Lets discuss this with barristerjohn cooper, whos in our london newsroom. Thanks for talking to us this morning. Lets get a view from you of what you think has happened in this case and whether you think everything has been done properly . Well, on the face of it everything does seem to have been done properly. That said i can understand the frustration of the public, and indeed my frustration as well to a degree with the law which says we cant see the evidence. But in terms of the process, it has gone as one would expect, except that it seems the victims, or some of them, were not informed of the decision, and thats where it has fallen down, the lack of information to victims, that this man is going to be released to. As far as the process is concerned, it should do. Looking at how the pa role it should do. Looking at how the parole board has come to this decision, then, what do you think us being able to see this would change . What the parole board have to consider is whether an individual is dangerous to society. Perhaps i should just explain the imprisonment for public retention system. It has been abolished, actually. But there are still cases such as worboys, about 3000 prisoners who are still serving from before it was abolished. Thejudge serving from before it was abolished. The judge will give a normal sentence for the punitive element of the sentence, in his case eight years, and then add to that the ippr it was considered that the individual was dangerous. And they could only be released after they had served their initial sentence if the parole board, after hearing evidence and seeing documents and having an assessment of the individual, were convinced that the person was unsafe to be released. In this case clearly the parole board have considered evidence, which we have considered evidence, which we have not seen, and had reports on him and have come to the conclusion that he is no longer dangerous, and they are applied should, if that is their conclusion, effectively to release him. So, theyre taking the evidence which was available at the time, is that correct . Obviously, theyre aware of the charges and the convictions, but they will have taken evidence since he has been in custody to see for instance whether he has been rehabilitated. This procedure takes place for all prisoners who are on ipps. In this case we spoke to kim harrison, whos representing some of the women who we re representing some of the women who were assaulted byjohn worboys. What they are upset about is that at the time the prosecution, there was evidence. There was a lot of evidence, to prove that he had attacked, they say, more than the women who he was charged for attacking. The cps at the time told these women that they had enough to put him away for a long time. And this evidence, the extra evidence, wasnt used. Is that normal, that this extra evidence, which could have contributed to a longer sentence, wasnt used . Thats not normal, certainly not in cases such as this. If there was evidence, and i have to say if there was evidence, if it was cogent, clear and strong, in serious cases such as this, it should have been presented to the court for consideration. But also during the course of this debate which weve been having over the last 2a hours, we need to look at the role of the police. Is it a case of the cps having evidence and dismissing it because it wasnt sufficient, or is it the cps for insta nce sufficient, or is it the cps for instance wrongly dismissing it . There may be an issue here about whether or not the police thoroughly investigated these other charges. The Crown Prosecution Service will only bring a prosecution if they think that there is a reasonable prospect of success, or it is in the Public Interest to do so. It might be that they considered there was not a reasonable prospect of success because the police had not thoroughly investigated. Let me at three points to you. I would love your opinion on this. The victims are angry about not being able to testify. They were never told, kim harrison says, that there was a problem with the reliability of their evidence. Thats the first point, they were simply told it wasnt needed. The cps released a statement yesterday saying that 83 complaints were made during the initial investigation that many didnt pass the evidential test. And then on top of that, as youve mentioned about the metropolitan police, they have said vocally that there is a suspicion that he assaulted more women. So, when you put all of that together, doesnt it seem very unusual that more evidence wasnt used and that it is already changing what could be a further prosecution in this sense . Lets deal with the matter two first. Firstly, the police have suspicion that other offences have been committed. Well, that is not evidence. The police have a lot of suspicions, it Means Nothing unless it coalesces into evidence. 0n the second point, evidence that was obtained by the cps not passing the threshold, that is the reasonable prospect of success threshold, 50 50 chance, well, then they cannot bring a charge anyway if it does not pass the threshold. Maybe the police could have taken more evidence to make it past the threshold. And your earlier point, if there is other evidence out there, lets have it, it is important to. I hear with your report that the complainants are saying that they now wish to further make a complaint is but well, thats good if there is evidence that he can be prosecuted. There is no sell by date on prosecution, so lets see what happens. Youre a barrister with three decades of experience. You make me feel old i apologise but that is a good thing in terms of what youre bringing to this interview. There is a feeling now that victims of Sexual Assault are being let down by the legal system is that fair . Well, that is a generalisation. No, its not, as far as the general situation is concerned. There have been massive developments in the criminaljustice system over the last decade or so to make it easier and more acceptable for complainants to give evidence. So, that is unfair. Sometimes things go wrong, as in anyjob. But generally, i should say, and it is important i get this message out to people who complain about these serious offences or any offences, that the criminal justice serious offences or any offences, that the criminaljustice system is well designed and well equipped to deal with these complaints and indeed to make it as easy as possible for people who are victims of such crimes to give evidence. Just being there on your own, its a lot to be going through, just dealing with the cancer. You need your family and your friends around you, you need people to talk to. Throughout that time, youre away from your support network of friends and family. Its a long period of time. The treatment alone is six weeks. We found it really, really difficult. Up till now, the nhs has sent patients who needed Proton Beam Therapy abroad, but after years of campaigning and fundraising, it will soon be available in the uk. Its inside a specially built centre at christie hospital in manchester that medicine and physics meat, offering a new way to treat life threatening cancers. Young patients will benefit most because their tissues are growing and very sensitive to radiation. But there are also tumours which are next to quite critical structures in the body, say, the base of the skull or around the spine, and this Technology Enables us to give a treatment dose to those patients while avoiding those critical structures. With standard radiotherapy, a beam travels through the tumour that can damage sensitive tissues in front, behind and around it. But a proton beam is much smaller, and stops at the tumour, causing less damage to otherwise healthy tissue. Were now below what they call the treatment gantry, where patients will be seen, and this really is the guts of this huge, 200 ton machine and its one of three that are being built here in manchester. But down here, you really get a sense of the scale of this project. The protons, which come from the heart of an atom, are generated in a particle accelerator known as a cyclotron, which was carefully lowered into place last summer. Then, travelling at a speed of 100,000 miles per second, theyre directed with pinpoint accuracy at the tumour. Put it on. Six years on, and lucas is cancer free and full of beans. But with this new added feature and the attention it is getting, it is a missing piece of the puzzle, when now we can contribute fully to peoples posts online and in social media, and especially in this day and age, social media is using pictures and art to convey your message is, a really useful tool, and now with being brought into the fold, blind people are able to contribute to these posts. I dont have a specialist blind phone or disabled phone that makes me stand out or anything like that, it is discreet and subtle. And i understand other smartphones offer this and can use apps to download this. I suppose there is also an onus on the social media sites to make sure that these facilities are able to be accessed as well. You have spoken about twitter, but there are other social media sites that people want to use, and apps, of course.
