Declaration for hawaii. The lead starts now. Unprecedented disaster. New images showing the power of flames ripping through communities in hawaii. The death toll rises to 36 as crews anticipate that number growing even higher and President Biden 6 billion deal with iran, will the regime free Five Americans in exchange for frozen funds . The first steps in the works, plus the deepest dive yet into the lavish life ill Supreme Court justice, clarence justice, private planes, luxury trips all bankrolled by billionaires detailed by propublica and never disclosed. Welcome to the lead. I am jake tapper. We start with the other did it of the utter devastation in hawaii. A lack of power and cell service complicates Search And Rescue efforts. At least 36 people have been killed in what the state Lieutenant Governor calls unprecedented wildfires. Most of the wildfires on maui island are still not contained. It could take days or even weeks for power and Cell Phones Service restored. Issues that are making it incredibly hard for survivors to know if their friends and family are okay. I have extended family. My grandmother, my uncle, my friends. We are looking for them. So many people have gone missing. I will say it is an unspoken that the death toll is way higher than 36. This afternoon President Biden approved the Disaster Declaration for hawaii includes money for temporary housing and for home repairs. The states governor estimates the damage to homes and buildings will be in the billions of dollars. Cnns Veronica Miracle starts off our coverage from maui, hawaii where one resident tells her it looks like a bomb went off. Its time to go reporter chaos and panic as the wildfires ravage the island being lost and destruction in its wake. Some residents escaping by boat watching the flames engulf their town as they sail away. We caught up with volunteers in harbor while they were loading up supplies. We had five bombs so big they were sucking oxygen out of the air. I think this is an absolutely top Level National disaster. We have never seen anything like it in 32 years. Reporter we are just beginning efforts. What we see is justice widespread devastation across many different neighborhoods in maui. Families waking up today after losing their homes, possessions and or some for some, their pets. It transformed overnight. Everyone that i know and love, my colleagues, friends, we are all homeless. Its extremely traumatic. There is a lot of emotion and trauma that will have to be dealt with for the whole community. Reporter the kos card pulled more than 50 people from the ocean but jumped in to escape to flame. Can see their bodies floating. Reporter nearly 11,000 customers remain without power. More than 2000 residents are in shelters and many travelers still stranded on the island. The National Guard reports they dropped one 50,000 gallons over the fires to help suppress the flames and all the flyers fire still rave ray john. Reporter Lieutenant Governor sylvia lake toward up by helicopter and was shocked. It looked as if the whole town was demonstrated devastated. Jake, these volunteers put out a call for help and all of the supplies came together in the last hour. They will be loaded on a boat and taken close to lahaina. They need gasoline. We are told some people are not able to leave because they dont have enough gas in their car. That is why supply runs like this are so critical. Jake . Reporter Veronica Miracle on the island of maui, thank you. The faa is restricting flights so Search And Rescue can complete work but there also are evacuation flights. For some of those people they touchdown with only the clothes on their backs knowing their home and all of their belongings are gone. Cnns mike valerio is outside the Convention Center in honolulu which has been turned into a makeshift safety center. Reporter jake good morning from honolulu. I think that to a person you hear expressions of profound gratitude. Everyone here is coming fresh off the flame from the epicenter of the disaster. We have been here since about midnight local town. I think that what has been so moving is when you see people come off these buses straight from the International Airport and you see in their faces expressions of laurel, exhaustion, families who have witnessed so much from this Disaster Zone that they never thought within the realm of possibility. To that end you will hear who a man from a man who is coordinating this Convention Center into a makeshift shelter. Also a woman who witnessed the devastation of the Disaster Zone. Listen to what they told us. We talk a lot about aloha, right . The value. We talk about the value of malama to cherish. Its one thing to talk about it and its another thing to live it out. Its devastating to see how much damage has been done. The entire hillside on one area where a lot of houses were wiped out. Then the other section of town where the old Historic Town was just a black and ruin these are intricate beautiful, sand castles. Think of the beautiful sales of the ships. All wiped out in a matter of seconds. So arresting for people to so wrapping up the plan here for the rest of the day authorities tell us they only cared for about 100 or so people overnight but as this Evacuation Operation becomes more of a finely Tuned Machine out of maui they are expecting more people whose lives were horribly disrupted to come find us alice here or at least a temporary spot where they can regroup and figure out how to go on from here. Jake . Mike valerio, thank you. Joining us a resident who has drone video of the wild fires. Clint, one of the worst things about being a journalist you talk to people on their worst day on one of their worst days and i am sorry to be doing that now. How are you and your family doing . How are your friends doing . We are one of the lucky ones. Im here on the south side in a fire that we had start over here and it ended up petering out on the wind and the wind has been the biggest Driving Factor in fueling the flames. Now he has had multiple fires that we have been juggling and its part of the reason why resources are gathered so thin because firefighters were dealing with evacuations. I was taking footage throughout the night working to make sure people understood where we sat and how disaster it it could be and whether or not we are able to get over this. It got pushed to a gully where the wind stopped and that created a natural firebreak so as of right now my main family is all safe and accounted for. I also own a Paintball Field on the west side and a lot of our friends are missing. We are so cowering scouring the regular locations. We are hoping this is just a Battery Issue or Cell Phone Tower Issue but its really terrifying and as i have heard and we all know this number of 36 people passing away will grow dramatically as time goes on and Rescue Efforts continue. We are asking everybody to pitch in and help. We already made multiple runs to drop off supplies and food and clothes. Diapers, wipes, anything that is of use. Toiletries. And i have had clients reaching out offering their Condo Vacancies up for people who are without shelter to get a couple of days and a nice bed and warm water. If they are able to make it over here on the south side but hospitals just way over capacity. Thousands of people with injuries there and let alone the number of is just well above 36 even though that number seems to be the official. Thats the number of the confirmed dead. And we can also tell our viewers the way they can help visitors of miami. You have described the devastation as the worst day maui will ever have. What is it like to watch part of your community disappear. I cannot fathom such a thing. It came trickling in. Without the communication we were only getting a few images and it was mostly just verbiage and descriptions. This building gone, this building gone. Pioneer in gone, harbor gone, it doesnt register her. It sounds like words. It cant possibly be true and then when you see that it literally all gone, it blows your mind. To have a fire storm moved through and burn every vote down to the waterline doesnt seem possible but running for their lives and jumping in the ocean to escape and one of my friends has fortunate enough to talk to his mom on the phone. He had to jump into the ocean. We didnt hear from him for a day and fortunately he was able to survive. Him and his girlfriend are badly beaten up both emotionally and physically. Part of the reason they survived was it took so long to walk to the shelters and he was able to help multiple people on the way out here which is why it took them so long to get there. Is somebody who knows about real estate, you have an idea for construction and such. Do you have any idea how long it might take to rebuild . Malley is notorious for having issuing permits. We have to come up with some other process because our county is lacking enough position to do the job appropriately. I dont know if that means outsourced adding or changing the dynamic where its more of an insurance bond against to make sure its safe as opposed to putting it on the insurance, but to replace or even put a dent in what has happened, our Current System cannot keep up so thats one of the things i have been scratching my head. There has to be a really big and draft changed in order to put people in a timely manner and the biggest fear is people will have to leave. There will not be a lot of options with being so isolated. People will have to move to the mainland and the only thing i can think is maybe provide them funds and provide a certificate for having first option on properties once things are rebuilt back in hawaii. Five wrongfully Detained Americans in iran have been released from a notorious iranian prison and are now on house arrest. This would be the first step in a deal that includes the United States government agreeing to release a half billion dollars of as of now frozen iranian funds. Today the three named an Unnamed American and attention were removed from rons prison to a tel guarded by iranian officials. A Fifth American was already on house arrest. Cnns kylie atwood reveals how two nations with no armored diplomatic relations made this deal. Five americans who have been imprisoned in iran are now under house arrest. A major step towards freedom. This man is. He has been imprisoned in iran for years. The identity of the other two americans is unknown. The deal could make 6 billion dealers in iranian ones held in south korea more accessible to to ron while maintaining strict limitations on how those funds can be used. Thats according to a source familiar with the negotiations. Iran also said that five iranian prisoners in the u. S. Would be released as part of the deal. The Biden Administration still needs to work out some elements of the agreement in the coming weeks. This leaves plenty of room for something to go wrong. All we know now today is that they are out under house arrest and what happens next is anyones guess. National Security Council spokesperson called their moved to house arrest an encouraging step that the Biden Administration will not rest till they are back in the u. S. Calling ongoing negotiations delicate. This man is the longest held american per mizner arrest in 2015 and left behind in multiple deals between the u. S. And iran that freed other americans. His brother telling cnn this 2021. Each time i saw lights at the end of the tunnel it turned out to be a fastmoving train on or jeanette lee. He was so desperate to get out that he courageously called Cnns Christiane Amanpour from behind bars this year. The negotiations to secure the release of these americans are separate from conversations regarding Irans Nuclear deal, Nuclear Program excuse me according to a source familiar with the negotiations but progress here could of course facilitate forward progress in other areas according to that source. Cnns kylie atwood, thank you. Lets talk more about this with jared answer the pro bono counsel. Jared he was arrested in 2015 for having relations with a hostile state hes a dual iranian u. S. Citizen his dad was lord to iran and also time behind bars although he was later released so he could get medical help. Both men deny ever doing anything wrong. Irans government ever attempt to share any evidence of wrongdoing with you . It was very narrowly shared. Had been repeatedly interrogated on a range of things. He was being questioned about those things but there really was no trial at all. In fact he was taken with his lawyer to meet the judge who handed him a 50 page judgment. He was not able to take that with him, just take it with him. To say there was new no due process is an understatement. This is a great step forward. It undeniable. There have been so many attempts that have failed. If i had a dollar for every attempt i would have 100 by now. This is important and at the same time as noted we need to take this through its final confusion and i was heartened by hearing the iranian government say that they will be pardoned and exchanged for iranian prisoners in the United States. The fact that they publicly committed to that is great but that at the end of the day we know we can count on anything. How will life under house arrest in iran look like . So i think its better than one might imagine. They are being held in a hotel and Five Americans are being held together and are able to talk to each other. They are able to have better food and have their own bad and their own shower. When they were living in the prison they were in dormitories with eight or 10 people. Lets just say not so high quality food so it a step forward. I think all of them no better than anyone got until its done, its done. Stay in touch. On the u. S. Southern border and this is cnn. This news just into cnn. Supreme court has blocked purdue farm. A manufacturer of oxycontin from Going Forward with Bankruptcy Proceedings and a 6. 6 billion settlement. This was part of an arrangement that would ultimately offer the family the founders of purdue farm a broad protection from opioid related civil claims. The Supreme Court says they will now take up this case and hear arguments about it in december. Lets bring in an cnns jake casarez. What exactly was in this settlement began in 2019 when the bankruptcy was declared by Purdue Pharma, all of the civil suits and there were so many around the country against Purdue Pharma. They all were channeled into the bank rips the action. That was one of the first things they did and people need to realize how huge this was. This involves states and counties and townships. Three and i remember being in the courtroom and it was filled with attorneys. So they started negotiating and they have been negotiating for years on this since 2019 and theyve finally determined and there is a handful of states that were opposed to this, but it was very symbolic. They decided that what would happen is that they would pay out approximately 6 billion to individual payment to states to of Treatment Procedures involving Crisis Medications that could be given to people and in lieu of that and their names would be taken off things around the country also was part of it, but in lieu of that they would not face civil suits Going Forward because the monies would be going toward everything i just described and here is the impact of this. Those people that were there some and that they wanted money and 6 billion is going to all of that. This will be stopped in its tracks so no community or medications will be going for the shirt harm to those entities that dont need it. Joan, are you surprised the rest of court has not only blocked this settlement that had been agreed upon but that they will also take up the case . Jake, those are pretty dramatic terms that gina just outlined and the Solicitor General of the United States actually use them in the argument to try to get the Supreme Court to intervene and say this is an exceptional agreement and unprecedented. The scope of it is something that maybe should be block and in encouraging the justices to pick it up say lower courts are divided out there on situations when parties can be released from liability so it is in some ways surprising that they are intervening but this is the most crucial stage and they have said it on a pretty fast track. They have ordered a quick Briefing Schedule and the case would be heard in early december with a resolution probably by the end of june of next year so when you think of the Opioid Addiction Crisis in america and the responsibility of Purdue Pharma and the Sackler Family this is a pretty unprecedented settlement thats why the Supreme Court has intervened. Thank you. Lets bring in the attorney general of ohio. One of the eight states as well as washington, d. C. That are part of the 6 billion settlement. You might remember ohio is one of the epicenter of the opioid crisis. Generally ghosts, thank you for joining us. Did you want the Supreme Court to pick up the case or did you want the settlement to move forward . We wanted the settlement to move forward. This is money thats not going to individual claimant families. Its not coming back equally important to our communities and to our states to fight back against this avalanche of addiction that was architected by the sacklers. Im going to ask you a question i have not asked anybody before. What is the best argument for the people who disagree with you . The best argument being made by people who want the Supreme Court to review this case . They disagree with the settlement . I realize im asking you to State Something you dont agree with, but what is their best case . Well, i think theres probably two arguments on the other side. The first is a lack of due process in the discharging. Fundamentally unfair to let them walk away. The problem with that is that under the law we can get to Purdue Pharma. The individual family money that is behind that is much more difficult legally in most of our states. The other issue which is a policy issue is what we do with these mass torts that are no mass that they are existential lawsuits and to maximize the recovery for the the done you have to have some means of marshaling all these claims. And this is going to be an interest argument. And your argument is, correct me if im wrong, there are people in ohio and others aides who need help now, who need that money now. Organizations that need to help people who are still suffering in this epidemic that continues to take thousands of lives per year, is that right . Thats correct. And as the Court Of Appeals says bankruptcy is a creature of compromiser. It a messy process of competing interest. We have seen preliminary data showing Drug Overdose deaths have leveled off but more than 100 thousand americans losing their lives and most of them i believe opioids. How is ohio working to alleviate the crisis . Well we have a coalition the one Ohio Foundation that has all of our local government and state governments sharing the money from these various loss to bring it back to the local level for treatment for Prevention Enforcement because this war is fought on the ground of our streets and our cities and our counties and so important to get this money flowing. Since 2019 it been this bankruptcy proceeding. It is the best thing i can say about todays decision to hear the case. At least they set it for december can you merit imagine if terrorists killed 100,000 a year . Thank you so much for your time and ours as always we appreciate it. Thank you. Of course i am talking about the friends of Supreme Court justice, clarence thomas. Tom foreman explains the new urgency about questions of transparency and ethics on and off the bench. The most complete accounting yet of the highlights of Supreme CourtJustice Clarence thomas shows much more than previously known. More private jet, more fancy vacations, more sporting events. Reporter Justice Thomas has been living a life of extreme luxury for 30 years underwritten by at least four different ultra wealthy benefactors. Earlier reports revealed lavish gifts including a house for his mother and this nine day vacation in indonesia from Conservative Billionaire harlan crow. I come from regular stock. He also wrote a film about the taste. Now benefactors include three more names according to propublica, david soquel, wayne and tony novelli. The report says the four moguls 238 destination locations including a previously yacht. 26 private jet flights plus an additional eight by helicopter. A dozen vip passes to professional and College Sporting events. Who stays at luxury resorts and one standing invitation to an over exclusive golf club. The dollar value . Likely in the millions. Little of which appeared in wired Financial Disclosures according to propublica. Thomas has previously said he did not feel the need to disclose gifts and that worries jeremy fogel an Expert On Judicial Ethics and a former judge. Even if the people involved didnt have interest before the court its just the idea that you are receiving gifts of this magnitude Associate Justices make about 285,000 per year. Reporter these new benefactors like harlan crow came into his life after he was appointed to the Supreme Court and thats why it is so problematic to and ethics standpoint. There is no evidence that these rich friends of roque any laws by giving these extraordinary gifts and its under clear if thomas did anything wrong by accepting so defenders of the benefactors of the justices are calling this a smear job but the earlier Relic Revelation spurred an outcry to come up with much more strict and transparent rules about thats such financial matters in this report will only make that drumbeat louder. Todays former Vice President mike pence is there. President trump will attend this weekend with his New Hampshire in public and governor to discuss you not heading to the fair but you are in the first in the nation. I know you are involved with candidate and other ways. You say you are not ready to in dorset a republican candidate yet have not ruled out endorsing a third party no labels picket. Not really. Im not really talking with them other than i know there path to fill the gap. If it were a trump bided ticket force have any percent of america they dont want to but my sense is theyd probably have to make the decision sometime next spring. The good news is i dont think its going to be a trumpbiden ticket. I really dont. I have my doubts on both of them even though i understand theyre leading in the polls today. Long way to go before iowa and New Hampshire. And already if you just check on the republican side, trump is having trouble in the polls here. Three out of the last five polls have him under 40 . So where the conversations are happening some of these other candidates are Making Headway and theyre slowly separating. And we havent even had the first debate yet. So i think theres just a lot to come in the next few months. Is it possible that after the Iowa Caucuses and as the candidates head east to New Hampshire you will endorse someone, especially if it is an important imperative to you to have a strong nontrump republican candidate . Oh, absolutely. I think i would consider that doing that even before the Iowa Caucuses. Look, im not sure 100 how much my endorsement helps or doesnt help. But i do believe in narrowing this field down. I do believe my sense is getting it down to five or six candidates into iowa, four or five going into New Hampshire, and then coming out of New Hampshire you really have a one on wynn race with the former president and somebody else. And thats where hes in trouble because he cannot hold 50 of the republican base. Perhaps one of the reasons why is because hes now facing three criminal indictments, with a fourth possibly going to come down soon in georgia. Here is you and what you said a couple months ago about the classified documents case against trump. Everyone has to be very straightforward and transparent about it and acknowledge the realities of the severity of these accusations. This is nothing like we have ever anything weve seen before. And theres very likely i think going to come down to some type of guilty verdict on the president , at least on some of these charges. Now, we should note you still have not ruled out supporting trump if he does become the republican nominee for president though youve made it clear thats not your preference. Can you explain how a vote for biden would be worse than a vote for a man that you believe could be a convicted felon . Well, look, its not going to come down to those two. And i have to say, if trump loses, and when he loses, its not because of the indictments. Its really not. Its because were moving forward. Were not going backwards. Thats the bigger when you talk to republicans on the ground, theyre not saying gee, im not going to be with him anymore because of the indictments. Theyre saying im not going to be with him anymore because we did that, its yesterdays news, we need a fresh face and fresh ideas and moving this country forward. Its really not about those indictments directly. I think joe biden has a lot of problems. Obviously whether its the hunter biden issue, even just his own health. I mean, god bless him, hes a very older much older guy. He doesnt quite have his fastball. Neither of them do. I think theres an opportunity for both parties to find a generational move forward with kind of that next generation, that next kind of push of energy, someone that can galvanize on the republican side young voters, independent voters, suburban moms. If youre not doing that, were not winning, guys. So we need a candidate that can close the deal in november, and obviously the former president , it aint it. This week at a rally in your state donald trump vowed to bring a full Service VeteransAffairs Hospital to New Hampshire and then he slammed you for being governor of the only state that does not have one. Take a listen. The only state that doesnt have one. Its because of our corrupt governor. Ah. I was waiting for that, actually. Selfish. Selfish guy. At the same time well, he ran for president and he got two points. He ran without running. You know, he didnt want to announce. He wanted to run but its a shame. All right. Just a quick fact check. Theres no evidence that youre corrupt. I dont think youre selfish. But thats my personal opinion. Thank you. And you did not run for president. But beyond that let me just ask about the substance of that. Do you have any plans to bring a full service va hospital to New Hampshire . Is that something that you want to push for . And what is your response to donald trump saying all that about you . So two things. Look, on the trump thing, he was upset. He said i didnt help him enough in 2020. And its like yeah, okay, so the former president is finally realizing he cant win New Hampshire without my help. Shocking selfawareness for a guy who lives in fantasy land all the time. As for the va hospital, look, we are one of the best states in the country for veterans and veteran services. And if the federal va wants to expand into a full hospital here, thats fine. Im more i believe more in communitybased services when you talk about mental health, opioid treatment, recovery, homelessness issues for veterans, specifically for veterans. Having one old centralized location im not saying is a bad model but its a little bit old school. Were a little bit kind of modern in how were doing things here.
