With freedom of speech, europes top court is due to rule on the right to be forgotten. A warm welcome to the programme, briefing you on all you need to know in global news, business and sport. Also in the programme the causes of obesity are complicated and not just about a lack of willpower, so lets stop fat shaming. That is the conclusion of the british psychological society. Do you agree . Tell us what you think. Just use the hashtag bbcthebriefing. The United Nations secretary general, Antonio Guterres, says the world is waking up to the threat of climate change. Closing a special un climate summit, he welcomed the pledge by nearly 80 countries to make their economies Carbon Neutral by 2050, but he warned that there was still more to do. You understand the Climate Emergency is the fight of our lives, and for our lives. I thank young people around the world for leading the charge, and holding my generation accountable. We have been losing the race against climate crisis, but the world is waking up. Pressure is building, momentum is growing, and action by action, the tide is turning. Today, in this hall, the world saw clear ambition and concrete initiatives. Joining me now is the bbcs nada tawfik, who is at the United Nations in new york. He ended the day with the up sum, the powerful speech was from the swedish activist greta thunberg. But looking back on the day, how successful was it, really . Well, looking back on the day, how successfulwas it, really . Well, you know, the secretary general said he wa nted know, the secretary general said he wanted countries to come with concrete actions and notjust fancy speeches, and really, given Greta Thunbergs powerful, emotional, raw speech, and he had hoped that countries would step up and they would come with ambitious new commitments. Now, unfortunately it was another day of fancy speeches, and if you ask environmentalists, from their perspective, even those countries that came through with commitments, whether it is the uk, france or germany, they felt like those actions just really didnt go far enough. And then they pointed out that china, the worlds biggest loser, didnt make any announcements. That the united states, besides a brief appearance by President Donald Trump which was unexpected, didnt even speak at the meeting. And the fact that it was really the developing countries in the countries that are responsible for such a small portion of emissions were the ones that were really coming up with some really strong commitments. All of this combined, they said, really showed that despite the millions protesting in the streets, young activists concerned about their planet, their future, that leaders still werent going far enough to keep Global Warming well below two celsius. Well, now talk us through what the agenda is today for us, you are in the middle of the night in new york, but on tuesday for the United Nations. Well, this is the big day of the Un General Assembly, where we kick off the biggest speeches. The president , donald trump, will be speaking. He has told reporters that theissues speaking. He has told reporters that the issues he will be focusing on oui the issues he will be focusing on our reasserting american sovereignty, its leadership and role at institutions like the United Nations. Countries have been a bit concerned that america has been withdrawing its role as a leader in Global Politics and diplomacy, so a lot of focus will be on what he says there. He has also said he will be speaking about iran. Now, given heightened tensions between the us and iran, theres been a lot of diplomacy on the sides here already in new york. We had written, the uk and germany meeting saying that they determine iran was responsible. They are sure iran was responsible, they say, for attacks on saudi arabias oilfacilities, and say, for attacks on saudi arabias oil facilities, and they think it is time, they say, to engage in new negotiations not just on time, they say, to engage in new negotiations notjust on its Nuclear Profile but also on its missile programme. So a lot of focus will be on that. And then finally, president Jair Bolsonaro of brazil has come under a lot of criticism for his policies in his country particularly when it comes to the amazonian deforestation. And with climate being such a focus here, a lot of politicians and certainly the environmentalists who have been so vocal here i going to be really interested to see how he defends his positions, and if there is any change there. Thank you so much. A packed agenda ahead for the United Nations. Interesting to note that the uks Prime Minister, Boris Johnson, is there, of course. Here in the uk, in a few hours time, the highest court will give its historic ruling on the legality of the Prime Ministers decision to suspend parliament for five weeks. Ministers say the suspension or prorogation is not a court matter. But critics argue it was intended to limit scrutiny of the pms brexit plans. If thejudgement goes against mrjohnson, parliament could be reconvened immediately. Clive coleman reports. It has arrived, at speed. Judgement day. 11 justices at the Supreme Court will rule on whether Boris Johnson acted unlawfully in advising the queen to prorogue or suspend parliament for five weeks. Is he anxious . Let us see what the justices say. Im going to wait and see what thejudgement justices say. Im going to wait and see what the judgement is, and justices say. Im going to wait and see what thejudgement is, and but i want to stress that this is a government that fully respects the law and fully respects the judiciary. The Supreme Court will resolve two dramatically contradictory rulings. Scotlands highest civil court ruled the Prime Ministers advice to the queen to prorogue was motivated by the improper purpose of stymieing and frustrating parliament during critical weeks before brexit. But the high court in london, in a case brought by the businesswoman gina miller, ruled that proroguing is a political matter and there were no legal standards against which a court could judge it. At the Supreme Court last week, the barrister representing the snp mpjoanna cherry and more than 70 other parliamentarians didnt pull his punches. Weve got here a mother of parliaments being sucked down by the father of lies rather than allowing lies to triumph, listen to the angels of your better nature. However, government lawyers argued firmly that this was not a matter forjudges to decide. The length of the session of parliament and the frequency of the sessions is regulated by constitutional convention, not by the law. The Supreme Court will first have to decide whether prorogation is a matter for the courts. If it is, the court will go on to rule definitively whether Boris Johnsons advice to the queen was unlawful, either because of his improper motivation, or perhaps more likely, because the effect was that legislation was lost and parliamentary scrutiny improperly denied. The wording of any declaration of unlawfulness will likely determine how parliament is reconvened, whether by government recall or at the invitation of the speakers of both houses. And we are expecting to hear from the Supreme Court around 10 30am local time. We will be across that story live on the bbc. Stay with us as that story unfolds. Thousands of stranded thomas cook passengers will be repatriated to britain on tuesday, as the rescue operation continues into its second day. Holidaymakers were being brought to the uk amid questions over the multimillion dollar sums received by the bosses of the firm prior to its collapse. Thomas cooks key destinations were Southern Europe and the mediterranean, but it also offered holidays in asia, north africa and the caribbean. With me is inga beale from london first, a not for profit group made up of Business Leaders from across the city, who is an insurance expert. Of course, a former ceo of lloyds of of london. This situation you know extremely well. Well, all sorts of disasters happen in the world, and of course, some of them happen to businesses like thomas cook. And when you work in insurance, you are a lwa ys when you work in insurance, you are always looking to the future to think about what could happen. And any business actually should be doing that. They should always be looking through, looking at how sustainable their Business Model is, looking at what could happen in the future that might put them off track. Now, often we think about natural disasters, and if you think about one of the other things that really hit the Airline Industry and the travel industry, of course, was the travel industry, of course, was the volcanic eruption in iceland. And some of those things are not so predictable. But when it comes to running a business, you would expect Something Like this to be a bit more predictable. And one of the things that disneys leaders should do is actually look to the future. Cash is king. We all know cash is king. They have huge, huge debts. That was one of the main problems. So if you are not watching your cash flow you are not watching your cash flow you are not necessarily doing what Business Leaders should do, and particularly governing that company appropriately. There is going to be an investigation into how the top execs, those in charge of thomas cook, examine this in the run up to its collapse, there is this fatcat headline on the front page, has over 22,000 employees look like they will lose theirjobs, and there are hundreds of thousands of people stuck overseas. Your thoughts on that . Yes, i mean, its. And when all of these things go wrong, it is a lwa ys all of these things go wrong, it is always the human factor that gets us so always the human factor that gets us so worked up, and it should do, because these are peoples lives being affected, particularly the employees, never mind the hundreds of thousands of people whose holidays, and they might have been saving for a long time for those holidays. So that is always sad. When you are running a company you ta ke when you are running a company you take a lot of risk and a lot of responsibility so you need to be compensated. I think what has happened in the Financial Services sector which i have always worked in is of course people do get paid bonuses, but there is the ability to claw back some of those bonuses if, after an event, and you could have even left the company, there is an ability to clawback some of these bonuses if people found that you didnt behave appropriately, you did something negligent, or whatever. Didnt behave appropriately, you did something negligent, orwhatever. It is interesting when you think about bonus payments for when something is good. How do we claw that back in non Financial Services businesses . All right. Thank you for now. Inga is back later with our news briefing. Make sure you stay with us for that. Still to come more problems for cruise liners as another european city, this time cannes, says it will impose restrictions on the most polluting ships entering the resort. Ben johnson, the fastest man on earth, is flying home to canada in disgrace. All the athletes should be clean going into the games. Im just happy that justice is served. It is a simple fact that this morning, these people were in their homes. Tonight, those homes have been burnt down by serbian soldiers and police. All the taliban positions along here have been strengthened, presumably in case the americans invade. Its no use having a secret service which cannot preserve its own secrets against the world, and so the British Government has no option but to continue this action even after any adverse judgement in australia. Concorde have crossed the atlantic faster than any plane ever before, breaking the record by six minutes. You are watching the briefing. 0ur headlines decision day at the uks Supreme Court. Judges prepare to deliver an historic verdict on Prime Minister borisjohnsons decision to suspend parliament. Un secretary general Antonio Guterres thanks young people for leading the charge against climate change. He says the world is waking up to the problem. The brazilian president is in new york where hell be delivering his speech at the Un General Assembly later on tuesday. Jair bolsonaro has come under Huge International pressure over the fires burning in the Amazon Region and is expected to use his speech to try to repair some of the damage done to brazils reputation. Fires are continuing to burn, as will grant reports from the amazonian state of para. From green, healthy, pristine to charred, blackened and scorched. The fire line in parra state is the indelible mark of human activity in the amazon. Everyday it encroaches a little deeper into the rainforest. From above, the forest cover and the scale of the problem is laid bare. Parra scale of the problem is laid bare. Pa rra state scale of the problem is laid bare. Parra state is the epicentre of an environmental crisis, a tragic combination of fire, deforestation and, in this instance, illegal gold mining. We accompanied arnaldo, a 71 year old leader of the ethnic group on a greenpeace monitoring flight group on a greenpeace monitoring flight to inspect the damage to their protected lands. Few of the amazon basins 20 million inhabitants have as much claim to this land as its indigenous people, and it pains arnaldo to see the effects of the illegal mines. Translation bolsonaro khan sayed thing is fine. He never spoke to us. How can he say everything is good . His idea of fine is different to us because he wants to destroy the forest, thats how he thinks. So this is not fine with us. As we fly over the rainforest, its hard convey the extent of the damage weve seen. The lowest protected areas of the amazon are being mined atan alarming areas of the amazon are being mined at an alarming rate, their waterways polluted with mercury. And as president bolsonaro gears up to tell World Leaders at the un that he has this situation under control, hes also legalising this activity. And, of course, its notjust mining. A recent wildfire here burned 1600 football pitches of forest in four days, one of the worlds last natural protections against climate change. Daniel gutierrez and his tea m change. Daniel gutierrez and his team decided to take matters into their own hands. A year ago they set up their own hands. A year ago they set upa their own hands. A year ago they set up a volunteer fire service. Woefully under resourced, this year they have barely rested. We when not putting out the flames, they patrol the forest to. Fires from breaking out in smouldering areas. With the amazon we are blind. We are making our graves stop this week the people held their annual festival to celebrate the native pink dolphins, as well as other species. The theme was the preservation of the regions unique fauna and rich indigenous culture, exactly the issues on which president bolsonaro may clash with the un over the argument of Global Responsibility on climate change. Lets talk more about the collapse of the Tour Operator thomas cook. Thousands of tourists are still stranded abroad but longer term, the collapse will not only affectjobs at thomas cook but in the wider tourism industry. Karen chalker and her husband john are from barrow in furness in cumbria in northern england. They are on holiday in benidorm until sunday and have been caught up in the thomas cook collapse. Thanks for being on the briefing. Tell us about your situation . Your holiday, does it end on sunday . How are you going to get home . Holiday, does it end on sunday . How are you going to get home7m holiday, does it end on sunday . How are you going to get home . It does end on sunday. As for getting home, we still dont know because weve been on the thomas cook website, as suggested, and looking at the caa information, its very difficult to determine any flight information at this point. I think its probably still early days for caa to have the flights displayed, but people are in panic mode because they dont know whats going to happen. We dont know whether well fly back to manchester. We have our car park there car parked there. Manchester. We have our car park there car parked there. Theres a lot of questions still and if you dont fly back sunday, whats your situation . Youre staying in a hotel, is that right . Presumably you will have to pay for the longest day. Talk us through your logistics. We came on thursday. There wasnt the correct room ready for us, so we then had to move rooms on saturday. Then we found out yesterday that thomas cook has gone into liquidation. Fortunately for us, weve still been able to get in the room, whereas we were involved in the monarch closure as well u nfortu nately. At the monarch closure as well unfortunately. At that time we were locked out of the room, but this time weve been able to gain access to the room. We did go down to the reception because there was a note left for us to go and speak to them. They just mumbled, saying, left for us to go and speak to them. Theyjust mumbled, saying, are you aware of thomas cook . We said, we have heard. Said youre going to have heard. Said youre going to have to pay 900 euros and if you dont, you must leave now. Presumably thats the Hotel Response because they know theyre not going to get the money paid to them by thomas cook. So youre now in the situation where you, in time and through a laborious process, have to call this money back, as you had to do with monarch presumably . We did. Did you get your money back with monarch and are you hopeful you will get the money back this time . We did get the money back this time . We did get the money back this time . We did get the money back but even when i showed ca a documentation to show that we had paid everything but the hotel didnt accept that. They were rude and they said if you dont pay, you must leave now. 0bviously my husband didnt want us to be out on the street, and wondering where we we re the street, and wondering where we were going to stay, so hes paid the money for our security. All right. When i spoke to simon calder yesterday evening on five live, he was saying that we shouldnt have paid the money and the caa wont be coming into all the hotels because they will have names of people currently staying will be coming. We will have to leave it there. Sorry to into you. We really empathise with your situation and we wish you all the best. Good luck and we hope you get home soon. Thanks for being on the programme. Thank you. One example of the thousands. We will talk about this in Business Briefing, some of the details on that collapse. Now its time to get all the latest from the bbc sports centre. Hello, im marc edwards, here is your tuesday sport briefing starting with football, and lionel messi and Megan Rapinoe were the big winners at the best fifa awards. They were named mens and womens player of the year at a glittering ceremony at la scala 0pera house in milan. Its the 6th time that messi has won a version of the fifa player of the year award. Megan rapinoe, who scored six goals as the usa retained the world cup this year, beat lucy bronze and alex morgan to the womens award. Rapinoe also became a vocal advocate for many of the issues facing football during the world cup, and continued that theme in her acceptance speech. If we really want to have meaningful change, what i think is most inspiring would be if everybody other than Raheem Sterling and koulibaly, if they were as outraged about racism as they were. If everybody else was there. If everybody else was there. If everybody else was outraged about homophobia as lgbtq players. If eve ryo ne homophobia as lgbtq players. If everyone else was as outraged about equal pay and the like of investment in the womens game as women, that would be the biggest thing for me. There seems to be some confusion over the future of the former Australian Rugby Union International Israel folau, with rugby leagues world governing body denying theyve given clearance for his return to the sport. Earlier, the Tonga National rugby league said folau had been cleared to play for them at next months 0ceania cup, but the rlif says thats not the case. Folau had his contract with Rugby Australia cancelled after writing on social media that hell awaits gay people, which breached a players code of conduct. Thats the sport. 0ur thats the sport. Our thanks 214 that. Our thanks to marc for that. The mayor of cannes says hell impose restrictions on cruise ships coming to the french resort. The new rules mean that passengers from polluting liners may not be able to set foot on land. It follows a similar ban imposed in the italian port of venice. The bbcs tim allman has the story. When you think of cannes, this is probably the sort of thing you have in mind luxury, wealth and opulence. But some here are worried that along with the glamour, there is pollution and increasingly dirty air. One possible culprit, the huge cruise liners that visit the city every year. A new cap is being imposed on the sulphur they emit. If theyre not clean enough, their passengers may not be able to disembark. Translation its not about being against cruise ships, its about being against pollution. We will no longer accept tour buses and Cruise Ship Passengers on the ground coming from polluting cruise ships. Nearly 400,000 such passengers come to cannes each year and some of the ships are older than others but their owners insist they are sticking to the rules. At the end of the summer, we will go into our maintenance cycles so the ship will be out of service for two or three weeks interesting story tim allman was filling us in on. Ill be back with the Business Briefing in a moment. More on thomas cook. Stay with us. Hello, monday didnt end on a particularly sparkly note across many parts of the british isles. If of the british isles. We take a quick look at the cha for if we take a quick look at the chart for tuesday, you get the sense we are going to do it all over again and some for some areas, thats for sure. Were darkening up the blues. Throwing in some greens as well. A wet start to the day for wales, east anglia, and all of southern england. Right from the word go, some heavy rain there. The leftovers of mondays weather front are taking time to get into the north of scotland. Slow progress on this rainfall, that is why widely 30 40mm, and some spots to get to 70mm of rain. Once its clear, bit of a lull in proceedings and then we start doing it all over again. More rain moves back into the south western into wales and we begin to pick up the winds. And it isntjust the wind factor in the south, notice how windy it is across the North Eastern quarter of scotland. So do the evening and overnight we may well bring another little system into the southern portions of the british isles, again that combination of wet and windy fair, but it isnt going to be a particularly cold night. In gaps in the cloud, we could make it into single figures. Having said all of the above about how we get on into wednesday, once that little feature is away, thursdays rain, if you like, is still waiting on the winds. So we have something of a lull in proceedings, yes we have to get rid of this wind and rain in the southern counties, but once that away, that is not a bad day in the context of the whole week. There will be some sunshine around, some dry weather to, there will be bits and pieces of sorry rain a bit further north into the heart of scotland. Here we are on thursday. The weather front is a little bit quicker than we were thinking of the last couple of days, it looks like it will hang around in sill friday before going away. Were safe and the northern corner of scotland. It is that it will move pretty rapidly, they will offer a chance for some eastern spots to brighten and dry up during the latter part of the day, but on thursday and friday there is no signs of a big area of High Pressure to settle things down. It is a low pressure that is going to be dominating the weather and it will have the effect ofjoining the showers together at times, to give some long spells of rain and again were darkening those blues, so there could be some pretty heavy downpours, be the odd rumble of thunder. Perhaps during the day, the further east you are the more likely it is you are going to stay that little bit drier. Take care. This is the Business Briefing, im sally bundock. The bosses of the collapsed firm thomas cook face scrutiny over their actions, amid criticism over executive pay at the company. And, balancing the right to privacy with freedom of speech, europes top court is due to rule on the right to be forgotten. And on the markets you can see at the momentjapan opened again today pretty flat, as was the night before on wall street
