This it strikes me that is different from some other investigations. Both sides admit to a lot of the fact. We have the rough transcript of the exchange. David why wouldnt it be value robert if you get that expansive view, pretty much everything is illegal. It is only certain kinds of things that are of value. The fact that you can encapsulate anything that would be president that would be benefit to the president of the United States under the sun frankly stretches the Campaign Finance at well beyond what was intended. David we are talking with robert ray, former independent counsel. We have had four times in our history we have had house investigation for impeachment, three of them in my lifetime. We have experience with president nixon and president clinton. What happens when Congress Demands information from the white house and they refused to give it . Robert it depends on your view of the law. Some of this is an uncharted territory, but not all of it. When the house acted as a body under an authorized vote of the entire body to open up an impeachment proceeding, that obviously allows a certain amount of flexibility the courts recognize in order for the house to get documents in connection with that proceeding, including grand jury material. The resistance from the Justice Department and the white house in connection with access to the grand jury material that was during the Robert Mueller investigation is because there is no impeachment proceeding currently attending. While that may seem to many in the political process as being a distinction without a difference , it does have constitutional significance and a legal difference because a number of things flow from the opening of an impeachment proceeding. You get access to more information and it gives rights to the Minority Party to issue subpoenas in that process, something the democratic leadership seems unwilling to do. You willrness dictates conduct a procedure leading toward an article impeachment that would be referred to the senate for trial. Both parties should be participating. Why . Because it does, at the end of the day, require bipartisan support in order to remove a president from office. That is why. David the conflicts involving the president are not limited to washington. We have one in new york, where we have the local prosecutor trying to conduct a criminal investigation into some activities of the Trump Organization. President trump has said you cannot do that. That is illegal. There was a ruling from the federal court saying yes they can, but then you had to stay. Who has the better of the argument . Robert it remains to be seen. Like a lot of things, at least from my view, and you have to respect the district judges contrary ruling until such time as the Second Circuit sees fit overturn it, and may ultimately land in the Supreme Court. I think the District Court gave short shrift to the president s argument under the supremacy clause, which i think is a substantial one, that prevents a state court in interfering with the president s exercise of his lawful constitutional duties while he is president. That is an area where the state authority is removed by constitutional authority, meaning the supremacy clause, not to be flip, trumps state authority and must give way to the exercise of federal authority. Of departmenttter of justice policy, you cannot prosecute a sitting president. This is not a prosecution, this is an investigation. Is there an argument that says let us get the information so we can preserve it for when President Trump is no longer president. Robert that is a better argument in connection with the exercise of federal authority. That is what the Robert Mueller investigation was about. It is different when you involve a state and local prosecutor and understand what the consequences of that would be in the extreme. Do you want to situation where every state and local prosecutor under our federal system would be allowed to investigate a sitting president of the United States. Doesnt that run contrary to the supremacy clause, which makes federal authority the supreme law of the land . David robert, thank you so much for being with us. David joel, what about it . If it is a way to express displeasure, is there an argument for it because there are not many republicans jumping to his defense. David you have Bernie Sanders and Elizabeth Warren who says corporations have way too much power. What would you do different from them . Tom there are things i propose they will never do. I propose term limits for Congress People in the senate and a National Referendum so the American People so if the American People want something, we can put it on the ballot ourselves. It takes away the monopoly over congress. I have talked about it and other people agree that we need to end the legal fiction that corporations are people. Corporations are not people and they dont deserve the political right of an american citizen. We need to break the corporate stranglehold, and that has got to be the first job. We got to do this in order to get the Supplemental Care plans. Honestly, we are close to dealing with climate in the real world, so all of those proposed, green new deals are really off the table. David in order to get most of those things down, you will need more than that because the law will require changes to the fundamentals. How do you bring that part together since the country so badly divided . Funny because i dont see it that way at all. That is the traditional way people have thought about this, but what i see is half of americans dont vote. We have asked them, an organization i started did the largest use Voter Mobilization in 2018 last year in american history. We asked hundreds of thousands of young people why they dont vote . They voted half the rate of other american citizens. No one tells the truth. No one deals with our actual issues and there is no difference between the parties. My but i participate in a failed system . That is the start of the conversation. To me, 50 of americans dont vote. Everyone talks about the 2 who do vote, but cannot decide which way develop. I am saying, oh no, 50 of americans dont vote. They all agree with what i am saying and what the democrats. Why dont we convince them the system is not broken . Participate, and if they participate, we can take out the government. David when you talk about referendums, do you think brexit was a good idea . Tom that was a terrible outcome. I think it was halfed by the russians, and i will be pushing for another referendum if i was in the u. K. Because it has become clear to everybody this was a mistake. I dont understand what they are doing, but what i see is an ability in the u. S. To pass things that congress will pass. Over 90 of americans have wanted mandatory background checks on every gun purchase for decades, and it has never happened. The nra is owned by the gun manufacturers and they dont want to happen. Tom i believe the impeachment process will have run its course long before november 2020.
