The suspect in the stabbing attack appeared before a judge a short time ago and ordered to stay behind bars. Reporter when the attacker left, he followed at a distance worried he was about to go to a synagogue next door. By then ambulances were arriving to get the wounded. There were patients lying on the floor, severely injured. Its something you dont see everyday. Reporter his team whisked away 4 of the 5 injured in the ambulance service, a volunteer service made up of Jewish Community members. And they tracked down the license plate number this gentleman had given them and they smelled bleach apparently trying to wash away the blood. The mothers can sleep not worrying about children going to school the next day or husbands going to pray the next day or shopping the next day. A lot of people say those attacks, the smaller ones you dont hear as much about really have people disturbed because its everyday people on the subway and street coming out with these words. With us now, explain what happened, jessica. This was a key case that could have put the separation of powers between executive and legislative branches to the test. It has now been dismissed by a federal judge in d. C. Judge richard leon. He said a lawsuit filed by former Deputy National security advisor, Charles Kupperman is now mute because this is a lawsuit asking the federal suit to decide whether kupperman had to comply with a subpoena thats since been withdrawn that had been in effect during the house impeachment hearings earlier this month. The judge points out this subpoena was no longer in effect and been withdrawn and the house since promised not to reissue a subpoena because the impeachment has already gone forward, the president has been impeached and the executive branch promised he will not be punished for defying that original subpoena. This was a case at of key interest at the height of the hearings. It since lost its urgency. His boss lost interest as the two shared a lawyer and whether john bolton would testify in house hearings if the judge ruled ckupperman had to testify and that bolton had crucial information to the withholding of military aid to ukraine. The court now staying out of the fight at least for now. Judge leon writing this in part. Have no doubt should the winds of political fortune shift and the house were to reissue a subpoena to dr. Cup kupperman, he will face the directives of this court vowing to balance the cooperating with the president could cup berman or john bolton be issued subpoenas and would this fight be back in the courts . Do you wish in a way they had not so there was a possibility of getting more information that could have helped your case . No, i dont think so. We had 17 sworn witnesses under oath, all of whom essentially told different parts of the exact same story, which is the president engaged in the shakedown of president zelensky, in order to get him involved and embroiled in our president ial election by going after the bidens and reviving the discredited 2016 Conspiracy Theory it wasnt vladamir putin and the russians engaged against our Campaign Election it was the ukranians. It was these two bogus things President Trump was trying to get president zelensky to do and lording over him hundreds of millions of dollars in Security Assistance as well as the much sought after white house meeting zelensky wanted. The evidence was not just overwhelming, uncontradicted and unrefuted. If we had 18 witnesses other than 17, maybe it would have been better but the prosecutor in the house of representatives said we have seen enough. This president has committed high crimes and misdemeanors against the American People and a crime in progress and danger to the public. John bolton had the same lawyer as kupperman, according to some testimony we saw on the house side, that it was a drug deal and hand grenade with Rudy Guilliani, going to blow everybody up. Knowing that with witnesses to testify in the senate trial, does that underscore anything there . It does underscore having a real trial in the u. S. Senate. The way the constitution is set up in article i for impeachment purposes, the house acts like a grand jury and prosecutor. It brings the charges. Two charges have been brought forward, abuse of power and obstruction of congress in our investigation. Now, it goes to the senate and they must conduct a real trial. Senator mcconnell said he had seen enough and was coordinating with the white house and Lindsey Graham said he didnt need to see facts at all. Thats a disgraceful ab jucationcation of their duty. And they have to have the others solemnly swear in the matter of impeachment of donald trump they will render impartial justice under the constitution and the laws. Its not impartial justice if you say you already made up your mind and dont need to see facts and evidence. True not just for republicans but democrats, too. Democrats should be open with the possibility they come forward with exculpatory evidence. We havent seen any but maybe there is an alibi we havent seen yet. The report of the aid withheld from ukraine as he tried to get them to investigate joe biden and his son, hunter, reporting the secretary of state and john bolton lobbied the president in the oval office saying you need to let this go forward and this is good for america that ukraine gets its military aid, he disregarded them. What does that tell you . That tells you this was Donald Trumps decision and his alone. It wont work to blame it on pompeo or Rudy Guilliani or anyone else. How do you prove that if you dont hear from john bolton . Thats why we need a real trial and real witnesses. I trust our colleagues on the senate side will render faithful Constitutional Service by making sure theres a real trial. Those cabinet members you mentioned urging the president to let the money go through as he was legally obliged to do, money adopted by congress, approved by congress, went through the anticorruption screen at the department of defense. All they had to do was let it go through. Those same members of the cabinet who urged the president to do the right thing were the ones the president told not to go testify and blockaded the witnesses and didnt turn over a single subpoena document. Think about that. Anybody else in america has to participate in the trial and the president thinks hes above the law. Youre back on the 7th. The articles of impeachment at some point have to go to the senate. Democrats say they will but dont know when. Have democrats been strategizing when thats going to happen or any idea . We want them to go over as soon as possible because we not only think this is a series of high crimes and misdemeanor. Its still going on, Rudy Guilliani going over to ukraine and are you going to send them over on the 7th . Heres the thing. We want to make sure the senate is going to to do its job. Thats the thing. The senate has to have a real trial. Theyre sworn under oath to enter impartial justice. When would you like to send them over . As soon as there are procedures in place for a fair trial. Before midjanuary . I hope its as soon as possible. I hope its next week they will come up with an agreement. 100 senators in the clinton trial agreed to the procedures. Its not that difficult. Americans know what a fair trial is. A fair trial is when all the evidence is heard, all the relevant witnesses come in and are able to testify and we get at the truth of the matter. New yorks Jewish Community has been targeted in these antisemitic attacks really almost every night of hanukkah this year. What do you think is behind this violence . There is a very dangerous growing antisemitism. It is growing in the last year or so, that horrible massacre at the tree of life synagogue. Were talking about what happened in jersey city obviously. Weve never seen anything like this. I think it is directly connected to the rise of hate speech and connected to the real american problem how social media has given open season to hate speech without a serious effort by social Media Companies to create boundaries and limitations. All of this is conspiring. What were seeing, were in a city with the largest Jewish Population of any city on earth. Historically, theres been good relations between our Jewish Community and surrounding communities. Something is changing because of this bigger backdrop. We have to answer it very assertively and make clear hate is not going to be given an opportunity to grow, means a lot of Police Presence and educating our young people and make sure they understand how wrong it is to act on hate or think in terms of hate. We will have community controls multiethnic to show solidarity to whoever is thinking of hateful things, people from their own community will be there to interfere and stop it. We have to do all of the above. The bigger problem in this country is this hate speech is getting normalized and people including folks with Mental Health challenges and young people impressionable, theyre hearing this and acting on it spontaneously. Thats a danger to all of us. What do you do . I understand you want to counter this with young folks . Is that going into schools and adding it to the curriculum . Social media is such an issue, how do you Police Something like that . We can in our schools give positive messages and help young people to understand what the holocaust was, what the Jewish Community has gone through for centuries and help understand when you commit an act of hate it spreads a domino effect that affects all communities. We will do it immediate lin our schools and neighborhoods weve seen these problems. This point of having Community Safety coalitions and having folks from different ethnic backgrounds banning together to be out in the streets enforce, community presence. Weve seen this with our cure violence in the community. Its worked to stop other violence at the grass roots ty members banding together and even gang members to dissuade them from acts of violence. Were taking these concepts and applying them to the hate crimes and biases out there. Young people need to hear from people of all backgrounds but particularly people from their own communities this is a very destructive and negative path. I think that kind of intervention makes a big impact. You say governor cuomos idea about having a state law about domestic terrorism, not just hate crimes but calling it domestic terrorism, you say it has merit, what sort of legislation would you want to see . We need the right kind of penalties to add to our efforts to stop this kind of thing from happening. Ill give you a powerful example. For years and years the nypd built a strong intelligence gathering capacity focused almost entirely on International Terror threats to new york city. We still take those seriously and more and more we have to focus on domestic threats and have a new unit to focus on ethnically motivated extremism. That wasnt needed a few years ago. We will identify these trends and systematic efforts growing out there. Then, there has to be a penalty out there anybody planning hate on a systemic level of violence, those penalties have to be really really strong, so people know theres no coming back if you do Something Like that. Tonight, as the standoff over the president s impeachment trial hangs over washington, theres new reporting by the New York Times thats raising additional red fla about President Trumps decision to freeze aid to ukraine. Lets break analysts including correspondent who broke that story, mark, with us. Your reporting is shedding new light what was going on behind the scenes with the president and administration, as he was choosing to freeze this military aid, almost 400 million to ukraine. What are the details . One of the things lost in the impeachment hearings is how this began and what was the origin of the aid freeze. You have a lot of officials hearing about it secondhand and who ordered it behind the scenes. One of the things we unearthed was an email from Mick Mulvaney to his staff, the president wants to know can we do this and so can we . The email response is, yes, but it wont be pretty. Expect congress to become unquote unhinged. That was an understatement, of course. The president got impeached about part of this. It shows there was Early Warning what might happen if the aid was frozen and one of the things we unearthed in the story. They were telling him this was good for america for ukraine to have this aid. Thats right. Later on in this summer you have a crescendo and senior cabinet officials, esper, pompeo, bolton, when he was National Security advisor, in the oval office the aid needed to be unfrozen because this is critical support to an embattled ally fighting a war with russia. The president was stuck in on this point about ukraine is corrupt. What we tried to do is see where the whole track of investigating the bidens and freezing the aid, where those tracks came together. Despite that warning, Top Administration officials, the president still disregarded their advice. What does that tell you . Its harder to argue this freeze had anything to do with policy when the policy professionals expressly disagreed with it. That has been a prime gop talking point, that this was about u. S. Policy objectives in ukraine. The timing is critically important. I participated in a lot of briefings with the president related to high stakes policy decisions. Guess what, National Security professionals with the secretary of state and National Security advisors expressed their analysis before the president took a decision and marks reporting indicates they expressed the views after the fact. Its unclear who they consulted with ahead of taking this decision and the president did not unfreeze this aid directly after this meeting. Based upon the New York Times reporting, this oval meeting occurred in august. The aid was not unfriesen until september weeks later after pushback from congress and the public. All this reporting really discounts any reasoninging this had anything to do with actual policy versus politics. Susan is our National Security and our legal analyst. We learned mulvaney is said to have stepped out of the room whenever mr. Trump would talk to mr. Guiliani to preserve mr. Trumps attorneyclient privilege. What does that tell you was on their minds as they tried to preserve that privilege . Its not hugely unusual that white house staff would leave the room when the president is talking to private counsel. He has his own lawyers. They could get around it if mulvaney witnessed it. The privilege would not exist if mulvaney was in the room. Its not unusual on its face but incredibly revealing on what was happening. Rudy guilliani was acting in his personal capacity for the president s political interests. There is question whether or not he was a lawyer at all or whether the attorneyclient privilege would apply to this situation. That said, it was clear this was not Rudy Guilliani carrying out policy of the united states, not Rudy Guilliani coordinating with other government officials in order to carry out the president s National Security mission. This is the president being warned by his own top officials this is harmful in the National Interests, essentially cutting them out in order to have this private conversation with Rudy Guilliani. What this really was about was not corruption and National Interest but the personal benefit to the president. The kwoequestion over privil Rudy Guilliani is working pro bono for the president but the ukrainian businessmen, to the tune of many many thousands of dollars, important to point out where the money was coming from. The Senate Minority leader, Chuck Schumer reacting, this shows all four witnesses we requested were intimately involved and had direct knowledge of President Trumps decision to cut o aid to benefit himself. That makes Even Stronger the case for why these witness must appear. Will this make it harder if Chuck Schumer is able to have a vote where he is requesting witnesses and hes trying to peel off just a few republicans to join him, saying they want more information, does this make it possible that we could see testimony from these folks . Well, republicans so far have been lockstep with President Trump, who has said he does not want some of these officials to testify. If there are a few, a handful of republican senators tend to be more independent than the republicans in the house looking towards reelection, some may want to actually find out what happened. Anyone in the senate who wants to find out what actually happened with the president and ukraine would need to hear from these witnesses including john bolton and Mick Mulvaney, who may say hes stepping out of the room President Trump is talking to Rudy Guilliani. I was at a press conference a couple months ago he said the president did mention to him directly this idea of corruption related to the dnc server, this Conspiracy Theory the dnc server was in ukraine and why we held up the money. He is clear what the president was doing and on air force one on this democratic scene in the New York Times article and would be someone to hear from if the senators wanted to know what happened.
