High Court Quashes PSA Detention Of Pulwama Youth SRINAGAR: Jammu and Kashmir High Court has quashed detention order under the Public Safety Act against a resident of Pulwama and directed authorities to release him from preventive custody forthwith. “On the touchstone of the settled position of law and perusal of record, the (detainee) was not supplied the materials relied upon by the detaining authority. (He) was provided material in the shape of grounds of detention with no other material/documents, as referred to in the order of detention,” a bench of Justice Ali Mohammad Magrey said, adding, “On these counts alone, in view of the settled position of law, the detention of the (detainee) is vitiated, the (detainee) having been prevented from making an effective and purposeful representation against the order of detention by not providing the sufficient material,”

Court Quashes Detention Of Sopore Youth Under Public Safety Act SRINAGAR: Jammu and Kashmir High Court has quashed the detention of a north Kashmir youth under Public Safety Act. Tawseef Ahmed Najar son of Ghulam Muhammad Najar, a resident of Brat Kalan Sopore had been arrested by police in Sopore a month after the abrogation of Special Status of Jammu and Kashmir in 2019 on charges of stone-pelting and was lodged at police station Bomai. He was shifted to Bhaderwah Jail after PSA was slapped upon him. The detenue was doing job in a private firm when he was arrested. He was accused of instigating people for violence.

SRINAGAR: The Jammu and Kashmir High Court has quashed the Public Safety Act (PSA) slapped on banned Jamaat-e-Islami chief spokesperson Advocate Zahid Ali saying “the grounds of detention were repeated by the detaining authority which was earlier quashed by the court.” The judgment passed by the Justice Sanjeev Kumar of High Court of J&K on Wednesday, a copy of which lies with news agency KDC reads, “That the impugned order of detention has been passed on same facts and for the same activities which were part of the grounds of detention in the earlier detention order passed against the detenue, which was quashed by this Court and, therefore, the same is not sustainable in law.”

High Court Quashes 7 PSA Detention Orders SRINAGAR: The Jammu and Kashmir High Court has quashed detention orders under Public Safety Act against seven persons, one among them nicknamed as ‘judge’. The detainees whose orders under PSA were quashed include Showkat Ahmad Mir of Sopore Baramulla, Muddasir Ahmad Dar of Pinjoora Shopian,  Shafqat Abrar of Kulgam, Rayees Ahmad Chack of Chakpora DH Pora Kulgam, Nissar Ahmad Khanday of Chersoo Awantipora, Atta Mohammad Malik of Kulgam and Javed Ahmad Sofi alias ‘judge’ of Parabagh Rawalpora Srinagar. The detention orders were quashed by Justices Sanjeev Kumar, Rajnesh Oswal, and Sanjay Dhar while hearing a separate petition filed by the detainees through their respective counsel, according to the judgments available with news agency GNS.

J&K Prisoners To Be Shifted To Agra Jail

J&K Prisoners To Be Shifted To Agra Jail SRINAGAR: About 21 prisoners from Jammu and Kashmir, presently lodged in various jails of Uttar Pradesh, have been shifted to the high-security Agra jail. This is being done on the orders of the Union Home Ministry (MHA). The prisoners being shifted now are believed to be separatists, of which 10 are associated with Hurriyat leader Syed Ali Shah Geelani. These inmates were booked under Public Safety Act (PSA) and were arrested in the wake of the revocation of special status to the erstwhile state of Jammu and Kashmir under Article 370 of the Constitution in August 2019.
