This is Christine Righeimer, one of the admins.
I am also a lawyer that has been practicing for 22 years and concentrates in animal law and rescues.
Although some people seem to be upset about certain fees and requirements of the shelter, the law is very specific as to what is required - even to the point of charging fees and how those fees must be deposited.
There are also laws about microchipping and spay/neuter.
Although the law allows for a particular shelter to set its own policy about whether it will do the microchipping and neutering versus requiring the owner to do it within 30 days - if the shelter does not do it, the shelter is then responsible for following up to confirm it is done.
If it isn't, they can impound the dog again.
HOWEVER, in my professional opinion this puts too much a burden on the shelter and its VERY LIMITED STAFF AND RESOURCES to follow up with every single dog and every single owner (surprise surprise - people don't often cooperate after they get the dog).
Small shelters like Carmi and White County have a very small budget and they are now working very hard to do what is best for the dogs within the confines of the law, as well as their financial and personnel resources.
Sooooo - DESPITE THE FACT THAT SOME PEOPLE FEEL IT NECESSARY TO BE NEGATIVE AND COMPLAIN ABOUT FEES/LAWS - this facility has an actual (versus wanna be) lawyer working with it to assure it is operating within the requirements of the law.
