But i think its important to note what he said on the Ellipse On January 6th is not actually what is in the indictment. And in fact, i actually worry that by calling it the january 6th indictment that it allows this message that you heard to make it about the First Amendment. He is allowed to give a political speech and say wrong things. The argument has to be it is First Amendment protected for you to say i feel like i lost georgia unfairly by 12,000 votes. You cannot call the Secretary Of State and say find me 12,000 votes. Those are different types of speech and it will be interesting to see if any of the republicans make that argument. You and i have covered a lot of these campaigns. I cannot believe that vivek is not trying to seize upon donald trump being arraigned in Federal Court to try to take advantage of his campaign. He sounded like he was auditions for Vice President or a member of the trump cabinet. What kind of bizarre world are we living in . It is his third indictment. He has more indictments than he does impeachments. One would think the other candidates in this race would be seizing on that. And they are not. Its the damnedest thing. Standby everyone. This has been a day unlike anything we have ever seen in our history. The 45th president of the United States arrested and arraigned in a courtroom just a stones throw from the u. S. Capitol. Where the plot to overturn the election exploded into deadly violence. Its an extraordinary moment. It really is. A day of extraordinary moments. Donald j. Trump arriving in washingt dto be indicted on four federal charges related to special Council Jack Smiths investigation into attempts to overturn the election. The former president standing up in court and pleading not guilty to all four charges. In spite of everything laid out, Kevin Mccarthy who was at the capitol on january 6th, well he is arguing trump is being prosecuted unfairly. I have the honor and the privilege to serve in congress. The building sits across from the supreme court. There is lady justice. She has a scale and a blindfold on. That is the way justice in america is supposed to play. That it is fair and even. By now most people in america will say it doesnt seem quite fair. Lets go right to our legal affairs. Another stunning day with the former president making his initial court appearance. What happened in that room and what happens next . Extraordinary, wolf. Our colleagues who were in the courtroom described how jack smith and former President Trump were seated just a few feet apart from one another. While they were waiting for the judge to take the bench, we are told that the two men actually exchanged glances toward one another. Multiple times. This is the second time they have been in the same room. Jack smith also attended trumps florida initial appearance and arraignment. Now once this hearing got underway. The former president was asked to cite his name, his age, he then listened to the charges that have been filed against him. And entered his own plea of not guilty. That is significant. Because in the florida arraignment, he had his lawyer enter that for him. We didnt hear him speak at all. Now notably, this case appear to be moving pretty swiftly. This hearing was before the Magistrate Judge. But going forward, this will be judge chutkin. She will handle this all the way to a trial. And she has put the government on notice. She wants an answer on when they think they could bring this case before a jury and how long they think that jury trial will take. And then she wants Defense Attorneys to respond a week after that. So by the end of this month, when everyone is back in court, she wants to be able to set a trial date. Wolf, that suggests she wants to move this along quickly and this could possibly go to trial before the 2024 election. If no Defense Attorneys have said in the other case that it would be unfair to put the former president on trial while he is running for the white house once again. But it appears this judge wants to move this along. Interest. Thank you very much. So what happens next in this case . It has a lot to do with what is called the Speedy Trial Act. Tom foreman is here to explain it all. So tom, with trump appearing as you know, obviously, the clock is starting to tick. A lot is happening immediately. Tell us whats going on. When he stood up in court, that started the clock and the calendar moving. Why . Constitutionally, we are guaranteed a speedy trial, but in 1974, the Speedy Trial Act came along and put finer teeth on that and said the act establishes time limits for completing the various stages of a federal criminal prosecution. Trial must commence within 70 days from the date the indictment was filed or from the date the defendant appears before an officer of the court. In which the charge is pending. That happened today. Which ever is later. The reason this was put into place is because you want trial to move along quickly to keep the accused from waiting in jail. Donald trump is not in jail, but many people are so you want to say you cant serve a Sentence Waiting to be tried. That is not right. To maintain witnesses, the memory of witnesses. The availability of witnesses. People who may be involved in accidents. You want to get to it while it is relatively fresh. If you were an innocent person, you would want your trial to go forward as soon as you could to prove it. We also know how the public reacts. You want to remove the cloud of suspicion by convicting or saying they didnt do it. And remember of course, too, the public has a right. Its the United States versus. It is not just victim. It is the public having their own rights vindicated. It is pretty straightforward. But the math, and of course todays proceedings, tom, that would suggest of course that they have a date of around, what, october . Is that it . October 11th if the math were all perfect. But there are many, many exceptions in this act. Pretrial motions can push the calendar further down. It could be complicated. Conflicting court cases. We already have these with donald trump. That could be a problem. The health of the defendant. Donald trump is 77 years old. The same age Ronald Reagan was when he left the white house as the oldest president in history. Joe biden is eclipsing him. But nonetheless, when you have an older defendant, there is always questions of health that may come up. Whether the case is so unusual or so complex, the argument could be made this is very unusual. It seems kind of simple but you could argue it is complex because he is the president. And lastly, conflicts with the best interest of the public and the defendant. Thats an interesting one. The judge could say yeah. The election coming up is a conflict. All the other courts are a conflict. That could push it forward or back. You could have a judge saying no. We have to get to trial because there is a vote coming up. Or we cant get to trial because there is a vote coming up. That goes to the idea of it being unusual and complex. So, technically, yeah. October is when this would technically, theoretically maybe happen. But ill buy an Ice Cream Cone if it happened october 11th because there are so many ways this could be delayed. I want a full sunday, first of all. Youre not getting it. The political cynics will add one more thing to that and say campaign donations. Tom, thank you so much. Wolf . Thank you. Well, with respect to the multiple opinions that donald trump received, the majority of the credible attorneys, his own white house council, his Attorney General, and a plethora of people told him, wolf, that this was not legal, asking pence to suspend the count in congress and send it back to the legislatures to overturn the vote in the states. He knew that was not legal. And as to his daughterinlaws statement that he believed he won, in this indictment, jack smith very clearly lays out all the times that the defendant donald trump privately conceded that he lost the election. I think there is proof beyond a reasonable doubt here. He is entitled to the presumption of innocence. But jack smith is going to put on a powerful case. Knocking down the idea that there was any credible legal advice or that this man actually thought he won the election. Tim, you worked on the january 6th select committee. How do you see it . Reading through this indictment, wolf, it almost seems like an Executive Summary of the Executive Summary of the select committees report. Anyone who paid attention to the work the select committee did, we know tens of millions of americans did, this will be a very familiar story. There is information that the Justice Department was able to get. My mind goes back, where he was trying to protect communications with the president. This is a year ago, last spring, that it was more likely than not, that federal crimes have been committed herement seeing this move forward in the indictment is certainly validating for the committees work. But it is also something that again, folks who have been watching this from the beginning shouldnt be surprised to see. Olivia, you worked in the trump administration. Give us your sense. I want you to hear what jason crow had to say about this. We are being tested to see if our rule of law can withstand someone like donald trump and his supporters. We cant be looking at predetermined outcomes. Will our country pass that test . Im concerned. To be honest. Im worried about what the future holds. Im worried about statements being made from the political parolty i have supported most of my lifetime. When you continue to understood mine the judicial system. When you are continuing to support those statements like those made by trumps advisers, there is a reason trump called pence too honest. He wanted him to lie. He knew. He knew that he was lying and he says to my former boss, you are too honest. This is a conversation that has happened in the past, by the way, when pence was out there telling the truth at times on other policy decisions. That was the dynamic between donald trump. And i think we have to get past this type of rhetoric, narratives and deviciveness because it is eroding at the fibers of our democracy and we are in trouble if we go down this path. In order to believe the republicans defense. Donald trumps director of national intelligence. All conspired. With the trump supporting House Speaker in arizona and michigan and state Senate Majority leader in michigan and the trump supporting Secretary Of State of georgia. Dozens and dozens of trump supporting republicans, trump staffers, they all conspired to steal the election from him . Now they are conspiring to frame him . If you believe that, you are entitled to a degree from trump university. What do you think . It is interesting you mention democracy. I dont hear much talk of it on the right. How important it is to have a democracy and preserve it and move things forward. I just dont hear that talk on the right anymore. And therefore, you cant hear the talk of upholding the rule of law. And how important that was to today. So i say this. To anybody on the right wondering about today, look at the mismatched arguments sold to you on capitol hill. Thats the hardest part for me to swallow. On the one hand, u hear the Election Interference. Saying Election Interference in 2024, its your people charged with Election Interference in 2020. And they go onto say my gosh, it took so long to get here. Yet they know the wheels of justice are slow and it takes time to get to an indictment like today and they know how scathing it is. Yet they go onto say this is nothing and lets draw parallels to the crimes hunter biden has been charged with. Nowhere in the same realm of what we have seen today. I think the phrase is false equivalence. And it has legs and for those who are seeing as you are describing, it has enough teeth that people are deciding not the speak out against that in many ways. When you think, it is suggested you disband the fbi because of his feelings of weaponnization. Why is this something that has that Staying Power . Well. There is a segment of the population. It is not a majority of the population. And as an electoral matter, it has been a losing proposition. 2018 in the runup to the 2020 election. Now, you have another segment of the population, 69 of republicans who say no. The prosecutors, the Justice Department will have a tough time proving the mens rea. Some think it will be easier than that. But i think they will have a tough time proving that. So i think trump, the former president is probably nervous. I agree, you know, with governor christie assessment thinking i could actually end up in jail here. Thats a real probability. Its interesting, here is how the House SpeakerKevin Mccarthy is characterizing this historic moment. Take a listen. You are entitled to raise a question. You are entitled to question whether it was honest or not. Thats the uniqueness of the First Amendment. Thats the uniqueness of america. But you shouldnt be prosecuted for your thoughts. When Hillary Clinton said it, Nothing Happened to her. When they said it in georgias election, Nothing Happened to them. So clearly he incited a mob to attack the u. S. Capitol. That is more than just a thought. How do you counter this narrative . If you are asking me, wolf, first of all, i think they have more than enough proof in this socalled speaking indictment. That donald trump knew that he had lost the election. Even if he believed he had won the election, that doesnt justify him sending a mob on the capitol and sending fake electors to continue his own power. If donald trump believed in the easter bunny, it wouldnt justify him raiding easter mass and turning everybody out. In some ways it is secondary what he believed. What he did was try to steal the election. After having lost it to joe biden. If our nation of laws means anything, indeed, if we are governed by laws and not by personalities, then it is important that someone incites a coup as donald trump and his coconspirators did face the consequences of our law. You know, we learned just the other day that former president obama privately warned biden at a private luncheon they had not to underestimate trumps political strength. The fact that mike pence is such a key person in this indictment. And compare that to what happened in the Congressional Committee of january 6th, the investigations. We would have loved to have known just how honest he was a year ago when the select Committee Really wanted to hear from him. But some of the details in this indictment are extraordinary. We knew in the select committees investigation that the Pressure Campaign on the Vice President was a central part of this scheme. What we see and hear, the direct pressure he was putting on the Vice President to violate the law. Its extraordinary. Im glad the record is becoming more complete now. And we are seeing the extent to which not only was the former president pushing this scheme. But he was so hands on with it. He was, the details of the phone calls, the notes. I think it shows that this was something that donald trump wasnt just consenting to in terms of the scheme. But he was very muching it himself. What do you make of his tone . Many thought he was too quiet were when it came to addressing the obvious criticism. But he didnt. It has been hard for me to be critical of someone i worked with so closely over two years right . And i have been critical of that. Because i think that we would be better off if the country if mike pence had stood up january 7th and said this is completely wrong. I think the Republican Party would be in a completely different place. But all kidding aside, i think there is something to be said where we need to make lying wrong again. And i think republicans need to take a step back and assess that. Because today for me, when i was thinking about it throughout the day, it was a somber day. But i was thinking about today being the culmination of all of these lies that trump has espoused and how it finally caught up to him. Finally. But all these lies that led to the violence on january 6th, lies like other things that he said. He talked about antiimmigrant rhetoric. And the invasion of immigrants in that country. And today actually is the four Year Anniversary of a mass shooting in el paso. My hometown. Where rhetoric like that was repeated by the shooter that went in there. He repeated the rhetoric and said it was a hispanic invasion of texas. Those lies like that have consequence. So you know, i was listening to the comment about ron desantis. It enraged me to hear that. That he was threatening government employees. He may say it in a frivolous manner but he should learn a lesson about what happened to donald trump today. Words matter when you are running for office. I hope we can get away from that. I do think it drives threats. It drives anger across our country. And while we may think it is hyperbole, everyone is thinking what next fbi agent, what next person they will target. Because they are angry. And it is all based on lies and all of these people know it. Following the execution of a lawful Search Warrant on mara lago, there was in fact somebody who tried to attack an fbi field office. Yep. I remember that. You know, its interesting when you hear if you read the indictment, it makes it clear that jack smith he has evidence in there. Strong evidence that trump was lying. That he knew he actually lost the election but he was lying to his supporters out there. A few things. Number one being i heard the counterargument that jack smith actually made the broad brush charges and didnt include a tough charge like Seditious Conspiracy for a reason. Why . Because he wanted to get this in front of a liberal judge. A democrat appointed judge. And then, get it to a liberal city jury. All in dc. This is what is being talked about. In republican circles. How jack smith did it this way to rush it and get a jury in dc to make donald trump guilty. This is where the alleged crime take place. Isnt that there normally would be a trial . And prosecutor haves no choice but to keep it where it took place. What you hear from republicans is move it to west virginia. My home state. A police where he won by Something Like 40 points in 2020. Thats not how justice works. You dont just move a trial to a friendly place. But this is what is being talked about in republican circles. You are hearing them sow lies. By the way, you know that you could pick out a judge . That is what the state was. You can say i would like this judge today. Laura, it is just like the way that a president can mentally declassify a document simply by thinking about it. I do want to say that there is going to be a hotly contested fight. One detail in particular seemed to irk the former president the most. And that is when he was in there in that hearing and the judge simply referred to him as quote mr. Trump. Well up next, as donald trump is arrested and arraigned, again, three of his allies in michigan are indicted for trying to tamper with Voting Machines at the 2020 election. I will speak with the man who charged them. Well, a third trump ally now facing criminal charges in michigan in an alleged plot to ize Voting Machines. They were both arraigned on multiple charges stemming from an ongoing investigation. Focusing on attempts by Trump Supporters to breach Voting Machines in michigan. Well, in the state of michigan, the Election Code is relatively clear as it relates to who can possess or obtain possession of Voting Tablet or machines. Everyone is presumed innocent until proven guilty. But certainly i have to say that Michigan State police and our own Attorney Generals investigators did a thorough job and provided me with a lot of material to sift through. But ultimately we felt very comfortable presenting this to the grand jury and them making the decision. Do you have a sense about the why . Why they were trying to seize . Were they acting on the direction . Doing something nefarious . You know, the why aspect i think will come out as we get to the court hearings. Clearly there was an alleged attempt to get into the machines and see if in fact, they could be manipulated. And well note in the statement, the attorney for Matthew Deperno said his client categorically denies any wrong doing and asserts these charges are unfounded and lack merit. And he maintains his innocence and firmly believes they are not based on any actual truth and motivated by politics rather than evidence. What do you think in response that there is some political motivation . If there that were true, i would not have gone through the process of obtaining a citizens grand jury to make the Charging Decision. I would have made that decision on my own. Consciously, i wanted to take politics out of this investigation and this Charging Decision. And specifically used the grand jury Citizen Grand Jury statute here in the state of michigan to assemble a group of unbiased independent citizens to make the Charging Decision after being presented with evidence.
