The past three weeks russia and iran backed the syrian president bashar assad while turkey supports opposition fighters. You have state with headlines on aljazeera the stream is next to stay with this. News has never been more available but the message is a simplistic and misinformation is rife listening post provides a critical counterpoint trying to bring mainstream we do narrative at this time on aljazeera. Ok and knowing the strain we are live on aljazeera im really could be today why do so many palestinian minors imprisoned in israel and howard be treated take a look at this video from our colleagues. That it didnt i didnt love it but i guess im not the mark of the past. The sixteen Year Old Girl that you saw there i had to me has captured International Attention the happening protests calling for her release both in palestine and in cities across the world including london and washington d. C. It is read that the arrest of a palestinian minor gets notice like this many palestinian activists are pointing out that there are hundreds of i had to mimis according to official israeli figures three hundred and thirteen palestinian minors are currently in prison there and since the year two thousand at least eight thousand palestinian minors have been detained and prosecuted thats according to Advocacy Group defense for Children International powers time during the strain to help us discuss this we have brad Parker International advocacy officer add stuff attorney at the defense for Children International palestine we do have santa is a journalist and activist based in East Jerusalem and altimimi is an activist and cousin of a head to mimi and in the u. S. State of indiana yes and matt bowe is a student at activist originally from bite marks in the occupied west bank its good to have you here. Everybody im fortunate under difficult circumstances i want to show our audience now this free. Social Media Campaign im just going to go for people here who somehow connected with i had story supported her story and your family why do you think it made International Headlines. Yes so now it yet. I had to use a. Shes living. In just. Living. One of the reasons. The line she. Wins she wants. And weve all been so on the good old when. Its all. Right the year of the year this is. Like. What. We. Really. Got the show. Im just looking at your twitter right here and has a thread here that says some of the forgotten teenage palestinian girls currently held in Israeli Occupation jails theyre not activists and i still dont appeal to white audience that children who lose their best years of our lifes behind bars so what the International Headlines are full of i had to mimi there are so many other youngsters who are also in similar predicaments can you tell us one of their stories. Yes so one of them is and i want to know how it is in. Poland here if you g. Cap she was with her cousin hetty the how they went to jerusalem they were carrying scissors headiness brother was killed by Israeli Occupation forces after spending months in coma so he didnt know he had both school and its seen that he was fourteen they were carrying the sister of the youth in their arts. They were suspected of trying to carry out and that tack against soldiers in jerusalem both of them were shot near a hand so her fourteen year old cousin and friend had been being killed in front of her eyes extrajudicial be executed right in her hand herself the errors and immediately taken to hospital and then to prison their handlers then just sixteen she had seen much of her best friend being killed in front of their eyes and then immediately herself and her hand was sent to thirteen years and the house in jail that were talking about a sixteen year old a school an Excellent High School who would be sentenced to thirteen years and six months and prison and just last ogust your hand was one of that lucky safe we can say like that thats why i was allowed to pass or to study her till he matriculation exams inside caves and she passed it on he exams with excellent results your hand is still injured by the way in prison but you Still Dreaming of becoming a lawyer we managed to believe she will be more than thirty years old which means that she will have lost her child who would end the best years of her you with inside prison where she is hardly struggling to recover from the film up something hi friend another one of them is a key when i was just fourteen when she was every step in the mess. Again he was accused of trying to carry out an attack and we are talking about many of them have been every october twenty fifth the majority of them were suspected of carrying out attacks usually in this attempted attacks that most of these attacks dont even take place and no one is injured but hes received incredibly high sentences many of them dont have good lawyers to represent them so this is why they receive my sentences and obviously even those who are precipitated in front off socalled civilian courts they dont count in the Justice System because youve got this whether were talking about military justice or criminal or. Civilian justice there is for palestinians there is grossly scarcely any justice and theres so much to talk about take a pause for a moment so we can get some the Online Community in the conversation as well and so were listening to your stories i want to bring up some of the commentary the feedback we got this is just a handful of people and rattle actually direct this over to you a couple of people have this point of view this is steven on facebook who says if a person or juvenile throws a rock at the police here in the u. S. They would be arrested and occasionally even shot by police so israel has been normal and even mild in their response to stone throwing another person writes and this is gene on twitter she probably meaning to me me shouldnt have physically attacked soldiers and in bed to push her propaganda the tension is not meant to be what would you say to people who have this criticism so regardless of guilt or Innocence International law set specific norms for how to treat juveniles that are in conflict with the law you know no matter who you are you have the right to be free from torture or ill treatment anything that could be you know. Treatment or punishment. There is basic due process protections under International Law with the right to her. An attorney the right to be free from torture. The right to know the charges against you when it comes to children there are specific special protections like detention must be used as a last resort and for the shortest possible period of time for that child and the child the main consideration should be the best interest of the child so what we see in the Israeli Military detention system is that really israel is unique in the prosecution of palestinian children in the military courts because its automatic systematic and by default theyre charged in a military court which inherent in military courts which is the case in the Israeli Military detention system they lack basic fair trial protections so for example under Israeli Military there is no right to an attorney during interrogation thats a pretty fundamental right that we take for granted in most jurisdictions throughout the world so you see these these basic protections that just dont exist you know added to the fact that. Three three out of four kids arrested by Israeli Forces from the west bank experienced some form of physical violence following arrest right so what weve seen defense for children through the legal representation that we provide is that physical violence the treatment the rights and the kids face that is widespread systematic and institutionalized throughout the system so in many ways the odds case is a typical case in what children face when arrested by Israeli Forces i think the unique thing is that she comes from a high profile family she has a high profile herself so its driven a bit of the tension and shine the light on the broader issues the palestinian children under you know plus years of occupation yes i dont have want to say you know i dont want to go back to the tweet regarding to me i think one of the main reasons. This story about kind of. We need to keep in mind that shes blonde lets say a white looking girl ok and it is appealing to a lot of people in the United States and europe and in different parts of the world it was important for the israeli army apparently to cover its face if youve seen the video when she while she was arguing arrested after midnight that her face was covered so the the image of i had this innocent while a blond girl was not really something that apparently israel wanted to wanted to show and i want to again say that the story by her it is just an example of hundreds probably thousands of stories and i see one of the pictures the serial is for. Shes the one they have the girl who was led by two israeli two Israeli Soldiers from my town of beit omar and she she was arrested in front of her school down this is john and she was arrested in front of her school shes my sisters friend and i know her and they know exactly that there is no reason at all to force him out to be arrested the. The main the main philosophy i guess or the main reasons would really drive these really army to arrest palestinian children is a its a systematic and planned way to destroy the Palestinian Society by taking these children away from their families and then just putting them in prisons not allowing them for education and family visits or basic human rights i mean at the end of the day they are children thats Something Else to deal with but even as humans theyre denied a lot of access to their basic human rights. And i was all i put this to you because we are asking israeli army can you be on this program we want to understand what is going on here why would you put my meds in detention. This is what the israeli army said to us they said that the i. D. F. And additional Security Forces acting order to maintain security and stability day and somalia unfortunately in recent years many mines have been involved in violent incidents including acts of terror and offenses so again that breaking the law defendant. If i could only in sorry. I dont i mean what we see from the cases that we represent is that its really not about guilt or innocence its not about Holding Children accountable for specific conduct i think generally the military detention system does work to control Palestinian Society so when we talk about military courts often people have a sense that if youre talking about a court theres some form of justice thats administered there the military court system is couldnt be further from justice really the goal is to arrest illtreat you know five hundred to seven hundred palestinian kids each year run them through this military court system where the overwhelming majority of these kids plead guilty because its the fastest way to get them out of that situ situation where pretrial detention is the norm right there theyre looking even a child facing one stone throwing charge which throwing stones is a specific offense under military law the majority of children are charged with throwing stones they may spend anywhere from three months to twelve months in detention for that specific charge and then when theyre released theres usually a fine that could be one hundred dollars to three thousand dollars and then also a suspended sentence probationary period essentially that would be three five years if they are charged the same offense again in that period they automatically serve you know whatever the specific charge or the sentence would be so if youre a fifteen year old child in the west bank youre arrested charged a military court and you have a five five year suspended sentence that carries you posture eighteenth birthday in the us for example youd have the right to have that expunged have a clean slate these these arrest these detentions you know even if its for a period of several weeks it stays with you. You for your life doesnt disappear youre talking about the effects on the person our community had a lot of questions on the effects on the family the Greater Family and what this does to them or not ill give this to you a couple of tweets this is jennifer she says where are the children how old in detention do they receive family visits another person this is lawrence on twitter and he wants to know how long the parents travel to see their kids in prison or in detention have you been able to see ahead and what is that process even like for the families who want to. I want to have been to feel because i spent last weekend. When its big. But for other children. When they are. They have to wait to see mom until the release of what it is that with their families to visit them you think this month doesnt match. The mine. They only the families only see them for. Like. Doing the royals which is for five minutes ten minutes maximum. Then. When they want to visit them when they have. To resist them all that is really present mind. Is looking inside if you buy forty which is illegal because according. To International Law all the prison supposed to be in the queue by tourists not in. This is my disagreements and illegal but the family says they have to leave their houses at the three in the morning so they will go so as to be able to visit there. For forty five minutes and sometimes. As nice or even one in the mornings and a big actually take them twenty four hours just. To see their. Sons and forty five minutes most of the time. That is a bit on inside the jail they are denied. Or sometimes for security reasons sometimes. They. Every time with the kids and so all this time. Yes of the job you see is a consumes a limp and then she was in your car when you began to shoot. And was is in there still fifty percent of the will in on fire and. Also it was done so when asked if months whenever son was is given us all wanted to visit. After he was nearly didnt leave the room they denied his instead heat and forced him to go back so this is also another bunch meant for the veterans or for the families of the vet is enough and you can imagine how this is again a close. Children and the mind that is when they are withing their families or the months or four months without seeing them and by the end they are in study for the cute or denied women. I know that think is a. Good inside deal that it is a disaster is nothing if you can call it everything but most food and bullets to me and they have to buy the food if. The bridges in the. School which is very expensive its nearly since time with the bright side the present and most of these is visually the mind. Was and. Then they were since mine are. Six of them they couldnt have money from their families for the. Resentment when they want to buy i think so as a prison like. Or. As an adult prison i would have to box of their money or. Which is only. The hole. You want. And then you have. To give someone money or. Mind. You know youve given us so much more insight into what we often see pictures like this one have a look here this one came from your bride and one of your attorneys is representing this young man here what happens after this moment when youve just really packed up for us again the israeli army told us that the Legal Proceedings involving minus takes into account the age required to interrogations are carried out by training youth investigators because the mind of the right for a parent to be present during the investigation that ensures that mine is only stand trial before a specially appointed youth court that is what they said in their statement to us medicare thats for their community is not so convinced this is john and they spoke who raises a point that you raised earlier about the spin disproportionate Israeli Settlers throwing stones receive slaps on the wrists if they are punished at all while sitting in face prison International Law supports resistance against armed occupation which would include stone throwing but i want to pivot just a little bit to this tweet we got from reg whos asking a question about facts physical or mental he says what type of physical evidence exists to support torture during detention obviously psychological scars dont show as easily and its relatively easy to ensure no child the scene until physical evidence is gone you want to talk about one. Absolutely i i have too many examples to use from from my own my own experience growing up and based on my own seeing most of my cousins and most of my phones being detained with a picture of the young kid the kid who was arrested by twenty thirty three soldiers shows some physical evidence and its been on his face that he was tortured in the process. I think that the. One of the stories of my cousins my cousin was transferred to come it sore and in the process he was beaten up in the in the jeep so and another cousin while they were taking him to the Interrogation Center he was also being kicked by the difference holders at the same time and the same thing with the sort of my father who. Had to go through that to see the physical cues for more than ten minutes during the transfer process so. Going back to the i. D. F. The israeli army comment the trained investigators are. Not sure if theyre really trained at all or maybe their training is to make sure the palestinian children sign papers they dont understand or just say that i threw one stone or two stones or whatever this is. From from the work of our lawyers in the military courts in working on these cases i mean what we see is that there are legal adjustments and amendments made to the military law that would you know sort of go in line with what the Israeli Military statement suggests but in practice there is no right to a lawyer during interrogation in ninety seven percent of cases that we document kids dont have a parent present right parents or even if theyre accompanied a child or followed the child to the Interrogation Center if theyre able to know where their child been taken theyre not allowed in or are being been able to sit in that interrogation are these proceedings happening in arabic so that the military Court Proceedings are all in hebrew or the arabic translation thats thats quite rough usually based on the observations that ive had been sitting in the courts in the interrogations are you know this is another disparity under the military law where theyre supposed to be conducted under the in the in arabic of the language of the child but often we have being conducted in hebrew with with limited arabic translation children in you know anywhere from twenty to thirty percent of cases do sign documents in hebrew that can be confessions incriminating statements and in really these interrogations you know getting back to the point on torture we see physical violence slopping punching. I think sixty two percent of cases from last year. Threats inducement and shouting pounding on the table in timid. Nation and its really all built around providing confession or creating something that could be used to pass to a military prosecutor to charge the child in the military courts because through the military Law Framework because the courts are you know locked to process guarantees the really is no independent oversight over us that means theres no evidence gathering so the interrogation is the place where the evidence is is created to then pass to a prosecutor. And he has this conversation going down on line guess a were almost out of time and i know theres so much more to talk about but how can people react to a lot of support for i had seen me on you tube and on twitter and i want to end with this tweet though from all mario put it go away and he said its about time the world recognizes that palestinian lives matter and our children deserve rights protected freedom and a stance of justice from the International Community so brad and. Thank you so much for being part of that conversation today i have a conversation at that we continue online at hash tag thanks for watching everybody take a. On you for doing something very strong couldnt someone an ambitious young artist from the mean streets of mozambique to set out to reveal the unseen truth about his country. To the muslim people do you do in close to see this really didnt exist did no good in politics change and through. The new african photography mario must the at this time on aljazeera. We hear in the Jerusalem Bureau covered Israeli Palestinian affairs we cover this story with a lot of intimate knowledge we covered it with that we dont dip in and out of this story we have a presence here all the time apart from being a farmer and its also very important to be a journalist to not the story very well before going into the fields covering the United Nations and all of the policy for aljazeera english is pretty incredible this is where talks happen and what happens here matters. Quite different. In two thousand and eight aljazeera documented a groundbreaking school. Preparing some of indias poorest children for entry into its toughest universities. Ten years on we return to see how the students and the scheme a helping change the face of india. Super thirty at this time. This is al jazeera and live from studio fourteen here at aljazeera headquarters in doha im Kemal Santa Maria welcome to the new spirit
