BUFFALO, N.Y. We re looking into the fallout after a judge s decision to grant dozens of local restaurants and bars a preliminary injunction on the state s closure curfew.
Those establishments were successful over the weekend, when a judge issued his decision in favor of the restaurants and bars.
For the more than 90 restaurants and bars, who were part of the lawsuit, it’s back to normal operating hours once again. This after state Supreme Court Judge Timothy Walker granted them a preliminary injunction, saying they no longer have to follow the closure curfew which Judge Walker called irrational.
The financial losses reach into the millions at the establishments familiar to everyone: Duffâs Famous Wings and Santora s Pizza Pub and Grill.
But the losses in the tens and hundreds of thousands of dollars are every much as crushing to the smaller restaurants better known in their own locales, like Londa s Diner in Depew and Raphael s in Hamburg.
Two dozen Buffalo area restaurants â big and small, with offerings from pub food to Italian cuisine, but all under an indoor-dining ban â submitted court affidavits this week detailing more than $10 million in financial losses for 2020 and 856 job cuts since March. They re among the 70 restaurants that signed on to a State Supreme Court lawsuit seeking a relaxation of state Covid-19 safety precautions.

BUFFALO, N.Y. (WKBW) â Thirty-seven Western New York restaurants are suing Governor Andrew Cuomo and other legislative and health officials in the state regarding shutdowns in Erie Countyâs Orange Zone.
âWe need to open,â said Paul Santora, owner of Santoraâs Pizza Pub & Grill.
These restaurants tell us theyâre hoping for a Christmas miracle.
Prominent local attorney Steve Cohen and others at HoganWillig are representing the restaurants and their owners, saying the governorâs closure of indoor dining is unconstitutional. Attorneyâs say this infringes on ownerâs rights to earn an honest living.
