Colorado man going to Washington to face riot charges January 29, 2021 GMT DENVER (AP) A federal magistrate judge on Friday ordered a Colorado man who is accused of using bear spray or mace on police officers in the deadly U.S. Capitol riot be sent to Washington to face charges there. During a virtual hearing in Denver federal court, Robert Gieswein, 24, of Woodland Park waived his right to have a hearing to determine that he is the person indicted on six counts, three for allegedly assaulting police, in the nation’s Capitol, ending proceedings in Colorado. While others arrested in Colorado over allegedly participating in the Jan. 6 riot have been released from custody, Magistrate Judge Scott T. Varholak ruled last week that Gieswein should be held because he posed a risk to the public since he went to the Capitol “prepared for battle,” equipped with a baseball bat, a reinforced vest and an Army helmet.

Varholak said the Capitol riots were “a fundamental attack on our democracy” and agreed with prosecutors that Robert Gieswein showed up in Washington “armed to do battle.”

Aspen businessman Ryan Chadwick and three companies under his control the Aspen bar, Escobar Vodka and Escobar Aspen in Denver federal court. The $5 million suit intended to force Chadwick into ceasing and desisting from using the Escobar monikers was served on the defendants in December. Escobar Inc.’s suit maintains it holds intellectual property rights to the name and also purports the company to be founded by Roberto Escobar, brother of the late Colombian drug lord. Earlier this month, defense attorneys introduced a motion to dismiss casting the lawsuit in a questionable light and contending Escobar Inc. rents a UPS mailbox but calls it company headquarters.

Wade decided he didn t want to fight the case anymore and have the expense of going to trial, Kinney said.
