This is the pensioner who feared he was going to be spending his remaining days in prison. You know . Lastly, he came into court, know7 lastly, he came into court, you could see the past year or so of this trial, hes been in custody for 19 months, it had taken its physical and emotional toll and he came into Court Last Week fearing they were going to find him guilty of murder. Then he was found guilty of the lesser charge of manslaughter and so, faced with the prospect of spending the rest of your Life In Prison, then hearing today that you were going to be sentence for manslaughter which can carry a sentence of 25 years, to walk free from court is just unimaginable. Its something his family never dared imagine and it was something that actually his lawyers and everyone in court quite frankly were not expecting 30 or 40 minutes ago from thejudges not expecting 30 or 40 minutes ago from the judges passed that sentence. Because what they said they were sentencing him to two years in prison, taking into account the time he had spent in custody so everyone was frantically trying to figure out what that meant and officially we were told he will be freed by the end of august and then literally in the past 15 or 20 minutes we were told no, he can actually walk away from prison, from court right now and that is exactly what has happened. You saw some months ago, he has walked away with his lawyer. And as divisive as this case has been, you have to remember this, that david hunter starting his life scratch now. His daughter said to us, this is a man who was enjoying a wonderful retirement with his wife, they had a house, a couple of cars, money in the bank, that man you have seen leave this court some moments ago, now has a carrier bag and this is what he has to adjust to. Hes going to need support from his family, his friends, his Friends Backin his family, his friends, his friends back in the north east who say they are ready to support him. And one person to do to seeing this man has already served a Life Sentence. He is going to have to live with what happened in that house for the rest of his life. And he is going to have to come to terms with that. He told us before when we were in court that if he was freed, it would mean, he said his wife would be pleased, he said his wife would be pleased, he said he thinks his wife is with him every day. She will be relieved that this had happened to him but also it would give him time to grieve. He has not had a chance to do that. Neither has his family and in fact in the past few minutes i have received word from his daughter lesley, back in the uk and in a few simple but she said this is incredible. She says i am in tears and speechless. And elated. No doubt he will be speaking to his lawyer now. Taking a moment about what happens next in terms of procedure. Bureaucracy. Maybe other reports need to be prepared with the prison . But now, he is a man making plans and this is not something he ever thought he would be able to do because do not forget, this is a man who also attempted to take his own life. So david hunter, a free man today and let me just sum up what thejudges are said today and let me just sum up what the judges are said to him. The message to society cannot be that human life, even with the intention to ease suffering, to take that, it is acceptable, it is not, committed a crime. Nobody should choose when somebody� s life should end, not even a loved one. We have taken into account that it must send that message to society, without giving the defendant a sentence that does not take into account the particulars of this and personal circumstances. He was telling the court that she begged me to do it. I didnt want to do it, it was her decision. I loved her so much, why would i want to kill the Love Of My Life . It was a crime of love and mercy. So there was no dispute in court, thejudges said, that he didnt love her, even the prosecution itself said that we dont dispute that. That this was an act of love. And so the difficulty that they had was whether or not this was premeditated or whether or not it was manslaughter. But the judges said for it to be a premeditated crime, Premeditated Murder, there would have to be proof that david hunter was cold, calculated enough to carry out that murder. And there was no proof of that. The prosecution was saying also that there was no evidence of an agreement between the two people, there was no pact, so how can you say that he was trying to help her . They also said this, when youre talking about assisted suicide, this is the other point. They are also saying, look, if you are trying to end your wifes life, prove to us that you are trying to assist her by giving her tablets, for example. That would show assisted suicide, rather than murder. There was no proof of that, they said. At the judges did not agree with the prosecution, that is why he received the charge of manslaughter and why he walked free from court and from prison today. Often it seems like the world is a big place, and global heating is a big place, and global heating is a big problem. Its not something that individual people can do very easily. What we have to realise is that individuals and individual countries can make a huge difference. The uk invented a lot of the Industrial Revolution and we can invent the carbon revolution, we are doing that. We started off in 1990, admitting omitting about double the Carbon Dioxide we are emitting per person, we have come halfway without crushing the economy or breaking the country. This is where it gets more difficult, where announcements like today, announcing large Carbon Capture and storage projects are really important, we are the first in the world to do this at a large scale across multiple industries, the omission of entirely decarbonising the uk economy. If we can show how that can be done, show that it really can be done, that gives confidence china and the united states, and brazil, that there is a path to follow. Another country has developed a pathway and it is feasible. And that is what we are doing. That may cost more for some things, but of course this needs to be part of a package, i said Carbon Capture and storage might be one of the many parts of the answer, other parts of the answer are becoming much more efficient in the way we use energy, insulating houses, for example, that could halve it. But i think thats actually a false argument, because that oil or gas, as many people point out, not a lot of that is exported, even the oil or gas we use here in this country is priced at International Market rates. So producing our own oil or gas for another five rates. So producing our own oil or gas for anotherfive or rates. So producing our own oil or gas for another five or ten years is not going to change the price which ordinary citizens pay for their gas, ordinary citizens pay for their gas, orfor ordinary citizens pay for their gas, or for the petrol in the car. That is on international pricing. What we can be doing is trying to become more resilient and self generate our electricity and our energy through wind power, through solar power, through tidal power, and the carbon which we do continue to use, the Carbon Emissions we make from making cement, from making steel, from making paper or glass, making petrochemicals, which are fantastically useful, all of those things emit Carbon Dioxide and Carbon Capture and storage is a way of countering that. What Carbon Capture and storage does says, ok, if you want to use fossil fuels, even capture the carbon and have the Carbon Dioxide, liquefied by pressurising it, and put that liquid Carbon Dioxide through a pipeline, may be 50 or 100, or 200 kilometres, and then inject the Carbon Dioxide into the tiny crawl space of the rocks where it came from, deep underground, beneath the north sea. So its a way of trying to mitigate the transition, whilst we reduce our carbon use and fossil fuels, we can also eliminate the emissions, to a large extent. But, of course, these are going to be giant projects, multi billion pound projects, and the uk is leading now and having four of the projects. We need to go faster, we need to not let up on that, we need to have double the amount of these projects by 2030. It amount of these projects by 2030. This is what he told the court. He said his wife janice and they were married for 57 years, she cried and begged him to end her life. She suffered from blood cancer. One of the points being made was there was no Firm Evidence this was. But his legal team argued he should be given a suspended sentence and this was a legal first for cyprus. In mitigation his defence lawyer said his motive was to using her words liberate his wife from all that she was going through because of her health conditions. And the court heard it was her wish to die and that her husband had only feelings of love for her. That concentrates the mind is in our next hour. He said he would never in a million years have suffocated his wife unless she had asked him to do so, unless it had been her wish. And he assured the court how he held his hands over his white s mouth and nose and he decided to grant her her wish after she became hysterical. The court then heard and this is another part of this, he tried to kill himself by taking an overdose but paramedics arrived in time to save him. You know, we all know the law in most countries france upon assisting a loved one to die. But i mean i have not done it myself but i wish i had been brave enough to do that because having to watch a loved one die in so much pain, it is horrible. And i think the law needs to be addressed. You have to be very careful with how these laws start and obviously we do not want people knocking people off with the excuse that they are doing it out of kindness but i do think the laws in a lot of countries, certainly the uk, needs to be looked at again. Because it is all very well saying life is precious, it is when it is going well. But when you are in so much pain, day after day, month after month, that is not life, thatis month after month, that is not life, that is a living death. And i think people who need help to pass on when they are in a considerable amount of pain, there should be a way of helping them to speed things up. The situation with your parents, janice, according to what david hunter said in court, his wife wanted help, she wanted her husband to help her to die. One of the nurses said if she got into a lot of pain during the day, i cannot remember the amount that they suggested i could give a small amount to ease the pain. But it shocked me, ok, she did ask to come home but that medication, there was a box filled with morphine in the house of my mother watch if i had been so inclined, i could have been pouring it down her throat all day. That is a difficult situation. I know. People want to go home to die, i respected the wishes of my mother as did everyone else. I would just say, my mother, she has been dead ten years now, i took her to a well clinic and they diagnosed her one over the with lung cancer. And they told me she would have three months. My mother was a sister in a hospital and she had not lost her marbles at all. I decided that i did not want her to know, i know a lot of people will hate me for that but my mother had gone blind and i did not want her to sit in a chair for three months waiting for the day she was going to die. And i was told by the surgeon if i did that, i could have no help at all from anybody. Because it is against their ethics. So i took her home and her own doctor came out to see us. She left me morphine and sleeping tablets and said, give it to her as and when needed to relieve the pain. And we never saw anybody again. For three months, my son and i looked after her until the day she died. I myself was happy that i did say i did not want her to know. She thought she had shingles. We must be so careful we dont use those and extrapolate unfairly to what can be done when there is good care. I have experienced looking after many dying patients, and they have been able to die peacefully at home with their loved ones around them. Ijust think david may be didnt have the support, and his wife didnt have the support around him, the Palliative Care. I think it must have been quite a violent passing for his wife. I am sure treatments have changed in the last 30 years, but he was at home and on a lot of medication. He had a morphine pump and various other things. I was in my early 30s. I remember standing at the bottom of the bed, looking at him. And he was like an animalscreaming the bed, looking at him. And he was like an animal screaming in pain. It was like he was in a trap. His eyes were just like black holes. Was like he was in a trap. His eyes werejust like black holes. I kept running to him to try to comfort him and every time i touched him, he screamed. Because basically his bones were just bleeding into themselves. I was running back and forward, not knowing what to do. It did actually cross my mind, i have to kill him, i have to put him out of his misery. We have this old cricket bat, and i thought, should i. And of course i didnt. It was that point of looking at somebody who seem to have become a creature of pain that i cannot help. And that was with the medication that he had. I was off and on to the gps, and Community Nurses came now and again, but basically i was on my own. When you are in that state and you want to help somebody, rather than watch them suffer over a couple of years, you just think hes going to die anyway, does it matter now or does it matter in two weeks . Even talking about it now makes me shake, because i will never get the image of his face out of my head until the day i die. Crazy, seeing a creature of pain as you put it . I have to say that macmillan and marie curie were brilliant. And i will back them forever for what they try to do. But even with pain relief, there are points where a human being cant take any more. And when you are standing looking somebody like that, well, i can understand why david felt that he had to do something, and i can understand his wife screaming in pain, because i have witnessed that.
