Well so the Affordable Care act which is sometimes called obamacare is the centerpiece that provides Health Insurance for millions of people in the United States and it is currently under legal assault and there is a court case that may invalidate the law. And if that were true that would actually remove Health Coverage for you know many millions of americans and also and also call into question the protections that Many Americans have who want to buy Health Insurance and who have preexisting Health Conditions and who you know Health Insurance companies if they were allowed to charge people more money if they say had a previous coben infection or another kind of Health Problem that would of course be a huge issue for millions of americans so this is this is a big moment for American Health care and of course its happening just before a president ial election so its its an amazing time and that Court Decision of course is going to be in the Supreme Court which is why it matters which way that court lanes how do you think that if los is will respond to biden linking the Supreme Court appointment to to the pandemic in health care do you think that will that will play for him. I dont think anyone fully knows the answer to that question i think the majority of americans do not want to see the Affordable Care act overturned theres this very strong evidence that is very popular in polling but theres a but among the americans who strongly favor the problem in party there is a core of voters who are very very motivated by the Supreme Court and those people are going to be quite important in the election so theres no question that if the Supreme Court overturned the Affordable Care act it would be extremely unpopular but there is a group of americans who you know who would welcome that outcome i suspect that i think in the long run that would be a very damaging thing for the american Supreme Court because it would be seen as the death of one justice and a politically partisan replacement you know ending up having a huge impact for millions of americans that would be very damaging to their legitimacy if the Court Process which is nominally nonpartisan. So as you said the same court is going to be considering the Affordable Care act i believe its the fed time its done so how is this time different. Well look theres a case that came up so one of the pieces of the Affordable Care act says that theres something called the individual mandate which says that people are required to have Health Insurance and and that was narrowly up held by Justice Roberts whos the chief justice of the Supreme Court who argued that that the u. S. Government had the power to require people to have Health Insurance under something called the taxing power that essentially the penalty for not having Health Insurance. Could be justified as come under the governments power to tax and then the Trump Administration basically eliminated that financial penalty and so a judge a lower court judge who was appointed by. By republicans said that now the now the Affordable Care act is unconstitutional because effectively theres no tax if the mandate you know if the penalty is 0 and most legal experts liberal and conservative dont regard that argument as very sound but but some judges have entertained it and in principle they could invalidate the entire law in fact if the Supreme Court has a 4 to 4 decision that is tie that would actually uphold the lower Court Decision you know calling the law into question so its theres a lot of uncertainty right now about what will actually happen.
