We could learn how the judge will approach the trump teams relentless efforts to delay the trial, to move the trial, and depending on how you look at t maybe even threaten those involved with the trial. A new social media post is now front and center where trump wrote, quote, if you go after me, im coming after you. Cnns Jessica Schneider is following all of this. Good morning, jessica. The last 48 hours this flurry of activity back and forth with trumps lawyers talking to anyone who will listen, whats the upshot of it all . Reporter yeah, and the Court Filings in that flurry, john, will probably continue through the week. In fact, just minutes ago trump posted again in somewhat derogatory terms about the Special Counsel and the judge in this case, Tanya Chutkan. This is what he wrote, he said, deranged jack smith is going before his number one draft pick, the judge of his dreams who must be recused in an attempt to take away my First Amendment rights. Then he continues on. Its really posts like these that are exactly why the Special Counsels team is asking the judge here, Tanya Chutkan to issue this protective order. It would restrict which evidence trump gets and also which evidence he can disclose publicly as this case moves forward because the Special Counsel in their filing about this over the weekend, they specifically cited several of trumps posts, they said that if trump were to post sensitive details once he got this information from the Special Counsel, like grand jury witnesses, it really could have this harmful Chilling Effect on the case. So as you mentioned, john, trumps team has to file a response here, theyve already said they will oppose this protective order, that response is due by 5 00 p. M. Tonight. Its one of these many fights we can expect in this case. In the coming days both sides have to propose a starting date for the trial. Trumps team has said that they really want to delay this, maybe slow walk this, and trump and his lawyers are already talking about asking the judge to recuse herself, mostly because shes actually referenced trump in previous cases in sentencings for january 6th cases. Trump wrote in a pt there is no way i can get a fair trial with the judge assigned. The ridiculous Freedom Of Speech Fair Elections case. Everybody knows this and so does she. We will immediately be asking for recusal of this judge on powerful grounds and likewise for a venue change out of d. C. Trump previewing a request to change venue, too. I will note that thats something, that request to change venue, more than three dozen january 6 defendants have asked for this and it hasnt been granted. The judges each pro trump or trump appointees have denied those requests. Meanwhile, trumps lead lawyer on this case, john lauro, he was all over the sunday shows pressing his case and what will be his case that trump is just broadly protected under the First Amendment. Here he is. Youre saying that asking is action. No, asking is aspirational. Asking is not action, its core free speech. What President Trump did not do is direct Vice President pence to do anything. This morning the streets outside the already barricaded courthouse in atlanta are now being blocked off as a decision regarding trumps possible fourth arrest this year could come soon. Fulton county Da Fani Willis has signaled charges in her 2020 election case could come anytime now and the court is alerting City Officials and residents that these dates could see potential Road Closures, you see them on the screen behind me here. Nick valencia joins us now. Nick, i want to start with you here that Fulton County is taking security very seriously here. What are you seeing on your end . Reporter yeah, they are taking security very seriously here, omar. Part of that of course has to do with the countless threats received by Fulton County Da Fani Willis. She started this investigation over a year ago, some of those threats have been credible. Shes spoken about it publicly saying shes had to make changes to her own personal security and it has not helped the rhetoric from the former president , hes called fani willis a racist, saying that this investigation is politically motivated. It was last week already that we saw a protester out here echoing those Talking Points from the former president. Now were seeing Security Changes being made here. You see barricades set up, that happened last week outside Fulton County courthouse, several Road Closures around Fulton County, one of several indications that this sprawling investigation could be nearing its end. There is a heavier than normal Police Presence here and there are also, you know, this letter that fani willis sent to Law Enforcement to be ready between now and september 1st. There are currently two grand juries seated in Fulton County, one of them is going to be tasked with hearing the trump case. 24 jurors are on each grand jury plus two alternates, 16 are going to be needed for quorum and it will take 12 of them to be in agreement for indictments to be handed out. Again, omar, those indictments could happen any day now. Omar . Nick, so much to keep an eye on and, again, for a potential fourth indictment. Thank you for staying on it. Thank you. Lets start lets run through a couple things and then i want to get to some of what john lauro the defenses hes starting to present as he blanket ed the sunday shows. First and foremost, recusal of the judge or getting the trial moved out of d. C. As we saw trump even posted about wanting the judge to be recused again this morning on truth social. What are the chances either of these things happen . Extremely minimal. This crime happened in d. C. , the alleged charges, all this occurred in d. C. , the victim is in d. C. This trial is happening in d. C. , and the recusal is extremely thin. Yes, the judge made some remarks in january 6 criminal cases about trump, but the indictment as jack smith made it very clear is largely not about january 6 itself, its everything that led up to january 6. So i dont see any reason to believe this thing is being moved or that she will be recused. And then the protective order that the Justice Department is asking for, is there a Halfway Point between like a full crackdown as the Justice Department might be asking for and no restrictions at all that we can assume is exactly what trumps team is going to say . Yeah, i think were going to likely find this somewhere in the middle. What we are waiting to see is when the trump team files their response by 5 00 p. M. Today what exactly they still wanted the ability to be able to possibly publicly disseminate that the Justice Department did not. What kind of information was at issue . The Justice Department sort of made their remarks in their filings over the weekend, leaving a large amount of Sensitive Information unprotected. We will have to see what that red lined proposed order from the trump team shows and what they truly wanted to have, quote, unquote, unprotected. Now the defenses that were starting to hear john lauro present, lets start with what Jessica Schneider played. The fact that he says that asking is aspirational. Asking is not a directive. What do you make of that . Yeah, thats ridiculous. Thats not how this works. I cant aspirationally go into a bank, say i believe you owe me 20 million please take it out of the reserves and hand it over to me and say, oh, i was not aspirationally asking. No, its very clear, trump told former Vice President pence as Vice President pence keeps saying to reject electors and decertify in favor of trump. Trump told the Georgia Secretary Of State he needed those votes in order to win georgia. This whole entire argument that this is just First Amendment commentary and that it wasnt instructions will fail in court. This is a political Talking Point which will help him in the short term, but is not going to save him in court. Okay. What about this one, and this is all of this is related. Lauro also argued yesterday this was on Meet The Press that this was a constitutional disagreement, not a crime. Let me play this for you, bradley. These kinds of constitutional and statutory disagreements dont lead to criminal charges and one thing that mr. Pence has never said is that he thought President Trump was acting criminally in a technical violation of the constitution is not a violation of criminal law. What is lauro trying to do here with this one . Hes trying to muddy the waters. Hes trying to make it sounds like, oh, this was just an abstract debate like you would have at a Liberal Arts College about the finer points of the constitution. No. Again, this is a political Talking Point. This is not a viable legal defense. The idea that mike pence had to say i believe donald trump was acting criminally is not necessary for jack smith to make his case. Seriously, that Talking Point, it was just a technical violation of the constitution, thats our foundation. Thats our bedrock principles. You cant make a technical violation of the constitution in order to overturn an election. Connected to this, lauro also says that since all of this took place while trump was president , he cannot face charges over any of it. Listen to this. Theres one other issue thats very important. Everything that President Trump did was while he was in office. As a president. He is now immune from prosecution for acts that he takes in connection with those policies. He said Policy Decisions there. Is there strength to that argument . So its a bit of an untested issue, which will be interesting to see in the pretrial motions. There are bases to claim that when a president takes action in his role as the president that there is immunity. Thats certainly been the case in civil actions. Its never been tested in a criminal context. Part of what jack smith is arguing and what the Justice Department is arguing is this went beyond the scope of his president ial duties. This was him gauging in separate criminal acts for personal benefit outside the scope of his official responsibilities as president and in fact was in violation of his oath as president to uphold the laws. That will be their argument in court. Lets see first what happens with this deadline today. As you said, it will be interesting to see what their response will be to the question of the protective order. As we can see right now the many arguments being laid for in Donald Trumps defense. Reporter it isnt clear how advance this had alleged plot indeed was and the Ukrainian Security services quite active in the media over the past week claiming Drone Attacks on Russian Cargo Ships and assault vessels and a bridge to crimea they are suggesting they have intercepted a russian informant, unclear of her nationality but she worked in kharkiv in a military Surplus Store near the cr crimean peninsula. They suggest she was trying to convey information to the russians about a likely visit from the president to mykolalv. Some of the messages exchanged apparently show them suggesting interlocutors suggesting can you get a picture and what time are we talking about. A majority, a slim majority of Americans Still believe that the economy is in a downturn. So this is the challenge that the president faces and why youre going to be hearing him talk about those legislative accomplishments, try to tie it to this improving economy. One Silver Lining that white house officials do see, the Michigan Consumer sentiment which shows Consumer Confidence in the economy, that number in july was the highest it has been in two years. So the white house believes that as americans feel more confident about their personal finances, they will feel better about the overall economy and better about the president s handling of that economy. This morning republican president ial hopeful and Florida Governor ron desantis is rejecting, kind of, former President Trumps 2020 claims, he says, desantis does, of course trump lost the 2020 election. In a new interview ron desantis acknowledged that biden is the winner and he issued a warning of sorts to republicans ahead of the 2024 race. If, on the other hand, the election is not about january 20th, 2025, but january 6, 2021, or what document was left by the toilet at maralago, if its a referendum on that, we are going to lose. With us now usa today White House Correspondent Francesca Chambers and cnns senior Political Analysis ron brownstein. Ron, the answer from desantis notable, because that was the most forceful he has been on this front, but also nuanced and i do wonder if desantis as far as hes concerned if hes not 100 right in the sense that he may be right in the General Election if its about 2020 instead of 2024 a republican candidate is in trouble, but 70 of Republican Voters say that joe biden didnt legitimately win the election. So is donald trump lost a viable argument for republican primary candidate . Youre kind of does a lot of work there, correct work there, john. I mean, look, the trajectory of desantis comments is unmistakeable, losing by now 30 points in the National Polling and still a substantial deficit in iowa where hes putting a lot of chips. Inevitably and inexorably hes moving toward more criticism of donald trump across multiple fronts, but it is always, at least so far, nuanced and qualified and offset by other comments like him saying that the indictment last week was, of course, politically motivated and not criticizing trumps underlying behavior. I think theres only One Direction that this can go, i mean, he has to provide Republican Voters a stronger, more compelling reason to move past donald trump than he or anyone else has so far. What we saw in 2016 and what were seeing again in 2024 is that hoping that trump somehow collapses on his own weight, that some external event knocks him from the race and you are there to pick up the pieces with his base if you dont offend them. That simply doesnt work. I think we know where this is going, but hes still hemming and hawing as he gets there. Francesca, if you listen to that 15second bite that we played before, he sort of leaned into the documents found in the bathroom part also, and i feel like desantis is such a deliberate speaker that he put that there for a reason. He is sharpening his criticism of the former president of the United States and other republicans say that if they can focus this on how not in addition to those cases that donald trump also was influential in republicans losing the midterms in 2022, if they can make the case that he would lose against joe biden, that there might be an opening for them. Now, what ron desantis also has to prove, though, is that the country would get behind his vision for the future and he has focused a lot of his campaign on these Culture War Issues and its not clear yet whether those are the things that most americans in a General Election would want to vote for, either. Ron brownstein, i saw the eyebrows raise when francesca says he needs voters to get behind his desantis does his version of the issues. Why the sort of rye look from you there . I thinkhe right. I mean, you know, desantis has the the core problem he has in making the case that he is more electable than trump is that polls right now dont show that. You know, it may be true in the end and there are yellow warning lights on the dashboard for republicans in terms of public reaction to the indictments beyond the republican coalition, of what it would actually mean to have a nominee who was facing multiple criminal trials, but desantis has chosen to run at trump as we talked about before almost entirely from the right, trying to pass him on the 6 inches of shoulder to his right that he is leaving in the republican race and that does raise questions about whether he would be any more successful than trump at bringing back white suburban voters that have mochb away from trump, even in the republican primary itself. This is a fraught decision for desantis because he is not consolidating the more moderate voters, the College Educated voters who have always been the most skeptical of trump. Hes trying to peel away a significant portion of trumps base. Maybe that is the only way to beat him, but if you leave a lot of those moderate voters, even the primary on the table, its going to be hard to make the math add up. Jeremy diamond was just explaining president bidens trip out west to talk about the economy and put up the poll numbers in terms of americans View Of Bides handling of the economy, 63 negative. How frustrated is the white house by this . Unemployment is low, you know, inflation is decreasing here, Consumer Confidence is going up, yet biden their Approval Numbers are still terrible here. And thats why you see him out in the communities talking about these issues. Their strategy here is to just repeat it over and over again until americans get the message. And democrats have long said that they wanted to see the president , the Vice President out across the country in the communities talking directly to voters, whether its a Campaign Event or not and these are official events because that is their strategy right now is for him to be president of the United States, look president ial, and to focus on that, while they have, for instance, the Vice President , she has been focusing on some of these more political political events that they have her doing, speaking of the culture wars. So that is, again, what you will continue to see the president do for the next several months as republicans are in their primary, as him focusing on being president of the United States and trying to draw a contrast in that way.
