Is it something you would expect given that it, this is washington dc, and this is a democratic time. I, i, its like, its still a good question. Yeah, obviously this is not the size of a big truck riley. Im not sure if hes going to come around and try to shake hands. But there is a festive atmosphere here that is best name to watch and im watching all these people walking by small children or older people. People of all races, colors, crees, and probably all portable parties. And they seem to be all having a heck of a good time. So this is something the thing with donald trump, this is 2016 people went alone to see the show. It wasnt about that this started wasnt about his policies. It was about what the next day rate, this thing hes going to say, i dont think youre gonna see any deep ideological discussions in this crowd. I think it is all about the show and i think theyre all, you know theres, they seem to be museums of. Yes, theres so many of these different trials going on, different prosecutions from causes persecutions. And i bet to some of these folks go from prosecution and prosecution, the prosecution, they probably start as a traveling show as including the media. So, you know, i think that from a democracy standpoint, you know, like was this is howard our, our democracy is sunk by the other science. You know, it is a populous world. We live in these days. And donald trump upgraded, but talking about democracy is and democracy, the whole idea that the legal system treat everyone equally. And therefore, donald trump, whos alleged to have committed crimes, is being treated equally, even though he was the president of the United States. Well i, i think that that, that case is being made. Whats up both donald trump and with 100 vitamins of rubbery, ask republicans, they see whats going on with how theyre buying their think youve got some sort of special break from the justice department. And thats the presence of sun, and now you have this persecution of donald trump mean. What republican see is i see and on equal up for, for the prosecution of the law. And they also look at the judge and i see that the judge used to work it 100 binds law firm may say what the heck is going on here. So republicans look at this and theyre like, they think that hes being persecuted, but they, they are also along here for the show. Is it tiresome that this is what american politics has become . I dont despair, actually i think that im getting more people involved. And if you look at the last several elections where people have voted and never before using a higher voting for sensors, never before the, you know, this kind of reminds me of the Andrew Jackson revolution of, of aging twentys when people were despairing of all these, you know grubby, dirty wester is coming and the votes mean that they feel the same way about the trump voters. I, i think, you know, the, ironically you have more people involved in politics. Theyre not there, sometimes the right people, but they are according to the li classes, but there are the people and theyre making their voice search both the left and the right. Do you think there are some republican senators who, at this stage regret not impeaching donald trump for january the 6th . Because if theyve done that, you wouldnt be able to run again. Hed be bound from office. And so the whole idea of him perhaps being convicted here and running for president , well wait for this where i think theres a lot of republican sanders who wish donald trump to go away. But they also know if they would have voted to convict down trump. They would have lost whatever election they would end driven from office, maybe in peace themselves from their own state parties. So i think they probably probably look back and they were style trump of go away. But they know that hes not what. Okay, that was the stuff going on. And how do you think if he is convicted here that will play out on a president ial election . Can we . Can we continue just to say, when he says theyre coming after you, but im in the way. I mean thats not exactly right. I think i think its a very telling what a 5 point. And i think as i think the Republican Voters largely really um, i also think that this, if this proxies us board and if they get a conviction in the dc court, there will be appeal to the supreme court. And i guarantee you that the sprinkler overall you think i dont think its going. I think this is actually a very, very weak environment. And im, if i are going trump, i would say that this thing that i most want to focus on. Because its the indictment that im best able to with because well because that took the spot for his speech. He didnt do an assignments. Hes basically saying that down from new the one the last election. And thats what the, or the fact that he somehow knew the very last, i dont think he, i think he really Still Believes that he won the election. And to prove that point is i think, part best by the prosecution. And i think that jack smith is not, is going to prosecute as people think. And i, a bob mcdonald, who is the governor of virginia, has this report to prove that thats the case. And i mean, i know, you know, lawyers, this might be an unfair question, but if i say im going to go hold the money in the bank, is my money. Okay. And then i going to give me all my money that doesnt suit and take the money from the bank. Thats more than we speech the past 2 months. Please be. So this is a free speech argument at difficult one to the way i dont know whether or not its saying is that theyre not saying that statement. Theyre not saying that he caused january 6th. What theyre saying is that he says theyre not, theyre not using assignment herself as conspiracy by a model or, but i think its pretty far fetched. I will say it right. People think the the or how the case is going to pano. Jack smith is going to take his team into court. Theyve got to present evidence, 1st of all, to the judge to show that this case is bible. And then theyve got to convince 12 people that beyond a reasonable doubt, what donald trump said was illegal. And just 2 days later, here we are with the former president s 1st court raymond, and really talking to people here who live in washington. Any said they were caught off guard for this that happened and escalates so quickly. That said, we are all now waiting as the president , the former president is having his arraignment occur as we speak. Hes been in that courtroom now for some 1015 minutes. A likely hell be there for another 15 or 20 and then everyone is expecting that he will quickly make his way back out of the court room. Likely the same way he went in, which was right past where we were standing through the underground garage. Also, some more details coming out of the court room were told that trump is dressed in his usual uniform reveals, so to speak, the navy blue tide of the Navy Blue Jacket rather the red tie. Hes with his 2 attorneys. And interestingly enough, among those within the court room, our 3 Police Officers who had defended the us capital on january 6th, 2 of them had been injured, and another was pursued violently by this mob. One of them releasing a statement after entering the court room that he just wanted to see those actions held accountable. And of course, this is the same court house where some 1000. 00 defendants have been charged in that attack on the capital. Some of them sentenced up to 18 years in prison. Its notable that those long sentences were they were found guilty of insurrection over trying to overturn the us government. And its interesting as our guests have been pointing out, that that is not a charge that was levied against trump in this indictment. Rather, he has been accused of conspiracy to defraud the us to deprive people of their Voting Rights and to stop and official proceeding. And speaking to experts, they say that might have been intentional, and that the prosecutors did want to tailor this case as narrowly as possible. Make it a compelling case, not only for the your, e before checked, potentially for the crater American Public to digest. And very importantly, in order for this trial to be completed potentially before the next election in november of next year. Anyway, thats all far down the road as were waiting for this 1st here at Court Appearance of donald trump in this conspiracy to defraud the us and voters case to wrap up the heidi many thanks so that thats heidi was saying, the boys very much rolling in the legal procedures now were probably about halfway through that hearing and which donald trump is being fully arrested. And the range he will not be in handcuffs, but he will have a chance to plead guilty on guilty. A few guesses as to what we think donald trump will say, whether that of course, will be a message that his lawyer says on his behalf of these a lot of pictures from outside the court room, things are pretty, come out there are few protests is against trump a substantial number 4, but nevertheless the police in washington dc havent been given violence much time, a tool between the indictment being issued and this quote, date being sent to arrange all the security. Lets take a closer look at the full charges. Donald trump is facing a bit more detail now. I mean, the indictments, donald trump, will have to also include conspiracy to the for the United States are refusing to accept his loss of the 2020 election. A 2nd charge, a conspiracy against the rights of voters by depriving vices of having that counts properly counted. Also, conspiracy to obstruct an official proceeding Technical Support is elections cannot be trusted. Im claiming that they are rigs and obstruction of an attempt to obstruct an official proceeding. And congress was trying to certify the elections on january the 6th, 2021. Okay, last spring. And michael is a golf, whos a student, washington, dc and investigative journalist, michael, welcome back to the program. I guess the big question is, will these charges stick eventually . Will it not Donald Trump Office punch as well . I, you know, this is going to be a long drawn out process. Its not quite as clean as the prosecutors presented in the indictment, although there is some really damming stuff in that indictment. Im just sort of dye sets the, the charges which you just enumerated um the of the conspiracy to defraud the United States. The conspiracy to obstruct the official proceeding. So they really rest on. Yep. Trumps refusal to accept the, the results of the election even after they have, even after there were recounts and there were certifications by executives in all the battleground states that affirmed joe bidens victory. But its not a crime to object to the result of an election. I should point out that in on january 6th, 2531 House Democrats objected to the results in ohio between George W Bush and john kerry had those objections prevail. They would have reversed the results of the election and awarded the presidency to john kerry. So merely objecting to uh, the results of an election right cannot be construed as a federal crime. What is alleged here . We have some really strong evidence is that trump went beyond that um and that the use of the fake collectors and the flood of, of, of merit list loss suits. And the pressure on Election Officials such as brad wrappings, burger in georgia, and others who were called directly by the president amounted to improper pressure. They cross the line, its still going to be a very tough case is to prove because, you know, you get to the question of intent. Did donald trump really know he had lost the election and was doing this anyway . So he could stay in power or did he believe what, at least some of his lawyers were telling them that there were grounds to object to the lawsuit. And thats why one of the curious things about the environment is that those co conspirators, Rudy Giuliani, john eastman kenneth chest burrow were not indicted as part of it because they were the ones who was telling trump you could do this. Right. And um i, it appears that jack smith, the prosecutor, the, the special council made the decision that in order to move this forward in order to have a clean case, right, that doesnt get bogged down in multiple motions. Hes going to leave out, at least for now, those co conspirators. But i think that thats going to be a big part of the case of the defense, right, right. I, the president , donald trump, was relying on what they told essentially what you say about the environmental go, the company, the and diamond he icons that i read every single word of it. But it is incredibly easy to understand. Its very easy to follow. I mean, in the 1st couple of pages, it says exactly what youve just said, that the defendant has a right like every american to speak publicly and even claim that in the election result may have been false. The problem is that the suggestion here is that the claims are false and the defendant knew that they were false. As you say, thats going to be incredibly difficult to try and prove in a court of law. So its what you think the defensive distracted she is going to be what just that, i mean, 1st of all, just taking a step back, the idea that anybody could get into Donald Trumps head is a pretty challenging prospect on his face. Right . And so what prosecutors have to prove is that beyond a reasonable doubt, the trump knew what he was saying was, milwaukee was not, it was not, i was not true. And eddie said it anyway. And he acted any way, not just what he said, but his actions. But again, i come back to look, there were many people who told trump, you know, you lost the election. There is no evidence of fraud. His attorney general told them that the. Ready bar, you know, the department of Homeland Security which was running the Election Security office, told them this was the clean is the election in American History. No evidence of fraud. Every individual states that conducted these elections and the investigators the relevant election authorities found no evidence of fraud. But yeah, oh, you had people like julie on a, an eastman dell and im a well the loud is. There are reasons. Yeah. Im talking about giuliani, of course he is one of the many trump loyalists who being repeatedly saying that this indictment that i have here in my hand is nothing short of a political document. Theres nothing legal in it. A tool. Yeah. Well, i mean look, Rudy Giuliani is got a lot of legal troubles on his own. I should point out that you know, this is not the last criminal case that donald trump is likely to be facing is already had to indictments. This is the 3rd, we are expecting a 4th one in georgia in a couple of weeks, and thats likely to include some of those people who are not indicted here. Um, so you know, the, the idea that donald trump, i could just select who we wanted to listen to and ignore you know, the official verdicts of the people in many cases he had a pointed um is going to be a contrast. The prosecutors are going to harp on, but again, theyve got to get that very high bar to prove that he actually knew that what the of what the attorney general was telling with the f b. I was telling him what state officials were telling him was false and he believed with these other lawyers were told by michael, lets talk about the republican reaction to this because i wonder how much of a public an opinion on know if this really matches, considering that the front of republicans were on the centers, for instance, flatly dismissed the indictment before we had a chance to, to read a tool. I mean, clearly criticising from carries a lot of political consequences for other republicans who are hoping to run the right. And so, yeah, no, no, look, i mean, the go back and look at and, and chart. The poll numbers throughout this year. Trump was always had as formidable base and was always going to be a formidable candidate in 2024. But where he really shot up was after that 1st indictment from alvin, brag about payments of cash money to stormy daniels, the, the porn star. That struck a lot of people, republicans, but also a lot of independent legal analysts as a fairly weak case. And it looks like a political prosecution, thats the closest you can get to the, to the trump charge that these and the republican charge that these are all political. And as a result, trunk numbers went up. Thats when he really took command of this g o p primary race with that. Um and you know, the, the 2nd indictment, mar lago classified documents, much stronger. No real evidence of, of, of political motivations in that one that was brought by jack smith with special council as well. But to the i, to Republican Voters, it had the, the feel of piling off. And here we have another indictment from jack smith and i have no doubt, Many Republicans are going to see this as more evidence of piling on. It is coming from the Joe Biden Justice department, even though jack smith is a career prosecutor appointed. And special council without political interference. But the optics of the piling on, i think, are going to be a big factor in the g o p primer race. And i think thats a big reason that people like randa santas and others who help to this place. Donald trump are treating this very warily because they know that to um, endorse these prosecutions will look like they are endorsing what Republican Voters see as piling on for pin. Okay, thats my michael. Let me push it out for a 2nd because then donald trump presented no not guilty plea on the charges of trying to over to and the 2020 us election. No surprises that. But of course, they say significant not exactly as of friday, if not exactly. It does mean that the wheels in motion for a trial just focus. We briefly, what happens next when thats likely to be, if it happens that tool as well, we dont know. Were going to be looking for clues. Now this is a magistrate judge, so this is not the judge who will be setting the trial date. But we could get some inklings about a potential schedule, at least for further hearings before the judge will be trying with kate case, judge jake, and shes the one that will set the set the trial date. And yeah, i expect that. Yeah. Jack smith has made it clear he wants this to move quickly. He knows what the trump strategy is, which is delayed delay, delay, get, wait till this, it wait until the election. And then of course, if he wins, donald trump will be in charge of the justice department. He could fire jack smith and he could. Ready order his attorney general to shut down the um, uh, any further actions on these proceedings, but thats only the case if its still going on. Um, uh, during when the next president , whether its donald trump or joe biden, or somebody else takes office, we dont know what our point to is is worth considering here is even if jack smith gets his way, and uh, this can go to trial next year before the election and trump is convicted, which is likely, washington, dc jerry pool. You cant get a more anti trump jury pool than washington dc. It, it will be on appeal. He will not be setting it. Will it be sentenced, but he wont be serving any time. The case will still be an open one. And when voters go to the polls, um, you know, the donald trump, all the may be convicted, but he will still be, is it will still have his rights and he will still be arguing an appeal. So these cases are not going to be resolved. As a practical matter, the power process you built a quarter bills you built for the supreme court, right . Its going to take years. Michael, michael, many, thanks for your insight. And all of this michael is cost that well as you, as i just mentioned. So weve got to play from the form of us present. Donald trump, a has pled not guilty to charges, so you can spite over time, the 2020 election of officials to be monitoring all of this very closely. Indeed. And i was quite struck by a quote from ronald reagan, of course, a full, my us republican president , who said the transfer of power, the democracy is nothing short of a miracle. And thats precisely what donald trump is being accused of subverting. And when daniel trump was running for the presidency in 2016, he said if anyone was under federal investigation that should immediately disqualify them for running for office. It didnt stop. Donald trump from the cleaning, his effort for presidency back in november last year. And many people felt at the time the whole reason for doing that was so that you call this a political post pressik persecution. And indeed, his lawyer has been speaking to the media just in the last half hour or so, seeing that, thats exactly what it is, but this is all political. The reason theyre taking the action is be see that donald trump is by far the leading republican candidate. I do a take on joe biden, in the election in november next year, and theyre also suggesting, according to recent polls that donald trump would beat joe biden in that election. So they are saying the reason theyre doing this is to try and take him out of the equation. The fact that donald trump pleaded not guilty as no surprise to anyone, were just getting some details from inside the courtroom. Bear with me just one second. So it might so it will stop my apologies. Um, what did it say . Not so is that just as were getting from the Court House Court Room number 22, the prosecutors will not seek detention for trump, which means of course, that hes likely to be freed on his own. Cook dyson says, they say that centrally, you can look at the court this evening and head back to bed minster, which is his plan. But also he told the court that he would need help in Getting Court appointed attorneys. All of this happening live in the court as were standing here. Id site the federal courthouse in washington dc. But going back to the point about donald trump running for president. The intentional was, was but he declared natalie because because he felt that he could make this about a political persecution that they were going after him because he wanted to run for the office again that it was the deep state. Remember, he talked about that a great deal when he was running a 2016 and then when he actually one the election, that it was the deep state that he was trying to dismantle. They were acting against them. And hes told many of his supporters that they would go after them, but he is standing in front of them. Well, theyre all to go after them if, if theyve committed crimes in that sense, such would one mean distinction, but thats resonated enough for the supporters that theyve put millions of dollars into his Political Action committee. And there was millions are being used to help with his legal defenses in new york, where hes facing as the charges in miami, where hes facing the case of keeping under instructing that the documents being returned to, to the rightful owners. And here in washington, dc where hes accused of 3 charges of conspiracy and one of obstruction when it comes to trying to overturn the president ial election in 2020. I know that its probably a typical question town. So right now, but clearly the prosecution of hoping to move very quickly on this. Is there any sense of how long it will take before this is a, this is a, in a quotes and the whole problem is on try as well. Certainly that is the, the fact that its a slim to dont indictment. That is pretty clear as you were saying, youve read through lots of ideas of most of the people here. I would suspect it is pretty clear and pretty simple. Its a speaking indictments essentially leaving out the keys, but we know that jack smith, theres a lot more information and a lot more evidence that he can present in court. Clearly, the intention is to keep it as simple as possible, not bring in other Defense Attorneys by charging there was a named cool conspiracy conspirators, because then you have to deal with a, the legal teams as well. So this makes it much more streamlined, and the intention does, of course, to bring it to court as quickly as possible. Something, excuse me, the jacks with this. Talked about in miami and also here at the, the defendant it should be to god that is innocent until proven guilty. And that he just as in court to challenge these allegations and accusations against them. And as i mentioned before, one of the reasons Many Republican senators did not vote for Donald Trumps impeachment, which would have stopped him running for office in future after january the 6th. And remember was after he left the office was that, well look, this a hes, hes gone from office is not for the send it to decide. There are other legal remedies. Well, jack smith, 2 days ago called the bluff and said these are the legal remedies were taking him to come. Busy im, were charging him with these 4 defenses. And so donald trump has been in court. Hes given his name, hes given his age. That interestingly enough, and this will become a talking point. When asked is a, she said 77 know 7072 bit 77. Its just a bit odd, but it will come a cooking point. New died and then of course pleaded not guilty to the charges which we knew and said that he didnt know problem funding his defense because we know hes getting the millions of dollars from his supporters and money.
