cnn, former Elections Official offered a a written invitation six days prior to examine machines. That invitation shared with attorneys working with trump and others hunting for Election Fraud on behalf of trumps then lawyer rudy giuliani. Just landed back in d. C. With the mayor. Huge things starting to come together. An employee for the firm hired to access Voting Machines wrote in one text in a reference to former mayor rudy giuliani. But it was a weekend of risk and opportunity as this big field of republican candidates descended on iowa. President trump seized many of the headline, but his rivals opened this campaign in just five months. Reporter ron desantis and his wife Riding Bumper Cars with their kids. A weekend filled with the traditions that make the Iowa State Fair a stop on the president ial campaign trail. Desantis encounterred protests and support from many conservatives, as he walked through the fairgrounds. Which he described as a sign of strength. I think when the left comes out, thats a sign of strength because they know that we will beat bideooid be able to turn t country around. Reporter former President Trump took the spotlight when he arrived bypassing traditional fair events but greeting ad admirers. He trolled his leading rival by traveling with with florida Members Of Congress who are have endorsed him over their states governor. And with the looming fourth indictment expected in the coming days, he pledged to remain the front runner in the race. Were not take ing any chanc. So clearly, when we talk to a lot of iowa voters over the last several days and months, many of them have more open minds. Theres no doubt that the former president has his core supporters, but its always surprising to know that many people are just beginning to look at this race. Next week the first president ial debate happens on the republican side. That could reshape things as well. This campaign five months from tomorrow is when it opens in iowa. A lawsuit has been filed against hawaiis Main Electric Provider claiming that power lines blown over by high winds cause d by Hurricane Dora foresee bliss ignite d the deadly and destructive fire. The new lawsuit does not state how the power lines caused the wildfire. An official cause of the wildfire has not yet been determined. The blaze is americas deadliest fire in more than a century with more than 2,000 structures damaged or destroyed. What we saw on the ground is nothing short of catastrophic or heartbreaking. The president signed a major Disaster Declaration Ands was clear to bring every federal resource that we have available to help these communities recover. So the people of maui, the people of hawaii need to know they are not at this alone and the entire family is committed to helping them recover. This weekend being on the ground, the president sent a member of his cabinet and administrators joined the head of feama to get a sense on the ground, a survey in person of what the challenges this community will face. And what was very clear is this is going to be a longterm recovery. Its going to require a whole of government approach, a whole of Community Approach to make sure we get this Community Back ion its feet. Can you explain what that means . Whats so straking tos us is to see an entire Business District decimated. Often when we talk about these disasters, its several its not the entire area. What happened inlahaina. What can these Business Owners count on the government . What does it mean to them . Do they get made whole . We walk through that district and this was not only an entire district, this was an historic part of the community that has a lot of value. So beyond just the businesses, the impact that is reverberating across the state, for us, people think about Small Business and the role sba plays day in and day out building businesses across this country. Were uniquely positioned to help homeowners, businesses, renters and private nonprofits, so a Business Owner impacted as an individual, we can help them. We heard from local residents saying they dont want the sea tourists at this moment in time given the scale of the disaster. Theres a difficult balancing act. How fast can these businesses expect the tourism to reach them . Whats the length of time this is going to take . In terms of the resources that are available now, the president signed a declaration before the fires were even complete ly out. Our First Team Members were on the ground that same day along with fema. So only of these business members, this community was devastated. Some parts of the island are still operating. These parts of the community, the governor was clear when we met with him, parts of maui are open. People ought to respect that space, but while those folks are still getting to safety and stability, we are in the shelters with fema providing those resources. We are ready now. Some people arent ready yet, but when they are, well be ready to help. Do you believe theres been some concerns on the ground saying that the response from federal, state, and local has not been adequate up to that point. On the federal side, do you disagree with that assessment . Ill tell you what i saw on the ground. There were First Responders still doing lifesaving work. So were focused on our role and mission on the recovery piece, working with fema. Were on the ground now. Were working in those shelters now. Were committed to be here. New overnight, Hunter Bidens lawyers are arguing a deal they made to resolve the Felony Gun Charge against him is still valid and binding. That part of it at least. This comes in a new court filing just days after prosecutors have Plea Deal Talks with the president s son had fallen apart. This comes as Merrick Garland elevated david weiss to Special Counsel status. The big question coming out of this news over the weekend was, okay, trial now . Right. So in this filing overnight, they argued that the gundy version, they are saying thats a valid and Binding Agreement between doj and us. Doj in their filing on friday said that deal was done. This is obviously a wrinkle that is going to continue to fester here. We might see some more filings over that. But under that agreement, it meant that hunter biden would avoid this serious Felony Gun Charge if he abide d by certain terms for 24 months. The judge had a big issue with this saying she wasnt sure if it was constitutional because they had a role for her. Ironically, they put that in there thinking it would awe void the politics of the situation in case there was a question if he were in that agreement. Also in this filing over the weekend, Hunter Bidens lawyers saying that they are putting blame on doj for mucking this up saying that they have come to them to do plea talks and they have written these agreements that the judge had questions with. Now doj wanting to tear up, but one of his attorneys was on cbs this weekend and heres what he said. Its not inevitable. That youre trying to avoid one . We were try ining to avoid o all the long, and so were the prosecutor who is came forward to us and were the ones to say, can there be a resolution short of a prosecution . So they wanted it, and neighbor they still do want it. They are still hopeful they are able to work out some kind of plea deal, but the timing here is now very different. Can i take a step back here. I have a ton of questions about what this means or doesnt mean. What does the Special Counsel designation actually mean for hunter biden and for david weiss Going Forward . Its interesting that the Attorney General have said he had authority to decide whether, when and to bring charges. If its not in delaware, would they bring in it in washington or california. The Special Counsel does make this a formal arrangement versus him being told he had these powers, but it also gives the him a budget. So he could hire more staff if he wants to. Its also a question of why now . What has changed . Is there different evidence . This investigation has been going on for five years. So why now is still The Big Question that we dont have an answer from the Justice Department on of what was it that made it important to do this. But certainly means for one thing this this is not going to wrap up in a Plea Agreement in the next couple weeks. This is clearly going to be a longer process. Thank you. Joining us now for a panel is michelle price, White House Correspondent and senior legal analyst elie honig. I want to start with you. Special counsel, no matter how narrow the scope seems to be at the start, they have a long history or some it ration with expanding and creating major headaches both legally and politically. Whats your read on the intent behind this designation . They do have a history of spinning out. And ufs just looking at the actual document doj signed. And it basically says anything to do with the hunter biden investigation, which is quite broad, now that david weiss has been named Special Counsel, he does have a bit more independence separation from the Attorney General. My big question is why now . Why in a case thats been going on for five years, four days ago there was no need for a Special Counsel. Now there is . What doj said is extraordinary circumstances. Whats extraordinary now that wasnt five weeks ago when they were day to go in court and ready to wrap this up for a misdemeanor. So doj has botched this. And the way this has played out has lent credence to the whistleblowers. That issue of what the whistleblowers said and did interviews on this network and testified before congress isnt what came up in court when the plea deal fell apart, but it seems to be more and more relevant right now. Its also interesting that if the Attorney General overrules the Special Counsel, you get transparency. You have to Tell Congress why you did it. And thats really important right now is transparency. I want to play something that President Biden said on may 5th from msnbc. Its days before this original plea deal came down about his son hunter. Here it is. I my son has done nothing wrong. I trust him. I have faith in him. I know its his son. Hes also the president. It is Merrick Garland,s it is this Attorney General of this administration overseeing everything. Theres a lots of questions now about whether the president should be talking about this at all. He usually doesnt. Thats a comment that has not aged well given the fact that his son ended up agreeing to a plea deal thats now fallen apart. The political ramifications of this are huge for President Biden. Its certainly not what he wants to see that this is going to be dragged out in the middle of the campaign now as he goes into the fall and into a general election next spring. Its a political weakness for him not only because of the fact that it will be a story, but because of what was exemplified in that quote. He loves his son and has a little bit of a blind spot for him. Its something you can understand for a father and son, but politically, its tricky. Theres some frustration behind t she scenes they are no going to talk about it, but frustration that it got to this point. They know this is only going to prolong this issue. I think so. And frustration within the campaign as well. I think what each side can i say, the white house would want to say even less than potentially President Bidens campaign because President Biden has said from the very beginning that doj is independent, whether its on this or President Trump, that was a big contrast he wanted to make to the previous administration. But its going to be hard for reporters to cover and others out there not to be asking him about something with relation to his son. Obviously, were watching georgia right now. A leading contender for the republican nomination is facing his potential fourth indictment. At this point in time, do you think voters care . Im not trying to minimize anything, but people can get numb to this. Its really hard to understand given how many there are. The question is which voters. Is it changing any minds though . Probably not. For democratic voters, this adds to the pile that they feel about donald trump. They have a long list of reasons they think hes unqualified to be president. Republican voters, theyll tell you that they think donald trump was a great president and think he did wonderful things. Maybe he did something that wasnt on the up and up, but it wasnt a crime. But they see all of these as a vast conspiracy against him. I think you bring up a good point. Someone over the weekend asked me, an independent voter, i i dont understand why they are all coming now. That is a great question. And i have been sort of banging that drum for the last couple years. He will have a rerhetorical point. By all these prosecutors, isnt It Interesting that nobody charged anything until now. And four of them come in a three or fourmonth stretch. How do you explain that . Partially, each one is its own story. Merrick garland just had inertia. He had no appetite to do this for the first year and a half. The political winds got strong enough. I think garland has shown himself to be a wind sock. When the political pressure goes too much, he goes whichever way its blowing. He didnt want any part of it until thecommittee and then wha does he do . He appoints jack smith. Same thing here. He was hoping the case would go away with a quick plea. Political pressure, Special Counsel. Its not a strong way to be. Based on your reporting, wind sock aside, inside the Justice Department, what is read on their read on this . They are not saying anything publicly about this. But i think ellie raises a good point that the performance in the court with the Plea Agreement, it all started to go off the rails. The prosecutors and the team were not on the same page of the immunity deal. There are these questions from these whistleblowers. They make some points. It seems that they are probably even though doj is not saying anything, they have to be responding to the political pressure because that seems to be the only thing thats difference different in the course of the past couple months thats changed. The community now has to rebuild one family is among those facing that daunting task. Joining us the kids whose parents lost their home. Tasha is a firefighter in maui and helped battle the blaze. And the human toll has gone up sadly over the weekend and is expected to rise. Batting the flames of this, as youre also trying to cope with your personal tragedy of losing your loved ones, how do you even do it . Support from each other, support from the firefighters and First Responders. Were all in this together. We have all lost something. Stay focused and stay busy. You mention ed that there ar some in your family that you have not gotten in contact with yet. Can you talk about the process right now of trying to reach people given the scale of the devastation. We have heard from so many families that are in the same exact position. What does it entail . So from august 8th, from the first day of the start of this horrendous tragedy, we went from no contact to finding them. So luckily, the Lahaina Community came together to help with that. Social media really pulled through. Right now, come from a very large family. And we have one uncle not accounted for. From the story from his wife, what she saw firsthand, were still looking. Thankfully, cell four phone towers are going back up. Were getting more communication with family and friends. But its still hard. Our viewers can see on your shirt that youre a firefighter. And you have been out battling this blaze while trying to cope and be there for your family. Can you speak to what it was like on the ground battling these flames that at times were moving more than a mile a minute because of the high winds. It seems surreal. It seemed like an apocalypse and everything seemed to be on fire. It was really hard to focus at times, but we had a job to do. And stood by while people watched their houses burn. They kept continuing to fight. Its still surreal. I think no matter how many times we see it every day going back to help, help put spot fires out, it seems like a nightmare that were trying to wake up from. Every day, every hour seems to get better. Can you tell people what do you need right now given youre on the ground, youre helping people and still putting out spot fires for people watching and have only seen the pictures, what does the Community Need right now . I think the community right now is healing. They are stable with resources that we have had an outpouring of support from our island, from the continue innocent, from our community. Supplies wise, i think were stable. Give us time to heal and let people get set, and then were going to need a lot more. But right now, we just need time. I know a lot of people are eager to get back into louisiahaina ae whats left, but give our First Responders time. Let people clean up the area and make sure its safe before coming back.
