Reporter good morning, rahel and amara, it looks like all systems are go for the Fulton County District Attorney to present her case to a grand jury this week, possibly as soon as tomorrow. In the investigation of former President Donald Trump and his attempts to overturn the 2020 election in georgia. Cnn previously reported this was expected in the coming days but we know that some of the key witnesses that were subpoenaed to testify were told specifically to show up on tuesday and the grand jury meets on mondays and tuesdays. One of the witnesses is george chidi and in 2020 he witnesses some of the fake protrump electors meeting in the state house in atlanta. Another key figure who will head to the grand jury this tuesday is former georgia Lieutenant Governor jeff duncan. Here is what he told our colleague Fredricka Whitfield yesterday before the subpoena. I did just receive notification to appear on Tuesday Morning at the Fulton County grand jury and i will be there to do my part in recounting facts. I have no expectations as to the questions and ill answer any questions that were put in front of me and i dont want to jeopardize the investigation. This is a story that is important for republicans to hear, americans to hear. Lets hear the whole truth and nothing but the truth about Donald Trumps action and the surrounding cast of characters around him. Dungeon who is now a cnn contributor was a republican and was in office when trump tried to pressure State Officials to flip the results and overturn the will of the georgia voters. Fani willis, an elected democrat, launched a probe in 2021. The investigation has steadily expanded over the years and fani willis is now scrutinizing trumps attempts to interfere with the Vote Counting and the election certification, shes also looking at fake electors scheme as well as breached by Trump Supporters of an Election System in rural coffee county. State prosecutors are expected to give that one or twoday presentation to the grand jury this week. Presumably starting tomorrow. Cnn has reported that prosecutors are eyeing racketeering and conspiracy charges known as rico. And fani willis is expected to pursue indictments against perhaps more than a dozen defendants, trumps allies in the state of georgia. Now the former president has already been indicted on federal charges stemming from his attempts to subvert the 2020 election and disenfranchise voters. He pleaded not guilty in that federal case and hes argued that the atlanta probe is just another witch hunt. Amara and rahel. Thank you. And for a closer look at how a fourth Trump Indictment could potentially play out, lets bring in darrell cohen, hes a former Fulton County assistant District Attorney. Welcome and thanks for coming in. Thank you. Good morning. Lets walk through how all of this will play out. There is a grand jury presentation by fani willis and testimony and also talk about the timing, when you expect an indictment if there is one to be handed up . I suspect there will be an indictment this week. And the testimony will be very simple, it is short. The investigate grand jury put it together. They wrapped it up and put it in a ball, put it in a nice piece of evidence. Now this grand jury has the ability to indict or a have a true bill or not indict. And when i was in the d. A. Office, the grand jury would indict a ham sandwich and here it is donald trump. And this is been a complete circus and it will continue to be a circus because were speculating. Im not talking about the d. A. s office doing the circus, but it is part of it. It is the law of unintended consequences. One people that the grand jury will hear from is republican jeff duncan and i want to explain what he told my colleague about this and then well talk. I think this indictment is given than the others is that there is 12 plus coconspirator yois and these folks dont have the same level of loyalty to donald trump when he was trying to change the election outcome in 2020 so it is interesting to see which way they go. These are serious charges. Racketeering, conspiracy, and rico. Those are things really kind of garners for the mafia or the mob. There was a lot there. One, just the sprawling sense of this investigation in terms of who else might be sort of involved in this, coconspirators, but also the potential charges. Walk me through the standards that wove to be met po pursue charges as such racketeering or conspiracy. To start with, the grand jury doesnt mean as much as a real jury. They are saying we have enough evidence that we believe we could do forth and obtain a conviction. A real jury, once it is out the grand jury stage, once a true bill or official charges has been brought, the jury has to died, if it gets there, if they are guilty beyond and to the exclusion of every reasonable doubt. So that is a whole different situation. When we talk about the rico, the best and the worst. The racketeering. The racketeering. It means that the d. A. Office of fani willis could reach out throughout georgia whenever something was criminal related to this incident and bring it in to the indictment, bring it into the trial. That way something that happened in a different part of georgia could be made a part of the trial that will take place here in Fulton County. That is great. The bad side is, it is a lot more difficult to prove and also we talk about the number of people indicted or will like by be indicted. When it is me that is going to be indicted, im going to start rolling because im going to worry about my own skin. I do not want to go to prison. I do not want to be convicted. If it is you, then it is different. It is no longer you, it is me or we. I want to ask you about some new reporting that we have. And that is that atlanta prosecutors actually have theyre in position of Text Messages and emails directly kecking the Donald Trump Legal Team to the january 2021 Voting System breach in coffee county. Thousand significant is that . By itself it is not significant at all. Put together piece by piece it becomes extraordinarily significant. Because you could charge someone and you go, okay, well what did they do. But here those texts will show a line, a direct line to what took place in Fulton County and as a result of that, it is going to take a long time to try this case because youre going to have to convince every juror, not just one, but all 12. And some of the alternates, that what they are charged with, that is the defendants, that their guilty of. And though we havent seen the indictment, i could speculate it is going to be lengthy, and it is going to take a very long time to prove it. Can i just ask you really quickly, were running out of you know fani willis. She has been attacked by the former president and others. What could you tell us about the way she works, what could you tell us about fani willis . Shes honest and shes a career prosecutor. She was out for a little while defending people. She does what she thinks is right. She doesnt do it for political reasons. She does it because fani willis in her heart knows the law and knows the ethics and what should or should not be done. And the fact that shes attacked, id be surprised if she wasnt. And also were talking about some dry run this is week and security outside of the courthouse. So the preparations have been made and well see how it all plays out. Darrell cohen, thank you for coming in. Thank you. And turning now to the lahaina fire. The death kntoll now stands at. They are warning that the death toll will go up as crews make their way through the hardest hit areas. It was so vast that so far it is hard to believe, only 3 of the fire zone has been searched with cadaver dogs and this morning frustration continues to mount for survivors hoping to return to lahaina and check on their homes. This shows the line of cars trying to get back to lahaina. The main highway has been opened and then it was closed and then opened. Most times with little to no warning. Lets bring in gloria pass meano, what are you seeing this morning and what are you hearing this morning . Reporter yeah, and that video that showed of the cars lined up, that was here in this place where we are standing right now yesterday. This is the area where people were told to come if they wanted to head back into lahaina, to give them a chance to get an idea of what happened to their property, what damages the buildings have suffered to try to assess just how much people have lost. Now i want you to give an idea of exactly where we are. This is route 30 right here. And just behind us is a highway that would lead into lahaina. There is only one way in and one way out. But as you could see right now, this is pretty des ol at with the exception of the Police Vehicles because this road was closed to Passenger Vehicles yesterday. And it is exclusively now going to be used as a road for convenience vehicles and convoys of supplies and other kind of official vehicles that are coming through the area to help in the recovery efforts. Now that is creating a lot of frustration. It is hard to navigate around the island and people are being sent to another location which would take them much longer to loop around and eventually make it back to where theyre trying to get to, to town. So that is creating a lot of frustration and anger among people here who are tieing to get back. I want you to hear from them directly while they were waiting in that line here yesterday. They told us that three miles back, or it could have been a bull horn or on the radio. Just pathetic. But the route theyre trying to make us take is a dangerous route. Even on a good day. Were just trying to do the best we can buts it really frustrating. We havent had a place that could open up and power for people to stay but they cant get to it. Reporter now, you could hear there that people are starting to lose patience. Now i do want to note the reason they are being so strict is because the area remains extremely dangerous. We heard from the governor and other local officials yesterday that the reason people are not being allowed back in is because it is just simply not safe. More importantly, is the fact that search and recovery operations are still ongoing as you said. Only 3 of the area has been searched. We are expecting the death toll to continue to increase as those teams get out there with cadaver dogs hoping to find more victims and just trying to get a sense of how much has been lost here. But caught in the middle are the people that are trying to get back and trying to get a sense of what they could do next and how they could start what is going to be surely a long recovery efforts. One resident believed he was going to die and he called his family and said goodbyes and they were forced to jump over the sea wall to stay safe from the flames but they did make it out. But with no cell service he wasnt able to tell his family that he was alive. But eventually as you could see in the photo, they were reunited. And this is all that is left in jordans neighborhood. He and his grandmother got no warning to leave and didnt make a run for it until it was almost too late. When they saw the flames approaching, that is when they knew they had to leave but with only one way out, they didnt know if they would make it. We were inching, we were not moving that fast. So what felt like maybe only been five to ten minutes felt like an eternity because you watch and see the smoke get closer and see in the furthest distance of what you could see through the houses or the trees, is things catching on fire already. Were joined on the phone now by steve scott who made a narrow escape himself when the flames rushed through maui last week. Thank you for being here with us on the phone. So walk us through what happened to you and your family on tuesday . When did you first notice that the fire was approaching . Well, the winds were just extremely, you know, high, maybe in the 50 to 60mileperhour range. And then we smelled smoke and then started seeing a fire over at Plantation Inn there on lahaina luna road. And i got a hose and a special nozzle and i was getting the roofs and trying to fight the fire. My wife was behind me. And she was trying to fight the fire when it just totally trapped us. We literally dropped the hoses and i didnt have a chance to grab my wallet, a single thing. We left and ran just ahead of the flames. We ran over to the harbor and the flames were coming right behind us. I then put her in touch with a friend and ran her down to prison street, walked her down there and then i went back to see if i could fight the fire a little bit more. Jumping in the ocean was not an option for me because at the harbor the boats were on fire leaking gas and oil into the water. So the water was on fire. So i didnt see that as an option. But my wife and i got separated for about 30 hours. Wow stayed in lahaina because that is our home, that is our culture and that is our history. I mean, there is so much history and artifacts and lahaina town is everything. And just could not get in a car and just drive away. We had to fight. Talk to me a little bit about what communications have been like. You and your wife were separated for 30 hours. How did you reunite and reconnect . You know, truly, i need to have a sign made or something in a future home, we lost everything. We lost our home, my car blew up, i mean everything. Literally my shirt. This is our fifth night in a car and we dont even know whose car it is. Were here at the harbor, i heard a description. We are next to the highway that leads to the west maui and of course we cant go anywhere. So this was our fifth night here. Now, we can get separated and truly by kind of tremendous grace my wife was able to make it somehow, she had been Fighting Down in poco and olawalu, as she got pushed further out of west maui, she ended up making it to walmart to get a charger. I dont know exactly how she got there. I ended up fighting and then a Police Officer asked me to take some people in a vehicle to the hospital. And i didnt want to leave west maui but i went ahead and did it. And now im in that car, i took the people to the hospital and now im in the car and i dont know whose car it is. It is a nice car. So she got a charger and started somewhere charging her phone and i found a man who had 6 left and he had no family. He lost everything also. An i said could i use your phone to make one attempt to call my wife. We had one shot. And i called and she answered. Unbelievable. Wow and i just said bee quiet, get to the mcdonalds in and i will get there and no matter how long it takes. So we both, i got there and she wasnt there. This big truck pulls up, big diesel truck, i had no idea who this was and she was in there. She pops out. So we got together again, i guess Late Wednesday night or thursday morning. The days are kind of funny. Yeah, steve, you know, it is so nice to talk to you an it is so nice to hear this story of you and your wife reunited in the midst of awful tragedy. It happens every year. But back in may, we knew Ocean Temperatures were warm but it was going to be an el nino year, and that suppresses hurricane activity. I think what theyre noticing is those Ocean Temperatures are so far above normal that theyre thinking thats likely going to be able to compensate for whatever el nino may try to suppress. They did increase their numbers. There were 12 to 17 named storms. Now 14 to 21. The low end, 14, is what we would normally see in a normal season. Hurricanes we went from 5 to 9 to 6 to 11. Were increasing in an el nino year thats the takeaway here. When will we see the season peak . The specific date is september 10th, the peak of Hurricane Season, but its the second half of august up to october 1st. Thats the busiest six weeks traditionally speaking, so we have yet to hit that part yet. Thats another key point. I know things are coming in a low period right now, but we have yet to hit the peak part of the season and were just about to enter that phase. It feels like the atlantic season has been quiet.
