Change of Plea Hearing
Last fall, 58-year-old Michael Schutt was arrested and charged with Conspiracy to Deliver a Controlled Substance to a Minor; Delivery of a Controlled Substance, and Possession of a Controlled Substance With Intent to Deliver- Marijuana. Two co-defendants were also charged in the case, Meagan Crone and Donald Brower. The crimes occurred last year on October 3rd and 4th. During a search of Schutt’s home, law enforcement seized approximately a pound of marijuana, various drug paraphernalia items and a large amount of cash.
Schutt, at Tuesday’s hearing, pleaded “guilty” to all three of the charges as part of a plea agreement that was reached with the State. The plea deal recommends a prison sentence of 3 to 6 years for each charge, suspended, in lieu of a 120-day split sentence and three years of supervised probation. The sentences will run concurrent to one another. District Court Judge John Fenn ordered that a presentence investigation be completed and set the sentencing date for April 22 at 9:45 am. Judge Fenn continued Schutt’s bond under the same terms and conditions that were previously set in Circuit Court, with the following modification that Schutt, upon his release from the Sheridan County Detention Center, be required to report to Probation and Parole and advise them that he’s pleaded guilty so that the presentence investigation process can begin.
