Maryland Committee Holds Hearing on Bill to Limit Warrantless Aerial Surveillance

ANNAPOLIS, Md. (Jan. 20, 2021) –  On Tuesday, a Maryland House committee held a hearing on a bill to prohibit “persistent aerial surveillance” in the state. Passage of the bill would not only protect privacy in Maryland; it would also hinder the rapidly-expanding national surveillance state. Del. Robin Grammer (R-Baltimore) introduced House Bill 159 (HB159) on Jan. 13. The legislation would prohibit any state agency from conducting “persistent aerial surveillance to gather evidence or other information in a criminal investigation without a warrant. On Tuesday, the House Judiciary Committee held a hearing on the bill. HB159 defines “persistent aerial surveillance” as “the use of aircraft, as defined in § 5–101 of the transportation article, to record video or a concurrent series of images or pictures that when viewed in aggregate depict a person’s actions over time.”

Duncan's Act Would Prohibit "No-Knock" Warrants in Maryland | Tenth Amendment Center Blog

ANNAPOLIS, Md. (Jan. 6, 2021) – A bill prefiled in the Maryland House would ban “no-knock” warrants and effectively nullify several Supreme Court opinions in practice. Del. Robin Grammer (R-Baltimore) filed House Bill 188 (HB188) last fall. Titled “Duncan’s Act,” the legislation would repeal sections in Maryland statutes that authorize judges to issue “no-knock” warrants. Under the proposed law, a warrant application “may NOT contain a request that the search warrant authorize the executing law enforcement officer to enter the building, apartment, premises, place, or thing to be searched without giving notice of the officer’s authority or purpose.” Under current law, police can apply for a no-nock warrant if they believe property subject to seizure may be destroyed if they believe officers could be at risk.
