State Supreme Court refuses writ request from church in switched at birth case

Jackie Lee Spencer (left) and John Carr III | Courtesy photo CHARLESTON – The state Supreme Court has refused a request for a writ of mandamus by the Diocese in the case in which two 78-year-old men who say they were switched at birth by staff at a Catholic hospital. The court issued its order June 14 after the Diocese of Wheeling-Charleston had petitioned the court. The vote was 3-2. Chief Justice Evan Jenkins and Justice Tim Armstead voted in the minority, saying they would issue a rule to show cause. Following the Supreme Court order, Monongalia Circuit Judge Phillip Gaujot issued a scheduling order July 20 that lists deadlines for attorneys, including a pretrial conference scheduled for April 12, 2022.

Couple sues surgeon for breast reduction surgery gone wrong

Pixabay MORGANTOWN A Star City couple is suing Akkary Center for Weight Management & Surgical Services for negligent care during a procedure. Dr. Ehab Akkary was also named as a defendant in the suit. Eden Richmond and Nathan Richmond filed the lawsuit after Eden Richmond sought to have a breast reduction to alleviate back and neck pain, according to a complaint filed in Monongalia Circuit Court. The Richmonds claim Akkary recommended bilateral breast liposuction, but following the surgery, she had many problems including uncontrolled pain, blisters on her breasts and hematomas that developed in one of her breasts. Akkary knew or should have known that performing a bilateral breast reduction was not the appropriate procedure for Eden, the complaint states.

Morgantown firefighters won t see reduction in pay after settling issue with city

MORGANTOWN – The City of Morgantown and members of its fire department have agreed to a proportional increase in base pay that will result in no change of pay. Last week, the city and 47 members of International Association of Firefighters Local 313 announced they had mutually resolved the firefighters claim that they were entitled to shift differential pay under the city s personnel rules, pending approval by City Council. The City of Morgantown recently has undertaken efforts to clarify and enforce existing personnel policies for all employees, to follow-through on completing a citywide employee compensation study, and to reorganize city operations to achieve greater effectiveness in delivering services to its constituents and taxpayers, a joint statement issued May 13 states. Former physician sues WVU for breach of contract

WVU Medical Corporation was also named as a defendant in the suit. Dr. Koshy Mathai claims he was promised an incentive wage structure when he was hired in 2012, however, he was not provided with the earned incentive wages as promised and he sent several emails and requested that the agreement be honored, however, they were never addressed and he resigned in December, according to a complaint filed in Monongalia Circuit Court. Mathai claims after he resigned, he again asked about the status of the incentive wages that were due from his employment and was told he wasn t due anything. The plaintiff alleges that the defendants breached their contract with him and made promises to get him to accept employment and did not provide on those promises.
