And whether or not trump makes it back into the white house. Before we talk to, i guess, lets take a closer look at what the latest charges up. In the short term, these are likely to help donald trump, because once again, what it does is it put Donald Trumps name in the forefront, in newscasts all across United States, all around the world. Its injecting oxygen into his campaign for another term of the white house. And so this is very good news for donald trump is what he likes its, its given him headlines, but of the long term it could be detrimental because what this is doing is time consuming for donald trump. He has yet another legal battle to fight. It is distracting, and its also sucking money away from the war chest if you will. These are all battles that he has to 5, and its a battle that is distracting from the battle. He was to be fighting against joe biden for the white house. And so ultimately, this is a problem for the man that wants to become president. Once again, with all of these distractions, i suppose you could argue that the donald trump is unable to, to offer voters in the us. Anything, anything new however you could say the same for the president find, couldnt you . I mean, how, how to us let us us feel about a binding trump pre match in many ways. And i think you can tell by these candidates what theyre offering. But it doesnt really matter who the candidate is. The American Public has already made their mind up is that americans are democrat or republican regardless of who the candidate is. And so, and the fact that these are the choices is really evidence of that. And the reality is, is that the people are voting really for their party more than their candidates. And so the fact is that many people who dont particularly like donald trump, but theyre voting for the republican leader. And that is true also of joe biden. And joe biden was very popular when he was the Vice President under brock obama. But thats not necessarily true now. In fact, he has about the same popularity is donald trump, when he was an office and, and we really seen the deterioration of joe biden. Well, hes been in office, hes made many gaps. He is not really likable in the same way that he was hes. Hes stumbling more and so really theres not a lot to offer the voters this time around and the economy is struggling. People dont feel like theyre doing better, theyre not better than they were 4 years ago. And in fact, when it comes to bite and nomics, the thing that he is branding is his big sort of salable and thing to the american voter. Well, and thats not really flattering to the president either, given the fact that weve now had finch, down reading the, the American Economy and, and really sort of the from aaa status now to a plus. And that doesnt really mean anything to the ordinary american. But the bottom line is, do you have another signal that things arent rate for the American Economy . So really what this says is that neither president or former president is really a good catch if you will. If this is the dating game, the bottom line is, is that americans are really just loading for their party and they really dont. Were in the era grievance politics. We also are in the era of, of voters and building against someone inside of for someone. And we saw that in 2016, we saw people vote for trump as a vote against hillary clinton. And now also one thing to really consider here is how trump is doing his campaign this time around. Theres been data release just this past week that shows that one in for donors to trump, campaign is a retiree. And then also the small donations are all largely going towards helping with his legal bills. Its only a matter of time until that money sort of runs out and cant help his Campaign Efforts and has to continue helping his legal effort. So these are the conditions under which this candidacy, this very unique candidacy of the former presents is, is operating under and then youve got all the sort of what would be called establishment republicans, people with long resumes and Public Service saying that theyre better than him hoping looking for the entry way through which they can make the case of the American Public that joe biden shouldnt get another chance of the white house. Now i see it this way. We have a very short set of time until we start to see more be independent voters. Its certain factor and right now in these polls and a much of these audiences that these g o, p, primary candidates are going to, youre seeing a lot of the most extreme part of the Republican Party show up. Youre seeing the sort of served in support or youre seeing people who are gonna stick with the standard bearer no matter what the, whats out there and the boat to capture and order the wind. Whitehouse not just the 2 primary is that independently minded suburban boat or in a swing state. And a lot of these are women and a lot of these women are to have a hard time stomach. And many of the decisions happening in republican lead speed houses across the country of ocean is going to factor in far bigger of an issue. Then President Biden son hunter, by that. And so we have to talk about these things in a way in which we understand that these are big issues here at them to do with it. But yeah, we were discussing whether these charges against trump, r as a republican site politically motivated all day or is, is this just the wheels of american justice in motion . Where electrical cycles on who might be running for what office of whatever time. But dont really matter. Yeah, thank you for having me. Uh, i think the suggest that these charges are political is, is somewhat preposterous if you read these indictments and you are all familiar with the american Justice System. You know, trunk famously said when he announced his candidacy or shortly after announced his candidacy back in 2016 that he could get somebody on 5th avenue and get away with it. And i think thats, you know, metaphorically, what were seeing play out here is a former federal prosecutor thats tried more criminal cases than i can count. I can tell you the, the, the indictments here and the evidence alleged is absolutely overwhelming. I wish i had anywhere near this much evidence in the criminal cases that i tried, and thats not just my perspective. Thats the perspective on these cases from republicans that serve in his administration. I think it was the attorney general bill bar trump appointees served as his attorney general and was ministration upon reading the deans. I then in the, the, the other case with the, the, the records of since the espionage application called the trunk toast. A others are sitting, theres no me smoking going here with the smoking arsenal. Its just an absolutely Staggering Amount of evidence in both cases. Whether its were direct witness testimony, his own statements being audio recorded video surveillance. It goes on and off. So it looks at the law wasnt just created, the laws that hes charged with werent just created in the past year to these laws have been around for a very long time. And the fast, the give rise to these charges were created by trump. So, you know, youve got existing laws, criminal laws, and youve got criminal conduct by trump, you put the 2 together and that gets you indicted and thats whats going on here. But, but adam adam, how, how does the american Justice System rise above all of this, this political month from thats going on of the accusations against it, but it is being politically weaponized. Yeah, im sorry. You cut out a little bit, but i think i heard the question, look, its incumbent upon the department of justice and the prosecutors to proceed a pace without regard to the politics of, of the day. And thats what theyre doing. So youre going to have the political partisans make what they want to make about these charges. The republicans are going to defend trumpet the democrats are going to use them against trump. And thats just, you know, thats just the way of the world. What jack smith and his team, the department of justice have to do is proceed without regard without fear or favor with respect to trumps of the president ial campaign and just proceed as they would and then the uppercase. And thats what i believe theyre doing at all what, what do you make of, of what you have just the, these challenges api. So you know, politically motivated. All right, let me on pack a lot of those guess. First of all, re not independent judiciary was talking about the dish already. Were talking about prosecutors and they have discretion, and theyre political individuals with the professor should note that every one of these has been either a democratic pointy for a and a like to democrat. Those bringing these, these prosecutions. This indictment is absolutely ridiculous on its face. It is the january 6th. And you see this as a reflection of how americans of los trust in our institutions. And this is something that happened very rapidly under the fall. It didnt start with trump, but its something he has really benefit from. And i think the judge eileen cannon in florida who had trumps other case. She wasnt as, as i let me put it this way, defend as hard as this next judge is going to be assigned this indictment case of the 3rd indictment because this amount of ball a vomit pointed jobs. So youll see republicans bring this up over and over, and its really hard for the country because we are, again, we have an independent judiciary in this country. Out of could trump face jail time if convicted on any of these charges, youre gonna have to explain to, to those of us who arent familiar with the, the way that the american Justice System works. The way that the political system was kind of, hes still a campaign or take office if hes a criminal defendant. Is there a president here, or all we in uncharted territory and what happens if hes convicted but wins on a windows on his den convicted . Yeah, look, theres nothing in the constitution that prevents somebody under indictment, somebody on trial, or even somebody convicted from running for and Holding Office in this country. The only thing that we prevent donald from, from taking office or remaining an office would be if he was impeached by the congress. So, you know, i think trumps legal strategy here because he knows and his attorneys knows that the evidence is overwhelming is so is Legal Defense strategies to be elected president. And you know, either, either himself, or in part of himself, excuse me, were, you know, hopefully uh, in his mind, uh, a republican thats uh, you know, favorable to him well get elected and pardon him like for did with nixon. But it is Defense Strategy at this point is exclusively when the presidency in part of himself. Because barring that in all likelihood, he would be convicted based on the evidence in these case. Okay. And if he is convicted on all of that, but the charges that he faces, he could face present time but, but he could also just be fined instead of any but, but how would you put a phone, the president in prison a look, you know . No ones above the law thats, you know, one of the bedrock principles in this country. You hear a lot about these charges and they talked about statutory, maximum prison terms. Those are kind of, you know, do not exceed numbers in reality. But theyre not really how, how sentences are fashion sentences or fashion by what are called the United States sentencing guidelines. They kind of inform the judge of, of the appropriate sentence based on a whole host of factors about the case and the defendants background. And then on top of that, the judge has a pretty broad degree of discretion in fashioning and appropriate sentence. They can succeed with the statutory maximum sentences are under the, under the but the criminal laws that the defendants convicted of. And in this case, you know, theyre consecutive and when you have them all, you know, youre talking to tens of decades of yours. But again, thats not how does it have an incentive, just going to be under the guidelines and the discretion of the judge. But when you look at the cases here, the crime is that hes charged with an a condo, that hes a list to have committed in all likelihood, if he is convicted of either of these 2 cases, he will be sentenced to some term of imprisonment. Thats, you know, it would be extraordinary if he wasnt that it would probably be very appealable by the government if, if he wasnt sentenced to a terminal imprisonment. Hows he done it . How, how does, how do you sentence a form or present to present the answer your question . Just like you sentence any other defendant. We know you had us talking to our White House Correspondent that way back at the beginning of the program and she was making the point. So do you have you dialed republicans . You have you, if you died in the, will the democrats, but it is the motor and an independent versus who, who going to the site the next president ial election . I mean, if it is a trump biking pre match and that then not faced with much of a choice all day, i mean what, what, what are they going to do to . Well, wed like to think we have a Multi Party System here, but truly we have a 2 party system. And so people do choose the major party when it comes time to elect the president and they get behind it. But more and more americans are feeling like these parties dont represent them. Look at our congressional approval ratings. They continue to go down year after year. We even feel like are elected representative sitting in congress dont represent us. So partisan stripes aside a by then trump 3 matchers release like those. One thing for the country is that were in truly charter territory to have octogenarians serving the white house when the retirement age on coast to coast in the country is anywhere between 61. 00 to 67. 00 is just, i believe, nonsensical. Im an advocate of term limits, but again, im also a really big believer in, in following the constitution. I dont believe in a lot abolishing the electoral college. I believe our Founding Fathers didnt think we would have leaders this old, but its where we are. So its incumbent upon the parties to do better, and i see the r and c doing something unique. This time, the art teacher wanted, mcdaniel has introduced at plus. Shes introduced criteria in the form of money or polls. And in certain polls you have to pull it a certain percent. She doesnt want these vanity tendencies to become really part and parcel with how we do politics, particularly from the republican side today. So i think thats quite unique. On the democrats side, you see bidens the guy, but who is 100 feet away from the presidency . And as kamala here, she still has record high levels of disapproval. There are Many Americans who are very nervous about hairs presidency, again, a heartbeat away. So i think what well see leading up to next year is biden, and trump are on the ballot. You will see americans vote against one or the other. At a we, we thought that the january 6th was, was an incredibly dangerous moment to for the, the us things dont seem to go much, much better since then. Even though they are a little comma. How dangerous some of it is. This for us democracy do think, and i think its a very dangerous mountain that were living and you know, very dangerous times to the in particular, you know, given the kind of reactionary tribalism on both sides. But, but you know, you see this with, from supporters is zillows core base day after day is like, fast, just dont get through. Right. There is a point of view about what is going on in this country and about this indictment. That is, its just immutable and if the truck is convicted and if they believe, you know those, if theyre not persuaded by evidence that is presented at trial and it doesnt look like anything would persuade them if he so hes convicted and youre going to have a lot of angry people and you know, a good chunk of these people have hardly shown a proclivity towards violence. So i think that, you know, following a conviction, we are very likely to see at least the types of violence, of our government has been prepared for it. And if the, if the, if the media explains it and, and, uh, you know, with the internet today and what can be, uh, you know, broadcast on that and the ability to, to assemble and all those things. It just creates a very combustible situation. So it, you know, i think its a, i think youre frightening time, right . We know weve got about a minute left to do your thoughts on that. Or, you know, i, i think we are in an area of Political Violence feeling like its the norm. But i think after january 6, 2021 of these, our federal level leaders have had taken it very seriously. We know political extremism is on the rise, but there are ways to counter it. And i think also in the state house, as you see, people taking it very seriously. Theres so much miss information. This information is going to get ramped up as we get towards in general election day 2024. But i do see there are some really bright spots here for american democracy and a former president who is now private citizen by, by for each of our dog or guiding document the constitution. He is being held accountable under the full weight of the law. And again, is up and down guilty, but, and it is an accusatory document. So lets see where this goes. I do think it is an important day yesterday was a very historic and important day for democracy because it shows that with just a just as accountability has to come hand in hand.
