Understanding there may be reactions but does not want to prejudice the jury in any way. I am another hour in the parking lot of the courthouse among the scores of correspondence, i think the reaction is fair to say characterized as not surprised by this verdict. The evidence sorry were you breaking in. I was just intrigued by the reaction. Not surprised. Continue your thought. Yeah, i mean the the prosecutions case as you have been discussing there was that holmes was sane that this extensive planning this methodical preparation indicated and his efforts to conceal his actions indicated that he was sane, and aware the fact that he sought been was still seeking treatment indicated that he was in what they call a state of psychotic ambivalence unable to determine whether he should move forward but obviously the jury rejected that argument, did so very quickly, after only 13 hours less than a day and a half of deliberation, and is rushing as we are hearing a verdict guilty on all counts with extreme indifference, and it will be on monday moving into the penalty phase where he could face the Death Penalty. As we continue to look at the back of the head of james holmes, and his Defense Attorneys next to him i wonder if theres anything particular about the Defense Attorneys or the prosecution worth knowing at this juncture, and worth knowing about how they presented this case . Is the prosecution as you had mentioned painted a very emotional picture, close arguments ended on a reunder soing note, with a picture of the youngest victim, nineyearold pardon me kindergarten saying she will forever be our kindergartner. That was shown on the monitor. The picture of the kindergarten girl who because killed in the theater underneath that was played the 911 call the sounds of shots and panic in the theater, and when the prosecution wrapped up that argument, he pointed to the picture and said that is her forever those sounds that is him, that is that guy and the prosecution never referred to him by his name, constantly referred to him as that guy that guy over and over again admonishing the jury at the end that he needed to be held accountable, the defense for its case, for its close argument rested on or relied on the motion that he was clearly mentally ill and that these would not have been carrying out were he not mentally ill. Unable to determine whether he should move forward flying in the face of methodical preparation, leading up to the attack, so both sides appealing to emotion but the prosecution obviously winning out their argument with the jury. Paul reporting from centennial colorado and the judge continues to go through each of the counts the injure is in rote to finding him guilty on every single one 24 murder counts two well, two murder counts for open of the 12 that were killed and then 140 attempted murder charges two for each of the 70 that were injured going through and finding the jury has found guilty on every single count we will have more on the guilty verdicts and the james holmes trial coming up we will also speak with a local attorney that has been following this very closely, and check in on the days other news including the push from the white house to get congress to go along with that knock loor deal with iran. Making the case for the obama administration. Final note from the greek Prime Minister for support of welcome back to al jazeera america. The jury, the trial of james holmes is finding him guilty on every count he has faced. They found him guilty on the murder charges. They are also pointing him guilty on every single one of the attempted murder charges. They reached up to count 65 you will hear the judge name the person that was under owners anded as part of the charge, we will get a taste of that listen. Verdict form, count 63, attempt to commit mutter in the first degree, denise axelrod, we the jury find the defendant guilty of attempted to commit murder in the first degree an deliberation there you have it, leading up to 164, karen theres a denver attorney that specializes in criminal defense for juveniles and adults were you surprised. You know, it was a difficult issue for the jury to decide to determine whether the defendant Mental Illness rose to the level of the definition of legal insanity. They had to find the prosecution has to prove beyond all reasonable doubt that even though he was mentally ill that that illness did not cause him to be unable to distinguish right from wrong and the jury found that the prosecution had met the burden, and they will then proceed presumably next week to the next phase of this case is the Death Penalty faze. How often are defts successful in their claims that somebody is not guilty by reason of insanity. It is a very difficult claim i think ma many people are skeptical this case was a little bit different in that they did have a lot of evidence that he was severely mentally ill, and the defense had twoens withs who found that he was insane at the time. So we were asking the jurors to make a decision about whether or not he was insane when the experts in the field in the field of psychiatry were unable to agree on that. I wonder if you can talk about the impact on the city of denver and the surrounding communities i know this is a trial that has been generating headlines what do you presume the reaction will be given that he has been found guilty on every count. I think that it isnt just from the last three months that it has impacted this community, that three years ago, almost three years to the day this case has had an enormous impact, so more people were effected by it, those victims in the theater people who were injuried and lost family members people who were in the theater but were not injuries, first responders, i mean so many people who are for so many years have been impacted by this i am sure there is a sense of relief among many people that at least this phase of the trial has come to an end and now we are going to the penalty phase as far as the penalty face is concerned is it your sense from the Legal Community and the rest of the community that they would like to see him get the Death Penalty. I think the community is very split question have seen a lot of issues particularly with the governor who is he has concerned about the Death Penalty, but it is a different decision, they have to decide whether death is the appropriate sentence for somebody who they probably will be acknowledging was severely mentally ill. And thats it is a lot different than looking at is the prosecution prove all of the elements of the offenses. Did they prove that he was insane at the time, they now have to decide is death the appropriate sentence in this case. I dont think that will be an easy decision, and i think our community has difficult feelings about it. Karen has there been anything that has happened in this trial the presentation of evidence, is that would be possible grounds for the defense to appeal . You know i think in every trial, there are always issues that occur, there are decisions that the judge has to make with regard to perhaps not allowing some evidence in, or allowing evidence in over defense objection that can always be grounds for appeal, but i also think that we saw a judge who is extremely meticulous from the very beginning making sure every ruling was thoroughly researched making sure that he was making findings that would stand any challenges to the rulings that he made. So while there may be some appealable issues, i think that the judge has done an excellent job of making sure that the end fooings that he made will be upheld by any higher court. Karen our defense attorney in Denver Colorado joining us, thank you for being with us we appreciate it and back here in the studio is i am defense attorney, we heard from karen talk about the nature of a guilty verdict in your experience, how cathartics it for the victims the families to hear that the defendant has been convicted of the charges with which were brought against them. I think thatly want to hear holmes being held responsible, then we get to the next level, which is what is the appropriate punishment, and it is interesting because the case goes from a fact specific case where the juries have to find did they prove elements to now a moral question, and this is a much more difficult question because of the balance of the enormity of the carnage. And thats a very tough call. Do you have a sense of how they will go. I dont. I would say he would get the Death Penalty no matter what, but the nature is changing very very quickly now do to the innocence movement, and other reasons. Is there also some look if this was some guy that was seen perfectly rational and sane, no problem giving him the Death Penalty but because there be some evidence presented that he was schizophrenic, that he did have delusions thats enough of a faulk tor. Absolutely. Know dowel that even though they believe he was legally sane at the time of the act there was countless evidence that he is crazy in a more vernacular sense. They were played the 20 hours of video being interviewed half of his answers were wildly irrational, so that will play upon their heart strings as they consider the moral question of death or life without parole. We will take a break again you are hearing the judge return a verdict guilty on every single count, 164 total by the end convicted on first degree murder charges and attempted murder charges the sentencing will happen on monday, in the meantime, on the other side of this break with he bring you the latest from chattanooga you are looking at picture from river park, which is near the Navy Operation center, where four marines were gunned down today by a 24yearold man who was born in kuwait, we will get you the latest on the shootings next, you are watching al jazeera america. Lap final note from the greek Prime Minister for support of you are looking at a live picture of the Navy Operational resort center. This is the second shooting location this morning at approximately 11 00 a. M. This morning after having already shot off a Navy Recruitment center mohamed went from this particular location, to the first one you saw the Navy Operations center where he killed four u. S. Marines that was also an exchange of gunfire, a Police Officer was wounded during the exchange, and then abdul was killed by police. We flow according to authorities that he was born in kuwait, but has been living in harrison tennessee. Theres a great deal of anxious today over whether theres anything that could have possibly been done to protect these navy facilities. Gi all accounts he did this alone, joining news studio joinings in studio, retired major. Is there any possible way to protect against a lone gunman at these various military facilities in. They likely had a plan, especially the recruiting center by the striple ma, it just gets back to the softness of the military targets. They didnt have any weapons they arent allowed to carry that, that probably had cameras and maybe some it looks like the car just pulled up and with an automatic weapon just poured gunfire into that facility. Only one person was injured there the shooter didnt aim or anything like. No indication he was working with anything else no significant of the date, no significance of these facilities would that indicate that somebody on his own theres a military target, i will take my assault weapon, whatever he used. It could be, it could be the last day of ramadan there could be a religious aspect to this, if something does happen on the late day there may be a greater reward how that played out it could have been that tries to recruit and was told no, and this is they are getting back the investigation has to play out, which is why i think it is early to call it islamic terrorism, but it may be that. For right now it is lone rat. Is there anything that the military has been doing in terms of training to try to prepare people that work at Recruitment Centers . Given there have been attacks before. Yes. They have, and they had a plan likely, and lets talk about the recruiters themselves, they are selected individuals, they are the cream of the crop, that job is not something that everybody gets within the military, and so they likely had rehearsed that plan, theres only so much they can do from defense perspective i saw something about new york city putting vehicles now around the recruiting centers they have here locally i think thats a good idea, as a minimum they want to create space between recruiters and potential attackers. That would be a standard protocol that is being left to the individual offers the fbi, we had the former assistance director he said they will have gone through the data, the cell phone information, they should have a pretty good idea, although they are not saying what inspired this person, or where he drew his effort from something, with he got the weapon from, all of those things young individual in his 20 eswe will find all of those things out but right now you have to think about the families and those Service Members that were killed to jaimes point they found out probably on social media, the days oif military having that survival assistance officer come to the door is almost premature because social media the information travels so quickly i have heard so many members of the military, talking to people at the pentagon that it is so bizarre, and heartbreaking you expect the military will lose people on the battlefield, but when somebody is lost sitting at their desk, or in a Recruitment Center or today in an Operation Center where they are coordinate log gistics it doesnt compute. Yeah, you ask somebody that has been to a war zone, they feel most uncomfortable when they take that weapon away from them. I think maybe thats a change they will make here they will allow weapons. They are trains it isnt like they dont have the training for it thats where they should have felt most safe, and again in this particular situation, no that was debt loy unexpected but just so senseless. If there is connection federal Law Enforcement is able to make between this individual and any particular groups whether they be separatist american groups whether they are overseas. The key then is finding a network and put it tot, find out where he got the weapon, think of all the people that he could have had contact with they will be knocking on all those doors anybody that he had any kind of contact with, that will be the key and try to again trace those back to that one moment, find that lynch pin that was the inspiration for him to make that kind of attack retired u. S. Army major also a National Security contributor, thank you for coming in we appreciate it, just ahead the man who admitted to carrying owl the Charleston Church shooting went before a judge there he is, he was physically in court in charleston for the first time, he was told that his trial will take place next year, roof faces nine counts of murder, three counts of attempted murder, and one count of weapons possession, the judge has not yet decided if documents in this particular case should be made public. Vice president was back on capitol hill trying to convince lawmakers to go along where the Iran Nuclear Deal he has been talking to Senate Democrats today yesterday, he spent several hours meeting privately with House Democrats including and there you see her in red minority leader, and in the wake of that meeting yesterday, with joe biden walking through the halls climbing up the stairs discussing this, nancy pelosi said that she will support the nuclear deal and this underscores that they will likely have the democratic support he needs in order to sustain a veto should republicans decide to do inning to block the deal. Britains foreign secretary says it assures that the program will remain peaceful and he says after a meeting with israeli Prime Minister that the deal will help build trust in the region. We believe that removing the threat of an a bomb which we are confident this agreement does, while allowing iran to reengage with the international community, is the best and perhaps the only way to build over time, the trust that will allow a dialog on the many other issues we have with iran been, met with one of the harshest critic whose believes that these particular facilities will be used not for peaceful purposes hamnd mo insists that sanctions will only be lifted if iran lives up to its side of the Nuclear Agreement frees is now getting a cash infusion after lawmakers agreed to reforms and deep cuts. European finance minister says they will start discussion in a three year bail out for the nation mexican drug lord is still on the run, nearly a week after he broke out of prison, now we are getting a upclose look at how he did it. At the prison west of mexico city. Behind this maximum Security Police where many of the more dangerous criminal redirect examination locked up and none of them will more notorious. Who is captured and taken here by the Mexican Government in february 2014. Cell number 20 was home to the worlds most wanted drug lord for 60 months until last saturday even income which he sat down on the bed of his cell, and put on his shoes he then got up and went into this area, which is one of the only areas in this cell where the cameras cant see him. And then he then knelt down, and kept going lower and lower until he december appeared into this hole, which then goes down into a tunnel which extended for 1. 5kilometers. It is worth noting this prison is a huge maze, and we passed through so many corridors and so many security doors just to get to this cell, it is impossible to know where you are inside, and that makes it even more amazing and suspicious, that his rescue team knew exactly where their tunnel had to come up. Behind me is the building where he eventually emerged after going 1. 5kilometers in hi underground tunnel, sort of luxury tunnel that had ventilation, electric lighting and even a motor bike. Theres now an all out man hunt there areout the country to try to catch him but it is anyones guess where he is now. Mexican authorities are now offering a nearly 4 million reward for information that leads to el chap poes arrest.
