Magistrate orders bone density scan for deckhand injured by steel cable

Kennedy EAST ST. LOUIS – Watco Transloading may test the bone density of tugboat deckhand Kevin Beam, U.S. Magistrate Judge Gilbert Sison ruled on June 21.  He found good cause for an independent medical examination.  Watco previously admitted liability for an accident that injured Beam in 2017, but it doesn’t admit liability for all the damages he has requested.  Sison resolved a dispute over the bone scan upon referral by District Judge Staci Yandle, who plans to hold trial in December.  Beam, a Randolph County resident, helped load coal into barges at Watco’s terminal on Route 3 in Rockwood.  In 2017, a steel cable snapped and struck his back. 

Jurors award $1 9 million to Thiems Construction in dispute arising from Fox Creek subdivision

Yandle BENTON – Jurors in U.S. district court awarded Thiems Construction of Roxana $1 million in punitive damages on April 8, finding its former insurer United Fire put its own interest ahead of the company’s interest.  Jurors found United Fire must also reimburse the company for a punitive damage award of $904,019.71 from the Madison County trial.   Late owner Gary Thiems personally paid that amount in 2015. He died in 2016.  The underlying suit involved erosion from the Fox Creek subdivision construction site in Edwardsville to a lake on property of Fred and Juanita Steinkuehler.  They sued Thiems Construction in 2010, and they added a claim for punitive damages as trial approached in 2013.
