City of Biloxi seeking approval for handicap accessible pier

WXXV News 25 June 15, 2021 The City of Biloxi and Harrison County are filing a claim so a developer can build a pier at Veterans Avenue. If the project is passed a pier will be built. The land will be leased to RW Development and they will fund and maintain it. The pier will be open to the public, 300 feet long, made of concrete, elevated, and handicap accessible. It will be located on Veterans Avenue near the West Beach Boardwalk which is also a city and county joint effort.  City of Biloxi Public Affairs Specialist Cecilia Dobbs Walton said, “Our waterfront is great. Of course, with all of our restaurants and casinos, having a pier that is elevated and it’ll hopefully withstand more hurricanes in the future.”

Veteran's Avenue pier proposal heading to court over dispute with local, state officials

A proposal to build a pier, a lawsuit to prevent the pier, a vote for a lease to build the pier, and now a Temporary Restraining Order. All of this has taken place since 2019 when Biloxi and Harrison County proposed a lease with a local developer to rebuild the Veteran’s Avenue pier.

Judge: No work on entertainment pier as lawsuit is pending A judge has issued an order that blocks a company from starting construction on an entertainment pier on the Mississippi Gulf Coast. Harrison County Chancery Court Judge Jennifer Schloegel issued the temporary restraining order Wednesday in a lawsuit that the Mississippi Secretary of State’s Office filed in July 2019, the Sun Herald reported. The state argues that before a pier can be built at the end of Veterans Avenue in Biloxi, a public trust tidelands lease is required through the secretary of state. The city disagrees. A hearing is set for May 5.

Lessons From Mississippi Supreme Court's Ruling in RW Development

Wednesday, January 13, 2021 Following Hurricane Katrina, the Mississippi Legislature amended the Mississippi Gaming Control Act to allow Mississippi Gulf Coast casinos to locate within 800 feet inland of a previous legal gaming site. Then, in December 2020 the Mississippi Supreme Court rendered an important opinion interpreting the legal site provisions of both the Mississippi Gaming Control Act and the Mississippi Gaming Commission regulations. RW Development (RW) owns property at the intersection of Veterans Avenue and US Highway 90 in Biloxi, Mississippi. RW filed its first application for gaming site approval for the Veterans Avenue property in June 2008. The  Mississippi Gaming Commission (Gaming Commission) denied approval, stating that the statute required an 800-foot measurement to commence from the “mean high water line,” which is where the water meets the shore, and not the toe of the seawall; that RW did not own and/or lease property to the shore; and th
