If you look at the stocks from that event to today, almost in a correction, down nearly 10 from peak to trough. That is not a great sign. The stock is underperforming its peers by about 5 during that same time. If you have a stock coming out of a bullish event into an Earnings Report suggests that hiphop ahead. Hiccup ahead. A the company could be under pressure until we have more certainty there. Certainty and uncertainty seems to be the words. David pretty consistent. The director of National Intelligence surprised us all yesterday by calling it is conference with fbi director Christopher Wray and announcing iran was behind a series of intimidating messages sent to democratic voters in that both iran and russia have gotten access to Voter Registration information. We have confirmed that some Voter Registration information has been obtained by iran and separately by russia. Foreigna can be used by actors to attempt to communicate false information to registered voters. David we welcome an authority on election cybersecurity. The reason why that is disconcerting is because we know from the Mueller Report and the way russia hacked into the Voter Registration database was through vulnerabilities in the websites. Russia got short shrift in these and it would be interesting to know more about what russia is up to and what is going on with these website vulnerabilities. There were messages sent to some voter saint do not vote democrat , vote for President Trump or we will come after you. Seems like a primitive form of tampering. You and i right now could go a list of email addresses from miami, florida, where you will have about 85 of the people you email be what seemand send out to be illicit videos. Is there much at stake . The firstink president ial debate had some impact on the numbers, positively for joe biden. It looks like some of that has come back down close to predebate levels. They do seem to be able to have an impact on voters who are still making up their minds or have not voted. Had 44hen, we have Million People have already cast their ballots. Time is running short for donald trump mount a comeback. I think this is the last major event that that can happen with. David explained the trump strategy and saying he originally wanted to be all about Foreign Policy. He will inject a lot of Foreign Policy. Is that offensive or defensive . Rick a little bit of both. He does not want to talk about covid. That is pretty clear. At a time when the country rates are going significantly higher. Changing the topic is important to him. He has mounted an attack on joe himself,amily and related to dealings with china and ukraine. He sees that as Foreign Policy. It gives him an opening to try to enter in this corruption issue into the debate, which he did very successfully four years ago against hillary clinton. That it does have some upside. There are Foreign Policy successes that donald trump has had in the middle east that he has not had much time or interest in talking about on campaign trail. This is that up well for him if he is able to stick to a message that is something the voters will see as productive. David having been around so any of these debates through the years, what you think Vice President biden learned or should have learned from that first debate . Rick not to engage donald trump. Donald trump is his own worst enemy. Even though they will control the mics on the first set of two minute questioning, it will still have a freefall for every 10 minutes of followup. I think what joe biden has learned from the first debate is not to engage, not to be angry, and not to come off of his script. He did a good job when he had a solo effort on the townhall last week. Stuck to policy and was able to make his points. I think the trick for joe biden is staying out of the wraps of donald trump. David when you talk about President Trump needing to stick to his message, what do you think that message is . Even today he has released 37 minutes of an interview from 60 minutes which will get a lot of people from the media hot and bothered . Is that part of the message. Everything seems like a distraction. Rick he is working the refs. Donald trump is a master of predebate policy setting expectations and working the refs. He knows he is not able to maintain message discipline well , so he wants to blame all of negatives associated with him in the media on the media personalities and the reporters. If he can get tonights moderator to feel like she needs to go out of her way to look like she is playing fair by trump standards, he has already won part of the debate. That is a tactic he is using right now. David what you think President Trumps path to victory. A lot of commentators are saying, prematurely, this is almost all over, but clearly President Trump has a task ahead of him. What is his best path to victory . Rick i think youre exactly right. I think it is way too premature to claim this election is over. There are a lot of states, florida, arizona, pennsylvania, michigan, that are in striking distance for an election victory. Obviously every day there is early voting makes it tougher. Not come outdoes until election day anyway. He has some time to try to keep them and peel a few people off of joe biden in order to win. In those states, if he can put together four or five of those states we just talked about, he has the ability to get to 270. David is that his base . And is his base coming down to white males who lack a College Education . That tends to be the people who are most enthusiastic supporters of the president. Rick that is certainly the core base of the Republican Party right now, and his voters. Obviously he is able to go beyond that. That would not be competitive on a National Basis nor in many of these states. Really the trick for him is to pull back some of these seniors inhas been losing in october key states like arizona and florida where seniors are key voting block, but also to try to get penetration back to women and suburban voters. He has been begging for them to come back. He got them in 2016 but does not seem to be able to put a message together that will bring them back this time. David can he go after the seniors were suburban women voters without addressing covid . A lot of polls indicate those voters are concerned about covid. Rick that is his biggest dilemma. He does not want to talk about covid, the news on covid is not very good. He wants to attack joe biden on the fact that he was talking about changing Social Security, he just wants to change the topic. If he is able to be disciplined enough to create some questions about joe bidens commitment to issues seniors care a lot about, maybe he can get a look back in his direction. What todays action means is lindsey graham, who is the chairman of this committee, is clear to move forward with issuing subpoenas for Mark Zuckerberg and jack dorsey and force them to testify over the decision to limit sharing of New York Post articles about joe bidens on hunter biden. There is no date set, but both are scheduled to explain their content policies next wednesday before a Different Senate committee. The backdrop is that after years of being left alone by washington, especially in their early days, big tech is constantly looking over at shoulder and stuck in the crosshairs of lawmakers and regulators. No real surprise it has had to increase spending on lobbying. Facebook spent 16 million in 2019, 10 million so far this year, but all of that is a drop in the bucket when you compare it to how much it has in cash. Facebook had 58 billion in cash last fiscal year. Meantime, you mentioned the other headline. Facebook is lining up a potential payout for its whatsapp unit. ,ather than selling ads facebook wants to offer its Business Users a Cloud Service that allows them to store and keep their interactions with their customers. This next phase after that would include payments to allow customers to buy products directly from businesses on whats app. This is a significant shift for facebook, which makes all of its money through targeted advertising. We can talk about regulation all we want, but as long as people keep using facebook and twitter and they make money, it will not change what they do. Even as people say they do not want to use facebook or contribute to it, they have tried to withdraw from facebook and say that we use instagram instead. Facebook owns instagram. There is a tricky situation where it does not matter if you boycott facebook as long as you go to another part of facebooks empire. Whatsapp is a different proposition because it does rely more on business customers than it would on consumers or people who are having social interactions with each other on the app. There is that complication. All of that will come to a head during the earnings season, and facebook poll reporting earnings. Facebook nation is more than one billion strong. As long as their utilities for facebook, the advertisers can boycott, but they will not abandon facebook. David while we were talking about earnings, lets go to the other end of the spectrum, which is railroads. All the way from social media to railroads. I know youve been looking at Union Pacific. Scarlet Union Pacific, along with the other Transportation Companies has High Expectations heading into the Third Quarter earnings season. More than 70 of analysts surveyed by bloomberg has raised their eps and revenue estimates for the company. When Union Pacific reported results and posted declines for the top and bottom line, it was bigger than expected because expectations have been raised. While it is approving while it is improving operational efficiencies, the concern is volume is not recovering. That is due in large part to the fact that the industrial economy has not yet recovered. It is still in recovery mode and we are still seeing double digit declines and things like bulk freight and industrial fright. That will not change in the near term. He is now serving as the chairman of the democratic redistricting committee. Start with the news overnight. We dont know much overnight, there were not many details. Does it surprise you that iran and russia would be trying to send this information to tamper with our elections . Eric not at all. We need to be prepared for these kinds of intrusions, attempts to interfere with our electoral system. What struck me that was strange was the press conference being held last night. The information being shared was not something that was unanticipated, but trying to spin it as an attack on the anmp campaign, as opposed to attack on the american electoral system, i thought was a little different and unexpected. David it seems a little primitive to have supposedly proud boys sending email messages to say that if you dont vote for President Trump, they would go after you. Is that the way that iran or russia would go about this . Eric you see these intrusions, some of them are pretty sophisticated, and others are, as you say, crude. What the American People need to be aware of is that everything on the internet is not necessarily accurate. Ofre are a whole range reasons why things are posted. It is incumbent upon our intelligence agencies working with their state and local partners to pushback, filter as much as this as possible. The private sector and the platforms through much of which this stuff passes also has a responsibility as well. David one thing that both sides agree on is that the stakes are high in this election. We in the media tend to focus on the president and the senate, and the house of representatives, but you have an initiative focusing on something longerterm and farther down the ballot. That is the question of aedistricting, and why it is particularly important year because of the senses. Anc i get it, this is existential election, obviously a very important election, but we have to focus on the down ballot races. We are going through their redistricting process in 2021, and the people elected this year will help to draw those lines. We are trying to make sure the process in 2021 is a fair one, and that the lines are not drawn to protect incumbents, but to make sure elections are competitive, and that we end up with representatives at the state level who will represent the people and not special interest. People dont understand, you were probably impacted more than who is in your state legislature than the United States. Criminal justice reform, protecting a womans reproductive rights, protecting the right to vote, a lot of health care decisions, these are decided more in the state legislature than they are in washington, d. C. David the senses has to happen every 10 years, and ironically, this time it is with the president ial, which doesnt happen very often. What happened 10 years ago . Eric we ended up with a process that Princeton University said was the most gerrymandered redistricting effort in the last halfcentury. Republicans used the powers they got in the 2010 midterms to draw the lines that favored them. We have had to deal with that over the course of the last 10 years. My organization is trying to make sure that we have a fair process. One that does not favor democrats or republicans, does not gerrymander for either party. I worked with Arnold Schwarzenegger on this effort. Out ini have a piece missouri today trying to protect something we helped put in place there, a Nonpartisan Redistricting Commission that will take the power away from politicians and put it in the hands of a neutral body. The citizens of missouri, politicians are now trying to weaken it. We posted an oped that said preserve those rights. David you are representing the democrats on this. Would you be willing to take it out of the political sphere and give it to a bipartisan commission, or is it making sure that democrats control the statehouses . Eric i think the Gold Standard is to create these nonpartisan commissions. , have existedxist in arizona, california. We were instrumental in owning them in in michigan, colorado, utah. They will be doing the redistricting next year. That is the best way to do it. Politicians, whether democrat or publican, are going to try to protect their district, party. Put it in the hands of these nonpartisan bodies. With,ay, you will end up i think, the fairest line drawing, and legislators that are more beholden to the people, as opposed to special interest. If we have a fair process, i think democrats and progressives will do just fine, but i dont want to gerrymander for democrats. Lets allow the independent commissions to draw the lines. David the Supreme Court is very much on our minds right now. Amy Coney Barrett being referred to the full senate for what looks like confirmation next week. To what point does the Supreme Court limit the degree of gerrymandering . I know that you cannot gerrymander for race, but what about politics . Could that be a limiting factor, or could it be the reverse of that if we have a 63 conservative majority . This the Supreme Court past year, which i think was wrongly divided, said that the court could not hear partisan gerrymandering cases. They are still open to hearing racially motivated gerrymandering cases. As a result, we have had to bring cases in state court when we want to attack partisan gerrymandering schemes. I think that decision was wrong. I think federal courts are uniquely situated to deal with gerrymandering, whether partisan or racial in nature. The courts have an Important Role to play here. My hope would be that the courts would stay open to hear racial gerrymandering cases. Wouldtely, that the court reverse itself and recognize the decision they made was the wrong one, and open the federal courts up to partisan gerrymandering cases as well. David more generally, how concerned are you, as our former foremost lawyer in the country, about legal challenges and disputes coming out of the selection . Are we going to have a clean election . Eric i think we are. I think we need to be prepared for parts of the election being decided in the courts. You may see a lot of litigation leading up to the election when decisions are being made about votes bye matches on mail, how long polling places should stay open. But i actually think the turnout will be sufficiently large, and i suspect the decision of the American People will be pretty decisive. I dont anticipate the course will play a significant role postelection, but it is clear that both campaigns are getting ready to have lawyers all around the country prepared to litigate whatever may surface. David it would be awfully nice to let the voters decide, not the courts. Eric that would be a good thing. David thank you for being with us. That is eric holder, the former attorney general. Today we welcome the reverend joe watkins, former 82 george h w bush. To george h debbie bush. We have been talking about pennsylvania, what is going on there. Going ont what is there between president and Vice President biden. What does it look like in pennsylvania . Bideneople say that joe is from scranton originally and ,lays well in the suburbs certainly in northeastern pennsylvania where he is from. No matter what the polling data tells you, the race is probably a lot closer in pennsylvania than anyone would care to say. I say that because donald trump did so well in 2016 with noncollege educated whites, many of whom are democrats. These are bluecollar democrats, as well as republicans who have not gone to college. He does extraordinarily well with that demographic. Last time, he did well in what we call the t in pennsylvania. The northern part of the state, center, and a little bit of the cell. Those world districts, which have democratic voters, but even those voters largely went for donald trump. You can expect a lot of that. We dont yet know the impact that the coronavirus economy will have on the attitudes of cycle is allf this similar to the last cycle, dont be surprised to see a disproportionate share of bluecollar democrats voting for donald trump and making the race very tight in pennsylvania. David there is little question the core for President Trump, those noneducated white males to a large degree. At the same time, last time out aent trump eeked victory, he picked up some women in the suburbs as well. He did not win over all but did better than expected. How is that looking . Joe it is tougher with suburban women. Collegeeducated suburban women have not been pleased with some of the tone, rhetoric. They dont like anything that looks like racism, overt racism. They have not been pleased with policead instances of killings of people of color over the past year. Many of them i think are going to vote for joe biden, even republican suburban women, because they want to make a statement. Cycle,n women in this will probably be harder for President Trump then in 2016. Im not sure that he will be able to rely on their boat. Turnout will matter in this election. Polls are one thing, but what really matters is who it turns out to vote on election day. In this case, we have so many voters who have already voted. Very few undecided, people have shown up in big numbers to vote. David that is my final question. Is this a matter of persuading people to change their mind, or just a matter of people have made up their minds, and it is about who turns out. Few i think there are very undecideds in this race. People already know what they are likely to do. It is just a matter of whether or not they are incentivized to do it, in their mind, whether they are enthusiastic about doing it. One thing that has helped President Trump in the past is the enthusiasm of his base. I think his supporters will show up on election day. For joe biden, the question is who will show up to vote . Will africanamericans show up in big numbers to vote for him . David always helpful to have you. That is joe watkins. Initial jobless claims and continuing claims fell again last week for the third time in four weeks. Still, the number of americans on extended benefits rose. To give us more perspective on what these numbers tell us welcome Eugene Scalia, the u. S. Secretary of labor. Going downhey are but still elevated way above before the pandemic. Eugene good to join you again. Yes, this was a very encouraging report. We showed initial claims filings people coming in, asking to be qualified for unemployment benefits. The number we reported today was number lower than the from one week ago. Below west number we have seen since march. You mentioned continuing claims, people whose claims have been approved and are receiving benefits. We know now in the month of september, 3 Million People went off unemployment, which is encouraging about the direction of the recovery. For the last week for which we have full data, we know one Million People came off of unemployment. The trajectory is strongly in the right direction, but as you said, these numbers are high. We need to continue to bring them down. We are bringing them down much more quickly than was predicted in april or may. We have putback 11. 4 million jobs through september. In the last economic downturn during the financial crisis in the obama administration, it took nearly three years to get unemployment under 8. 5 . We have gotten it under 8. 5 in four months. It is a strong recovery heading back to that Strong Economy that we had precovid. David have we got a lot of the low hanging fruit . What im really asking is, we have a lot of people saying the jobs have been coming back, but some jobs may never come back because we have permanent changes in the employment structure. How is the Labor Department assessing that, do you have any sense about how many jobs we will lose over the longerterm, and what can we do about that . Eugene i want to be clear, david, this is not job completed. This is not a situation where we can look at back look back at this and say there is no more work to be done. There are encouraging signs about the job market and economy generally. We had a really good existing home sales number, retail Sales Numbers last week. One other interesting job Market Report we put out on tuesday, the report regarding state unemployment rates. We know the National Rate is 7. 9 . We saw that a couple weeks ago. Now we know what it is in individual states. For a majority of states, 6. 7 or lower. Three states stick out. California at 11 . New york and illinois at 10. Those are three of our five largest states. They are having a harder time bringing people back to work. The National Picture looks better. I think we will continue to put jobs back, but we have to recognize there are some sectors, like conventions, to an extent, airlines, that will take longer, although there was good news as well about airlines. A couple airlines said passengers are coming back at a higher rate now. Tsa numbers are picking up. A lot of progress, still more to be done, but i think we can continue this, especially the progress that we are making on the vaccine as well. David i also want to address a osha. Issue under we have talked about it before, and i know you think you are doing what you need to do, but give us your sense, philosophically, you agree there should be regulation for employers to ensure safety and health. You believe the balance has gotten offkilter. How do you strike that balance . Eugene i think we have the right balance now. Osha, which is a part of the Labor Department, has been communicating to workers and employers about covid safety since january.
