In a separate ruling, the Supreme Court unanimously is ruling that philadelphia must accommodate a Catholic Foster Care Agency that is refusing to place children with samesex couples. Big issues at question there. Jessica schneider is live In Washington with all of the details as they come in. Focus in on the obamacare ruling, please. The Supreme Court saving the Affordable Care act, once again this morning. Doing it with a2 decision. The latest challenge of the law, that was put in place, the latest challenge is invalid because the justices are saying that the plaintiffs here, including republicanled states, didnt have the injury, or the legal standing, to bring this case. The Affordable Care act remains in effect. And the 20 million that have conch coverage under obamacare, they will continue to have coverage because of the Supreme Courts decision this morning. Its possible that republicans or other plaintiffs might find a way to challenge this law at some point. For now, it stands. And for president joe biden, this is a major win because his administration asked the Supreme Court to let the law stand after the Trump Administration tried to advocate to get it struck down. The court found a procedural way to uphold this law. Conservative Justice Alito was joined by justice gorsuch, wrote a dissent, saying they were exasperated this the Supreme Court pofound to way to keep Th Law Intact for a third time. And they said that the majority twisted itself into a pretzel to make the law stand. And of course the states must challenge the aca because they have the burden of maintaining it. That was two justices in that dissent. And the Supreme Court, in a 72 decision, keeping intact, the Accordable Care Act. Thank you, jessica, for that reporting. Joining right now, cnn chief legal analyst, Jeffrey Toobin and abby phillip, the host of inside politics sunday. Taking me back to when i was hit next to you in the oral arguments, to the original challenge of obamacare way back when. What do you think as jessica is laying it out, four conservative justices joining three liberalleaning justices for this challenge. This was a bad case. This was a long shot for the plaintiffs. In the oral argument, it looked like, even the Con Serservative justices, like chief Justice Roberts and Brett Kavanaugh were skeptical. The message that chief Justice Roberts is trying to send now, for almost a decade, if you, my conservatives, want to overturn the Affordable Care act, do it through the political process. Dont trust the courts to do it. We saw, when the president was donald trump, and the senate and the house were in republican hands, they couldnt do it. They couldnt come up with a replacement. This is a Supreme Court that changes nothing. This isnt the samesex marriage case, where states tomorrow have to allow samesex marriages. All the case does is preserve the status quo. But its a status quo, where people with preexisting conditions are protected. People can keep the kids on Health Insurance for age 25. Theres no Lifetime Limits on coverage. These are parts of american life, that i think even though this Supreme Court didnt address the merits for a third time, i think they are sending a very strong message that they are done with challenges to the Affordable Care act for good. Until the makeup of the court changes, until it does again. Strengthens one way or another. Abby, this was a case brought by republicanled states, chiefly texas. What do you see as the practical and political impact of this now . Jeffrey says its a case that changes nothing. Thats true from the perspective of people and their held insurance. But politically, theres something cig kapt is the result of this decision. It virtually kills this issue of changing the Affordable Care act, repealing it, replacing it. That issue politically right now, is more or less dead. Its been a loser for republicans. Even when republicans had control over the white house, control over the house and the senate. They were not able to legislatively change this law, in a significant way. As a result of that, this decision makes it more unlikely. The dynamic on the Supreme Court can change. But its a political loser for republicans and a legal loser for republicans. For that reason, its a political moment. Youll see republicans moving in this direction, pushing for the next step. The next Movement Forward when it comes to changing how health care is dealt with in this country. It really does embolden that push that has been well under way for the last several years now. The decision on standing, jeffrey, means what for possible future challenges . Are you thinking that obamacares future is now secure . They will be able to find plaintiffs who have standing. The it is worth remembering, before you think that Clarence Thomas and Amy Coney Barrett have liberals, conservatives believe in the narrow standing. They like to keep challenges to laws out of court. John roberts has devoted much of his career to this. The idea of Con Servetives taking a hard line on standing is nothing new. Theres a sub text here. We have heard this issue enough. And, yes, the law as big as obamacare, there will always be challenges around the fringes and what is covered and how essential the law is. In matterms of whether this law survives, in a Supreme Court that includes the current three liberals, john roberts and Brett Kavanaugh, i dont see any chance for this court to overturn the obamacare law. It has to be done through politics. At this moment, the wind is in the sails of people who want to expand obamacare, not the people that want to get rid of it. In the political realm, im told that House Speaker pelosi, just reacted to this ruling. For the first time, lets listen to what she said together. We are, of course, happy, with the Supreme Court decision on the Affordable Care act. Its important to note this historic decision. Once again, the Supreme Court upheld the constitutionality of the Accordable Care Act and the transformational projections that it provides every american, no matter where they get their coverage. You spoke to, abby, the role obamacare plays. You dont hear the words repeal and replace at all anymore. And that was the entire message for two election cycles, at least, when it came in republican campaigns. I sometimes wonder, is this animating . Is this animating in the sense that, they republicans see it as nancy pelosi can claim victory, this can animate our base. Or do you think that it seems it is no longer a political winner . I honestly doubt it. When you look at where it is on the republican party, not on issues of taxes. On the cultural issues. On critical race theory. And maybe even the border. Its not on the issues. The republicans are having a hard time motivating the base to go to the ballot box over this, like they did in 2012. On the flip side, its a major motivator on the democratic side. Democrat want the kids on the insurance until 26. Want coverage for preexisting conditions. And Many Democrats want to expand the role of government in some ways in health care, by moving towards something that approaches a singlepayer system. The politics has shifted. The days of the tea party coming into existence on the backs of this issue are more or less over. Great insight. Clarence thomas, jeffrey, supporting this ruling, this side of this. On its face, it seems surprising. What do you see here . Its surprising. I thought i might be missing something. Im flabbergasted to see him on that. Neil gorsuch and Clarence Thomas vote together in almost every single case. And here, gorsuch was with Justice Alito, as the only two dissenters. Im flabbergasted to see Clarence Thomas on this side of the case. It is worth remembering. And i think people like me who think about the Supreme Court a lot, need to be reminded that these people are not robots. They do things that are surprising. I dont believe he wrote a separate opinion. We dont know why he voted the way he did. The fact that Justice Breyers opinion, is very surprising to me. Its also surprising to me, that Amy Coney Barrett is on that side. We know less about her philosophy on the Supreme Court. Shes very new. The thomas vote, it beats the hell out of me why he was on that side. Thats why we cover the news. Stuff is unpredictable. When you see who is in the majority here, two off Donald Trumps appointees supported. Gorsuch did not. The statement that comes from donald trump will be coming. Lets switch gears to the other decision, and the case of a Catholic Foster Care Agency, and philadelphia. The court rules with the catholic care agency, that was refusing to work with samesex couples here. This was seen as a big case on questions of religious freedom and discrimination and guy rights. Your reaction to the ruling. Its part of the big, political movement. As abby was saying, the struggle against obamacare has lost steam. But what replaced it is religious liberty. Do religious institutions and people have to follow the rules as everyone else. The argument has been, they have a First Amendment right, not to pay for contraception under the Affordable Care act, if they have religious objections. That was the hobby lobby case. Do they have a right to serve gay customers, the colorado bake shop case. That was not resolved def definitively. But that is out there. Do religious institutions have to treat lgbt couples the same as everyone else, when it comes to foster care . And the answer is no. They have permission to discriminate against gay people. Thats how the plaintiffs see the case. The winning side saw they have the right to bring religious beliefs into their assignment of foster care apparent. While there was a narrowly written decision. The bigger message is that religious liberty, as they call it, is very much in the ascendancy. This is a big political question. Religious freedom, based on sexual orientation. I think jeffrey is right, this momentum on the right is. And it extends beyond, even, you see on the state level, transgender rights, youre seeing republican state after republican state, trying to weigh in on this issue, preventing transkids from participating in sports, et cetera. These are related issues. At some point, its going to come to a head and it raises significant questions about equal protection under the law and whether or not that applies to people who are Gay Aend Peope who are transsxwgender. And what extent the state can give religious institutions a path to say, i dont want to serve these people because i gis agree with their Gender Identity or their physical orientation. And that might, you know, will the courts allow that . This is an unsettled issue. And another way this issue is manifesting itself. Is religious institutions are getting more access to government month. Religious schools are figuring out ways to get subsidized. Through direct tuition assistance. The paying for playgrounds, for school lunches. Historically there were rules in place that said the government cannot subsidize religion. At the same they are asking for exemptions, they are getting access to government money in bigger ways than they have before. Its a powerful movement and its winning. An interesting point. Your reaction to the ruling of the Supreme Court, leaving intact, obamacare. Well, a great day of relief for tens of millions of americans, who have insurance. And its time for republicans and their cohorts to stop attacking the insurance security of 30 million americans that have found coverage under the Affordable Care act. Do you think obamacare is secure with this . I have no doubt, that our republican opponents of the Affordable Care act will find ways to try to challenge it. Three strikes and youre out, already. It seems to me that they need to reconcile themselves. This is the law of the land. And the takeaway on that summit, from the Top Republican of the house, just came in. Kevin mccarthy. He says that biden gave putin a, quote, pass. He put out a statement today. Let me read what it said in part. President biden should have used todays summit to stand up for our national interest, and that the United States will hold Russia Accountable for its long list of transgressions. Mccarthy said that President Biden gave putin a pass. What do you say to that . I think leader mccarthys statement is laughable. Where was he when donald trump stood alongside of Vladimir Putin and accepted the denials that he had created on the United States. And said i believe putin. I dont believe my intelligence agencies, even though there was unanimous view of all of the agenciageses of all of the United States, that russia under putin had tried to undermine our elections. Where was he when a lack of sanctions on a whole host of things that russia did was absent. And just recently, trump said he had a good meeting with putin in 2018. I know he embraces United States. He embraces that was a good meeting. That was not a good meeting for the United States. That was a dark moment in our Foreign Affairs policy. President biden did what needs to be done as a president. Stand up to our allies and stand up to those that wish us harm. Putin got a clear message. And the way he acted in a press conference, was a putin less confident, less braising than ive seen in Previous Press conferences. Before departing, we got biden assessment of the putin summit. It feels like we got a statement from joe biden on how he sees the world at this moment. Let me play this for you. The world has raised a fundamental point of what its going to look like ten years from now. I mean that literally. Not hyperbole. Not like im trying to pump it up. Its genuine reality. Each of the countries around the world, that have power and still do, are wondering, how do i maintain and sustain, our leadership in the world . He was on new day earlier today. Congressman clyde has made some incendiary remarks, downplaying the event. To be honest with you, downplaying, it was disingenuous. He out and out lied. Im going to play for you what foxs tucker carlson, the networks toprated premier show, is now pushing on who he wants you to believe was behind the insurrection. A warning, a headsup. This is not true. This is a lie. Look at the doctrine. The policy of unindicted coconspirators. Every case, they were fbi operatives. Really . Joining me now, cnns legal analyst, and prosecutor, ali honig. How bill barr broke the code and corrupted the justice department. Talking about unindicted coconspirators, certainly working for the fbi, he says. What is the legal reality here . This is just a bunch of garbage by tucker carlson. Hes trying to take something that prosecutors do every day in every case, and turn it into a conspiracy theory. When youre drafting an indictment, the only full names you write in the indictment, john smith, kate baldwin, elie honig, everybody gets a generic label. And the crazy leap is, wow, theres some people that get the generic label. They must have been fbi. Must have been an inside job. Coconspirator, that cannot be an fbi agent. Anybody working for the fbi is not part of a conspiracy. Theyre just pretending. No prosecutor would identify anybody working for the fbi as a coconspirator in the environment. Tucker carlson does not have his facts straight at all. Theres more to this. Let me play something else. Wait, heres the interesting thing. Person two and person three were organizers of the riot. The government knows who they are. But the government has not charged them. Why is that . You know why . They were almost certainly working for the fbi. This is, like, written and thought through. This is one of his monologue things that he goes off on. Your Reality Check on this . Yeah. Its the same tactic here. The use of the term person is broader than coconspirator. Its a Wild Leap Of Faith to say these are fbi agentagents. Theres nothing in the indictment to support it. This is the stuff that Conspiracy Theories are made of. One final thing, what tucker does here, he furtherer makes the case for an independent bipartisan commission. If you believe wild Conspiracy Theories, the best way to get to the bottom of it, is to have an independent commission to investigate it. A 9 11 style commission. This is a case, in the ruling, the justices say the city of philadelphia wrongly ended its relationship with this foster care agency, as a result of the agencys policy. Thats where things stand right now on that. Joining me now is montie alv alvarado. She represented the catholic services, the foster care agency, before the Supreme Court. Whats your reaction to the ruling today . Its a fantastic ruling for religious freedom. Its a great unanimous win. EnSupreme Court justice said that religious freedom is not a secondclass right. Its front and center, the bedrock of our constitution and our freedom in america. This is, as you mentioned, about religious freedom. But its also about discrimination on the basis of sexual orientation. What do you say to a gay couple who have the desire, have the resources, to care for a child in need of a home . What harm would come to the children if they stayed with a samesex couple . Catholic services serves children regardless of this sexual identity. Theyve been serving children in need. And the government decided that because of their religious beliefs, they didnt want to work with them. And thats unconstitutional today. The security unanimously said theyre not allowed to do that. And gay couples in philadelphia, have 29 agencies they can go to for their home study. Catholic social services has placed children through the government with gay couples before. Its about home studies. About the personal certification, of what a home look like for a child. And not working with Catholic Social Services is unconstitutional today because the Supreme Court said so in a unanimous ruling. But on a personal level, what harm would come to a child if placed in the home of a loving samesex couple . Children are placed in samesex homes all the time. They are placed i think youre asking me a question about religious beliefs. And the religious beliefs of Catholic Social Services im asking about the needs of children. The aclu argued, they were involved in the case. They said this could have a profound consequences on more than 400,000 children in foster care across the country, putting aside the legal Ripple Effects im asking you, do you think that a child is put in harms way a child who needs a foster home and we know a lot of children are in need of foster care. Why would you cut off an avenue for children to be in a loving home of a samesex couple . What harm would actually come to them being in a home of a samesex couple . Thats not the issue thats not at issue today. Children need loving homes. The moment that Catholic Social Services was kicked out by the city of philadelphia, 350 children didnt have homes. So, this is not a winnertakesall proposition. We need everyone, all hands on deck, fostering these children. Catholic social services is part of that, as well as the other 29 agencies that work with lgbt couples and are tailored to the needs of lgbtq adults and children. We need more people to work in this space. I understand what youre saying. But i dont think needs of a lgbtq couple are different than the needs of any loving couple who would want to foster a child. I think thats a distinction. And thats the core of the Discrimination Argument that is also at issue here. This is the Supreme Courts ruling today. Ruling in your favor. I read with great interest your new Opinion Piece in the washington post. You called the Delta Variant a profoundly concerning threat. Tell me why. First of all, kate, thanks for having me back. It is a concerning threat and ill explain. This variant, which has now taken over in the uk, represents maybe 10 of cases here is far more contagious than any variant weve seen. Seems to be a bit more deadly than the prior variants and even for people who are, lets say, partly vaccinated, it does seem to cause real problems with the immune response. Theres a bunch of reasons why this is a virus and a variant that i think has a real potential for causing a lot more infections and unfortunately even a lot more deaths. Youve labeled it as a triple threat. What do you mean . Yeah, so whenever you look at a variant you look at three features. Is it more contagious, is it more deadly and does it escape our immune response . Now, it is undoubtedly far more contagious, as i said, a little bit more deadly. If youre fully vaccinated youre going to do fine. But for people who are not, this really does seem to push the Immune System and tend to cause some amount of immune escape. It is a real problem of a virus. You mentioned vaccinated, youre probably pretty protected, youre concerned about how many people are missing their second shots and second doses. What are you seeing . There are two sets of issues. First of all, a third of American Adults havent gotten any Vaccine Doses at all and we also know that about 18 million americans have missed their second shot. Got their first shot. The appointment came up for the second one and they didnt get it and the evidence right now is very clear that if you only got one shot and you didnt get your second shot you are not adequately protected against this variant. And so weve really got to redouble our efforts, not just to get more people vaccinated but to make sure people complete their vaccinations as well. Absolutely, dr.
