The European Council president donald tusk has urged members of the European Parliament to stick together, or, as he put it, face defeat. Brexit, he said is the eus toughest stress test, and the eu must not be divided at any costs. Mr tusk also said the outcome of the brexit talks is up to london and that abandoning the decision to leave the eu is still an option for the uk. 0ur europe correspondent Damian Grammaticas reports. With just a year until a brexit deal has to be done, the eu side is deeply uncertain about how this process will end, with an organised deal or a chaotic split. Huge challenges ahead, said donald tusk. Ahead of us is still the toughest stress test. If we fail it, the negotiations will end in our defeat. Donald tusk is no fan of brexit. He even hopes it may not happen. But he says success or failure in the talks depends on how the uk handles them. It is in fact up to london how this will end, with a good deal, no deal or no brexit. Last weeks summit in brussels brought no breakthrough. Jean Claude Juncker has denied theresa may begged him for help. Today, he said the eu wants an agreement. The commission is not negotiating in a hostile mood. We want a deal. Those that dont want a deal, they have no friends in the commission. We want a fair deal. This is the man that will secure a deal. Michel barnier says there has to be agreement on the uk exit terms first, what is called orderly withdrawal, and only if the principles that are settled will of the eu then engage in talk about a transition period. Today, he told several european newspapers, if we reach an agreement on the orderly withdrawal of the uk, such a transition period, both short and framed, it is possible. A transition might, he said, be short. It makes sense that it covers the financial period, so until 2020. The transition, he said, would leave us more time to prepare for the future relationship. That is because the eu will not formally agree to a trade deal until during any transition period, after the uk has quit the eu, so after brexit day. But the fact there may be suggestions that the comments like this more recently, although he denies them, the labour party feels as though they have to investigate. Do you think there will be any suggestion that labour has been slow to announce this . Earlier this afternoon, the education secretary, he was writing tojeremy corbyn about all of this, will there be those within or out of the party who said this should have been announced sooner . When these things happen, and they have happened with other parties as well, it is notjust the labour party, mps making comments that are inappropriate, racist, sexist, homophobic, it is the way they have the whip withdrawn. That is the process it goes through, the conservative party did it recently with one of their mps. There were some, even in the labour party, who said they should have been acted upon much sooner. Well have to see what the result of the investigation is, but there is some disquiet amongst some of his colleagues. The question put by Justine Greening is, how can someone who made those remarks go through the process of selection, becoming a labour candidate and then becoming an mp. Hospitals in england could carry out 280,000 extra non urgent operations every year, by making better use of operating theatres. The analysis comes from a Health Service watchdog, nhs improvement it suggests that an average of two hours a day are lost in operating theatres, because of late starts and other delays. Our Health Editor hugh pym has this report. Patients waiting months for planned surgery may be surprised to hear the nhs could be doing a lot more operations. Thats the view of a health regulator, who says time is wasted and more patients could be fitted in. The analysis seen by the bbc suggests hospitals could be more efficient. Nhs improvement looked at non urgent surgery at 100 trusts in england last year. It said 1. 61; million operations were carried out, but an extra 280,000 more could have taken place. On average, there was about 140 minutes of unused operating theatre time each day. Theres all sorts of reasons why theatre lists do start late. It may be that the patient hasnt been brought to the theatre on time, there may be things they have to sort out with the individual patients that make it rather delayed. Or maybe not everybody is there at the right time. But by looking at the detail of that, they are actually able to put things right. But one leading surgeon told me there were no simple answers and many complex factors had to be addressed. We do need to look at resource issues. I think we need to look at staffing issues. I think we need to look at bed issues. Address more the staff morale within the Health Service as part of that as well. Hospital managers argue its often hard to find beds for people after surgery if medically fit older patients cannot be moved on because of social care problems. They say there are many challenges to face, including money. There is clearly more that the nhs can do by way of improving productivity and efficiency. But it cannot be the only answer. There is a gap facing nhs finances, the gap between demand and supply. We need to recognise that more funding, alongside the trusts doing more to improve productivity, are two parts of the same answer. Waiting lists for operations are rising. Hospitals are under mounting pressure. The debate over whether new money or more efficiency is the answer for the nhs can only intensify this winter. Hugh pym, bbc news. We are in troubling times and this will allow me to speak up. It is so interesting you refer to the troubling times as you put it, you have been very frank about a lot of the abuse he suffered. People will be watching and thinking, i couldnt have stood it for so long, i couldnt have put myself out there in the face of that abuse. I am very struck, looking at the list this year, there is a lot more women on this list than they have had in the past. I am curious what you make of that, given the backdrop you have just described and experienced . What is interesting, when society is rocking and when things look as though we are going from bad to worse, womens voices seem though we are going from bad to worse, womens voices seem to be stronger. We have a way of staying calm, acting with grace and stained with the region and pushing forward debates, i call it the womanising of debating. It is very powerful and i think it is a very positive sign there are so many women think it is a very positive sign there are so many women on think it is a very positive sign there are so many women on this list. Did you have moments when you felt like giving up what you were campaigning on because of the abuse . It horrified me, more than anything. It horrified me, more than anything. It is not the country i thought i lived in and if you want to protect something you have to fight for it. The more abuse i got, the more i was determined to fight. I will not allow the principles i value and love about this country fall away, i will fight for them. The abuse you went to at the time, perhaps still do, it wasntjust misogynistic, it was racist as well and i am furious to the point of the power list, wide, against the backdrop of the things you went through and others go through, that is still important and a list like this can help . Three things have struck me over this last year and things have struck me over this last yearandi things have struck me over this last year and i still get the abuse, to a nswer year and i still get the abuse, to answer your question, as a woman of colour, this idea i couldnt have been bright enough to bring this case or have a debate. These are three methods we must fight against and that is why this list is so important and why this accolade is so important and why this accolade is so important. The trial of an Army Sergeant accused of attempting to murder his wife by tampering with her parachute, has been hearing evidence of an earlier alleged attempt on her life. The prosecution alleges that Emile Cilliers interfered with a gas pipe in the couples home, hoping to cause an explosion when his wife victoria lit the oven. Emile cilliers denies this and other charges against him. 0ur correspondent Duncan Kennedy is at Winchester Crown court. Duncan . For the past three weeks, this trial has been dominated by the fa ct this trial has been dominated by the fact Emile Cilliers tried to kill his wife victoria by sabotaging her parachute in wiltshire. An allegation he denies. The trial moved in a different direction to counter the second allegation facing Emile Cilliers, that he attempted to kill victoria a few days before the parachute accident by tampering with gas fixtures at their home in aylesbu ry gas fixtures at their home in aylesbury in vulture. Today, the prosecution called a number of witnesses to testify about the gas fixtures. The trial of Emile Cilliers, on the left, has so far concentrated on allegations he tampered with his wifes parachute. Today, the emphasis shifted to another charge he faces attempting to murder his wife by tampering with a gas fixture. Emile cilliers and his wife victoria lived at a house in wiltshire and had been married forfive years. The gas fixture was in their kitchen. The prosecution say Emile Cilliers deliberately loosened the nut on this gas pipe to create a gas leak. 0ne forensic scientist told the court it would have taken significant force to loosen the nut, and that the tool was one used in cilliers home. Another witness was michael osbourne, a gas engineer. He was called out after victoria cilliers smelled gas, in order to fix the leak. Mr 0sbourne told the prosecution that the nut had been loosened by a quarter of one turn, possibly with a tool, and that when he did it back up, the gas leak stopped. But he acknowledged under cross examination from the defence, that the nut could have come undone through heat, acknowledging that the pipe was next to the kitchen cooker. The trial has already heard that a week after the gas leak, Emile Cilliers allegedly sabotaged his wifes parachute at the airbase in wiltshire. Mrs cilliers fell 4,000 feet after both her main and reserve chutes failed to open properly. She suffered a number of injuries. Emile cilliers denies two counts of attempted murder and one of recklessly endangering life. The trial continues. All those expert witnesses who gave evidence today about the gas fixtures have concluded that evidence. Emile cilliers does deny attempting to murder victoria cilliers and there will be more prosecution witnesses in the morning. Duncan kennedy, thank you. The firm brighthouse, which provides Household Goods to people on Hire Purchase agreements, has been reprimanded by the financial conduct authority. The company will now pay out nearly £15 million in compensation to customers because of mistakes with contracts and refunds. First, as a general principle, there is a lot of Companies Like this out there, what is the driving principle, what is the customer getting out of it . Brighthouse is a dominant player, provides Household Goods to some of the poorest people and some of the most Vulnerable People in society. It offers anything from washing machines, televisions, right through to sofas and beds. It allows individuals to spread the cost of weekly payments over a number of yea rs. Weekly payments over a number of years. But the problem is, it is hugely high cost and what ends up is the individual, who can least afford it, ends up paying triple the amount for everyday goods that most people ta ke for everyday goods that most people take for granted. Yet, if that person really need something, as you say, as basic as a bird or a fridge and they cant afford to just walk in and pay the £300 up front or whatever, what is their alternative, whatever, what is their alternative, what are they meant to do. The issue is, as the financial regulator has shown, brighthouse and other companies havent been treating customers fairly. They have been charging extortionate amounts of money for everyday items. What we wa nt to money for everyday items. What we want to highlight is there are alternatives out there in the form of credit unions. Anybody can go to their credit union and apply for a much more affordable loan or other Charitable Organisations such first to use which offer a similar model, but on a much better terms. You would argue there are alternatives out there, so it must be the case people just arent aware because nobody is willingly going to pay four times as much for a product than they can get it at a better deal . This announcement shows that brighthouse havent even been checking that some of the poorest in society can afford the repayments they have been taken on. This is a company, since the economic downturn, has grown astonishingly. It has more than doubled in terms of the number of stores, gone from 135 in 2007, up to 315 and the number of Customers Using it has gone from 125,000 up to 300,000. And that is ata time 125,000 up to 300,000. And that is at a time when peoplesspending has been constrained and their choices, this is the problem, this profile people have very limited choices when they do need to borrow. There might be people watching thinking, he was very early 20s, we all say things in our early 20s before we have mature, possibly. Is that a fair argument now . Yes and no because he was in his early 20s, it would have been quite clear that if he was 15 or 16 because he would have been young or evenif because he would have been young or even if he was older, it would be clear cut.
