This is where the former President Donald Trump found himself today for this arraignment, where he did enter the not guilty plea for those four criminal charges related to his alleged attempts to overthrow the results of the 2020 elections. It was a brief 30 minute procedure in court. Many of the steps we have seen in the previous other arraignments with the former president. He arrived by motorcade, came in through a back door. He had to wait about 20 minutes for the Magistrate Judge to arrive in the courthouse. According to reporters who were in that courtroom, they say President Trump was calm and he was surrounded by his legal team, the special Counseljack Smith was sat just the special Counseljack Smith was satjust behind him in the front row, as he listened to those charges and entered his plea. That is what we will be looking for in this august 28th hearing, we might also hear arguments that the case should be moved outside of washington, dc, trumps lawyers have been vocal saying they dont believe he can get a fair trial here. That might be a long shot argument. That is the next step. As we know, several other legal cases donald trump is dealing with. This is his third indictment, there are other cases in new york as well. And thats on top of the fact that he is still the lead republican candidate for the nomination in 2024, so politics and legal cases will begin to combine very soon. I asked him whether its possible to assemble an impartialjury, given the high profile of this case. I think that they will be able to do that. We have had this issue arise before with other high profile cases, and i am convinced that there is not a person in the United States who has not heard of donald trump, and has not formed an opinion on him or about the prosecution. The question is, will they be able to put those preconceived notions aside and focus only on the evidence presented inside the courtroom and base their verdict on the evidence . For that, we have to hold jurors at their word. If they tell us they can, then they move into the pool of 12 people who could be selected to sit on this jury. So those are the people we are looking for. People who can put their preconceived notions aside and focus on the evidence presented to them in the courtroom. As carl mentioned, it seems like mr trumps defences strategy is to delay this as long as they can. But what is fascinating is that, even if he was found guilty and if he won the election next year, he could hypothetically run the country. Talk us through the law behind this. What needs to happen here is not only a conviction, but one that is upheld on appeal and that conviction would be a disqualifying conviction for the individual who has then been elected to hold office. It is only at that point would he be disqualified. Depending on how long these cases take to go to trial and then work through the court of appeals, he could not be a confirmed, convicted felon before the election and inauguration takes place. 0dd set facts, but thatis the way the constitution has been written. Of course, that is if he is found guilty. If he was reelected next year, could he possibly pardon himself . That is a question being debated by constitutional scholars and lawyers like myself alike. Theres no specific provision that says he cannot to that. There are certain provisions that arguably would say that you cant. We did not see former president nixon pardon himself. He was pardoned by then Vice President ford, who became president ford. Weve seen president s pardon other people but never before have we had a situation where a president might potentially be able to pardon himself. Of course, he could possibly face another indictment, of course the third indictment that he is currently facing, but a fourth one is possible in georgia. Tell us about that. We saw shades of what that indictment might contain within this indictment itself. They talked about the election in georgia and the efforts that mr trump undertook to try and overturn the results of that election. We heard reference to the phone call he made. So a state is a separate sovereign from the federal government. They are entitled to bring their own parallel proceeding, and if a grand jury returns an indictment, then he will be in court for yet another arraignment on another indictment. That will take its place in the line of three cases, as to when those cases will go to trial. Meanwhile, the former president has been attacking the judge and the prosecutors personally, possibly putting them and theirfamilies in danger. How unusual is this . Quite unusual. In most if not all cases, the litigants in the case, whether its the prosecution, the defence or defendants themselves, are very reluctant to say anything about the people who control the case or people who are prosecuting the case. Thats not the way he acts and operates, and at some point, if it continues and it escalates to the level where there is a physical, personal safety risk for the prosecutors, judges, someone will ask the judge to impose some sort of gag order on him and if he violates that, he will be held in contempt. Its not something that a defendant ought to be doing, especially when you are talking about the person presiding over your case. The Republican Party today is more a cult than a normal political party. Republicans are with donald trump no matter what, and republicans in congress are also with him no matter what. There are many things that could have already been done, very simply, to remove this possibility, the constitution could be amended, or because that is difficult but it could be done. The simplest thing that should have been done was afterjanuary sixth, donald trump should have been removed from office, impeached and disqualified from running. The reason he wasnt, only a handful of republicans in the senate voted to take the necessary action and left us in a really difficult and surreal position of having to consider a possibility that a man facing trial, even a possibly convicted felon with authoritarian tendencies, might sell him might save himself from the election. I think if you look at the share gains, we estimate about 300 bits of share gains in china from apple, and thats really been the hearts and lungs of the growth story for apple, and i think that is something that we see across big tech earnings, is a lot of fear going into big tech earnings. Its been a lot better than expected. Thats a big reason that we have seen that green in the market, in terms of nasdaq.
