Detailed description is I specialize in being the "criminal" Criminal Defense Attorney, offering affordable, caring, and client-centered legal representation.
My name is Charles Edward Heaton II.
I am better known as Roscoe.
This is my story.
I was born in Atlanta, Georgia in 1974 to a poor dysfunctional family.
I was physically and mentally abused throughout my childhood.
My mother and father were both alcoholics and drug addicts.
My mother had me at age 16 and my father, age 20, was in prison when I was born.
I did not meet him until I was 7 years old.
In my father’s absence my mother took to theft and prostitution to support me.
When I was four she was sent to prison too.
I went to live with my grandmother, who did not have the means to support me, but did her best, raising me on welfare and government assistance.
When she passed away I was shuffled to different family members’ homes or lived on the streets.
.
.
As a kid, growing up in the poorest parts of Atlanta, drugs and crime were a way of life.
On my 17th birthday (August 14, 1991) while in the tenth grade, I was involved in a fight when two kids jumped my little brothers (age 11-12) and I defended them.
No one was hurt.
I was arrested and charged with aggravated assault and terrorist threats because the kids said I had a weapon, which was never found.
They just said I had a weapon.
As for the terroristic threat, it was saying, “I will knock your head off.” (Their mother actually went to the Court Clerk paid $11.00 and swore a warrant out on me).
I was convicted and sentenced to serve 4 years in prison.
I served 34 months in Scott State Prison in Milledgeville, Georgia and 14 months on parole.
.
.
It was while in prison that my worst nightmare came true and changed my life forever.
One day as we filed out of the mess hall I noticed a man of medium build covered in tattoos.
This man was my father.
It had been 10 years since I had last seen him, but I knew it was him.
I was devastated.
I had become the man I hated.
I felt my life was over.
I knew I had to change my ways, or I would keep coming back to prison.
I went back to my cell and prayed.
I prayed for the strength to change and the power not to fear the obstacles that lay ahead me.
I promised myself I would go to college, became a productive member of society, and never come back to prison.
This is a promise I have kept..
.
In prison, counselors teach inmates to set goals and try to better themselves while serving time.
That way they are better equipped to function in society when released.
I took this very seriously.
While serving my sentence I got my GED, scoring 98% or above in all sections.
I became a teacher’s assistant, teaching inmates the skills needed to pass the GED.
I set my goals on going to college.
Upon my release, I took the SAT and got into Young Harris College (YHC) on a scholarship within 8 months of my release..
.
While at Young Harris College (I was on parole at the time with an ankle bracelet), I was a model student.
I was president of SGA (Student Government Association), President of Phi Theta Kappa (National Two Year School Honor Society), President of Delta Gamma, START Leader (new student orientation counselor), Residential Assistant, and Student Rep to the Dean.
I graduated Magna Cum Laude (3.83 GPA) in 1999.
I was accepted to four universities (Penn State, Alabama, Duke, and Emory University).
I chose Emory University.
.
.
At Emory, I was a good student, member of two clubs, and worked full time.
I graduated in 2001 with a major in Political Science.
I was planning on going to law school afterwards.
However, I received a set back when I called the Georgia Bar Association and was told I could never be a lawyer in Georgia because of my felony conviction.
This was my first disappointment since my prison release in 1996.
At age 27, I began to see my past mistakes were permanent and could prevent me from achieving my goals and dreams.
I felt resentment towards God, my family, and my country.
.
.
Despite my feelings, I did not let this destroy my dreams of one day practicing law.
I began a letter writing campaign to media outlets, celebrities, Government Officials (federal, state, and local), and even the President.
From this campaign I received numerous letters stating “There is nothing I/We can do.
Thanks for writing.” I began to lose hope.
Then later that year, I received a phone call from Bert Lance, who was a member of President Jimmy Carter’s Cabinet.
I had met him while attending YHC, but never told him of my past.
Mr.
Lance wanted to help.
We began working towards getting me into law school.
He put me in contact with Lee Sexton, a criminal defense attorney here in Atlanta, who told me I had been misinformed by the person at the Georgia Bar Association.
Mr.
Sexton said my becoming an attorney was not going to be easy, but it was not impossible.
He is currently working on getting me a pardon (I became eligible last month) and will represent me when I go for my Character and Fitness review in front of the Bar Association.
.
.
In November of 2005, the Atlanta Journal-Constitution (AJC) featured a front page story (2 1/2 full pages) in their Sunday Edition about my life.
The response to the article was phenomenal.
I received hundreds of emails and letters.
Since its printing I have been invited to speak all over the country.
I have met and spoke with hundreds of government officials.
My story has been featured on the Internet, on radio talk shows (such as The Barnes and Firfer Show, Kimmer, and Neal Boortz), and on TV (CNN)..
.
This exposure allowed me to help others who have been to prison and who are banned by society in the age of background checks.
I hope the attention to this issue brings about change, both social and political.
Isn’t this America, where we give people a second chance? How is a person who made a mistake supposed to change and better themselves when they are treated like outcasts by society? I know now what my professor in Sociology meant when he talked about the “Revolving Door” principle when referring to people who keep going back to prison time and time again.
They have no other choice when we, as society, do not give them a chance..
.
I mean I messed at age 17.
At 17, I was not an adult.
I was a kid with no parental figures.
I was thinking foolish thoughts as kids do.
I didn’t even know what a felony was at the time this happened to me.
I had no idea I would be punished for the rest of my life for something I did as a kid.
I was 17, an age where I couldn’t vote, drink (legally), join the army, smoke cigarettes, and had only been driving for a year.
Society obviously doesn’t think a 17 year old is an adult, but Georgia law does.
And for this everyday I am punished..
.
Thank God in 2007, the state of Georgia, woke up, looked at the evidence, and FULLY pardoned me, opening the door for me to go to law school.
I sold my success business and everything I owned to go to law school in hopes of one day helping those in need.
My dream was/is to bring top notch, quality legal representation at affordable prices to those in need of real legal representation from a real attorney.
That is what I do every day.
Ask around, even as a public defender, I was the best dressed, hardest-working, and most competent and effective attorney in the courtroom- no matter how big or small the case.
.
.
My parents, who both died from their addictions, knew nothing else.
I am the first, and only, member of my family to go to college.
I am living proof that people can change and the "cycle" can be broken.
.
.
In the words of George W.
Bush, "America is the land of the second chance." I am living my second chance, so et me help you get your second chance.
I practice law to fight for those in need of a chance, so give me the chance to fight for your second chance.
.
"There is NO "I" in team, but there is a "U" and "I" in JUSTICE!!!!! Let's work together to get your JUSTICE!!!!!!!.
